RECOMMENDATIONSIFINDINGS
Should you elect to approve, disapprove, or add additional conditions, based upon the staff analysis, comments
received, and the site inspection, staff offers the following motion(s) for your consideration:
Motion to Approve:
I move to approve the six DSJ2 Ltd Parcel Maps subject to the conditions as outlined in the "Conditions of
Approval" section of this report, after having made the findings outlined in the staff report.
Motion to Disapprove:
I move to disapprove the six DSJ2 Ltd Parcel Maps.
Findings:
1.
Consistency. The Parcel Map application is consistent with the goals, objectives and policies of the Nye
County Comprehensive Plan. There currently are no restrictions prohibiting this proposal.
2.
Improvements. Adequate utilities, roadway improvements, sanitation, water supply, drainage,
and other necessary facilities are available, or will be provided by the developer.
3.
Site Suitability. The site is physically suitable for the type and intensity of the development.
ROAD/STREET DEDICATION RECOMMENDATIONS
No additional streets are being created hereon nor being offered to Nye County its successors and assigns for
public use.
Evening Avenue, Tamarack Road, Harvest Street, Vassar Road and Conejo Road were previously
dedicated/rejected on file map #694875; Valley View Boulevard was previously dedicated/accepted on file map
#694875.
SITE PLAN/ PROJECT ANALYSIS
The initial DSJ2 Ltd Parcel Map applications were received November 2, 2007 and considered a complete
application on November 4,2007.
This application was field reviewed by Planning and Engineering staff on November 5,2007 wherein no concerns
were noted.
Planning staff recommends that all six parcel maps shall be recorded en masse in order to ensure adequate legal
and physical access to all parcels.

FEMA Flood Insurance Rate Map; Community Panel #320018 4125c dated September 28, 1990. I have attached
staff recommendations from Richard Johnson, Floodplain Manager/Administrator for compliance with Nye
County Code 15.12 Flood Damage Prevention, per 44 Code of Federal Regulations (CFR) 60.3(b)(3)
communities must require that all new division of land proposals and other developments greater than 50 lots or 5
acres, which ever is the lesser, include Base Flood Elevations (BFE) data. Mr. Johnson recommends disapproval
of the division of land map and offers requirements should the Board approve the division of land map (attached).
These parcels were previously divided by a large parcels map (file map #694875), approved on December 5,
2006, recorded on September 27,2007 and does not constitute a subsequent or second parcel map (NRS
278.464.5).
LAND USE SUMMARY
Land Use Designation(s): There is no land use designation in this area of Nye County.
Conformance with the Comprehensive Plan: These applications conform to the existing Nye County
Comprehensive Plan.

All jurat sheet signatures with the exception of the Nye County Treasurer and the Planning Director must
be present prior to submission of the Mylar.
A preliminary title report not more than ninety (90) days old must be provided.
Prior to beginning any required construction three (3) copies of engineered plans, drawing profiles, crosssections and all other details necessary for the improvements prepared by a civil engineer, registered in
the State of Nevada, shall be submitted to the Planning Department for review and approval. All
improvements shall be subject to inspection and approval of construction by the Department of Public
Works prior to meeting any improvement conditions. Approval of road construction is not an acceptance
of the maintenance responsibility by Nye County.
Any road construction that will tie into an existing road requires an encroachment permit issued by the
Public Works Department prior to disturbance of the right-of-way.
The cost of any required signage as determined by the Public Works Department shall be borne by the
developer.
Public utility rights-of-way must be approved by the utilities in whose favor the rights-of-way are being
granted by signature of each utility's authorized representative appearing on the map (i.e., water, sewer,
power & phone).
Taxes for the current fiscal year must be paid in full.
For a second or subsequent parcel map the following water sample is required (Note: pursuant to Nye
County Code l6.20.020.g "Subsequent Parcel Map" means any parcel map which purports to divide a
parcel which is less than forty (40) acres, or one-sixteenth (1/16) of a section in area that was created by
either a subdivision map or a parcel map as defined by Nevada Statutes); A water sample (known as a
Routine Domestic Analysis) is required that meets the State of Nevada safe drinking water standards.
Attached is a copy of the list of the required test constituents, and if the test results do not list each
constituent the sample will not be accepted. This sample must be taken from a well located within onequarter (y.;) mile of your property boundaries, you must have the sample analyzed by a laboratory and
submit the results to this office for review. Please be advised that you may submit an existing sample as
long as it is not over three (3) years old. Also, should your sample not meet the standards set forth by the
Division of Health the Nye County Commissioners will review the results of the sample and may
determine that the quality presents a serious enough health risk to disapprove your map; or the Nye
County Commissioners may allow the map to be recorded subject to you recording a statement of the
condition of the water along with the map.
If any party signs the ownership certificate on behalf ofthe owner then proof of his authority to act in this
capacity and authority to conduct business associated with this parcel map must be provided.
