Answer: All telephone, data, clock/ PA and low voltage requirements shall be
coordinated, provided and installed per the SFM’s ‘T’ drawings and specifications in
the Construction Documents.
Question 3: Lighting fixture identification on drawings E4.10 and E4.20 is controversial and
needs to be clarified. Example, 2’x4’ fixtures identified as ‘A’ are not on lighting fixture
schedule. Instead, there are A1, A2, A3 and A4 fixtures are listed. Per description, we can
only guess, that not shaded symbols should be fixtures ‘A1’ and shaded symbols are ‘A2’
fixtures. Another example is fixture ‘M1’ and ‘M1EM’. Drawing E4.10: In one instance
‘M1’ identified as not shaded symbol (at columns D and 5.2), in second one it’s shaded (at

J2 and K, right above column 1). Please, clarify.

located on job. Armstrong 2776 is a 2x4 second look tegular edge ceiling board that is 3/4"
thick. This product number also installs in 9/16" grid. 095113 2.5 calls out 15/16" grid.
Please clarify which ceiling board and grid type is basis for bid. On sheet A9.02 detail 25
calls out a Donn VSA Post. These are over $40 per unit as opposed to a 1 5/8" 20g stud
(DSA approved) for 1/10th the cost. Will this be accepted?
Answer: There is no 746-12” X 12” on the project. The correct tile is Cortega Second
Look (Lay-in), Size 2’ X 4’X 15/16” with a 2’ X 2’ Score. Color is white with a medium
Texture. The grid system is Armstrong Prelude XL Fire guard 15/16 Exposed-Tee:

Answer: All educational and laboratory casework and wood trim shall be
incorporated into one bid package, see addendum #1 revised proposal. Educational
and laboratory casework are not to be provided by the same manufacturer, as each
require different certification and materials.
Question 3: In the Science Rooms: which countertops are to be Epoxy Resin and which are
to be Trespa? Sec Section 12 35 50 specifies “Trespa tops at wet areas, i.e. shops, science
classrooms, etc.” Drawings show “Chemical Resistant” tops along casework at walls and
“Epoxy Chemical Resistant” at teacher demonstration station. It will be helpful to have this
clarified to ensure all the casework bids have the same scope.
Answer: All casework identified with a “PS” on the drawings shall receive chemical
resistant epoxy resin countertops per Laboratory Casework specification 12 35 53. All
casework identified with a “PC” on the drawings shall receive Trespa countertops per
Educational Casework specification 12 35 50. No P-Lam countertops will be accepted.
Question 4: Will Durcon Epoxy Resin tops and sinks be an acceptable substitute for the
Kewaunee brand spec’d in section 12 35 53 (assuming all the performance spec’s are equal)
Answer: Yes, as long as all specifications are equal.
Question 5: In the Science Rooms: are all the cabinets to comply with Section 12 35 53? If
not, please provide clarification as to which cabinets need to comply with Section 12 35 53
and which can comply with Section 12 35 50
Answer: All casework identified with a “PS” (All Science Classrooms and Prep
Rooms) on the floor plans shall follow Laboratory Casework specification 12 35 53. All
casework identified with a “PC” on the floor plans shall follow Educational Casework
specification 12 35 50. All casework identified with a “PM” on the floor plans shall
follow Music Education Casework specification 12 35 51.
Question 6: Will the submittals due date of Feb 25, 2014 be a hard date for all subs or
flexible based on the construction schedule? That will be a very hard date to meet based on
the requirements for this project.
Answer: We do not need all of the submittals at once, but we need these items in an
orderly manner to prevent scheduling issues and in many cases information is required
to place certain items that you can only coordinate from the information provided in
the submittals. Coordination will be required with Gonsalves and Stronck, and allow
minimum 2 weeks time for architectural review.

who are licensed and experienced with that scope of work. Please confirm that these items
are intended to be installed by other specialty contractors experienced in just mentioned
scope of work and not drywall contractor.

Question 2: Spec Section 092116/3.8 list all levels of drywall finish and 3.9 describes spray

that the product used meets deflection requirements, loads, allowable movement, and

A.
Each bidder shall thoroughly examine and become familiar with the drawings and
specifications. The failure or omission of any bidder to receive or examine any
bidding document, form, instrument, addendum, or other document or to visit the
sites and acquaint himself/herself with conditions there existing shall not relieve
that bidder from obligations with respect to his/her bid or to the contract.
B.
Contractor is informed that this is a DSA project. All project correspondence must
be kept and submitted (i.e., submittals, billings, RFIs, change orders, etc.) per DSA
project application number. This applies to the Construction Manager at Risk and
all subcontractors and suppliers involved in the project. In addition, one complete,
up-to-date set of documents must be kept on the school site at all times for the use
of the IOR and DSA. In addition, per CBC, a current copy of the CCR Title 24 Part
1 and Part 2 requirements must be kept on site at all times for the use of the IOR
and DSA.
C.
The contractor will be totally responsible for maintaining security on the site during
the construction period. It will be the contractor’s responsibility to coordinate with
the District for access.

Pursuant to District Policy, the contractor is hereby notified that smoking, alcoholic
beverages or drugs are not allowed on school grounds. No exceptions will be made.
This includes the inside of any contractor trailers or containers, as long as they are
sitting on school property. The general contractor will be responsible for enforcing
this District Policy. Each violation of this policy will result in a $500.00 deduction
from the final contract amount.
E.
The contractor is responsible for all utility location prior to any excavation or
demolition, including in slab electrical conduits and plumbing lines, etc. The as
built documents provided by the district are to be used for reference only.
F.
The contractor is responsible for the maintaining of all existing mechanical,
plumbing, electrical, sprinkler and phone systems utilized by the existing school
site. The contractor shall repair any systems that are damaged as a result of work
performed by the contactor to as good as or better than the original condition of the
work damaged. Additionally, any system modified as a result of work done under
the contract shall be brought up to the specifications of the current code.

It is the contractor’s responsibility to verity that all grades are correct prior to
placement of concrete walks, ramps or walls to insure they allow water to flow
away from all structures. Notify Architect immediately in the case of a discrepancy.
Any concrete or hard scape material placed by the Contractor directing water
toward the building structures will be removed and properly re-installed at the
contractor’s expense without an extension of time issued to the contractor.
PRE-BID CONFERENCE
A.
A mandatory pre-bid job walk will be held in the location as described in Section
1.07.
B.
Bidders should have become thoroughly familiar with the terms and conditions of
the bidding documents and local conditions (permits, etc.) affecting the
performance and costs of the work prior to attending this conference.

SUBSTITUTIONS DURING BIDDING

Substitution Procedures:

Submit requests are due prior to bid by January 10, 2014. Substitutions

Architect will be published in the addendum prior to bid.

Request shall contain sufficient information to assess acceptability of product
or system; insufficient information shall be grounds for rejection.
3.
Accepted substitutions shall be listed in addenda.
4.
Substitutions may be requested for any product specified unless otherwise
noted. Note that no substitutions will be allowed for District Standard
materials, which include but are not limited to: door closures, locksets and

PROPOSAL
A.
Bids shall be submitted upon the proposal forms provided in the Project Manual,
properly executed, with all blank spaces properly filled in. The proposal form shall
be submitted without interlineations, alterations, or erasures to the bid items listed.
Any unauthorized additions, limitations, conditions, or provisions attached to the
proposal form will not be considered. Bids shall not contain any recapitulation of
the work to be done. No telegraphic or telephonic proposals or modifications of bid
items will be considered.
B.
No bids received after the scheduled closing time for receipt of bids will be
considered, and if so received, they will be returned to the bidders unopened. It is
the sole responsibility of the bidder to see that a bid is received in proper time.

No person, firm, or corporation shall be allowed to file more than one proposal for
each individual package of this project. All signatures shall be in long hand by the
principal duly authorized to make contracts. The bidder's legal name shall be fully
stated.
Each bid shall be addressed to the Board of Trustees of the Jefferson Union High
School District, Reference: Jefferson High School New Classrooms & Music
Buildings and shall be delivered to the District Office, 699 Serramonte Blvd., Suite
100, Daly City, California 94015 on or before, Thursday, January 23, 2014 at
2:00 P.M. The bid must be enclosed in a sealed envelope bearing the title of the
work, the name of the bidder, the date and hour of the opening, and specific bid
package identification.

QUALIFICATIONS OF BIDDERS
A.
All Subcontractors whose contract is $10,000.00 or more are required to be
pre-qualified with the District.
B.
Pursuant to Section 1706 of the Public Contracts Code, each bid shall be
accompanied by a Noncollusion Declaration on the form provided in the Project
Manual, duly executed by the bidder.
C.
Each bid shall also be accompanied by a Bidders Qualification statement on the
form provided in the Project Manual, duly executed by the bidder.
D.
The bidder's responses to the Bidder's qualification Statement shall be executed by
the bidder and verified under oath by the bidder in the same manner in which civil
pleading in civil actions are verified. The responses and accompanying financial
statements shall not be public records and shall not be open to public inspection
pursuant to Public contract Code section 20111.5
E.
In order to be deemed a responsible bidder, a bidder must have the quality, fitness
and capacity to satisfactorily perform the proposed work. The District reserves the
right to consider any factors pertinent to the proposed work in its evaluation of the
bidders. A bidder must have substantial construction experience in public works
construction and sufficient completion ability, financial resources, bonding
capacity, and insurability in order to be deemed responsible. The minimum
qualifications for a responsible bidder include the following:

1.
The bidder and the bidder's field supervisor for the project have successfully
completed, within the last five years, at least three public works construction
contracts of comparable scope, type, value and complexity.
2.
The bidder must be able to obtain performance and payment bonds for the
full amount of the contract from a surety company authorized to do business
in California with a Best's rating of A-VIII or higher.
3.
The bidder must be able to obtain CGL liability insurance coverage in the
amount or $2,000,000 from an insurance carrier authorized to do business in
California with a Best's rating of A-VIII or higher.
4.
The bidder must be able to obtain property insurance coverage in the amount
of the contract from an insurance carrier authorized to do business in
California with a Best's rating of A-VII or higher.
5.
The bidder must have a net worth sufficient to be able to complete the project
package as evidenced by financial statements for the last fiscal year that have
been audited and for the last month that have been reviewed by a Certified
Public Accountant.
6.
The bidder or any officer of bidder or any employee of bidder who has a
proprietary interest in bidder or the superintendent for the project must not
have been disqualified, removed or otherwise prevented from bidding on or
completing a federal, state, or local project because of a violation of a law or
safety regulation.
7.
The bidder must not have incurred within the past five years more than one
sustained claim of $50,000 or greater from an owner or a surety based on
poor workmanship, incomplete performance or unexcused delays in
completion.
8.
The bidder must not have failed, on more than one occasion in the last five
years, to receive a recovery of at least 50% of the amount in dispute, not
including attorneys' fees and costs, for claims filed against owners for extra
compensation.
9.
The bidder must not have a history or a pattern of violating federal, state, or
local laws that govern worker pay, safety, conditions or training.

If the bidder intends to perform work with its own forces, the bidder must
show proof of successfully completing three similar projects with its own
forces for that specific type of work. If the bidder can not show proof of
being capable to perform such work with its own forces, then said work must
be subcontracted to a licensed specialty contractor who is, and can show
being, capable of performing such specific work on at least 5-similar projects
within the last 5-years.
The District retains the right to accept insurance or bonds from a carrier or surety
that has a comparable rating from some rating source other than Best's that the
District deems comparable.
BID SECURITY (Required for bids of at least $100,000.00.)
A.
Each bid shall be accompanied by a Bid Bond on the form designated in the Project
Manual, duly executed by the bidder as principal and a corporation authorized to do
business in the State of California as surety, naming the Jefferson Union High
School District as obligee; or a cashier's check or certified check certified without
qualification drawn on a solvent bank of the State of California, in the amount of
10% of the base bid and made payable to the Jefferson Union High School District.
B.
The bidder's bond shall guarantee payment of actual damages in case the successful
bidder fails to file satisfactory bonds as required by the Bidding Documents or fails
or refuses to enter into a contract within five days after Notice of Award by the
District. If the bid is not accepted by the District within ninety days after the date
set for the opening of bids or if the bidder to whom the contract is awarded,
executes and delivers to the District the required Contract Documents, the bid bond
or the amount of the certified or cashier's check will be returned to the bidder.
C.
The bid bond or the amount of the certified or cashier's check of each unsuccessful
bidder will be returned to the bidder immediately following the award of the
contract. If no contract is awarded, the bid bond or the amount of the certified or
cashier's check or bid bond of all bidders will be returned to the bidders
immediately following the rejection of all bids.
BONDS REQUIRED BY THE CONTRACT DOCUMENTS ( Not Used)
A.
The successful bidder, simultaneously with the execution of the Agreement, shall
furnish a Payment Bond and a Performance Bond, each in an amount equal to
100% of the Contract Price, each secured from a surety company authorized to do

B.
The Payment Bond will be released six months after completion of project. The
Performance Bond will be reduced by 90% at completion. The remaining 10% will
be released at the end of one year from acceptance of the project provided any
deficiencies in the work have been corrected.
C.
Subcontractors shall be required to submit faithful performance and payment
bonds, and this requirement shall be specified in the prime contractor’s written or
published request for sub bids in accordance with Public Contract Code Section
4108.
LISTING OF SUBCONTRACTORS
A.
Each bidder shall submit a list of the proposed subcontractors who will perform
work or labor or render service to the bidder for a value in excess of one-half of one
percent (1/2% or any amount over $12,050.00) of the bid as required by the
Subletting and Subcontracting Fair Practices Act (Government Code Section 4100,
et. seq.)
B.
Subcontractors to the subcontractors performing work in excess of $10,000.00
must show proof of performing similar work to this project, in size and scope on
five past projects, within the last five years. Within 24 hours of the bid, the three
apparent lowest bidders shall submit a list of the proposed subcontractors that are to
be used on the project whose value of work is at least $10,000.00. Within 72 hours
of the bid, the three apparent lowest bidders shall submit to the District the
qualification statements of those subcontractors. Failure to do any of the above may
render the bid non-responsive.
C.
The form for this purpose is included in the proposal form.
D.
If bidder elects to perform work with its own forces in lieu of listing a
subcontractor for such work, the bidder’s attention is called to item 1.12 E.10
above, which requires bidder to show proof of the capability to perform such
specific work with its own forces.
WITHDRAWAL OF BIDS
A.
Any bidder may withdraw his/her bid either personally, by written request, or by
telegraphic request confirmed in the manner specified above at any time prior to the
scheduled closing time for receipt of bids.
B.
Bids may not be withdrawn for ninety (90) calendar days after submittal or for such
extension as may be subsequently agreed in writing.

DISQUALIFICATION OF BIDDERS
A.
No bid will be accepted from a bidder in arrears to the Jefferson Union High
School District, or who is a defaulter to a surety.
B.
No bid will be accepted from a bidder who is not licensed in accordance with the
provisions of chapter 9, Division 3 of the Business and Professions code.
GOVERNING LAWS AND REGULATIONS
A.
Worker's compensation: Pursuant to the requirements of Section 1860 of the Labor
Code, the successful bidder will be required to secure the payment of compensation
to its employees in accordance with the provisions of Section 3700 or the Labor
Code. Prior to the commencement of work, the contractor shall sign and file with
the District a certification in the form provided by the District.
B.
Apprentices: The successful bidder will be required to conform to the provisions in
sections 1777.5, 1777.6, and 1777.7 of the Labor Code concerning the employment
of apprentices by his/her or any subcontractor under him or her.
C.
Anti-Discrimination: The successful bidder will be required to comply with all
provisions of executive Order No. 10925 of March 6, 1961, as amended, and all
rules, regulations, and relevant orders of the Presidents Committee on Equal
Employment opportunity. No discrimination shall be made in the employment of
persons because of the race, color, religious creed, national origin, ancestry,
physical handicap, medical condition, marital status, or sex of such persons.
D.
Prevailing Wage: The successful bidder will be required to pay not less than the
prevailing rate of per diem wages as determined by the Director of the California
Department of Industrial Relations in accordance with section 1770 of the Labor
Code.
E.
Hours of Labor: The successful bidder will be required to comply with
requirements of sections 1810 to 1815, inclusive, of the Labor code.
F.
California Education Code 17076.11 states: Any school district using funds
allocated pursuant to this chapter for the construction or modernization of a school
building, shall have a participation goal of at least 3 percent, per year, of the overall
dollar amount expended each year by the school district, for disabled veteran
business enterprises (DVBE). Refer to Document 00310 for requirements.

Should the Subcontractor fail to complete his contract within the contract times,
due allowance being made for unavoidable delays, the Contractor will pay the
Jefferson Union High School District the sum of $1,000.00 per calendar day (as
published in the Supplementary Conditions) for each day the work remains
uncompleted beyond the contract time as liquidated damages, and not as a penalty,
it being expressly stipulated that it would be impracticable and extremely difficult
to fix the actual amount or damage.
EVALUATION AND CONSIDERATION OF BIDS
A.
The contract, if awarded, will be awarded to the responsible bidder submitting the
lowest qualified bid price based on base bid which is in compliance with these
Instructions and the Notice to Bidders. In order to be deemed a responsible bidder,
a bidder must have the quality, fitness and capacity to satisfactorily perform the
proposed work. The District reserves the right to consider any factors pertinent to
the proposed work in its evaluation of the bidders. A bidder must have substantial
public works construction experience and sufficient completion ability, financial
resources, bonding capacity, and insurability in order to be deemed responsible.
B.
The competence and the responsibility of bidders and of their proposed
subcontractors will be considered in making the award of contract. Any bidder,
before being awarded a contract, may be required to furnish evidence satisfactory
to the District that he/she and his/her proposed subcontractors have sufficient
means and experience in the type of work called for to assure completion of the
contract in a satisfactory manner. The District reserves the right to reject the bid of
any bidder who has previously failed to perform properly or to complete on time
contracts of a nature similar to this project.
C.
The District reserves the right to reject any or all bids and to waive any informality
or irregularity in the bids or in the bidding. The District reserves the right to reject a
bid or revoke a determination of the lowest responsible bidder if the District
determines that any information provided by the bidder or its subcontractors was
incomplete, misleading, or inaccurate in any material way.
FORM OF AGREEMENT
A.
The Agreement for the work will be written on AIA Document A201, 1997,
standard Form of Agreement between Owner and contractor where the Basis of
Payment is a stipulated sum. A copy of the form of agreement is provided in the

Gonsalves & Stronck within 10 calendar days from the date of such District
notification. The Subcontractor agrees to commence Work under this Contract on

the Project within the specified number of calendar days after the signing of the
Contract.
The Subcontractor further agrees that construction insurance certificates delivery
to the District and the securing of building permits are prerequisites to site move-in.
The Subcontractor agrees to District assessment of liquidated damages stipulated
for incomplete Contractor work in Document 00800.

exceeds 85 percent, or when temperatures are less than 5 deg F above dew point.

Do not apply traffic coatings in snow, rain, fog, or mist, or when such weather
conditions are imminent during the application and curing period. Apply only when
frost-free conditions occur throughout the depth of the substrate.
WARRANTY
A.
General Warranty: Special warranty specified in this Article shall not deprive Owner of other
rights Owner may have under other provisions of the Contract Documents and shall be in
addition to, and run concurrent with, other warranties made by Contractor under
requirements of the Contract Documents.
B.
Special Warranty: Written warranty, signed by traffic coating manufacturer agreeing to
repair or replace traffic coatings that do not comply with requirements or that deteriorate
during the specified warranty period. Warranty does not include deterioration or failure of
traffic coating due to unusual weather phenomena, failure of prepared and treated substrate,
formation of new substrate cracks exceeding 1/16 inch in width, fire, vandalism, or abuse by
snowplow, maintenance equipment, and truck traffic.

TERMINATIONS AND PENETRATIONS

Prepare vertical and horizontal surfaces at terminations and penetrations through traffic

Provide sealant cants at penetrations and at reinforced and non-reinforced deck-to-wall butt
joints.

Terminate edges of deck-to-deck expansion joints with preparatory base-coat strip.

wall substrates according to manufacturer's written recommendations.
