Thank you for joining us for our 24th Annual Horse and Charity
Auction which helps our mission to be a premier, Biblically based
organization that excels at mentoring and supporting youth and
families in crisis.
Thank you for blessing us in so many ways to help make it
possible for us to maintain the horse program for our boys! As
the stories presented in the page of the boy’s answers to the
question, “What does the horse program mean to you” reveal, this
program is very valuable in helping our boys to make positive
changes in their lives.
We are able to present these excellent horses at our auction
because of the generosity of our donors. God has given Salem the
“best of the best” volunteers to enable us to make our auction day
a success. We sincerely thank all the wonderful people that have
given of their time, talents, and energy to put together this event.
We hope you have an enjoyable day and thank you for your

TERMS AND CONDITIONS
LAW: The horses included herein are offered for sale in accordance with the laws
of Illinois.
NO WARRANTY: The buyer may have any horse examined at his expense by a
veterinarian of his choice prior to the sale, until 12:00 noon, Saturday, April 13,
2013. Arrangements may be made by contacting Salem Children’s Home. This
right of buyer is offered in lieu of any warranty of quality, condition or otherwise.
SELLER MAKES NO WARRANTY OF MERCHANT ABILITY OR FITNESS
FOR A PARTICULAR PURPOSE OR OTHER WARRANTY OF ANY KIND,
WHETHER EXPRESSED OR IMPLIED, EXCEPT OF TITLE EACH HORSE
IS SOLD “AS IS” AND WITH ALL FAULTS.
Neither sale management, auctioneer nor any person is authorized to make
warranties about any horse. Their oral or written statements do not constitute
warranties, shall not be relied upon by buyer, and are not part of any contract of
sale.
LIMITATION OF LIABILITY: Buyer’s exclusive remedy for any breach shall
be limited to return of the horse and repayment of the purchase price received by
seller less commissions and cost of sale. The liability of seller or seller’s agents with
respect to any sale or anything done in connection therewith, whether arising out of
contract, negligence, strict liability, warranty or otherwise shall not exceed the
prices, less commission and costs of sale of the horse upon which liability is based
and which has been received by seller. Except to the extent set forth in this
paragraph, buyer shall not, under any circumstances be entitled to consequential,
incidental, punitive, compensatory, special or general damages, damages for mental
or emotional distress, loss of profits or revenue, damages or loss of any other
property, or loss resulting from any general or particular requirements and needs of
buyer.
WARRANTY AND TITLE AND POSSESSION: Seller warrants that upon
horses’ sale, he shall deliver title and possession free of any cloud whatsoever,
subject to the terms of the sale.
WARRANTY OF PEDIGREE: Seller warrants horse’s pedigree as represented.
REGISTRATION PAPERS: Registration papers shall not pass to the buyer
until the horse has been paid in full.
WARRANTY OF REGISTRATION: Seller warrants horse’s registration as
represented.
CATALOG: Every effort has been made to assure correctness of the catalog. The
seller, auctioneer and sale management and personnel are not responsible for errors
or omissions. All corrections made to the catalog at the time of the sale from the
auctioneer’s stand shall supersede the catalog.
RISK OF LOSS: All risk of loss and diminution of value, for whatever cause or
reason, passes to buyer immediately upon the close of bidding on the horse (i.e.,
the “fall of the hammer”).
BIDDING DISPUTES: Should any dispute arise between or among two or
more bidders, the auctioneer shall forthwith adjudicate the dispute, and his
decisions shall be absolute, final and binding on all parties. Bids received after the
fall of the hammer are not grounds for dispute. Bids acknowledged
by bid spotters are recognized as if tendered to auctioneer. In case of dispute, the
bidding on the horse shall forthwith be reopened for advance bids, and if there be
no advance, the horse is sold to the person from whom the auctioneer recognized
the last bid. In case of dispute, advance bidding shall be restricted to the
contending parties, but should the recognized bid be reduced below the bid at
commencement of dispute, then the bidding is reopened to all bidders, regardless
of whether or not final bid exceeds bid which was disputed. The auctioneer
reserves the right to reject any or all bids.
DEFAULT OF PURCHASE: If any person shall purchase a lot and not pay for
it as described above, the seller shall have the right to resell the lot or at option
bring action for specific performance, in which event the defaulting buyer agrees to
pay all costs of such suit together with attorney’s fees as fixed by the court. In the
event of resale, the defaulting buyer agrees to pay all cost of resale, plus any resale
price deficiency
DELIVERY TO BUYER: Title passes to purchaser at fall of hammer, at which
time he assumes all risk and responsibility for the horse. BUYER OR HIS
REPRESENTATIVE SHALL TAKE CARE, CUSTODY AND CONTROL OF
THE ANIMAL IMMEDIATELY AT THE FALL OF THE HAMMER and such
taking shall constitute delivery of the animal, which shall be contingent upon the
purchaser presenting himself to the sale office to make settlement. Buyer must
present himself within thirty minutes of the conclusion of the sale in which the
horse is sold, at which time delivery will be made in the form of a “STABLE
RELEASE” for the horse, provided the buyer satisfactorily makes settlement.
TRANSPORTATION: Buyer, at his own expenses, shall transport horse(s)
purchased at the sale.
LAWS AND TAXES: These terms and conditions shall be construed and
governed by the laws of the State of Illinois in effect as of the date of sale, and any
dispute shall be resolved pursuant to the laws of the State of Illinois and
jurisdiction and venue shall be irrevocable in Livingston County, Illinois. Each
buyer agrees to pay any legal city, county or state sales or transaction privilege tax
which may be claimed because of buyer’s failure to qualify for an exemption from
same.
WITHDRAWAL RIGHTS: Salem Children’s Home reserves the right to
withdraw any horse from the sale without liability to anyone.
STABLING: Horses become the responsibility of the buyer upon the fall of the
hammer. However, arrangements may be made for horses to be stabled through
Monday, April 15, 2013 at Salem Children’s Home. These arrangements should be
made with Kevin Lindley.
ACCIDENTS: Salem Children’s Home is not responsible for accidents. Under
the Equine Activity Act, each participant who engages in an equine activity
expressly assumes the risk of engaging in and legal responsibilities for injury, loss or
damage to person or property resulting from the risk of equine activities.
ALOCHOL: No alcoholic beverages are permitted.
SMOKING: No smoking is allowed in the buildings or on the grounds of Salem
Children’s Home.
The boys were asked “What does the horse program mean to you?”
*I love animals a lot. I think the horses are a great gift from God and a privilege to ride
*When I first got here and found out about the horses, I was like, “Oh, big deal” but
now the barn is the only thing that keeps me sane here. I love just going out there and
working off any stress or worries that I have. It’s crazy but there’s something about
horses that’s so easy to get attached to.
*I really enjoy working alongside the horses whether it means picking their stalls or
longing a horse, I enjoy all of it. Before I came here I didn’t care about horses but now
that I’m here there is and always be a special part of my heart for them. What this
horse program has taught me is to respect horses because they are powerful and
majestic creatures.
*What I like about the horses is being able to ride them. It’s a relaxing feeling. It gets
the stress out, letting y our mind go free and taking a walk in the barn is vary calming.
*The horse barn gives me comfort because it makes me feel like Jesse James.
*To be honest – I’m not big on horses.
*When I am stressed, I know that the horses will always be there for me to talk to.
Also, working in the barn helps me feel pride in myself and what I do.
I think the barn is a great place to relieve anger. Picking tires you out. The horses are a
good animal to talk to as well because they don’t make fun of you no matter what you
say.
*I feel like the horses are like something that you can go to if you are sad. Anytime I
go out to the barn I cheer up a lot because I usually groom one horse that likes to
follow you around the stall. Ann (our instructor) would say funny stuff about the horse
I rode names Bailey. She was really nice for all the times that I saw her. She never got
spooked. I love the barn!
*I’ve learned how to be a hard worker. Also I like the horses and riding.
*I love horseback riding and grooming.
*I enjoy standing in a stall with a horse and having to feel its emotions. Horses look
pretty rad. Playing with the horses and cats is always fun.
*I’ve learned how to ride!!! I’ve learned how to pick stalls. I’ve learned how
to work in a TEAM setting.
*I’ve learned a lot about the horses and in the barn I learned that being around them
lets you forget about your problems. It also builds character and I’ve learned the
different types of horses there are and it’s so much fun going out and riding them.
*It is a great learning experience in a couple different areas in my life. The horses are
great animals to help you when you need support. They are great to help you get your
mind clear whether it’s riding them or hugging them. They can help you emotionally.
Even picking stalls is a great thing. Believe it or not, it’s great to do work and do it
right. I never worked at home and now with the help of chores and picking, I am
disciplined in the work aspect of my life. It has opened a great opportunity in my life,
without it I wouldn’t have learned the things I have.
*The horse barn for me is a place to relax and get away from negatives.
*I enjoy riding, petting, grooming, and working with them. I enjoy every second out in
the barn when I’m with the horses
*I love the barn. I’m a city boy and I’m not used of picking or grooming horses yet. I
will probably buy me a horse when I’m back at home. I honestly love horses. They’re
like big dogs, but horses. I can’t wait to ride a horse. Oh my goodness! The barn is
the best part of Salem. I love horses.
