Subject to the required retention money or special bank guarantee, the winning bidder shall
provide a waff.^nty against defects on materials and workmanship. The warranty period is
three (3) years or 100,000 kms. which ever comes first and shall cover the parts, services and
maintenance of the unit. Availability of Service Center/s in key cities with Luzon Area is
requfued for the unit.
III.
Delivery
The unit shall be delivered to the PhilHealth Head Office and Delivery Receipts/ Invoices
shall be delivered to the PhilHealth Head Office, Supply Section, Rm. 1501, 15m floor,
CityState Centre, Btgy. Oranbo, Pasig City within fifteen (15) days after the issuance of the
Notice to Proceed (i\TP).
The unit should be accompanied by the following documents:

All Goods, Delivery Receipts/Invoices shall be delivered to the PhilHealth Head Office, Supply
Section, Rm. 1503, 15'h floor, CityState Centre, Btgy. Oranbo, Pasig City, provided that the
photocopying machines shall be respectively deployed by the winning bidder at arrypart of the offi.ce
premises of PhilHealth as determined by PhilHealth and at the expense of the winning bidder.
Bidding will be conducted through open competitive bidding procedures using non-discretionary
pass/fal, criteria as specified in the Implementing Rules and Regulations Part A (IRR-A) of Republic
Act 9184, otherwise known as the "Government Procurement Reform Act," and is restricted to
Filipino Citizens/Sole Proprietorships, organizations with at least sixty percent (60'4 interest or
outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a
country the laws of regulations of which grant similar rights or privileges to Ffipino Citizens,
pursuant to Republic Act 5183 and subject to Commonwealth Act 138. O"ly Bids from Bidders who

advance to the post-qualification stage in order to finally determine responsiveness of the bid to the
technical and financial requirements. The contract shall then be awarded to the Lowest Calculated
and Responsive Bidder (LCRB) who would be determined as such after the post-qualification
procedure.

Pasig City, and inspect the Bidding Documents from 8:30 a.m. to 4:00 p.m.
A complete set of Bidding Documents should be obtained by interested Bidders ftom August 26,
2010 to Septembet 14, mlO at the address below. The interested Bidder or his authorized
representative shall receive the Bidding Documents personally.
PhilHealth will hold a Pre-Bid Conference open to all interested parties on September 21 2010 at
10:30 a.m. ^t the SBAC Conference Room (Rm. 1,002),PhilHealth Head Office, 10mfloor CityState
Centre, 709 Shaw Blvd., Brgy. Oranbo, Pasig City.
Bid proposals must be delivered to the SBAC Conference Room on or before September 15, 2010,
10:30 a.m. The official time shall be based on the wall clock located at the SBAC Conference
Room. Late Bids shall not be accepted.
Bid opening shall be on September 15, 2010110:30 a.m. ^t the SBAC Conference Room. Bids

4.1
The biddet shall obtain bid docurnents from the BAC Secretadat on the date
indicated in the Invitation to Bid (ITB) on the Bidding for the Ptocurement of
One (1) Unit Passenget Wagon through Negotiated Procurement (ITB
No. 20L0-009-G).
4.2
To clanfy disctepancies, omissions, vagueness of certain featutes of the bid
documents, the BAC-GS shall conduct at least one Pre-Bid Conference. Minutes
of every Pte-Bid Conference shall be published in a Bid Bulletin that will be
issued by the BAC-GS and shall become an rntegnl part of the bid documents.
Should thete be othet discrepancies found by the prospective bidder after
the pte-bid confetence, the bidder shall noti$ the BAC-GS in writing not
later than ten (10) calendar days befote the deadline set for the submission
and receipt of bids so that a clatifying bid bulletin may be issued to all
bidders. No relief shall be granted on a plea of eror in the bid. BAC-GS shall

Biddets ate solely tesponsible for informing themselves of all the conditions that
could affect their offer and t}rat could a.ffect their performance if awarded this
contract. Submission of all bidding tequirements shall be regarded as ar:,
acceptance of all the conditions of bidding, all conditions of work and all

5.2
The Lowest Calculated Bid shall undetgo post-qualification in order to determine
whether the bidder concerned complies with and is tesponsive to all the
requirements and conditions as specified in the Bidding Documents.

Within three (3) calendar days fiom receipt by the biddet of the nodce from the
BAC that the biddet has the Lowest Calculated Bid, the bidder shall submit the

5.3.3

Collection Enfotcement Division of the Bureau of Internal Revenue
National Office, attesting that the taxpayer has no outstanding Final
Assessment Notice andf or delinquent account, to prove full and timely

5.4
The biddet is prohibited from promising to give money or any gift of any value
to any official or employee of PhilHealth to secure the conffact. Ary violation of
this prohibition shall be sufficient grounds for the
reiection of the bid or
cancellation of the contract, and even disqualification of the bidder in future
biddings of PhilHealth.
5.5
PhilHealth shall awatd the conftact to the bidder with the Lowest Calculated
Responsive Bid, that is, to the bidder with the offer most advantaseous to
PhilHealth, based on the documents submitted as determined by the BAC-GS.
PhilHealth reser\res the right to veri$r the authenticity of the documents
submitted and content theteof. Falsification of documents shall be a sufficient
gtound fot the rejection of bid and exclusion of the bid, andf or disqualification
of the bidder in future biddings of PhilHealth.
5.6
The winning bidder shall pick up the Notice of Award, which is prepared
in trnro (2) copies, within three (3) days from notice by the BAC-GS. The
winning biddet shall indicate acceptance of the award by returning the duly
signed copy of the Notice of Award to the BAC-GS within trvo (2) working
days ftom teceipt theteof. In case the winning bidder refuses to accept the
award, the bid bond shall be fodeited and PhilHealth reserves the right to
negotiate with the second lowest calculated tesponsive bidder. The urinning
bidder will be notified through telephone, facsimile, elecftonic fld,
special
delivery mail with teturn receipt card or other modes of communication.
5.7
The Notice of Awatd and the d"ly signed General Conditions, bid bulletin, and
other issuance on the Bidding fot the Procutement of One (1) Unit
Passenger Wagon thtough Negotiated Procurement (ITB No. 2010-009G). shall form an integtal patt of the contract between the winning bidder and
PhilHealth.

5.8
As guatanteed by the Bid Security, the winning biddet or its duly authodzed
representative shall comply with all the temaining docum entary requirements, if
any, prior to forrnally entedng into a contract with PhilHealth within ten (10)
calendat days from its receipt of the Notice of Award.
5.9
PhilHealth shall then issue the Notice to Ptoceed together with a copy or copies
of the approved conftact to the successful bidder within three (3) calend"t
days ftom the date of the approval of the contact by PhilHealth. PhilHeatth
shall also specift the effectivity date of the Notice to Proceed, and all notices
called for by the terms of the contract shall be effective only from such date.
DELIVERY
The unit shall be delivered to the PhilHealth Head Office and Delivery
Receipts/Invoices shall be delivered to the PhilHealth Head Office, Suppty
Section, Rm. 1501, 15e floor, CityState Centre, Btgy. Oranbo, Pasig City within
fifteen (15) days after the issuanceof the Notice to Proceed (I.{TP).
The unit should be accompanied by the following documenrs:

TERMS OF PAYMENT

PENALTY CLAUSE
8.1
In case of delay in the delivery as above stipulated, the winning bidder shall pay
the amount of one-tenth (1/10) of one petcent (lo/o) of the cost of the
undelivered items for everyday of delay per delivery schedule as liquidated
damages which shall be automati cally deducted ftom ^ny payment due the
winning bidder. Once the cumulative amount of liquidated damages reaches ten
petcent (I0"/r) of the amount of the contract, the procoring entity shall rescind
the contract without prejudice to other courses of action and rernediesopen to it.

In case there are defects in the items delivered by the winning bidder, PhilHealth
has the right to return and demand replacement of the defective iterns at the
expense of the winning biddet. Replacement of the above items should be made
within ten (10) working days upon notice.
OTHER
CONDITIONS
9.1,
The foregoing genetal conditions shall form an integralpatt of the contract. T'he
winning biddet is enjoined to observe strictly the above conditions. Any violation
of the general conditions shall be sufficierit grounds for the cancellation of rhe
contract andf ot its suspension.
9.2
PhilHealth reserves the right to pre-terminate the conftact after gt"irg five (5)
calendat days advance written notice to the winning bidder after due
verification of facts that the winning bidder is not providing satisfactory goods or
not comply-g with the terms and conditions of the contract.
9.3
Failute to comply with the Genetal Conditions on the Bidding for the
Procurement of One (1) Unit Passenger Wagon (ITB No. 2010-009-G) nray
be ^ ground for disqualification and blacklisting of the winning bidder irr
participating in future biddings, including the forfeiture of the bidder's

9.4
All mandatory ptovisions of RA No. 91,84, its rules and other pettinent larvs,
