We, the members of Beefmaster Breeders United, do hereby associate ourselves for the following purposes: to continue the improvement of Beefmaster cattle throughout the world; to use as a standard for this continued improvement, the six essential characteristics upon which the breed has been developed: Disposition, Fertility, Weight, Conformation, Hardiness and Milk Production; to ascertain, preserve and disseminate all useful information and facts contributing to the desirable qualities and distinguishing characteristics of the breed, and for promoting and servicing the best interest of the breeders and owners of Beefmaster cattle as well as the general public to, as near as possible, ensure the Beefmaster breed their rightful place in the cattle industry. I. MEMBERSHIPS 1. BBU shall have charter, lifetime, active, international, associate, junior and honorary members. The rights, privileges, duties, benefits and classification of members shall be governed by the following provisions. 2. Charter members are those current members who: a) joined between the 21st day of July, 1961, and the 21st day of August, 1961, under the provisions of the By-Laws adopted on the 21st day of July, 1961, or b) were lifetime, active or charter members or joined BBU as lifetime or active members during the period January 1, 1996 to March 31, 1996. 3. Lifetime and active members must be owners of BBU Certified Beefmaster cattle at the time of joining. At the time he joins, each lifetime or active member shall sign a BBU name franchise and holding brand contract and such application and forms as may be adopted by the Board of Directors. 4. Only charter, lifetime and active members in good standing shall be entitled to vote, serve as directors or hold office. Each charter, lifetime or active member shall have a single vote. Charter, lifetime and active members shall be entitled to all services of BBU upon payment of such fees as may be fixed by the Board of Directors. 5. International members are those persons or legal entities located and/or with qualifying cattle in foreign countries who elect an alternative international membership available to them with the lower fees, restrictions on their privileges and powers and limitations on services provided to them, all as prescribed by the BBU Board of Directors. These parameters for these international memberships may be different in reference to different foreign countries and may be changed from time to time by the BBU Board of Directors. 6. Associate members shall be elected by the Board of Directors and shall be reputable individuals, corporations of firms who do not own any BBU Certified Beefmaster cattle but are interested in the Beefmaster breed of cattle. Associate members shall be entitled to those services granted by the Board of Directors. 7. Junior members shall be elected to junior membership by the Board of Directors and shall be under the age of twenty-one (21) years on January 1st of the current year. At the time of joining, each junior member shall sign a BBU name franchise and holding brand contract and such application and forms as may be adopted by the Board of Directors. Junior members shall be entitled to those services granted by the Board of Directors. 8. By the action of the voting membership at the annual general membership meeting, honorary membership may be conferred upon individuals who have made outstanding contributions to the Beefmaster breed of cattle. Honorary members shall be entitled to those services granted by the Board of Directors. 9. Corporations, firms or partnerships which are charter, lifetime or active members shall each designate in writing an individual officer, director or member of the corporation, firm or partnership who shall exercise on behalf of the corporation, firm or partnership the rights and privileges of such membership, including the right to vote and hold office. 10. Members may be dropped from the roll for cause by the action of the Board of Directors. 11. The Board of Directors may make such investigations as to the qualifications and desirability of an applicant for membership as it may deem necessary. 12. Proxies will be mailed to the general membership by the Secretary thirty (30) days prior to the annual membership meeting to vote on behalf of any member at any meeting of the general membership. Proxies shall be in writing, by fax or e-mail and filed with the certified public accounting firm so designated by the Board of Directors no later than five (5) days prior to the meeting date. The tabulation of the proxies and the receiving stamp of the accountant shall be conclusive. A self-addressed stamped envelope, addressed to the certified public accounting firm, will be enclosed, as well as their fax number and email address. The only exception to this procedure will be in the case of a special called meeting, whereby only fifteen (15) days notice is given. In this case, proxies may be given to vote on behalf of any member at this particular meeting of the general membership. Proxies shall be in writing, by fax or e-mail and shall be filed with the Vice-President twentyfour (24) hours prior to such meeting. A list of proxy holders shall be furnished the President prior to a vote on any question. 13. The members shall meet in the annual general membership meeting on a date and at a place to be fixed by the Board of Directors, who shall give the members at least thirty (30) days written notice of such meeting. The members may be called to a special meeting by the Board of Directors upon at least fifteen (15) days written notice. At all meetings of members, ten percent of all the members entitled to vote, present in person or represented by proxy, shall be necessary and sufficient to constitute a quorum for the transaction of business. If a quorum shall not be present in person or represented by proxy, the members entitled to vote who are present in person or represented by proxy may adjourn the meeting from time to time without notice, other than announcement at the meeting, until the requisite number of members to constitute a quorum shall be present in person or represented by proxy. At any such adjourned meeting at which a quorum is present, in person or represented by proxy, any business may be transacted which might have been transacted at the meeting of which notice originally was given. The members entitled to vote present in person or represented by proxy at a duly organized meeting may continue to transact business until adjournment, notwithstanding the withdrawal of enough such members to leave less than a quorum. Less than a quorum may adjourn. Except as otherwise required by these By-Laws or the Texas Non-Profit Corporation Act, all matters shall be decided by the vote of the majority of the members present in person or represented by proxy and entitled to vote thereon. Minutes of each membership meeting shall be permanently filed in the records of BBU. A copy of the minutes shall be forwarded to any member upon written request to the Executive Vice-President. 14. Each member upon joining shall execute the name franchise and holding brand contract and such forms as may be adopted by the Board of Directors referred to in Section I, Paragraph 3. The prefix name to be selected by each member shall not duplicate that of any other member (nor be such as to mislead the public as to the identity of the herd), and each prefix name must be approved by the Board of Directors before it can be used. II. THE BOARD OF DIRECTORS 1. The governing body of BBU shall be a Board of Directors composed of twelve (12) members elected by the voting membership at the annual general membership meeting to serve for terms of three (3) years; and in addition to such members, the President, Vice-President, Treasurer, Secretary and the immediate past President as ex-officio shall also be members by virtue of their office. It is declared to be the policy to have the various areas in which Beefmaster cattle are bred be fairly represented on the Board of Directors, provided that no more than ten (10) of these seventeen (17) elected Directors and Officers may be residents of the same state of the United States of America. 2. At each annual general membership meeting, four (4) Directors shall be elected to replace those whose terms expire at the end of such meeting. In the event of a vacancy on the Board, the Board of Directors shall fill such vacancy until the next annual general membership meeting, whereupon, a successor shall be elected for the unexpired term by the voting membership. Meetings of the Board of Directors shall be called by the President, or by any three (3) board members. A majority of such members shall constitute a quorum for the transaction of business. The Board of Directors shall have at least three (3) formal in person meetings each calendar year, upon fifteen (15) days written notice. In addition to such in person meetings the Board of Directors may, upon notice to all Board members, conduct a meeting by means of a telephone conference or other communications. A majority of the members of the Board of Directors must participate in such communications to constitute a quorum for the transaction of business. All meetings of the Board of Directors shall be documented by the secretary or a member of BBU staff to ensure accuracy of minutes produced from same. The powers and duties of the Directors shall be those conferred by law and these ByLaws. Two consecutive absences from in person Director’s meetings shall constitute a resignation from the Board unless otherwise qualified medically. 3. Minutes of each Director’s meeting shall be permanently filed in the records of BBU. A copy of the minutes shall be forwarded to each director following each meeting. III. OFFICERS The officers of BBU shall be a President, a Vice-President, a Treasurer and a Secretary. A President and VicePresident shall be elected by the voting membership at a general membership meeting called and held in even numbered years for a term of two (2) years. A Treasurer and a Secretary shall be elected by the voting membership at a general membership meeting called and held in odd numbered years for a term or two (2) years. Such officers shall serve as such without compensation for such respective terms and until their respective successors are elected at the end of the relevant general membership meeting. Neither the President nor the VicePresident may be re-elected to the same respective office for consecutive terms. There may also be appointed an Executive Vice-President by the Board of Directors who shall serve at the pleasure of the Board. PRESIDENT: The President shall be the presiding officer and shall carry on the business of the corporation under the By-Laws and the instructions of the Board of Directors. The President shall preside at all conventions or meetings of the members of BBU or of the delegates and shall be chairman and preside at all meetings of the Board of Directors, when he is present but shall vote only in case of a tie vote; and when he is absent or unable to perform the duties of the office, the Vice-President shall act in his stead. The President, upon the completion of his elected term, shall remain on the Board of Directors as an exofficio member for a term of two (2) years with all of the attendant rights and responsibilities of a regular member of the Board of Directors. VICE-PRESIDENT: The Vice-President shall be the presiding officer in the absence of the President and shall perform such other duties as may be delegated to him by the President and the Board of Directors. TREASURER: The Treasurer shall be the custodian of the funds, shall attend to the collection of dues and fees owing to the corporation, and shall pay the expenses of the corporation, keeping account thereof. SECRETARY: The Secretary shall keep the minutes of the meetings of the general membership and of the Board of Directors unless done by a member of BBU staff and shall have custody of the seal and records of the corporation. EXECUTIVE VICE-PRESIDENT: The Executive VicePresident shall perform such duties as may be delegated to him by the Board of Directors and the officers. All instructions and directions from any member to the Executive Vice- President shall be channeled through the President. The Executive Vice-President shall be the Chief Operating Officer of BBU. He shall be appointed and his term of office and compensation fixed by the Board of Directors, and he shall be subject to the directions and control of the Board and President. He shall exercise such power and authority and shall perform such duties as customarily pertain to the position of General Manager or Chief Operating Officer of a corporation, and such other duties as the Board of Directors may from time to time assign him. He shall be the corresponding and recording officer of BBU and shall receive, attend to and dispose of all applications for membership in BBU, all applications for certification of animals and all applications for ownership transfer of such animals; he shall sign and issue all certificates of membership, Certificates of Breeding and ownership-transfer, and shall keep a record of all such certificates issued. Under the rules and regulations prescribed by the Board of Directors, he shall have charge of all programs of BBU. In the event of the death, resignation or incapacity of the Executive Vice-President, his duties and responsibilities shall be discharged by an appointee by the Board of Directors until such time as a vacancy in his office has been filled by the Board. It shall be the duty of the Executive Vice-President to manage the operation of the office, to employ and supervise the work force and, in cases where practicable, to administer the purchasing procedures of all supplies including printing and other necessities on a timely basis and in such volume as may be deemed expedient and for the best interests of BBU. If after a Certificate of Breeding of an animal has been issued, anything shall be learned which raises a doubt as to the propriety of such certification, the Executive VicePresident shall report to the Board of Directors his findings and recommendation for investigation and issue such notices for hearings on such matters as elsewhere prescribed in these By-Laws and/or Rules. The Executive Vice-President may at any time investigate or cause to be investigated the breeding and herd records maintained in his office for the purpose of verifying the validity of applications for certification or for the purpose of investigating other matters in which BBU may be interested. The Executive Vice-President need not be a member of BBU. IV. COMMITTEES There shall be the following standing committees composed of no fewer than five (5) members, except for the Ethics and Rules committee which shall consist of no less than seven (7) members, who shall be appointed by the President, subject to the approval of the Board of Directors. There shall be such other committees as the President may suggest from time to time, whose members shall be appointed and approved in the same manner except the Nominating Committee which will be determined as set forth below. FINANCE AND AUDIT COMMITTEE: This committee shall have supervision of the books of account of the corporation and shall have annual audits made by a certified public accountant of such books of account. To it shall be referred all matters pertaining to fiscal affairs, and it shall have the duty of preparing an annual budget for presentation to the Board of Directors and the general membership. This committee will review all proposed allocations and proposed budgets by the other committees of BBU. A separate audit committee will be appointed by the President, made up of members other than the Treasurer. MEMBERSHIP COMMITTEE: The primary function of this committee is to aid in the recruitment of new members, to make recommendations to the President, and to carry out those duties requested of them by the President and the Board of Directors. NOMINATING COMMITTEE: This committee shall be composed of the current BBU President, the three immediate past Presidents and a representative elected by each active BBU Satellite Board of Directors. This committee shall submit its nominations for both officers and directors to the membership at the annual general membership meeting. Nominations may also be submitted from the floor by any voting member. Members of the nominating committee shall not be eligible for nomination for a position on the BBU Board of Directors if they have served on the Nominating Committee during the current year. ADVERTISING AND PUBLIC RELATIONS COMMITTEE: This committee shall supervise all activities involving relationship with the public and with government bodies. It shall also be responsible for assembling and disseminating information concerning the breed, which shall include recommendations of agencies and/or individuals that would prepare, coordinate, and place such advertising. The committee shall also investigate all advertising matters and provide a proposed budget for review by the Finance and Audit Committee. BREED IMPROVEMENT COMMITTEE: This committee shall investigate possible useful information and facts that could contribute to the desirable qualities of the breed and supervise all activities involving breed improvement. It shall make recommendations to the President, the Board of Directors and the general membership regarding breed improvement activities. This committee shall also be charged with the responsibility of determining, from time to time, what recessive factors are considered undesirable and harmful to the breed as well as those breeding methods and husbandry tactics that conflict with the furthering of the six essential characteristics upon which the breed has been developed, and to define the nature, type and form of the information which is accepted by the Board of Directors and to be kept on file. BY-LAWS COMMITTEE: This committee shall consider and make recommendations to the President, Board of Directors and the general membership regarding changes in these By-Laws. ETHICS AND RULES COMMITTEE: This committee shall be charged with the responsibility of determining the ethical principals which determine the rightness or wrongness of particular acts or activities involving disputes of a BBU member and BBU Beefmaster cattle when such transactions are covered by BBU By-Laws, Approved Sale Agreement or Terms and Conditions of BBU Approved Sales; and transfer of BBU Certificates of Breeding in accordance with the BBU By-Laws. Procedures of the committee shall be approved by the Board of Directors and published in the BBU Policies & Procedures Manual. This committee shall not be empowered with direct action. The findings of the committee shall be reported to the Board of Directors with a recommendation of Board action. This committee shall not accept or proceed further with any disputes or claims that are in litigation. EXECUTIVE SALES COMMITTEE: This committee shall consider and make recommendations to the President, the Board of Directors, the general membership and the Breed Improvement Committee concerning activities and rules pertaining to sales. CONVENTION COMMITTEE: This committee shall consider and make recommendations to the President and the Board of Directors regarding annual conventions. PRESIDENT’S COUNCIL: This committee shall be appointed if the BBU President so desires. This committee shall be made up of the President of various satellites to serve as a conferring group and line of communication for the President. INTERNATIONAL COMMITTEE: This committee shall consider and make recommendations to the President and the Board of Directors regarding the coordination of activities with international breed organizations and the international marketing of the breed. COMMERCIAL MARKETING COMMITTEE: This committee shall supervise all activities involving the commercial marketing of Beefmaster and Beefmaster cross cattle. It shall work together with other committees in furthering the use of Beefmaster genetics in the commercial industry. This committee shall consider and make recommendations to the President and the Board of Directors regarding the commercial marketing of Beefmaster and Beefmaster cross cattle. V. RECOGNITION OF BREEDING The Lasater Beefmaster herd, owned by the Lasater Ranch of Matheson, Colorado, formerly of Falfurrias, Texas, is recognized as the foundation herd of the Beefmaster breed. Cattle, other than individuals of or from this foundation herd, shall be recognized as being of Beefmaster breeding provided: 1. They are purebred descendants of the foundation herd, which was recognized as an American breed by the USDA in 1954, or 2. They are produced by three consecutive crosses of recognized Beefmaster breeding and in conformity with the rules and regulations promulgated by the Board of Directors of BBU. BREEDING AND OWNERSHIP PROCEDURES 1. The breeder is that individual, corporation or firm who owned the dam at the time of conception of the animal in question. 2. The first owner is that individual, corporation or firm who owned the dam at the time of birth of the animal in question. 3. Application for a Certificate of Breeding shall be made by the Breeder-Member-First-Owner upon the official form or forms available from BBU and completed, authenticated and returned to BBU as prescribed and published by the Board of Directors. Dam identification by BBU certificate number shall be required to be designated by the BreederMember-First-Owner upon the application form when applying for a Certificate of Breeding for a specific animal. Upon application for certification, sire (or sires, if multiple) must first be certified by BBU in accordance with the rules, regulations and By-Laws of BBU. Based upon this application, having been fully completed with all required information and, provided that all the conditions of these By-Laws and rules and regulations set forth by the Board of Directors are met, BBU shall issue a Certificate of Breeding covering the specific animal. The affirmed application and a copy of the Certificate of Breeding shall be retained in the files of the corporation for such period of time as the board of Directors shall approve. The form of application and form of certification shall be approved by the Board of Directors. 4. Without regard to the provisions contained in these ByLaws, the Beefmaster foundation herd owned by the Lasater Ranch of Matheson, Colorado will be eligible to apply for Certificates of Breeding on cattle produced from such herd without dam identification so long as it remains a closed herd and is owned by the Lasater family. 5. If the estate of the deceased Breeder-MemberFirst-Owner wishes to secure a Certificate of Breeding, application for Certificate of Breeding shall be made by the legally authorized personal representative of his estate upon the form to be provided that the animal covered by the application for Certificate of Breeding is still owned by said deceased breeder-member’s estate. Said individual will likewise sign in lieu of the deceased breeder-member, both on the face of the Certificate of Breeding and, in the event of transfer, he will sign on the back thereof. 6. A Certificate of Breeding may be transferred to a member or non-member of BBU who, in turn, may transfer same, provided that the non-member pays two times the member’s fee for transfer. At the time of transfer, the certificate must be returned to the BBU office, for validation of transfer. Should the Executive Vice-President be provided a bill of sale in the form then available from BBU that appears on its face to have been appropriately fully completed and executed and be advised by the buyer in such bill of sale that the seller has been unable or unwilling to make application for transfer of the related Certificate(s) of Breeding, BBU will request, by certified mail, such seller to make such application. Should such seller not make such application within thirty (30) days of his receipt of such request and not in the opinion of the Executive VicePresident adequately justify his not making such application, the Executive Vice-President may, on behalf of BBU, and after receipt of the transfer fee then applicable, transfer to such buyer the Certificate(s) of Breeding on the relevant animal(s). 7. The Board of Directors shall approve a policy for issuing duplicate Certificates of Breeding. VI. ANNUAL DUES AND OTHER CHARGES 1. The amount of annual dues and late payment penalties to be paid by charter, active, associate and junior members, as well as the fees to be charged for Certificates of Breeding, for other printed material and services, shall be fixed by the Board of Directors from time to time. 2. Dues will be due and payable at the time each member joins. Thereafter, dues will be due and payable in January of each year except for Lifetime members. 3. Each year in June, there shall be published a roster of all members, their prefix names and addresses. VII. REGIONAL OR LOCAL ORGANIZATIONS 1. Regional or local organizations of members of BBU may be authorized by the Board of Directors to engage in activities to further and improve the breed of Beefmaster cattle. Members desiring to form such an organization shall submit a written application for authorization to the Board of Directors and, in addition, a statement of the plan of organization and the proposed scope of activities of such organization. 2. If, in the opinion of the majority of the members of the Board of Directors, a need exists for a branch of BBU in a locality sought and if the statement of the plan of organization and scope of activities conforms to the overall purpose and activities of BBU, then authorization of the branch may be granted subject to the By-Laws and rules and regulations prescribed and promulgated by such Board of Directors from time to time, and it shall at all times keep BBU advised as to its activities in order to ensure full compliance with all applicable federal, state and local laws and regulations. 3. Any member of BBU shall have the privilege of participating in any activity of any such regional or local organization upon the payment of the fees set and prescribed by such organization, and, if required by that organization, the prior joinder of same. Such fees need not be equivalent for a BBU member, which is a member of such a regional or local organization and for a BBU member which is not a member of that same regional or local organization. 4. The authorization of any such association may be revoked for cause by the Board of Directors. VIII. AMENDMENT OF THE BY-LAWS Amendments to the By-Laws shall only be adopted in the manner hereinafter provided. The proposed amendment shall be first submitted in writing to the Board of Directors. If a majority of such Board believe that the proposed amendment is worthy of submission to the general membership, they shall notify such membership of the proposed amendment at the time of issuance of the written notices calling the general membership meeting. In the event that fifteen percent or more of the members endorse a proposed amendment, the Board of Directors shall submit same for consideration to the membership. An amendment shall be ordered adopted if a simple majority of those voting, either in person or by proxy, vote in favor of adoption. IX. RULES OF ORDER Robert’s Rules of Order will apply in whatever is not covered by these By-Laws. X. ADDITIONAL REGISTRATION PROCEDURES 1. International Exchange of Certificates Notwithstanding other restrictions herein contained, any national Beefmaster breed association headquartered outside the U.S. (“Association”) or interested member thereof may make a request in writing, including copies of their By-Laws, rules and regulations, amendments, and Purebred Registration Procedures, to the Executive VicePresident of BBU for approval of the exchange of their purebred Beefmaster Certificates of Breeding for BBU certificates. The Association must substantially conform to appropriate BBU By-Laws, rules and regulations, and amendments thereto that pertain to Recognition of Breeding, Breeding, and Ownership Procedures. Upon review by the Executive Vice-President to confirm that the Association meets standards established by the Board of Directors for exchange, including, as a minimum, dam identification and three crosses in any upgrade program, a recommendation to accept or reject that Association’s application for exchange would be presented at the next BBU Board of Directors meeting. If approved by the board of Directors, BBU would accept exchange applications thereafter from that Association. Upon amendment of or substantial changes to these documents, or the report of significant problems associated with the exchange of Certificates of Breeding with the Association, the Executive Vice-President may review those documents and procedures and again make appropriate recommendations to the Board of Directors. Any individual, corporation, or firm, currently a lifetime or active member of BBU, may make application for a BBU Certificate of Breeding on an Association purebred registered Beefmaster, which has been previously approved for exchanges. Application must be made on forms established by BBU and accompanied by normal transfer of ownership fees, if applicable, and such additional exchange fee and handling fees as may be established by the Board of Directors. Each request must include written confirmation from the Association, dated no more than thirty (30) days prior to the application, that the applicant is the current owner of the animal. Any individual, corporation, or firm, currently a lifetime or active member of BBU, may make application to transfer ownership of semen or embryos from a dam or sire currently registered with an Association with which BBU exchanges certificates of breeding as follows: (1) the applicant would apply to BBU for exchange certificates of breeding on the donor and/or sire, as appropriate, as indicated above; and (2) the applicant would comply with applicable BBU procedures for transfer of ownership of the embryo and or semen, including applicable blood and/or DNA typing. XI. DNA TESTING BBU may require that any animal for which application for registration is made or which is already registered be subjected to a DNA genotype as an aid in verifying the accuracy of purported or recorded parentage and/or breed purity. The Board of Directors, or the Executive VicePresident acting on behalf of the Board of Directors, may require that a DNA genotype be made by such person, breeder or agency as it or he may designate of any purported Beefmaster animal as an aid in verifying parentage or which has been alleged to have been incorrectly represented on an application for registration or incorrectly registered, or for any animal for which blood or tissue analysis may be relevant to the accuracy of any record or registry maintained by BBU. It shall be the duty of the owner or owners of record of any such animal in question and the owner or owners of record of its purported sire and dam to afford BBU or its representatives reasonable opportunity to secure blood or tissue from the animals involved in the investigation. The Board of Directors is empowered to determine who shall pay all or part of the costs of any such investigation, including laboratory fees assessed under these provisions and to make detailed rules prescribing the procedures to assist in parentage verification and maintenance of breed purity. XII. INVESTIGATIONS REGARDING CERTIFICATIONS Effective October 27, 2006, after a certificate of breeding has been issued for an animal and credible information is thereafter received by the Executive Vice-President that raises a doubt concerning the propriety of the certification of the animal, the Executive Vice-President may make further inquiry regarding the propriety of the certification of the animal and report the results of his findings to the Board of Directors. The report may include a recommendation by the Executive Vice-President for an investigation of the propriety of the certification of the animal. The Board of Directors may institute an investigation of the propriety of the certification of the animal or, it may appoint a special committee to conduct this investigation and submit a written report of its findings and recommendations to the Board of Directors. The Board of Directors may suspend the registration of the animal and any further registrations of its progeny pending the Board’s final determination of the investigation. BBU recognized sales and transfers of the progeny, semen, embryos, flushes or pregnancies of the animal must involve notice by the seller to the buyer or transferee of such investigation. BBU may require written proof of such notice unless it occurs in a BBU Approved Sale. The Executive Vice-President shall duly notify by letter the member-owner(s) of the animal of the action(s) of the Board of Directors. This notice letter shall be sent to the member-owner(s) not less than thirty (30) days prior to the hearing by certified mail, return receipt requested. The notice letter shall include: (1) a copy of the charges, (2) notice of the date, time and place of the hearing of the matter, (3) a statement of the purpose and scope of the hearing, (4) the actions the Board of Directors has the power to impose regarding his membership in BBU and the certification of the investigated animal and (5) that the member may appear in person or by counsel and produce witnesses, affidavits, documentary or other evidence that is appropriate to the investigation. The Executive Vice-President shall also notify the membership of the suspension of the registrations of such progeny and of the notice requirement regarding the sale or transfer of the progeny, semen, embryos, flushes or pregnancies of the animal by direct mail or by publication in the official BBU publication. If the investigation reveals that, under the By-Laws or Rules of BBU in effect at the time the certificate was issued, an animal was not qualified to receive the category of certificate or the pedigree as shown on the certificate, the Board of Directors may take any action in its final decision that it deems appropriate and necessary to assist in parentage verification and maintenance of breed purity. Board actions may include but are not limited to imposing the suspension or the revocation of the certification of the animal. Without limitation, one basis of determination that an animal did not qualify for its certificate would be a determination by the BBU officially designated laboratory that the animal did not qualify as the progeny of one or both of its represented parents. The laboratory’s determination may involve derived blood types or DNA genotypes and, while not complete, may be adequate and acceptable to exclude the represented relationship of the animal by the currently accepted scientific standards within the field. From the laboratory reports, and/or other accepted, credible evidence, and the totality of the circumstances of the investigation of the animal, the Board of Directors may determine the disqualification of the animal. If the Board of Director’s decision disqualifies the animal, the Executive Vice-President shall immediately mail letters to the membership informing them of the Board of Director’s decision. This letter should also inform the membership that BBU will not register additional progeny of the disqualified animal which are born more than three hundred and fifty (350) days of the date of the letter of the Executive Vice-President. In the absence of fraud or intentional wrong doing that is reasonably proven by credible evidence to the satisfaction of the Board of Directors, all progeny will be left in the BBU register that were registered to the animal prior to the date of the letter notifying the membership of the disqualification of the animal. The owners of such progeny will also be notified of the disqualification of the animal and of the date the Board of Directors determined the disqualification. Additionally, in the absence of fraud or intentional wrongdoing that is reasonably proven by credible evidence to the satisfaction of the Board of Directors, all progeny of the disqualified animal that were born prior to or, that were born within 350 days after the date of the aforesaid advisory letter from the Executive Vice-President to the membership, may be registered with BBU. However, their certificates of registration must disclose the respective parental disqualification. Sales or transfers of such registered progeny or progeny that may be so registered within such 350 day period that may be sold and transferred in BBU approved sales or that may be sold or transferred other than in a BBU approved sale will be recognized by BBU provided the prospective buyer or transferee is given notice of the respective parental disqualification prior to incurring any obligation for same. BBU may require written proof of such prior notice unless it occurs in an Approved BBU sale. BBU will not recognize the sale or the transfer of semen, embryos, flushes or pregnancies from a disqualified parent which occur after the date of the notification letter of disqualification to the membership. The provisions of this Article XII shall not alter any relevant agreements existing between BBU and any of its members as of October 26, 2006. Both Conformation and Underline scores will be placed on Certificate of Breeding and will follow in the pedigree. e. “Unacceptable” or “X” female – Owner of Record must surrender Certificate of Breeding for cancellation. An “X” female would have visual inherited deformities which occur in Bovine, as listed in the BBU Standard of Excellence, or would have a combination of discriminations that would be a definite detriment to breed improvement. Males may be presented for classification up to twenty-four (24) months with a yearling scrotal measurement taken at 320-410 days of at least 30 centimeters. All cattle presented for classification should be legibly fire branded with a permanent, individual identification number. (Cattle may be tattooed in the left ear with a permanent, individual identification number). Fire Brand Preferred. Year number and holding brands are optional. Classification requests should be submitted, in writing, to the BBU office, with ample time to allow for geographical scheduling. She must be a Second Cross or Purebred Beefmaster. Females no longer in production as of August 1, 2006, must also be U classified. 2. She must calve by 30 months of age and this calf must be enrolled in the Weights & Measures Program to establish the cow’s age at calving as well as calving interval data. 3. She must have 3 consecutive natural calves with an average calving interval of 375 days or less, or 1 natural calf followed by 1 embryo calf with a calving interval of 375 days or less. 4. She must have 3 natural calves with weaning ratios of 105 or better in their respective contemporary groups, or 1 natural and 3 embryo calves with weaning ratios of 105 or better in their respective contemporary group. There must be at least 5 animals in the contemporary group of each offspring. 5. The cow herself is not required to have individual weights and measures data for her performance of weaning weight. The cow’s calves must, however, be enrolled in a Weights & Measures Program, and all of her progeny data must be entered into the Program before the third calf is born. PACESETTER SIRE 1. He must be a Purebred Beefmaster. Bulls no longer in production as of August 1, 2006, must also be U classified. 2. He must sire 5 Pacesetter Dams. For both Pacesetter Dams and Pacesetter Sires, the word “PACESETTER” will appear on the BBU Certificate of Breeding wherever applicable. BBU will determine the Pacesetter status of cows and bulls, regardless of the ownership of the animals or their progeny. Designed to recognize outstanding performers in the Weights & Measures Program, the Pacesetter Award is one of the Beefmaster breed’s top honors. TERMS AND CONDITIONS OF SALE ADOPTED BY BEEFMASTER BREEDERS UNITED FOR BBU APPROVED SALES Effective September 10, 2010 THE FOLLOWING TERMS ARE APPLICABLE TO ALL TRANSACTIONS IN BBU APPROVED SALES: 1. BIDDING: Each animal will be sold to the highest bidder without reserve. 2. BIDDING DISPUTE: The Auctioneer in charge will settle any dispute as to bids, and his decision on such matters shall be final. 3. TERMS: Terms of the sale are cash due upon sale, unless prior credit arrangements for the sale have been agreed upon in writing between the Buyer and Seller, in which event, the terms of the written credit arrangement between the Buyer and Seller for the sale shall prevail. The failure of a member buyer to pay the appropriate party the sale amounts when due may constitute a cause for exclusion from BBU pursuant to Article I, section 9 of the By Laws of BBU. 4. PURCHASER’S RISK: Each animal becomes the risk of the purchaser as soon as the auctioneer declares it sold. 5. CERTIFICATE OF BREEDING AND/OR TRANSERS: All required paperwork will be transferred to the buyer at the seller’s expense, upon settlement. 6. HEALTH: All animals will have appropriate certificates of veterinary inspection for travel to the sale site and will to the best of the seller’s knowledge be eligible for interstate shipment, however, buyers need to be aware of their individual resident state’s requirements for shipment of cattle. Any and all testing will have been completed within thirty (30) days of the sale date. 7. ANNOUNCEMENTS: Any changes in information of any kind will be announced from the auction box and such announcements shall take precedence. 8. BREEDING GUARANTEES: a) FEMALES: OPEN AND/OR EXPOSED FEMALES: Females younger than twenty-four (24) months of age can be sold as open. Open females are so guaranteed. Any female is considered a breeder if she is certified to be pregnant by a licensed veterinarian at the time of sale and/or has a nursing calf at side. Cows (including donor cows) with calves at side six (6) months or older must be certified to be pregnant by a licensed veterinarian. b) SAFE IN CALF FEMALES have been examined by a competent veterinarian and are so guaranteed. c) BULLS: Bulls eighteen (18) months or older are guaranteed to have passed a Bull Breeding Soundness Evaluation (BSE) and to have been certified a satisfactory potential breeder by a licensed veterinarian within forty-five (45) days prior to sale date. The results of the Breeding Soundness Evaluation (BSE) must be reported on a fully completed official form and attached to the health papers required for the sale. 9. DISCLOSURE OF PRIOR PROCEDURES: If known to the seller, there must be a disclosure in the current sale catalog or from the box of any circumcision or other surgical alteration of any underline of any male or female and of any single egg or super-ovulation flush of any female sold in a BBU Approved Sale. 10. INHERITED DEFORMITIES GUARANTEE: All bred females are guaranteed not to produce a calf with an inherited deformity occurring in Bovine for a period of nine months following date of sale. 11. REPRESENTATIONS AND GUARANTEES: All representations and guarantees, whether set forth in sale catalogs, these Terms and Conditions of Sale or otherwise, are solely those of seller and are not those of BBU. Except for the assurances set forth in the Approved Sales Agreement that an animal does not exhibit a genetic defect and that its registry information is consistent with the information in BBU’s records, BBU makes no representations, warranties, guaranties or assurances whatsoever. 12. RIGHTS AND OBLIGATIONS: The above terms and conditions of sale shall constitute a contract between buyer and seller of each animal and shall be equally binding upon both. Each sale or resale of an animal constitutes a separate transaction. Neither BBU, the sale manager, nor any other person connected with the management of the sales assumes any liability, legal or otherwise, for any subsequent resale of an animal. 13. REMEDIES: a) OPEN AND/OR EXPOSED FEMALES are guaranteed to be breeders by twenty-four (24) months of age except in cases of animals purchased and then fitted for show or administered any super ovulation drug. In cases of animals fitted for show or administered any super ovulation drug after purchase, the breeding guarantees, if any, shall be such as agreed upon between buyer and seller. All claims for a refund must be made in writing to the seller within six (6) months after the animal reaches twenty-four (24) months of age. Open females are so guaranteed. If within sixty (60) days after the sale date, a female sold as “open” proves to be with calf, the buyer may return the female to the farm of the seller, provided the female is in good condition and in compliance with the health requirements of the seller’s state, and receive refund of the full purchase price. The acceptance of the refund of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The buyer’s failure to notify the seller within sixty (60) days from the date of sale and to make the election as hereinabove provided shall relieve and absolve the seller of any duty, obligation or liability to the buyer regarding the purchase of said female. The seller and buyer shall bear equally all reasonable and necessary transportation expenses that are incurred in returning the animal to seller. b) SAFE IN CALF FEMALES are guaranteed to have been examined by a licensed veterinarian. If within thirty (30) days after sale date, a female sold as “safe in calf” proves not to be in calf, the buyer may immediately request that the female receive service from the bull previously used, if available, or return the female to the farm of the seller, provided the female is in good condition and in compliance with the health requirements of the seller’s state, for a refund of the full purchase price. The acceptance of the refund of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The buyer’s failure to notify the seller within thirty (30) days from the sale date and to make the election as hereinabove provided shall relieve and absolve to the seller of any duty, obligation or liability to the buyer regarding the purchase of said female. The seller and buyer shall bear equally all reasonable and necessary transportation expenses that are incurred in returning the animal to seller. c) FLUSHES AND TIME REQUIREMENTS: A flush consists of all viable embryos, transferred or frozen, received from a female as the result of the administration of any super ovulation drug. The sale of a flush or resulting pregnancies must specify in the sale catalog the number of pregnancies guaranteed and the disposition of any other pregnancies resulting from the flush, the disposition of any frozen embryos resulting from the flush and any additional charge for the recipient cows. The maximum time for the delivery of the guaranteed results must be specified along with a payment schedule. Non-delivery or only partial delivery by the specified time by the seller will result in a pro-rata refund of all monies paid by the buyer for such flush or pregnancies not delivered. d) PREGNANCY AND/OR PREGNANT RECIPIENT COW: Pregnancy and/or pregnant recipient cow is a cow of any breed that is carrying a pregnancy (guaranteed to have been examined by a licensed veterinarian as safe in calf) as the result of a flush as so stated on the certification of embryo transplant form. Such pregnancy and/or pregnant recipient cow is guaranteed to be carrying the embryo pregnancy so stated and if found not safe in calf by a licensed veterinarian within thirty (30) days of delivery of the recipient cow to the buyer, the buyer will have the same remedies as set forth in clause b) for the safe in calf females. The amount bid by the buyer for the individual pregnancy and/or pregnant recipient cow offered at a sale will be inclusive of the recipient cow. A pregnancy and/or pregnant recipient cow should be available at the sale site; however, if not available it must be delivered to the buyer, at the seller’s expense, within thirty (30) days of the sale with the necessary health papers sufficient for delivery to the buyer. e) CLONES: Only BBU replication cell-cloned animals shall be eligible for registration and eligible to sell in BBU Voluntary Approved Sales. Genetically modified animals shall not be eligible for registration and cannot sell in BBU Approved Sales. Cloned animals shall be guaranteed by the seller to be breeders under the same terms of the agreement for females and bulls. Any additional guarantees with respect to clones shall be by separate agreement between buyer and seller. f) BULLS: If within one-hundred twenty (120) days from the date of sale, the bull has failed to pass a Breeding Soundness Evaluation (“BSE”) certified by a licensed veterinarian, buyer must send seller written notification of the failure of the test within one-hundred and twenty (120) days from the date of sale and include the BSE test results. Within sixty (60) days after sellers notification of the failed BSE test, buyer and seller shall identify a mutually agreeable licensed veterinarian or technician certified by a licensed veterinarian to perform another BSE on the bull at the buyer’s expense. The results of the test shall be deemed final and conclusive of this matter and binding on buyer and seller. If, in the opinion of said veterinarian or technician, the bull is unable to pass a BSE and be confirmed a satisfactory potential breeder, he shall so certify in writing to the seller and the buyer which shall include the official form used by the Society of Theriogenology or the official BBU Breeding Soundness Evaluation form. In such event the buyer may return the bull to the farm of seller, provided the bull is in good condition and in compliance with the health requirements of the seller’s state, for a refund of the full purchase price. The acceptance of the refund of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The seller and buyer shall bear equally all reasonable and necessary transportation expenses that are incurred in returning the animal to seller. A listing of industry standards for Scrotal Circumferences for bulls at various ages will be printed in the sale catalog. Satellites, Marketing Groups, or individuals may specify additional guarantees. Beefmaster Breeders United Approved Sale Agreement (For Consignors, Sale Managers and Consultants) In consideration of the permission granted by Beefmaster Breeders United (“BBU”) for the undersigned to conduct a BBU Approved Sale and the mutual agreements set forth below, I hereby agree to the following terms and conditions: 1. All cattle to be sold shall be represented by the seller as properly identified with permanent identification number. All identification numbers, branded or tattooed on an animal, and the description must match identically the identification numbers, holding brands and description listed on the Certificate of Breeding. 2. At the time of the sale, all cattle exhibiting any genetic defect that, in the opinion of the designated BBU official, would be a detriment to the breed, and all cattle that, in the opinion of the designated BBU official, would classify “X” under the BBU Voluntary Classification Program will be removed from the sale offering. 3. BBU’s fees for services rendered in connection with an Approved Sale are available upon request from the BBU office. 4. The designated BBU official responsible for implementing the above regulations will be at the sale site in ample time to inspect the cattle and accompanying records prior to the commencement of the sale and I agree to provide such official with appropriate access and accommodations required to assure full compliance with the terms of this Agreement. 5. All cattle sold, other than First and Second Cross calves under fourteen (14) months of age and the embryo recipients, must have BBU Certificates of Breeding. All First and Second Cross calves under fourteen (14) months of age must be accompanied by a properly completed and executed Application for Certificate of Breeding. The sale management or seller must present all Certificates of Breeding (or applications when applicable) to the BBU office fourteen (14) days prior to sale date. Substitute animals will be accepted provided the Certificates of Breeding (or applications) are in compliance with all applicable requirements upon arrival at the sale site. 6. All semen and frozen embryos sold at a BBU Approved Sale must have a BBU Semen/Embryo Bill of Sale provided at the time of the sale. The BBU Semen/Embryo Bill of Sale shall include, if applicable, the Blood Typing Case # and DNA Genotype Case # of the bull whose semen is sold, or the sire and dam of the embryos being sold. All A’I Sires and Donor Dams must have a DNA Profile on file (or Blood Typing, if applicable) at BBU prior to the approved sale date. BBU approved sale catalogs must include the blood type case number and DNA genotype case number of all animals selling that have been typed; and include the blood type case number and DNA genotype case number of the sire and dam (if typed) of all animals selling. The PV designation for “Parent Verified” must also be included in the BBU Approved Sale catalog on each animal to which it is applicable. 7. BBU Certificate of Breeding number of each service sire of a bred female must be indicated in the sale catalog. 8. If an animal is classified, such classification must be reflected in the catalog, as provided for below or on the pen card if applicable or announced from the box. All existing available official BBU performance information will be included in the following block, (only that portion of the block must be printed where official BBU information exists) for the display of official BBU classification and performance information. The sample block below may be used or other formats may be used but the information must be official BBU data as listed on the registration certificate. FAILURE BY A MEMBER TO COMPLY WITH THIS SIGNED AGREEMENT WILL BE AUTOMATIC CAUSE FOR APPEARING BEFORE THE BBU ETHICS AND RULES COMMITTEE TO SHOW CAUSE WHY HE/SHE SHOULD BE PERMITTED TO RETAIN HIS/HER MEMBERSHIP IN BBU. The provisions of this Agreement only apply to a sale that has qualified to the satisfaction of BBU as a “BBU Approved Sale.” Such qualification shall be manifested by the certifying statement of an authorized officer, director or staff person of BBU expressed from the sale box immediately prior to the sale. All BBU Satellite Sales shall be conducted in conformance with, and subject to, the terms and conditions of this Approved Sales Agreement. My agreement to be so bound shall remain effective until BBU’s receipt of a written revocation by me. No obligations that arise prior to such revocation will be changed by such revocation. BBU will keep its membership informed of revisions to the BBU Sanctioned Sale Agreement by announcements in its official breed publication, The Beefmaster Cowman, by a general direct mailing, or by publication on the official BBU website (www.beefmasters.org) and will provide a member additional copies of the BBU Sanctioned Sale Agreement upon request. Beefmaster Advancer Cattle By definition, these are animals of 50% or more Registered Beefmaster breeding and 50% or less of other Registered and DNA genotyped* nonBeefmaster Beef breeding. These animals may be certified in BBU provided they are produced from breeding of one of the following: 1. Known registered Beefmaster sire mated to a DNA genotyped*, registered dam from another breed association. 2. Known registered Beefmaster dam mated to a DNA genotyped*, registered sire from another breed association. 3. A known progeny of a 50% -74% Beefmaster Advancer and a known registered Beefmaster sire or dam. 4. Known progeny from animals recorded in the Beefmaster Advancer Program meeting all Association requirements for registration that are 50-87% Beefmaster breeding. Section II. Animals Eligible for Beefmaster Advancer Certification A. Animals eligible for recording in the Beefmaster Advancer Program must come from parents that are enrolled in the BBU Whole Herd Reporting Program. All animals as defined above may be certified as Beefmaster Advancer cattle by the Association but none such shall ever become registered Beefmaster animals. Section III. Animals Eligible for Beefmaster Registration A. "Purebred" Beefmaster Cattle Animals produced from a 75% or greater Beefmaster Advancer mated to a Purebred Beefmaster may be presented as a registered Beefmaster if the percentage Beefmaster is greater than 87.5% in the resulting offspring. Animals eligible for recording in the Beefmaster Advancer Program must come from parents that are enrolled in the BBU Whole Herd Reporting Program. All animals as defined in Section II may be certified by the Association but none such shall ever become registered Beefmaster animals. Section III. Fees Fees charged for certification by BBU for members of the Association in good standing shall always be the same fees charged others for Whole Herd Reporting and that all such fees shall be subject to review and change by the active members of the Association at any duly convened meeting of the Association members. *All non-Beefmaster animals must have a sample (semen, blood, hair follicle) on file (order kit from BBU Office) with a complete DNA genotype. Additionally, sires and dams from non-Beefmaster breeds must have negative DNA tests on file for known genetic defects identified by the respective breed association (e.g. arthrogryposis multiplex for Angus cattle or tibial hemimelia for shorthorn cattle). Breeder: the owner of the dam at the time of service. Certified Beefmaster: the male and/or female offspring by a Certified Beefmaster Sire and out of a Certified Second-Cross Beefmaster Female. Certified Beefmaster Sire: a Beefmaster bull for which a BBU Certificate of Breeding has been issued. Certified First-Cross Beefmaster Female: the female offspring by a Certified Beefmaster Sire and out of a Documented Base Female. Certified Second-Cross Beefmaster Female: the female offspring by a Certified Beefmaster Sire and out of a Certified First-Cross Beefmaster Female. Documented Base Female: a pure or cross-bred female. Grade Brand: Base Cow; a bar followed by the letter “C” (-C), First Cross; the cardinal numeral one (1) followed by the letter “C” (1C), and Second Cross; the cardinal numeral two (2) followed by the letter “C” (2C). Listed Female: a Documented Base Female, a Certified First-Cross Beefmaster Female, or a Certified Second-Cross Beefmaster Female. Number Brand: the brand which is represented by one or more cardinal numerals, and indicates the number of the subject female for identification purposes. Owner: the owner of the dam of the subject animal at the time of the latter’s birth. Owner’s Brand: the brand indicating ownership by an individual. Year Brand: the brand represented by a single cardinal numeral indicating the year of the decade in which the subject female was born. II OFFICIAL FORMS AND CERTIFICATES 1. 2. 3. 4. Certificate of Breeding: the Certificate evidencing the fact that the subject animal is by a Certified Beefmaster Sire and out of a Listed Female. First-Cross Beefmaster Certificate of Breeding: the Certificate, printed in red, issued after the subject female has been inspected and application for Certificate of breeding submitted. Second-Cross Beefmaster Certificate of Breeding: the Certificate, printed in green, issued after the subject female has been inspected and application for Certificate of Breeding submitted. Request for Inspection: the form to be obtained from the BBU office on which request for inspection of base females, first and/or second cross females is made. III BREEDING METHODS 1. 2. 3. Certified Beefmaster bulls to be used in the official BBU Upgrading Program must be inspected and accepted by an official fieldman of BBU. Either artificial insemination or live coverage may be employed. Each Breeding Certificate shall state which system the breeder employed, and the bulls used in the artificial insemination program must be blood typed and/or DNA genotyped. (Refer to BBU AI Program Regulations). When artificial insemination is employed, and the owner of the sire and the breeder are the same person, a written statement shall suffice from said person to certify that the semen from a particular Certified Beefmaster Sire was artificially inseminated into a certain Listed Female on a certain date. However, where the owner of the sire and the breeder are different persons, the breeder must obtain from the owner of the sire a properly executed Semen Bill of Sale which must be submitted to BBU for recording. IV DOCUMENTED BASE FEMALES 1. 2. 3. 4. 5. A written request for inspection of base cows must be filed with the BBU office. All pure or cross-bred females must pass inspection by an official fieldman of BBU. The cows accepted by the fieldman must be properly identified. Those cows accepted by the fieldman will be recorded with BBU. After receipt of the properly completed and executed Inventory of Base Females and requisite fees, BBU shall then record each such female. Each such female so listed shall then be entitled to be designated a “Documented Base Female.” V CERTIFIED FIRST-CROSS BEEFMASTER FEMALES (ONE-HALF BLOOD) 1. 2. 3. 4. 5. A written request for inspection of First-Cross Beefmaster Females must be filed with BBU. All First-Cross Females must pass inspection by an official fieldman of BBU. The First-Cross Females accepted by the fieldman must be properly identified. The First-Cross Females accepted by the fieldman will then be recorded with BBU. A properly completed and executed Application for First-Cross Certificates of Breeding will be submitted. The correct fees, as set by the Board of Directors, must accompany the aforementioned Application for First-Cross Certificates of Breeding. 6. After BBU has received application for the subject female, a Certificate of Breeding evidencing the fact that the subject female is so listed, shall be issued. The subject female shall then be entitled to be designated a Certified First-Cross Beefmaster female. VIII BRANDS 1. 2. VI CERTIFIED SECOND-CROSS BEEFMASTER FEMALES (THREE-QUARTERS BLOOD) 1. 2. 3. 4. 5. 6. 7. A written request for inspection of SecondCross Beefmaster Females must be filed with BBU. All Second-Cross Females must pass inspection by an official fieldman of BBU. The Second-Cross Females accepted by the fieldman must be properly identified. The Second-Cross Females accepted by the fieldman will then be recorded. A properly completed and executed Application for Second-Cross Certificates of Breeding will be submitted. The correct fees, as set by the Board of Directors, must accompany the aforementioned Application for Second-Cross Certificates of Breeding. The identity of the dam of each Second-Cross Female will appear on the Application for Certificate of Breeding. After BBU has received application for subject female, a Certificate of Breeding evidencing the fact that the subject female is so listed, shall be issued. The subject female shall then be entitled to be designated a Certified SecondCross Beefmaster female. VII CERTIFIED BEEFMASTER (SEVEN-EIGHTHS BLOOD) 1. 2. The male and female offspring out of a Certified Second-Cross Beefmaster Female and by a Certified Beefmaster Sire shall be automatically eligible for a BBU Certificate of Breeding. A properly completed and executed Application for Certificate of Breeding, along with the correct fees, as set by the Board of Directors, must be submitted to the BBU office. After BBU has recorded the subject animal, a Certificate of Breeding evidencing the fact that the subject animal is so listed shall be issued. The subject animal shall then be entitled to be designated a “Certified Beefmaster.” After inspection by an official fieldman of BBU, those females accepted will be branded with the grade brand. All brands and their locations shall be correctly noted on each Application submitted. IX TRANSFER OF LISTED FEMALES 1. 2. 3. In the event that a Listed Female is transferred, a properly executed BBU Bill of Sale, application for transfer (Certificate of Breeding with reverse side completed), if applicable, and the appropriate fees as set by the Board of Directors, must be submitted to the BBU office. In the event that a Documented Base Female or a Certified First-Cross Beefmaster Female is pregnant at the time of sale or transfer, and was mated to a Certified Beefmaster Sire prior to such time, and was transferred to the purchaser’s name, the female offspring thereof shall be automatically eligible for registration with BBU. In the event that a Certified Second-Cross Beefmaster Female is pregnant at the time of sale or transfer, and was mated to a Certified Beefmaster Sire prior to such time, and was transferred to the purchaser’s name, the male or female offspring thereof shall be automatically eligible for registration with BBU. BEEFMASTER BREEDERS UNITED ARTIFICIAL INSEMINATION PROGRAM (See pg 57 For Semen A.I. Certificate Form) Regulations Related to Certification of Calves Sired Artificially 1. All A.I. Sires used for artificial insemination must have a DNA profile on file (or Blood Typing if applicable) before any such A.I. sired calves will be registered. All blood typing and DNA genotyping required under these rules must be by the official respective laboratory specified by BBU and the respective reports filed in BBU headquarters. Otherwise the produced progeny will not be eligible for certification. 2. Effective October 27, 2006, during the investigative and post investigative periods of any question about the propriety of the certification of any animal, the status of its certificate and the registration ability of its progeny and the transferability of its progeny, semen, embryos, flushes and pregnancies will be as stipulated in By-Laws provision number XII and, where not inconsistent with Article XII of the By-Laws, in the Terms And Conditions of Sale and the Voluntary Approved Sale Agreement. 3. An animal may have no more than four (4) owners of record at one time. Owner(s) of record refers to the current owner(s) of an animal in whose membership(s) the animal is recorded. The owners of an animal shall designate the four (4) owners of record if the animal is owned by more than four (4) owners. 4. Upon the sale of semen, the seller will provide an AI Certificate Form to the Buyer. A copy should be sent to BBU headquarters, whereupon receipt of the AI Certificate Form BBU headquarters will record the sale or transfer of the information accordingly. 5. Provided BBU headquarters receive a complete, accurate and acceptable AI Certificate Form, the progeny produced from the purchased semen will be eligible for certification. 6. There will be an additional charge (see fee schedule) for the certification of a calf sired artificially if the applicant is/was not an owner of record of the bull at the time of said calf's conception. 7. If BBU headquarters receives detail written information indicating that any sire used in the official BBU A. I. Program has transmitted genetic defects, they shall cause the matter to be investigated and shall have the power to temporarily suspend certification of any additional calves sired artificially by said sire pending such investigation. If it is found that the sire in question is in fact transmitting detrimental genetic characteristics, the Certificate of Breeding on said sire must be surrendered for cancellation. BEEFMASTER BREEDERS UNITED EMBRYO TRANSFER PROGRAM (See pg 58 for Embryo Bill of Sale) Regulations Related to Certification of Calves born from Embryo Transfer 1. All E.T. Donor Dams used for embryo transfer must have a DNA profile on file (or Blood Typing if applicable) before any such E.T. calves will be registered. Embryo calves are not required to be blood typed or DNA genotyped for certification eligibility. 4. When the ownership of a donor dam changes after embryos have been recovered, the owner of the dam at the time the embryos were recovered shall retain the ownership and certification rights of said embryos. 5. Immediately upon the sale (or change in ownership) of an embryo (frozen or fresh), “seller” must submit, to the BBU headquarters, a properly completed "Embryo Bill of Sale" form. 6. Immediately upon the sale (or change in ownership) of a pregnant recipient, the applicable "Recipient Transfer" form must be completed and signed by the 'seller' of said recipient. This completed form must then be submitted to the BBU office for recording of the recipient transfer. 7. Only the owner of the recipient at the time of birth of the resulting embryo calf will be eligible to certify said calf. 8. Rules and regulations for the BBU Artificial Insemination Program will apply to all sires used in this embryo program. Beefmaster Breeders United Blood Typing & DNA Genotyping Policy 1. 2. 3. 4. All sires used in A.I. and females used in embryo transfer shall comply respectively with the Rules and Regulations for BBU Artificial Insemination and the Embryo Program. All blood typing and DNA genotyping required under these Rules must be by the official respective laboratory specified by BBU and the respective reports filed in BBU headquarters. Otherwise the produced progeny will not be eligible for certification. accuracy of purported or recorded parentage and/or breed purity. The Board of Directors, or the Executive Vice President acting on behalf of the Board of Directors, may require that a blood type and/or DNA genotype be made by such person, breeder or agency as it or he may designate of any purported Beefmaster animal as an aid in verifying parentage or which has been alleged to have been incorrectly represented on an application for registration or incorrectly registered, or for any animal for which blood or tissue analysis may be relevant to the accuracy of any record or registry maintained by BBU. Effective October 27, 2006, during the investigative and post investigative periods of any question about the propriety of the certification of any animal, the status of its certificate and the registration ability of its progeny and the transferability of its progeny, semen, embryos, flushes and pregnancies will be as stipulated in ByLaws provision number XII and, where not inconsistent with Article XII of the By-Laws, in the Terms And Conditions of Sale and the Voluntary Approved Sale Agreement. If the breeder refuses to work with the association staff in an attempt to resolve the blood typing or DNA genotyping dispute, the animal with the dispute will be expunged from the registry. The progeny registered to said animal will be left in the registry (grandfathered) provided they were registered prior to the date the dispute was reported to the BBU office and provided the breeder didn't knowingly misrepresent to the association the correct ancestry of said animal. DNA testing will be used by BBU when a dispute cannot be solved through red cell typing (blood typing). Beginning August 1, 1998, IMMGEN LAB, (Lab conducting blood typing for BBU), began storing a sample of blood on each animal submitted for blood typing. This blood will be used to establish a DNA file for the time when the BBU Board of Directors implements DNA genotyping in conjunction with or in lieu of blood typing. 5. In all cases, the blood typing or DNA genotyping dispute is the responsibility of the breeder and not BBU. 6. BBU may require that any animal for which application for registration is made or which is already registered be subjected to a blood type and/or DNA genotype as an aid in verifying the It shall be the duty of the owner or owners of record of any such animal in question and the owner or owners of record of the purported sire and dam to afford BBU or its representatives reasonable opportunity to secure blood or tissue from the animals involved in the investigation. The Board of Directors is empowered to determine who shall pay all or part of the costs of any investigation including laboratory fees assessed under these provisions. 7. If the owner of record shall refuse reasonable opportunity for BBU or its designated agents to secure blood and/or tissue samples as set forth is these rules, the Board of Directors, or the Executive Vice President at the direction of the Board of Directors, may take such actions and impose such sanctions as it deems appropriate under the By-Laws or these Rules including, without limitation, the suspension of the registration of the animal in question. 8. Should a parent from which blood or tissue is needed for parentage verification of any purported purebred or first cross or second cross Beefmaster be unavailable, the Executive Vice President may confer with BBU’s official lab to determine whether an acceptably reliable blood or DNA genotype could be derived for a needed parentage verification in view of available relatives and existing information on relatives dead or alive and, if so, to advise a breeder of the means of doing so. A blood or DNA genotype derived through this process will satisfy the parentage verification requirements of BBU rules and may be required and initiated by BBU. RESEARCH & PERFORMANCE Beefmaster Breeders United (BBU), through guidance of the Breed Improvement Committee and Long Range Planning Committee, participate in research projects with private industry as well as private and public universities. As a Not-For-Profit organization, BBU does not pay for indirect costs associated with funded research projects. WHOLE HERD REPORTING… AN OVERVIEW (See pg 50 for WHR reporting form) The basic concept of beef cattle performance records is to measure genetic differences between animals for traits of economic importance. BBU has chosen to implement a Whole Herd Reporting system for breeders choosing to maintain performance registry records. Whole Herd Reporting is a system of registration and performance tracking whereby every participating breeder updates his/her cowherd inventory yearly and is charged on a per cow basis. The system is positively endorsed by the Beef Improvement Federation, a North American umbrella organization of beef breed associations, beef producers, researchers and the academic community. With this system, BBU will be able to measure economically relevant beef production traits such as fertility, longevity and reproductive efficiency. Furthermore, the greater volume of data reported from each herd for measured growth and carcass traits, enhances the accuracy of Beefmaster EPDs. Participation in Whole Herd Reporting is voluntary and breeders may choose to maintain pedigree records without recording performance information if they wish. Beefmaster Breeders United recognizes the importance of performance records in today’s beef industry and through Whole Herd Reporting (WHR) can provide a system flexible enough to meet the needs of most record keeping breeders. USING EPDs FOR ACROSS HERD COMPARISONS Animal comparison across herds and contemporary groups should only be done through Expected Progeny Difference (EPD) values. An EPD is the predicted difference of an economically important trait that is expected from the progeny of one animal as compared to the progeny of another animal within the same breed. In other words, EPDs are a prediction of how one animal’s offspring will perform, on the average, as compared to another. Years of research and practical application have proven the importance and reliability of EPDs as a selection tool in the beef cattle industry. EPD calculations are based upon volumes of weights and measures collected in thousands of herds over many years and processed through performance programs. These calculations include differences within management or contemporary groups and incorporate all available data on a trait into the prediction of an animal’s EPD value for that trait. Performance information used to predict an EPD can come from any combination of the following: 1) progeny 2) relatives in the pedigree, particularly the individual’s sire and dam 3) grand progeny and 4) the individual’s own performance record. This information is appropriately weighted for the amount of data available in each category in calculating the EPDs. In addition to the above information, parent EPD values are adjusted for the genetic merit of the animal the parent is bred to, the performance level of other parents with progeny in the same contemporary group, and genetic trends. Some of the more economically important traits and most easily measured with EPDs are birth weight, weaning weight, milk and total maternal and have EPDs expressed in pounds. Calving Ease is expressed as % additional calves born unassisted. Scrotal circumference is expressed in centimeters. Fat is expressed in tenths of inches, ribeye area (REA) in square inches and %IMF (percent intramuscular fat) is expressed in tenths of a percent difference. Calving Ease (CE) is expressed as percentage of variation from the average for animals being born unassisted. EPDs predict progeny performance differences and not absolute values. If for example Bull A has a +50 pound yearling weight EPD and bull B has a +20 pound yearling weight EPD, one would expect a 30 pound difference (50 - 20) in the yearling weight of the two bull’s progeny if both were mated to comparable cows and the resulting calves were of the same sex and were handled alike from birth through yearling. Along with the EPD calculation itself, a companion calculation is made which determines the accuracy of the EPD. Simply stated, the more data, the more accurate the data becomes and more reliability can be placed upon it. An accuracy expressed as “PE” means the EPD is simply a pedigree estimate or the average of the sire and dam EPDs. Numerical accuracy values range between 0 and 100 percent and consider data from the individual, its progeny, its ancestors and the ancestor’s familial ties. EPD values are the best predictor of the performance of an animal’s future progeny in comparison with progeny of other animals in the breed. EPD values have been shown to be from five to nine times more accurate for animal selection than any other available performance data. Due to differences in “base” years and other fundamentals of EPDs, it is not appropriate to compare EPDs across different breeds. EPDs for the Beefmaster breed are calculated twice annually with interim EPDs (denoted with a PE in the accuracy value) being calculated throughout the year. Registration certificates issued by BBU for breeders always contain the most current interim EPDs as of the date of issue WITHIN HERD AND GROUP COMPARISONS CONTEMPORARY Whole Herd Reporting records provide a basis for comparing cattle only within a contemporary group within a herd. Records generated through WHR can include measures for calving intervals, calving ease, birth weights, weaning weights, yearling weights, scrotal circumference, carcass traits and ratios for most of these measures. These within herd and contemporary group records are adjusted for known environmental sources of variation in animal performance such as age of dam, age of calf, etc. The large environmental differences that exist between herds and contemporary groups within a herd make comparisons using ratios and raw data impractical. This is also a less accurate way of comparing genetics. EPDs are the most powerful tool presently available for comparing animals across contemporary groups and across herds. WHAT CONSTITUTES A CONTEMPORARY GROUP? Contemporary groups are those calves raised together and managed in the same manner so that each calf’s data can be fairly compared against all of the other calves within the group. Contemporary groups are the foundation principle behind EPDs and thousands of such groups are considered in EPD calculations. This wide breadth of data is the foundation for accuracy and allows for comparisons across herds in different regions of the country within the breed. Performance comparisons with Whole Herd Reporting records should be restricted to animals within a herd and contemporary group. For the records to be meaningful, breeders must pay strict attention to the proper construction of contemporary groups. A contemporary group should consist only of animals in an individual herd that are the same sex and same management group within a relatively narrow age range of birth dates. Whole Herd Reporting “slices” birth, weaning and yearling contemporary groups into 60-day windows. A breeder can control where a slice begins by using different numerical performance group designations on the worksheets to move odd calving dates into performance groups. For instance, assuming a breeder has an extraordinarily early calf on Jan. 2, followed by a large group of calves that begin on Feb. 2, with a few stragglers that finish by March 31. It would be best to “Slice” the group in half and have two 45-day contemporary groups so not to leave any calves out. Remember we are trying to group a minimum of three to five head of the same sex together to get the most accurate and meaningful information. Please call BBU if you need clarification of the contemporary grouping concept. WHOLE HERD REPORTING: AS SIMPLE AS 1, 2, 3, 4 A general overview of the program structure and flow can be found in the following sections. BBU mails current cow herd inventory to breeder, based on previous year’s inventory. January 1 for “Spring and Fall” calving groups BREEDER STEP #1 Member updates inventory & returns to BBU. BBU bills member in accordance with number and kind of animals maintained on inventory. BBU issues Dam Production Summary Report for each enrolled female. BREEDER STEP #2 Member submits completed Birth Information Worksheets (Form 1). Calves should be registered using this form at this time. BBU returns Birth Report/Weaning Worksheet (Form 2). BREEDER STEP #3 Member submits completed Birth Report/Weaning Worksheet (Form 2) reporting weaning weight information or a disposal code for animal’s not weighed (Weaning weight or disposal code required). BBU returns Weaning Report/Yearling Worksheet (Form 3) when all inventoried females have been reported BREEDER STEP #4 Member submits completed Weaning Report/Yearling Worksheet (Form 3) with yearling weights or disposal codes for animal’s not weighed. If ultrasound carcass data is collected, technician submits carcass data directly to a BBU approved ultrasound lab that will process the data and forward results to BBU for database inclusion. BBU returns Birth-Weaning-Yearling Group Report (Form 4) and/or Calf EPD report (Form 5). If ultrasound data is reported, BBU will calculate and return an Ultrasound Data Report (Form 6). HOW TO PARTICIPATE IN WHOLE HERD REPORTING 1. Member contacts BBU and requests to be enrolled in Whole Herd Reporting. 2. BBU sends the breeder’s latest inventory to them at the designated time of year and requests that the breeder update and return to BBU. 3. Complete the form for all purebred registered cows and breeding age heifers as well as herd sires expected to be represented by a calf during the calving season you have designated. 4. For each animal inventoried, provide herd ID number, registration number, name and date of birth. 5. Include only the animals you expect to calve during your designated season. 6. Mail the completed inventory form to BBU. Retain a copy for your records. Your account will be billed $12 per female per year and $12 for each sire maintained on inventory for that calving season. WHAT IS MY CALVING SEASON? Whole Herd Reporting gives you the flexibility to custom design the “calving season” that best fits your operation. Traditional spring season… January 1 through June 30 Traditional fall season… July 1 through December 31 Non-traditional season… you choose the start and end dates, i.e. spring might be December 15 through March 1 or April 20 through July 10, etc. Fall might be November 5 through February 1, etc. HERD ID NUMBERS ARE IMPORTANT Some important points to remember about herd ID numbers are: Each animal inventoried must be assigned a permanent ID number. The ID number must be unique to each animal inventoried and cannot be used more than once within the same herd. Once assigned to an animal, the ID number must remain with that animal as long as it is in the herd. ID numbers cannot exceed eight characters (shorter is fine). Take care not to duplicate ID numbers within a herd when assigning ID numbers, including not duplicating ID numbers that once were but no longer are active in your inventory. BBU’s computer system identifies cattle within a herd with duplicate ID’s and requires an appropriate edit before any work can be processed. SUGGESTIONS FOR HERD ID NUMBERS It is recommended that the animal’s permanent tattoo be used or incorporated into the numbering system. Possible numbering systems worth considering are: YEAR SYSTEM- using the last two digits of the year (01 in 2001) as the first two digits in the ID number, i.e. 01001. ALPHANUMERIC SYSTEM- This system is used in many countries worldwide. If you choose this system, your letters should coincide with the International System where each year has been assigned a letter. For example, 2006- S; 2007- T; 2008- U; 2009- W; etc. The letters “I”, “O”, “Q” and “V” are not used. The next three years would follow as, 2010- X; 2011- Y; 2012- Z. COSTS The fee for enrolling or maintaining each animal on the herd inventory is an annual charge of $12 for females, and $12 for each herd sire listed (herd sire listing is optional). Owned donor dams will be allowed one registration per year if enrolled in WHR. Subsequent ET calves will be charged a $12 WHR fee per calf if enrolled in WHR. Inventories must be received in the BBU office by April 30 each year. Fees will double on inventories received after the stated deadlines. As is the current policy, all accounts for Whole Herd Reporting must be current on payment before registry or performance work is released. Likewise, monies received from breeders will be applied first to their longest outstanding balances on items charged. MasterCard, Visa and Discover are acceptable means of payment, particularly if a breeder wishes to insure that none of his work is held for payment of funds. BREEDER STEP 1: WHOLE HERD REPORTING HERD INVENTORY RECORD Breeders should keep their Herd Inventory Record complete and current. A dam must be listed on the breeder’s most current Herd Inventory in order to process her offspring’s registration and weaning performance data through Whole Herd Reporting. Prior to their designated calving season, a Whole Herd Reporting Herd Inventory Record form will be printed and returned to each breeder listing all animals currently active in their breeder account for that designated season. All breeding age females on a breeder’s previous inventory not otherwise deleted, all reported additions and all current breeding age heifers previously recorded by the breeder will appear on the updated inventory. BBU will use the corrected inventory report form to update the database on your herd. BBU will issue a Dam Productivity Summary Report and a Birth Information Worksheet (Form 1) which will be mailed to you. Note that on the inventory forms there is a box to check indicating if you prefer blanks or a preprinted Form 1. Requesting the blank forms allows the breeder to fill out the report from his calving book in the order they were born. With a pre-printed form, every cow inventoried for that calving season will be listed and have a line next to it to add the requested data. The pre-printed forms save the breeder a lot of time and also serve as a safety check to remind the breeder which cows he hasn’t yet reported data for. Remember, your updated inventory should list all females in your herd exposed to calve in the upcoming year. Breeders wanting to remove animals from their Herd Inventory should enter the appropriate disposal code and date in the comment column and mail the form to BBU. If a female remains in your herd she should remain on your inventory even if a calf will not be reported for her this year or if she is an ET donor dam not being regularly bred for a natural calf. Do not remove a disposed female from your inventory record before you have registered the last of her progeny that you plan to register, otherwise the reactivation fee will apply. Once a cow is removed from a breeder’s inventory, a substantial reactivation fee, in addition to the normal annual inventory fee is imposed to re-enroll the same cow in the same breeder’s Whole Herd Reporting inventory. Breeders are encouraged not to attempt avoiding individual animal fees for one or more seasons by deactivating a female likely to return to active status at a later date. Doing so will trigger the reactivation fee. It is less expensive in the long run to pay an annual fee and continue to record calving information than it is to reactivate a disposed female. Whole Herd Reporting participants are encouraged but not required to maintain all active sires on their inventory as well. Doing so speeds and eases the breeder’s reporting process by allowing use of shorter sire ID numbers rather than using the full eight digit registry number. Sires should be enrolled and updated annually, are subject to a re-activation fee and charged $12 per sire annually. If you wish to use herd ID numbers rather than registry numbers for sires when reporting your calves, you must maintain an active bull inventory. DAM PRODUCTION SUMMARY REPORT Once a breeder has returned to BBU their annual (or seasonal as the case may be) inventory update BBU will return a Dam Production Summary Report in addition to a statement for inventory fees and the breeder’s Form 1 worksheets. The Dam Production Summary Report will list each female in the breeder’s upcoming calving group, either spring or fall. The summary contains a wealth of information on each inventoried female including herd ID and registry numbers, her age, the number of bull calves and heifer calves she has produced, her average calving ease score and her calving interval. Additionally, her progeny will be summarized with regard to average birth, weaning and yearling ratios as well as the number of contemporaries represented. Finally, all of her latest EPDs and accuracy for all traits will be indicated. BREEDER STEP 2: COMPLETING FORM 1 BIRTH INFORMATION WORKSHEET Instructions for completion of Form 1 can be found on the reverse side of the form. In addition, please note the following specific instructions. Please note that all calves reported on Form 1 should be listed as either a bull or female even though the bull calf may have been castrated by the time you complete the forms. Designation as a steer can be appropriately made later on weaning or yearling forms if necessary. BIRTH WEIGHTS Birth weights, although optional, are among the most economically important data a breeder can collect. Space has been provided for breeders to record calf birth weights and breeders are encouraged to take birth weights as soon after the calf is born as possible. Reporting of birth weights is optional, however, if any are reported, all calves in a calving group must then have their actual birth weight or a calving ease code of 6 (Calf born dead/died shortly after birth) reported. If a producer submits only a portion of a calving season’s birth weights, processing of registry certificates and issuing of weaning worksheets will be delayed until all birth weight records in the calving season have been submitted. If a breeder has reported some of his birth weights but not all of them, no birth weight data from a calving season will be added to the Sire Summary Analysis until the breeder submits the balance of the birth weight records. In situations where a breeder has an extended calving season but wishes to report calving information in smaller sub-groups of the season, they may do so but should be aware that no Form 2 Birth Information & Weaning Worksheets or registry certificates will be generated until all calves in the calving season have been reported unless he/she chooses a second option of reporting no birth weights on Form 1. Doing so will generate registry certificates with birth weight EPD pedigree estimates only but will allow the certificates and Form 2 to be released at the time of application. The breeder will still have the option of reporting either all or none of the birth weights from a calving season on Form 2 when he/she reports weaning weights. example of BIF Udder and Teat Scores and explanation for each score shown. This is a subjective score that should be assigned by the same person for an entire calving season and most preferably assigned by the same person every calving season to follow. Further suggestions to make your birth weight data more meaningful include 1) weigh the calves within 24 hours of birth if at all possible 2) weigh all calves with a scale or an industry accepted birth weight tape (estimates are not acceptable) and 3) be sure all calves whose dams were similarly managed are kept in the same contemporary group. ET CALVES Embryo Transplant (ET) calves are required to have performance data reported and they will incur a $12 per head charge to register if the breeder is currently enrolled in WHR. Each donor dam will receive one registration and first transfer for being on the active inventory. Remember, calves with ultrasound data collected and submitted to BBU must have weaning weights submitted, including ET calves, in order for their ultrasound data to be used in genetic analyses. Within herd comparisons are expressed in ratios. A ratio indicates how an individual calf compares to its contemporary group which are those calves that can be fairly and accurately compared together because they fall within a reasonably close calving period, are of the same sex and whose dams had generally the same management environment. (Note: See contemporary group section at the beginning of this document) CALVING EASE Calving ease scores are not required for participation in BBU’s Whole Herd Reporting program but are encouraged. Calving Ease Scores include: Registration of ET calves requires submission of the appropriate ET requirements at the same time as application for registry. All AI and ET fees will be waived if “YOU” the member is enrolled in the WHR program (See page 5 Costs Section). ET calves will be reported on a blank registration application form where dam and sire information shall be filled in by hand. CALVING RECORD OR STATUS IS REQUIRED The Whole Herd Reporting system requires breeders to report the calving record or status on all cows within a calving season that are listed on a Herd Inventory. Doing so allows for calculation and compilation to the breed database of accurate performance measures. (Form 2 may not be returned if birth and weaning weights were both turned in when recording/registering the calves.) 6- Calf born dead/ died shortly after birth An area is provided to record a dam’s birth management group (i.e. 1= MGMT Group 1, etc., maximum of one character). Producers should assign a different management group number for each group of dams managed differently during the months prior to calving. For instance, dams managed on dry native pasture and cake during that time should be coded (i.e. MGMT Group 1) and dams maintained in dry lot on silage and corn coded (i.e. MGMT Group 2). DAM UDDER AND TEAT SCORE Space is provided on Form 1 for the optional scoring of udder and teats of females that calve. The measurement should be recorded within 24 hours of calving, using whole numbers from 1-9. Please refer to the included BIRTH PERFORMANCE DATA If actual birth weights were reported, Form 2 will show the actual birth weight as well as the adjusted birth weight and weight ratio. If you have chosen the non-reporting option for this trait, these columns will be blank. If you have chosen to delay reporting birth weights until you report weaning weights, use the blank birth weight column to record them at this time. Actual birth weights are adjusted for age of dam at the time the calf was born. Birth weight ratios are calculated on a within sex and contemporary group basis. If actual birth weights are not reported, a breed standard birth weight will be used to calculate adjusted weaning weights. The standard birth weight will not be used in the calculation of birth weight EPDs. Instead, BW EPDs will be calculated based on the current breed correlation of BW to WW. WEANING WEIGHT DATA Reporting of weaning weights or an appropriate disposal code on each offspring of all cows enrolled is required in the Whole Herd Reporting system. Every dam listed on a breeder’s Whole Herd Reporting inventory must have a weaning weight submitted for her calf or an appropriate disposal code for the calf must be recorded in lieu of a weaning weight. Weaning data reporting is accomplished on Form 1 or Form 2, which also has allowable calf disposal codes listed on the back of the form. Failure to report either a weaning weight or an appropriate disposal code will result in a delay of further processing of performance data for the account until the necessary data is submitted. If missing data is not supplied prior to twenty four (24) months after the beginning of a “season” (i.e. December 31, 2008 with regard to the spring 2007 calf crop), the herd will be considered as a pedigree registry account. The breeder can choose to supply the missing data and return to a WHR account. Record the actual weight in pounds and the month, day and year each calf is weighed in the space provided on Form 1 or 2. Report the weaning management type and weaning group. Instructions for completing Form 1 and 2 are detailed on the reverse side of the form. As with birth weights, weaning weight contemporary groups are key for accurate within herd performance comparison. The best management practice is to plan for a breeding season of 90 days or less so your cowherd will consequently be calving within a similar period of time. This makes it possible for these calves to be treated as contemporary groups of bulls and heifers, provided they have all been managed in the same way. Remember, a weaning contemporary group is that group of calves born within 60 days of each other, of the same sex and having the same feed and management conditions. To ensure the maximum effectiveness of contemporary grouping from your cowherd’s calf crop, calves should all be weighed within 7 days of each other and all be within the range of 140 days to 270 days of age. Also note that suggested most desirable dates to collect weaning information based on the calves in the report is printed at the bottom of the form. When you have completed the form return it to BBU for data entry and calculation. BBU will calculate the weaning portion of the data and return to the breeder Form 3, Computed Weaning Report and Yearling Worksheet listing calculated weaning records, the latest available EPD information for each calf and the most desirable dates to collect yearling information. BREEDER STEP 4: COMPLETING FORM 3 WEANING REPORT AND YEARLING WORKSHEET If you do not plan to report any yearling data, simply write “No Yearling Data Available” across the front of the first page of the report and return it to BBU in order to receive Form 5, below. Reporting of yearling data is optional in the Whole Herd Reporting program, however, if a breeder chooses to report any yearling data, then all yearling data, either weight and date or appropriate disposal code must be reported. A list of disposal codes is provided on the reverse side of Form 3. Reporting of scrotal measurements with each reported yearling weight is also optional (but suggested). Record the actual weight in pounds and the month, day and year each animal is weighed in the space provided on Form 3. Remember the age window for yearling weights is 320 – 430 days. If you plan to record scrotal measures they should be taken on the same day as the yearling weight. Scrotal measures are adjusted to a mature dam equivalent. Scrotal circumference is an important indicator trait for improving reproductive potential in beef cattle. It is strongly and positively correlated with total sperm production and is a good indicator of age at puberty in bulls and is favorably associated with age at puberty in related heifers and possibly to subsequent fertility and production traits in related females. As with birth and weaning data, it is vitally important that the breeder correctly specify the appropriate contemporary grouping information by designating the correct management code as well as group number if it is necessary to further separate groups within a code. Available management codes are listed on the back of Form 3. Additional instructions for completing Form 3 can be found on the reverse side of the form. FORM 4, BIRTH, WEANING & YEARLING GROUP REPORT FORM 5, CALF EPDs BBU will calculate the yearling portion of the data and return to the breeder Form 4, Birth, Weaning and Yearling Group report, listing calculated data for all birth, weaning and yearling measures reported. Additionally, Form 5, Calf EPD Report, will be generated listing the most current EPDs of each animal in the calf crop for birth, calving ease maternal and direct, weaning, yearling, milk, total maternal, 12th rib fat cover, ribeye and intramuscular fat. CARCASS DATA COLLECTION PROCEDURES AND REPORTING FORMS: FORM 6 Ultrasound carcass data collection is optional, however if collected, it should be done at the same time as yearling weight data is collected. Ultrasound carcass measures should be reported using ultrasound barn sheets provided by the certified technician or the association upon request. Keep in mind that the ultrasound age window is 320- 460 days. Ultrasound data for a trait will be utilized in the data analysis only if collected by a BBU recognized certified technician who is currently certified in the trait(s) being reported. Current procedure calls for the technician to submit the images to the central lab for interpretation and the lab forwards the computed data to the BBU office for inclusion in the database. (Breeders do not submit the data directly to BBU). Once the data is adjusted by BBU, the breeder will receive Form 6, Ultrasound Carcass Data Report. Remember calves with ultrasound data collected and submitted to BBU must have weaning weights submitted, including ET calves, in order for their ultrasound data to be used in genetic analyses. LIFETIME DAM PRODUCTION SUMMARY Breeders may request a printed Lifetime Dam Production Summary report for all dams on inventory or for specific dams of interest. An additional nominal fee may be charged for this service to defray shipping and handling costs depending on the size of the inventory and frequency of requests. These summaries can also be accessed and printed at BBU’s website once you obtain an account access code which allows only you to view your records. Summary contains a threegeneration pedigree, the dam’s individual record, individual records of all of her reported progeny and a summary of her production averages. WHOLE HERD REPORTING EPD REPORTS Performance registry breeders may also request a Whole Herd Reporting EPD report when a summary of all EPD information for their herd is needed. The report includes the registry number, herd ID, animal name, sex, sire and dam herd ID or registry number, animal’s birth date and latest calculated EPDs and accuracy for all reported traits. Breeders may request a printed report or may access it directly on the Internet if they have established a BBU Internet account. An additional nominal fee may be charged for the printed reports to defray costs depending on the size of the inventory and the frequency of requests. Report options include all females on current inventory, all bulls on current inventory and all calves in selected calf crops. WHR Reminders and Frequently Asked Questions 1. How do we handle multi-owned animals? Multi-owned animals are handled a little differently. The member with possession of the animal must have it included on their inventory. The other owners can use an “M” for a code if they are not going to have any progeny to register for this year. This code does not appear on your inventories at this time but it is ok to use for this specific situation. If you will have progeny for this calendar year leave the female listed as active. 2. Do all females owned go on inventory? Only those females that are reproductively active go on inventory. Young heifers do not need to be on inventory until they reach their first reproductive year. 3. Do Donor Dams go on inventory? Yes, donor dams must be kept on inventory (even if she is deceased or culled) so that you can apply for registration on E.T. calves out of the donor female. 4. Do I change the Calving Season? If so How? Yes, all inventories will have females listed as spring calvers unless previously denoted. Any of your females that will calve in the fall must be designated as fall calvers in the “Change of Season” column. 5. What Bulls go on the Male Inventory? Herd bulls that will sire the majority of your calves are the sires that you would want to list on the male inventory. Remember, no bulls will be listed. You must manually add the bulls that you want on inventory. Notes: Remember to use the appropriate disposal codes! Only use the disposal codes as they apply to the animals you are removing. DO NOT remove females as long as you will be applying for registration on calves out of that female. When selling an animal with registration papers use the “T” (Sold with Papers) for a disposal code so the animal will not be deactivated. A list of disposal codes can be found on page 7 of the WHR manual. The Beefmaster Educational Endowment Foundation is pleased to support education, youth and research and will make available this it’s first year, $5,000 in general scholarships to young men and women who are active in the Beefmaster Family and pursuing a higher education. These one year awards will consist of 1- $2,000 scholarship, 2 - $1,000 scholarships and 4 - $500 scholarships. No equivalent work will be required from the scholarship recipients. MURPHY MEMORIAL SCHOLARSHIP FUND The Brian L. Murphy Memorial Scholarship Fund is the culmination of efforts of those many Beefmaster enthusiasts who knew and were affected by Brian. Consultation fee is $250.00 (No charge with minimum $250 Classification). Inspection of Base, First and Second Cross Females is $3.00 per head or $250.00 per stop, whichever is greater. Any "special" request for classification or consultation will be for the minimum fee plus travel expenses. I will agree by the decision of the BBU Field Representative, I will not hold the BBU Field Representative or BBU liable for any classification they may place on any of my cattle. I further agree to release the Certificates of Breeding on all cattle classified as "X" cattle to the BBU Field Representative and not ever offer any bull or cow classified as "X" to any person as a Certified Beefmaster.
