I hope everyone had a safe and fun 4th
of July — “Independence Day”! We are
so blessed to be able to enjoy the freedoms we have! Freedom isn’t free! I
hope everyone took a moment to remember those who gave all for our freedom
in light of what has happened both in
Dallas and in Baton Rouge. I would also
like to take a moment to remember our
police officers as they put their lives on the line every day.
My how time flies. It seems like only yesterday we were hoping for Spring and warmer weather. Now here we are in the
heat of the summer. As you drive across South Dakota it is
amazing how the crops are already starting to turn on the
western end of the state. It won’t be long now!
By the time this letter is published we will have had our
second annual NextGen Dealer Summit at the Cedar Shore
Resort in Chamberlain, SD. I look forward to my first meeting
with this group and being a part of their business sessions.
On the truck side of the business we are dealing with glider
kits (trucks sold as a part) and regulations on if excise tax
needs to be paid and who is responsible. With the changes
in emissions it seemed to make more sense to buy a Glider
and repower with older technology to eliminate the need for
DPF. Well no matter how things are done someone is always
ready to collect what they believe is their share in taxes. This
one could get interesting. If you would like more info on this
please give me a call.
I’ve been following the Tesla “auto pilot” saga. Is technology
being pushed out ahead of safety? Are corners being cut to
save money or just to get technology out there? It is amazing when you think about the changes in technology. I have
an older car with 4 wheel drum brakes. It is almost scary to
drive, but in its day that was technology. Today we expect
these things to stop on their own.
Well until next month get out and enjoy what is left of summer. It will be gone before we know it and the kids will be
back in school.

In my recent travels across the state, I have
seen farmers in the fields beginning the
summer harvest of grain. Although we have
had some rather strange weather in the last
month or so, it appears the harvest will be
bountiful and that is a good thing. As lifetime South Dakota residents realize, when
our farmers do well, we all seem to do well.

I am writing this column while on my return
flight from the summer meeting of the Automotive Trade Association
Executives (ATAE). While the group is rather large with every state executive and includes several large metro association executives, it seems
the problems and issues are not any different. No matter where you live
or what franchises you have, the issues seem to parallel.
An old staple on the agenda was the Consumer Finance Protection Bureau (CFPB). It seems, despite Congressional action, this federal agency
will continue to be a a sharp burr under the saddle of dealers for years
to come. Their focus on this industry now includes ancillary products
included in the sale. NADA continues to point to their flawed theories but
progress is slow.
Another major agenda item was the new Cadillac "Project Pinnacle"
program from General Motors (GM). Wow, just when you think you have
heard it all, they come up with something that again balances on the
edge of violating sales and service agreements along with state franchise laws. Mr. Johan de Nysschen (formerly with Audi), hired to administer this new program, gave a lengthy presentation that was not well
received by dealer advocate ATAEs.
We also spent some time talking about the new minimum salary threshold for salaried employees. We were informed there will be an NADA webinar in late September that will provide further guidance for dealerships.
I have already met with a couple of dealerships regarding this issue and
had phone conversations with a couple more. If anyone wants to have my
"two cents" opinion, you know how to find me.

Report. Of particular note are the dates of the NADA Washington Conference scheduled for September. Usual attendees are the Chairman, the
NADA Director, the PAC Director, a NextGen Dealer and we have room for
a first-time dealer. Registration is open now! If there is a first timer that
wants to go, please let me know as soon as possible.

NADA Director’s Message
In late June, I attended the seventh annual year executive forum sponsored by NADA and the American Financial Services Association (AFSA) where we discussed legislative, regulatory and operational
challenges facing auto dealers and finance sources.
Executives from virtually every major finance company and major bank in the nation engaged in indirect auto financing attended the forum along with a dozen or so dealers from the NADA board. There
were representatives from the American International Automobile Dealers Association, National Association of Minority Automobile Dealers, and Automotive Trade Association Executives in attendance
as well.
While there were several presentations and discussions during the event, it was Consumer Financial
Protection Bureau (CFPB) Director Richard Cordray's comments to the group that struck me. As he reviewed the bureau’s activities in the area of vehicle financing, he insisted on calling our retail discounting of interest
rates a "dealer markup" and suggested several times that some type of "flat rate" compensation to dealers was a preferred
model. While it was not a surprise to hear this, it was frustrating to see and hear how narrow-minded he still was on this issue.
A survey of those in attendance revealed that top concerns for finance sources include exams and enforcement actions, cybersecurity, compliance, changes in vehicle values and hiring, training and retaining employees.
Dealers are most concerned with new regulations from the FTC and CFPB, existing regulations and compliance, and hiring,
training and retaining employees. New opportunities focused on technology improvements and mobile financing options for
lenders, and leasing and e-contracting for dealers.
House Again Rebukes CFPB Over Its Flawed Auto Finance Guidance: By a bipartisan vote of 260-162, the House of Representatives passed an amendment offered by Rep. Frank Guinta (R-N.H.) that would nullify the Consumer Financial Protection
Bureau's (CFPB) flawed auto finance guidance by preventing the CFPB from spending any funds to enforce the guidance. The
amendment was added to the fiscal year 2017 Financial Services appropriations bill (H.R. 5485) on the House floor. This House
action is another rebuke of the CFPB's auto finance guidance, which threatens a consumer's ability to receive a discounted auto
loan from a dealer. This is the first time Congress has used the appropriations process to rein in the CFPB. Nineteen Democrats
and 241 Republicans voted for the amendment.
Last November, the House passed Rep. Guinta's bill, H.R. 1737, by a bipartisan vote of 332-96. This bill would nullify the CFPB's
2013 auto finance guidance and establish a transparent process with public participation to determine future auto finance
guidance. In contrast, the CFPB issued the flawed 2013 guidance without any public comment or transparency, and the agency
admitted it has failed to study the impact of its guidance on consumers.
Economic Analysis Reaffirms That State Franchise Laws Lower Prices, Benefit Consumers Retail prices for new cars are lower for consumers because of state franchise laws, according to a new economic analysis from
the Phoenix Center for Advanced Legal and Economic Public Policy Studies.
The analysis, “State Automobile Franchise Laws: Public or Private Interests?” found that state franchise laws serve to foster
intense competition among franchised new-car dealers, which “demonstrably lowers prices for consumers” and “alter[s] the
way consumers buy cars and service in a positive way.”
“Franchise laws do not limit competition or lead to higher prices,” said study co-author and Phoenix Center Senior Fellow Professor T. Randolph Beard. “In fact, all the evidence suggests that there is intense competition leading to very low margins on new
car sales.”
The Phoenix Center study came in response to recent scrutiny of state franchise laws by the Federal Trade Commission (FTC) and
others, and the suggestion that these laws are outdated. The study concluded, however, that state franchise laws are indeed
still very beneficial to consumers.
“When selling an automobile-service bundle, our analysis indicates that franchised auto dealers have a better incentive with
respect to consumer desires than car manufacturers,” said study co-author and Phoenix Center Chief Economist Dr. George S.
Ford. “As such, it is not unreasonable for state legislatures to choose a market design that best serves their constituents in the
form of local auto franchise laws.”

A dealership's general manager asked a staff member to go get bagels and donuts for an employee meeting, and gave the employee his demo to use. On her way to the store, the employee ran a red light while
texting. She broadsided another vehicle in the intersection, severely injuring the driver. Police discovered she had a suspended license.

What policies are in place to help prevent this from happening at your dealership? Do you know who's

Sertoma Park Baseball Diamond Named For Longtime Yankton
Baseball Supporter During Monday Dedication Ceremony

It all caught Jim Robinson by surprise.
As the last logo to put on the newly turfed Sertoma fields was displayed to the crowd, Robinson
had a big smile on his face.
The logo read ‘Jim Robinson Field.’
“It was a total shock,” said Robinson. “I had absolutely no idea any of this was coming.”
The community gathered on Monday night for the honorary opening ceremony of the two turfed youth baseball fields on the
north end of Sertoma Park.
To have a turfed youth baseball field is quite an accomplishment for the community, as they are a rarity. The two fields in
Yankton are the first of their kind in the state of South Dakota with only a few existing in the entire region.
“We have been fundraising for the longest time,” said Robinson. “From pancake feeds to drawings, you name it and we did
it. Our whole goal was to make the park better in any way possible.”
A group of individuals and businesses donated time, money, and supplies to help make the newly turfed fields possible.
Youth baseball leagues in Yankton began in 1972, but the ground for Sertoma Park was not purchased by Jim Robinson
until 1978. “It has improved greatly since then,” said Robinson
“Since we got the ground, I always dreamed about doing more and more,” said Robinson. “This was just the next step to
improving the park.”
After the conclusion of the ceremony, four games were held on the two fields, giving the kids a chance to test out their new
playing grounds.
“This truly is a beautiful gift to the city,” said Yankton mayor Charlie Gross. “Yankton has so many groups that help support
young people. This community really cares for the youth.”
Yankton is no stranger to turf. The Sertoma project followed in the footsteps of Riverside Park, who had its field turfed in
the fall of 2014.
“Projects like this are only possible with the entire community buying in,” said Charlie Gross. “With this kind of generosity,
complexes across the city are able to make great improvements providing our young people with great places to play.”
From 8-year-olds playing in youth Sertoma baseball leagues, to 30-somethings playing in the amateur league, all baseball
players in Yankton will now have the opportunity to play on a state of the art, turf surface.
