DIRECT THREAT TO
PUBLIC HEALTH OF RUSSIA AND UKRAINE / Academy of the General prosecutor of the Russian

The article is devoted to the concept of health as an object of criminal law protection. The author examines
the organization and maintenance of places for consumption of narcotic drugs, psychotropic substances or
their analogues as a direct threat to the health of the population of states such as Russia and Ukraine.
Crimes related to drug trafficking, as a general problem of the former Soviet Union, from the point of view of
criminal law in Russia and Ukraine have a common object types, combining them with each other social
relations that arise about the health of the population. According to article 232 of the Criminal Code of the
Russian Federation shall be punished by the organization or maintenance of dens for the use of narcotic
drugs, psychotropic substances or their analogues. In accordance with Article 317 of the Criminal Code
establishes liability for the organization or the content of sites for illicit use, production or manufacture of
narcotic drugs, psychotropic substances or their analogues, as well as providing facilities for this purpose.
Despite the fact that the organization and content of drug houses is a small proportion of crimes in the area of
drug trafficking in Russia (no more than 3% of the reported crimes in the area of drug trafficking in the past 2
years) and in Ukraine (less than 4% of the reported crimes in the sphere of drug trafficking over the past 2
years), underestimate the danger to the public of these crimes cannot, because they directly impinge on the
health of the population, creating conditions of injury unspecified persons.
The author gives her own definition of health of the population: it is such a state of society in which the main
socio-demographic indicators let you play and educate a person has a normal from a medical point of view of
health and capable of solving its basis the necessary social problems.
The author concludes that the identification of underlying problems and threats to public health is to ensure
the real conditions of formation of a set of measures to counter the negative phenomena. In such a situation,
to consider as a direct threat to public health organization and content of drug houses, and, therefore, the fight
against these crimes is of the utmost importance for the protection of health in Russia and Ukraine.
