The ENVIRONMENT DESTRUCTIONS, atrocities by unlawful mining activities a
manifestation of ABUSES by PUBLIC OFFICER who ENTRUSTED with POWER by the
PEOPLE; Also a very clear evidence of GRAVE MISCONDUCT; INEXCUSABLE GROSS
NEGLIGENCE; OPPRESSION and DISHONESTY constituting a BETRAYAL of PUBLIC
TRUST, committed by CAMARINES NORTE GOV. EDGARDO A. TALLADO and DENR-MGB 5
OIC RD THEODORE ROMMEL E. PESTAÑO, et al.
Lawak na 10 ektarya at lalim na tatlong daang (300 feet) talampakan na dating
bulubundukin at lupang sakahan, taglay ang mga punong matatayog ng ibat-ibang punong
kahoy at niyog, subalit ngayon ay isa ng malaking “LAWA NG NAKAMAMATAY NA
KEMIKAL.”
MS. SHIENA BARRAMEDA, Philippine Daily Inquirer Correspondent, witnessed the
devastating effects of environment destructions to the formerly hilly forest land that Gallardo
family had been planting and harvesting coconut trees for copra since 1970’s. But all of their
dreams were sucked dry by the appearance of a deepening hole that Chinese mining company
Bohai Top International Mining Corp. started digging on the property on July 26, 2011.
NBI probes gov for illegal mining

“Gallardo claimed that Tallado was using the Chinese firm as a front for his
illegal mining activities”. The National Bureau of Investigation has since come
in, investigating the allegations against Tallado. “We lost everything, our
livelihood and my children’s houses. All that is left is this house my husband and
I built, and a few square meters of land,” said Gallardo”.
Mrs. Zenaida Gallardo, the complaining tenant farmer, while she has demonstrates to us the
successive erosion across the vertical open pit area which excavation resulted to this MAN MADE LAKE
with an area of Ten (10) hectares and 300 feet in deepness, containing toxic chemicals from the
destructive unlawful mining operation of Gov. Tallado with his dummy mining operator in connivance
with the Foreign Chinese Traders.
Gallardo said she came to know of Tallado’s involvement from Antonio “Tony” de Jesus, heir of
her former landowner, Felixberto de Jesus. “It was Tony who told me in a text message that he had given
Governor Tallado the authority to mine on his land. He said he signed an agreement with him,” said
Gallardo. She still keeps De Jesus’s text messages as evidence. Gallardo said De Jesus and even employees
of the mining facility, particularly a certain Polding Borja and Leo delos Angeles, who led the digging of
the open pit, often referred to Tallado in conversations as the owner of the facility. “I strongly believe that
they (employees) are just using the Chinese to protect Tallado. He is in fact the owner of that mine,”
Gallardo claimed.
No Rehab plan. It was Gallardo who took up the fight and took their complaints to the local authorities
who directed her to go to the regional office of the Department of Environment and Natural Resources in
Legazpi City. She appealed to the office in 2011 not to issue an ECC to the mining company because it was
destroying an agricultural land.
Henry Lopez, regional chief of the Environment Impact Assessment and Management Division of the
Environmental Management Bureau (EMB), said the EMB and the MGB did not release an ECC to the
mining company because the firm failed to present a rehabilitation plan when it applied for a mining
permit. Tallado, however, had released and signed temporary mining permits to the mining
company, which were presented to Gallardo and the residents there.

This below pictures of tailings pond of the dismantled Mineral Processing Plant at Napaod is
containing of contaminated hazardous waste; in case of heavy rains it will overflow across the
Minalulon River, then it will traverse down to Labo River and down to Vinzons River and will
exit to Pacific Ocean fronting the natural long white sand of Calaguas Island.
This waste pond is the atrocities of unlawful mining activities, this area of Brgy. Napaod, Labo,
Camarines Norte is formerly hilly forest land with various fruit bearing trees, it is now totally
destroyed.
And now after four (4) months the TREE together with the GENERATOR HOUSE were
totally DROP OFF in the pit. This date February 6, 2014 around 3pm together with NBIEnCD Special Investigator Marvin Matamis and other operartives has witnessed the
environment destructions at Napaod Mining Pit.
