Legislative and Regulatory News What you need to know and how it impacts you The Greater Bakersfield Chamber of Commerce is dedicated to: • Building a Strong Economy • Providing Business Education & Networking Opportunities • Promoting Our Community • Representing the Interests of Business with Government The end of January 2012 marked another legislative deadline leaving AB 400 (Ma) dead, a Chamber opposed bill that would require all employers to provide paid sick leave, at a rate of one hour for every 30 hours worked in a calendar year. Employees would have earned paid sick leave after only seven days of employment. The Chamber opposed this bill as it was another burdensome and restrictive regulation placed on the back of small business owners. More concerning was the lack of detailed cost-benefit analysis to determine the economic impacts that it would have on many businesses. Thank you to all our members who responded to our call to action. We had feed back that our actions did have a major impact on this bill not moving forward. Hall Ambulance Service Kern Schools Federal Credit Union At the February meeting of the Greater Bakersfield Chamber of Commerce Board of Directors, the Board voted to take a support position on two pieces of legislation AB 987 and AB 988 both sponsored by Assemblywoman Shannon Grove. They deal with aspects of prevailing wage and projects subject to that wage. During Governor Gray Davis administration the definition of a public works project was expanded from “construction, alteration, demolition, or repair work” to include installation. This change resulted in a larger number of infrastructure projects coming under the jurisdiction of prevailing wage laws and inflated the cost of construction. AB 987 would change the threshold of a public works project from $1,000 (set in 1931) to $100,000, and it would repeal the expanded definition of public works. It would repeal expanded state mandate for workers that are not actually in the construction of a project, such as land surveying, inspection services, refuse hauling and off site manufacturing and fabrication work. It would also exempt certain kinds of sensitive construction projects such as schools, seismic retrofitting of hospitals, and volunteer work. Lastly, it would let local governments set their own prevailing wage, which is currently set by a board in San Francisco and based on union bargaining agreements, which inflates wages, especially in the Central Valley. Currently, the wages are inflated because they are based on union collective bargaining agreements which include fringe benefits again inflating the wage rate. Construction jobs are classified in two categories: residential construction and commercial construction. Residential construction wages are generally lower than commercial construction. However, when bidding a project, the commercial wages are used because of the complicated process for estimating residential construction rate. Additionally, since the Davis administration, Union management companies have been able to access employee data (name and address). This bill would require that that information be redacted and only information about a job description and rate of pay would be available. Although the bills were defeated in committee the Chamber felt it was important to take a position because these issues will come up again in the future. The Chamber will now be able to lobby for its members in a timely and effective manner on future prevailing wage issues. This event was intended to connect veterans, military spouses, National Guardsmen, and Reservists who are seeking jobs with employers that currently have open positions and are looking to hire. In an opening ceremony with a Marine Corps Honor Guard, Chamber Chairman Tim Terrio, Chamber President/CEO Debra Moreno and Robin MangarinScott of Mercy & Memorial Hospitals welcomed the job seekers and employers. Over 200 job seekers pre-registered for the event, but over 260 actually attended, far exceeding the estimate the U.S. Chamber expect based on their experi- ence in other communities. Nearly sixty employers were represented and although each had to have at least one currently open position in order to participate some employers had many more openings. The goal of this group is to give a greater voice to business with the State Legislature and government to stop continued onslaught of regulations and overreaching legislation. In January, the CCCA hosted a legislative luncheon in Sacramento with State Legislators, their staff and Chambers to introduce and highlighted the importance of business in the Central Valley. This well attended event highlight issues that affect the business and agriculture climate of the Central Valley Area Chamber members. The CCCA seeks to be a driving force to protect the business interests of California’s Central Valley through cooperation and collaboration of its member chambers. Its purpose is to create a coalition of area Chambers of Commerce for State and Federal legislative affairs; to provide coordination and to advance the common business interests of chambers of commerce in Central California; and to serve as a public advocacy body on issues that impact the business and economic climate of Central California. As a means to meet these goals and objectives, the CCCA members will be conducting a survey of their businesses to find the top three regulatory issues that are keeping us from growing and restricting our ability to prosper. We ask that when you are contacted about this survey that you respond. It is vital for us to hear from our members on the issues that are most important to you so that the Sourthern Central Valley issues will be well represented in the overall Valley-wide advocacy efforts.
