FRANCHISING:
The Advantages & Disadvantages
Franchising is the practice of using another firm’s
successful business model. For the franchisor, the
franchise is an alternative to building a ‘chain store’
to distribute goods that avoids the investments
and liability of a chain. The franchisor’s success
depends on the success of the franchisees. The
franchisee is said to have a greater incentive than a
direct employee because he or she has a direct
stake in the business.

WHAT IS FRANCHISING?
Franchise Act 1998 – Act 590
Section 4 – “Franchise” means a contract or an agreement,
either express or implied, whether oral or written, between
two or more persons by which:







Right to operate with the business system
Use of trade mark, trade secret, intellectual property, etc
Right to administer continuous control
Responsibility to provide assistance
Required to pay a fee
Operate the business separately

franchising since the 1930s: fast food
restaurants, food inns, motels, Subway,
McDonald’s, 7-Eleven, Hampton Inns, H
& R Block (tax preparation), Dunkin
Donuts, and Mini Market

distributors, etc.

attorneys, suppliers, and vendors of franchises.
