FHA LOAN LIMIT INCREASES

The temporary limit in Nassau,
Suffolk & Queens is now $729,750
The Long Island Board of REALTORS®, Inc. (LIBOR) lauds the recent
FHA loan limit increases as part of the economic stimulus package that President
Bush recently signed into law.
“Increasing the loan limits for Fannie Mae
and Freddie Mac will bolster the housing
finance market, which continues to be severely stressed, by providing an immediate infusion of much needed liquidity to the nation’s
mortgage market,” said Mohsen Zandieh,
President of LIBOR. “This package will help
the many families that need mortgage
options, whether they are purchasing or refinancing to keep their homes,” he continued.
The U.S. Department of Housing and
Urban Development published the new
FHA and conforming loan limits, based on
median home prices as mandated by the
Economic Stimulus Act signed by President
Bush in February. New loan limits for FHA
and Fannie Mae and Freddie Mac are now
calculated at 125 percent of the HUD published median prices, with a floor of
$271,050 and $417,000, respectively, not to
exceed $729,750. The temporary limit in
Nassau, Suffolk & Queens is now $729,750.
Additionally, the increased loan limits will
help many residents in our area achieve the
dream of homeownership and will allow many
more homeowners to refinance and potentially
keep their homes in this challenging market.

Nassau County Executive Thomas
Suozzi has been appointed by former
Governor Spitzer in January to Chair the
New York State Commission on Property
Tax Relief. The Commission has seven
members and is charged with examining
the fundamental causes of The State of
New York’s high property tax burden
including the expenditures of local governments and school districts.
“New Yorkers pay the highest property
taxes in the nation, a burden our residents and
businesses can no longer bear. We need to
take a comprehensive look at the root causes
and recommend ways to reduce them” said

year's Annual Long Island Press Power
List. Each year, the Press Power List committee begins to debate the merits of what
power means as they examine lots of
applications from well deserving individuals. E-mails pour in and the phones ring
off the hook. The Long Island Press says,
“In truth, most of the people who are
pitched to the committee by a third party
are not chosen for the list.” The Press only
selects 50 individuals for this honor.

Mottola received his nomination for his
work in serving the real estate industry for
the past 35 years. As the CEO of the Long
Island Board of Realtors (LIBOR), he is
recognized for his leadership over the
largest local Realtor association in the
country. He is also the CEO of the LIBOR
subsidiary Multiple Listing Service of Long
Island that ranks amongst the top ten
MLS’s in the country. When asked how he
felt about receiving this nomination Joe
said, “It’s obviously quite an honor but
essentially is a recognition of the influence
of our Board of Realtors and Multiple
Listing Service in the overall marketplace.”

APRIL IS FAIR HOUSING
MONTH
The Long Island Board of REALTORS
helped sponsor another new Habitat
for Humanity house that is currently
under constructing on Wilson Place in
Roosevelt. Through the “We’re More
Than Realtors” Campaign, LIBOR
donated $10,000 that was earmarked
for the construction of this house in
2007, but do to unforeseen delays, the
ceremonial “Wall Raising” did not take
place until Saturday, March 29th.

The campaign is getting a new look this
year. As posters and campaign materials
become available, they will be distributed to
all offices and will be made available through
all the Realtor Service Centers. Watch for
details in the next issue of the Realtor® paper.

been holding hearings throughout New York
State and the first and only Long Island
Hearing was held on March 5th at the Suffolk
County Legislature Building.
Many prominent local officials testified
concerning the impact that high property
taxes have on people living here on Long
Island: forcing seniors out of their homes,
driving the young people out of our state, and
discouraging the formation and expansion of
many local businesses. Nassau County Tax
Assessor Harvey Levinson said, “The
assessed value of a home is not an indicator
of a family’s ability to pay school taxes.”
The hearing brought about many suggestions about possible reform to the tax structure.
E.J. McMahon, from the Manhattan Institute,
suggested a property tax proposal similar to
one that Massachusetts voters approved in
1980. Under the Massachusetts system, taxes
would be capped at 2.5% of property values
and limit annual increases to 2.5%.
Another proposal was offered by Martin
Cantor of Dowling College, which is similar to that of Senator Dean Skelos’ proposal. Here, the school districts would be consolidated into four regional districts and the
state would also take over salaries and benefits of teachers. Senator Skelos’ proposal
would call for making all new school teachers State employees. School taxes make up
approximately 60% of property tax bills.

has called for a countywide agency to run
school business operations which has been
performed up to now by the county’s 56
independent school districts.
The Property Tax Commission has until
May 15, 2008 to issue an interim report
stating the Commission’s recommendations
with respect to a statutory school property
tax cap, and a final report no later than
December 1, 2008, setting forth its findings
and conclusions and making its final recommendations.

PR Committee Mission Statement: To
improve the perception of Long Island
Realtors® by promoting a positive and professional image of our members to the public.
Our aim is to create a positive image of
Realtors® by raising the public’s awareness
about what Professional Realtors® are doing
for buyers and sellers and their community.
This year, the Long Island Board of
REALTORS, Inc. Public Relations
Committee will continue branding the
“We’re More Than Realtors®” campaign
that was set into motion back in 2006 and
since that time has continued to gain momentum as it receives more and more publicity.
Recognizing the importance of branding, the
PR Committee has decided to continue
branding the concept that Realtors® are more
than Realtors® and for 2008, has added the
tag line —“Professionals working for you
and your community” to reinforce the fact
that Realtors® are professionals.
The campaign will have a three pronged
approach to creating a positive image by
focusing on charity work and community
service, housing and political advocacy
efforts, and professionalism. Joe Sinnona,
Committee Chairperson says, “I am pleased
to report that the committee has developed
an effective campaign that takes us to a new
level. The committee worked to put together a campaign that includes pieces from the
past two years that were deemed successful,
and then added a new dimension to the program that further promotes our role as real
estate professionals. I believe this campaign will help us meet our goal of improving the public’s perception of Realtors® in
Nassau, Suffolk, and Queens.”
This year’s public relations campaign
includes donations to Rebuilding Together
Long Island, the Hagedorn Community
Center, and the New York City Housing
Partnership Home Maintenance Program. It
also includes the continuation of several
Realtor® sponsored college scholarships that
are awarded to students at Hofstra University,
Dowling College and Queens College.
Additionally, money has been allocated
to go toward strengthening LIBOR’s affiliation with other organizations such as the
Long Island Association, the Long Island
Housing Partnership and the Long Island
Builders Institute. LIBOR will be sponsoring several major Long Island events that
are scheduled to take place over the course
of this calendar year.
The Committee also approved continuing the Realtor® Spirit Award Program,
and will once again promote the month of
December as Realtor® Spirit Month. TV,
radio and print ads will appear at the end of
this year that will showcase the efforts of
Nassau County

Navigating the Right
Course
As we all know, real estate is ultimately a local issue and even though financial
difficulties have engulfed Wall Street, our
service area will weather this storm. One
needs to keep in mind that the benefits of
property ownership surpass almost all
forms of investments. Capital appreciation, tax right-offs on mortgage interest
payments, comfort, dignity and the security that a home offers its owners are a
few benefits of ownership; in truth, there
is no place like home.
Our challenge is to get these points
across to the public. I am please to report
to you that the National Association of
Realtors has taken the right steps to
address these issues. It has earmarked a
significant amount of member dues to
meet this challenge. NAR has launched a
program called “Surround Sound” with a
$2,500,000 commitment to assist the
local boards in dealing with the media in
their service area. NAR provides advice
and assistance in working with local
media in an effort to get reliable and accurate information to the news outlets.
The National Association of Realtors is
launching a major commercial campaign
throughout the country. The fund associated
with this campaign is $40,000,000. These
commercials focus on two themes: “Buy
Now” and “The Time is Right”.
Another significant effort by NAR is
the national syndication of two hours of
“Talk Shows” where the public is being
engaged the entire buying and selling
process. As part of the same venue, NAR
is developing a 30 minutes weekend
cable TV program with the helpful tips
for the public.
LIBOR’s Public Relation Committee
along with its capable staff, in coordination with NAR “Surround Sound” campaign, has entered into an agreement with
Newsday to run our customized NAR
advertisements in a quarter, half and full
page size at no cost to our membership.
These advertisements emphasize the
importance of homeownership in creating
long term wealth as a mean of capital
appreciation.
The message is very clear; with knowledge, hard work, dedication and the application of professionalism, the ship is navigating the right course and together we
will succeed as a united cohesive force.
This ad is a sample of one of the
complimentary ads that NEWSDAY will begin
running in the paper in the coming weeks.

LIBOR Unites with Builders and
Developers to Form Coalition

Four of Long Island’s professional real
estate groups have joined forces to create a
new coalition to affect public policy. The
Long Island Real Estate Organization
(LIREO), which is comprised of LIBOR,
the Long Island Builder’s Institute (LIBI),
the Commercial Industrial Brokers Society
(CIBS) and the Association for a Better
Long Island’s developers (ABLI), will
work in unison to foster much needed
change in our region.
Among the many goals of this organization will be to focus on the critical smart
growth issues that affect all residents
including: zoning; affordable and available
housing as well as an ever-increasing tax
base. All of which work towards making
Long Island a viable place to live, work and
retire. Newsday recently reported on this
historic alignment of forces calling it an
“unprecedented coalition.”
The group’s first order of business has
been to commission Dowling College to
research the economic impact of open space
on Long Island, its burden to the taxpayer, its
role in shaping the redevelopment of existing
commercial and residential properties and
what the long-term implications are when
property assessments and confiscatory property taxes continue to hobble the sensitive
and healthy economic growth of the region.
Members of this coalition previously
worked together to defeat the Transfer Tax
proposal in the Town of Brookhaven. We will
keep you abreast of the coalition’s activities.

Looking for Donations to Help
Fill Empty Pantry Shelves
Newsday ran an article on March 31,
2008 that highlighted a growing problem
whereas some middle class working Long
Islanders now have to turn to food pantries
to help supplement their family’s food budget. The growing number of households
seeking assistance from free resources such
as the Long Island Council of Churches
Food Pantries is creating a shortage of food
and supplies on pantry shelves all across
Long Island. As a result, donations of nonperishable food products and personal
items such as toothpaste, shampoo, deodorant, and diapers, are now in dire need.
After this story ran, a phone call was
made on behalf of LIBOR to the organization’s manager, Carolyn Gumbs, so we
could get details on how Long Island
Realtors® could possibly help. Gumbs,
who has worked at the Long Island
Council of Churches location in Suffolk
County for the past 29 years, said that any
sort of donation would be appreciated at
this time. She noted that in the month of
February alone, the Riverhead location
helped over 278 households which
included 230 children, 319 Adults, and
58 Senior Citizens. Gumbs said the she
unfortunately expects that number to
grow as more and more households feel
the pains of the rising cost of living.

REALTOR® Magazine is seeking nominations for the ninth annual REALTOR®
Magazine Good Neighbor Awards. The program recognizes REALTORS® who’ve

Together Long Island
on Friday, May 2nd at the
Hagedorn Community Center in Manhasset
he Hagedorn Community Center was originally
built in 1929 as a public school. It was then
re-opened as a community center focused on
helping “at risk” youngsters in Manhasset/Great
Neck achieve success by providing support for
both the children and their families. Activities
include a Head Start program, after school
programs, a family support program, teen youth
council, summer programs and AA meetings. The
school, which is run with great dedication and
effectiveness, is in desperate need of help.

Volunteers from Nassau, Suffolk and Queens are
welcome! 50 volunteers are needed in total for
the work day, which will begin at 9 a.m. and end
around 3 p.m.
Projects will include:
• gardening/landscaping
• outdoor painting
• fence installing
All volunteers will receive a free "We’re More
Than Realtors®" T-shirt and lunch/refreshments
courtesy of LIBOR. This is not only a chance to help
children in need, but a great day of networking and

and Short Sales —
For Listing Agents and Selling Agents
the MLS Rules Have Not Changed
It will come as no surprise to you that
we are in a new marketplace where properties in foreclosure and short sales are
no longer the oddity or exception. Their
existence raises many new issues and
some confusion as to what the strategies
and rights of selling and listing agents
should be to comply with their obligations under the law, their fiduciary duty
to their clients, and their adherence to
Multiple Listing Rules.
During my attendance at various zone
meetings, certain questions come up
again and again. How do I convey an
offer on a property in foreclosure? What
happens if the listing agent refuses to
convey my offer to the bank, but cannot
provide a copy of the seller’s directions
that no offer may be submitted once an
offer as been accepted? How do I confirm that my offer on a property in foreclosure has been conveyed? How do I
know if the listing is subject to the equity theft protection act? What must the
listing broker include in the Realtor’s
copy of the listing on stratus in regard to
short sales or properties in foreclosure?
What information, if any, should be
included on the public site, and when
should a potential buyer be advised that
they are dealing with a short sale?
First, and most importantly, although
the bank as a seller may take the position
that they don’t have to play by our
(MLS) rules, YOU DO!! What does this
mean? It means that if you are taking a
listing on a foreclosed property it is your
duty to advise the seller (the bank), as
you would any other seller that you are
bound by certain rules under the Multiple
Listing Service. The bank wants you to
list the property on the MLS!! Therefore,
they should at least be aware of the procedure YOU will have to follow. This
means that unless the seller (bank) advises you in writing that once an offer is
accepted they do not want to hear any
other offers, you cannot take the position
that when an offer is accepted and another offer comes in from a broker that you
can refuse to convey it!
You are legally obligated and the MLS
rules provide that all offers MUST be
conveyed if there is no contrary direction
in writing from the seller. If you as the
listing broker refuse to convey the offer
without written instructions, the broker
with the offer waiting to be conveyed
should contact the zone chairperson and
explain the problem. The zone chair person should then contact the listing broker, and absent directions in writing not
to present offers after an acceptance,
should demand the offer be conveyed
and acknowledged by the Seller.
Alternatively, as with any other listing,
the zone chairperson may demand the
contact information for the seller (bank)
from the listing broker, if the listing broker refuses to obtain the required
acknowledgment of offer.
I have had this experience in my own
office, when a listing broker who had no
written directions from the bank refused
to convey my agent’s offer. I advised the
listing broker that I could have the zone
chairperson contact him, or he could provide me with the seller’s information and
I would convey the offer myself. The
listing broker chose to have me convey
New MLS Stratus License
Agreement
With the approval of the Multiple
Listing Service (MLSLI) Board of
Directors all Participants, their agents
and administrative staff who wish to
access Stratus will be required to accept
the terms of the MLSLI Subscriber
Agreement. This will be done by clicking “I accept” which shall appear at the
bottom of the Agreement after logging
on to Stratus beginning the week of
April 21, 2008.
Upon such acceptance the Subscriber
will thereafter be able to access Stratus.
There will be no need to repeat this
process after the Agreement is accepted
the first time.
This Agreement has been created to
protect the MLSLI listing content from
piracy and misuse by unauthorized per-
sons. The main points of the Agreement
are:
• Subscriber will not disclose their
STRATUS password to anyone.
• Violation could result in loss of the
right to access Stratus.
• Subscriber represents they are
authorized by owner and Participant to
enter property listings into STRATUS.
• Subscriber transfers all intellectual
property contained in listing content to
the Participant to which they are
licensed and MLSLI as equal one-half
owners.
• Subscriber agrees to use the listing
content only as outlined in the
Agreement.

the offer, which I did by facsimile to the
bank. This generated a call from the bank
employee handling the account, who
acknowledged receipt of my offer. The
bank employee indicated that they would
keep my offer on file in case the other
offer did not close. There are numerous
reasons why once informed of another
offer the bank will keep your offer on
file, including but not limited to the fact
that the bank has a duty to recover as
much of the money that is owed and
could face challenges to an attempt to
collect a shortfall on the note if it did not
consider the offer(s). At a minimum you
know that your information is now
before the bank, which was your goal to
begin with.
In regard to short sales, both listing
and selling agents must be clear that
most if not all lenders will only consider
a short sale by receiving an actual contract, and there can be more than one
contract submitted. This means you don’t
have a deal until the bank accepts the
contract and you are not entitled to a
commission, unless the contract is
accepted. If you as the listing agent are
not clear in the remarks section that the
property as listed is a “short sale”, a
cooperating broker who brings a buyer,
ready, willing, and able to purchase pursuant to the terms stated in the listing,
may make a claim for a commission.
Sellers who are reluctant to share this
information should consult with their
attorney as to whether they want to
assume this potential liability.
When should a customer, be advised
that a property is being offered on the
basis of a short sale? I am aware of a situation where a seller listed a property
with an MLS participant who was
advised by the seller that the transaction
would be a short sale. Unfortunately, the
agent did not convey this information to
other agents or to the customer who
eventually made an offer that was
accepted by the seller. The customer paid
to have an engineer’s report, and only at
the point of actual contract was the seller’s attorney advised that this would be a
short sale. When the seller’s attorney
conveyed this information to the customer’s attorney, who also happened to
be her mother, the fireworks began. The
customer’s attorney refused to go for-
ward with the transaction and demanded
that the agent pay for the engineer’s
report, threatening an action against the
agent with the Department of State. This
is clearly not the outcome anyone was
expecting, and probably could have been
avoided had this information been conveyed at the point that the customer
expressed an interest in conveying an
offer.
Finally, what if a sale is subject to the
Equity Theft Protection Act? If your seller is in foreclosure or is sixty days behind
in their mortgage payment, the sale will
be subject to the Act. To read a summary

http://www.banking.state.ny.us/hetpyrul.pdf. About a year ago, before we
were focused on issues such as the Act,
one of my agents discovered what can go
wrong when the seller is less than truthful
about their financial situation with their
lender, and the parties are not familiar
with the requirements of the Act. Not
knowing that the seller was behind in his
mortgage payments my agent listed the
property and obtained an accepted offer
from an investor on a two family home.
The seller and buyer’s attorneys had only
a passing acquaintance with the provisions of the Act, with the result that the
deal fell through when the requirements
of the act were improperly explained to
the buyer. By the time my agent was able
to explain the problem to me and I was
able to provide accurate information on
what was required, the transaction could
not be saved. The moral of this story? Try
to tactfully gain information from your
seller and explain why you are asking.
Become familiar with what is and what is
not required under the Act, and if there
appears there may be a problem, intercede and seek advice as early as possible.
Finally, many of these questions are
answered at your zone and chapter meetings by guest speakers such as Cathy
Nolan, and I strongly urge to you to take
advantage of those opportunities when
they arise. Being prepared in a changing
market is the first step to being successful
and profitable during challenging times.
Major Change in New Rental Listing Agreements
The compensation published is now the
amount paid to the Listing Broker rather
than the Renting Broker Compensation.
The Cooperating Broker will be able
reach an agreement with its tenant as to the
total broker compensation and forward to
the Listing Broker their portion as set forth
on the published listing.
All old rental listings should be edited by
the Listing Broker to show the Listing
Broker Compensation.
Please note there is a new Multiple
Listing Service Rental Agreement which
was approved by the MLS Board of
Directors. It is now a two part agreement
similar to the Residential Listing
Agreement.
The change to the rental compensation
field will also be on Residential, Condo/Coop and Commercial listings offered for rent.

Through Effective
Online Strategies

For most real estate professionals the
business climate has changed dramatically.
Whereas for several years, simple presence
in the field was a license to be successful
and earn a significant living, today a much
better strategy needs to be utilized, just to
stay on the playing field.
In an e-commerce environment the focus
or goal of a Website is encouraging the site
visitor to buy something. Since that
approach is not likely to work for real
estate transactions, the most critical objective is to capture the contact information
from a visitor so that a pipeline of prospects
can be developed. While the gist of this
article is about utilizing the Internet to help
locate qualified prospects (buyers or sellers), I think it's also important to mention
that leads arising from the Web will still
need to be worked effectively.
Building a pipeline begins with attaining
both a phone number and an e-mail address
from someone. If you have a traditional
direct mail program in place, then a street
address is vital as well. While direct mail
can still be of value, e- mails can be powerful, better targeted and less expensive. For
example, by grouping your prospect base
into categories (like single family vs. condo
buyers or buyers vs. sellers), you can send
out e-mails that are tightly aligned with
someone's interests. You will experience a
much better response rate by segmenting in
this manner.
Here are a few more ideas to boost the
effectiveness of your Website/online lead
generation efforts.
1. Take advantage of the two main
opportunities on Search Engines:
Search Engine Optimization (SEO) and
Search Engine Marketing. SEO, also know
as Organic or Natural Search is the process
by which a site is designed to be aligned
with the algorithms of the engines. Key
ingredients include robust content, search
engine friendly architecture and effective
linking strategies. Each major Search
Engine has a Paid component to its search
results as well. This involves paying for site
visitors on a "per click" basis. There are a
series of variables that need to be considered when starting a campaign. These
include keyword selection, geography
(where do you want your listing to show
up) and bid strategy (how aggressive do
you want to be? What is your budget? etc.).
2. Keep the content on your site
fresh, accurate and robust. For example, it's a big turn-off to arrive at a site with
inaccurate information or links that don't
work. Create a compelling reason for someone to search for properties on your site,
rather that just going to realtor.com.
3. Honor channel preference — By
that I mean make it as easy for someone
to contact you via e-mail as by telephone.
Prompt follow-up is also critical. Make
sure you get back to them before they have
a chance to reach out to a competitor. And
as already mentioned, get complete information from each person so that you can
maintain multiple contact points with
them.
4. Utilize a contact management
program. There are a number of these programs on the market today that will allow
you to keep in close contact with those who
warrant it, schedule others for contact later
on, and also parse the database for mailings
(as described above).
5. Study competitor sites. Although
most sites have similar attributes, especially ones that are template driven, others are
unique with varying degrees of professionalism. While a template site is okay, it has
limitations from both a design standpoint
and from a Search Engine Optimization
perspective. Many Realtors have sites
through the companies that they are representing (Prudential, Century 21, etc.) and
also have another site that allows greater
flexibility and opportunity for differentiation.
6. REALLY IMPORTANT — If you
send an e-mail to your database and you do
it in one bulk e-mail, make sure that you
blind copy (Blind CC) all of the recipients.
I received an e-mail recently from the
developer of a new community. The e-mail
was sent to 200 + individuals who had
requested to be on the mailing list. The person who sent it out didn't Blind CC everyone, and the entire list saw each other's
names. Besides the negative credibility
impact for the developer, it was likely a
bonanza for the handful of other realtors in
town who were on the list themselves.
There is no question that this is a challenging time for most people associated
with the real estate industry, including
homeowners who are trying to sell their
properties. The factors that fueled the market on the way up, along with the ones driving the downturn are out of the control of
any individual.
What remains in your control is the lead
generation and follow-up process. Hard
work, strong organizational skills and a
willingness to embrace e-mail/the Internet,
are important ingredients to attaining
impressive results in a tougher marketplace.
2007 Internet Advertising Revenue
Exceeds $21 Billion
The Interactive Advertising Bureau (IAB)
estimated that $21.1 billion was spent on
Internet Advertising in 2007, a figure that
represents a 25% increase over 2006.
Additionally, five years ago the IAB
reported Internet Advertising Revue reach-
ing the $6 Billion mark to which 21 percent
was being allocated on keyword programs
using search engines like google and
yahoo. Today, reports show that companies
are allocating almost 40 percent of their
marketing budgets to key word searches.

In response to a question from the New
York State Association of REALTORS®
(NYSAR), the Department of State (DOS)
has recently clarified its regulation concerning disclosure of commissions where a broker is being paid by both parties to the transaction. Regulation 175.7 requires that in
such a case there must be “full knowledge
and consent of all parties.” NYSAR raised
the question as to whether the regulation
required a buyer’s broker who is being paid
a cooperating commission by the seller and
also a commission by the buyer, to disclose
to the seller the amount of commission
being paid to the buyer’s agent by the
buyer. The DOS answered that the buyer’s
agent need only disclose the fact that they
were being paid by the buyer as well as the
seller to the seller or the seller’s agent, but
not disclose the amount they are being paid.
Since the buyer is the buyer’s agent
client, the buyer’s agent must disclose
both the fact that they are being paid by
the seller and the amount they are being
paid by the seller to the buyer.
The complete text of the DOS interpretation is as follows: NYSAR has asked
whether 19 NYCRR §175.7 requires disclosure by a buyer’s broker to the seller’s
agent of all the terms of the buyer’s broker representation agreement when seeking a co-broker split.
19 NYCRR § 175.7 provides: “[a] real
estate broker shall make it clear for which
party he is acting and he shall not receive
compensation from more than one party
except with the full knowledge and consent of all parties.” Generally speaking,
the regulation requires: “that real estate
brokers clearly state for which party they
are acting.” Almo v. Shaffer, 149 A.D.2d
417 (N.Y.A.D. 2 Dept., 1989). The underlying administrative decision which was
confirmed by the appellate court opined
that “[19 NYCRR 175.7] places a heavy
burden on the broker: ‘to make it clear’
what the state of facts are. It is the broker’s responsibility to be sure that the person with whom he or she is dealing understands, and the broker may not rely on the
assumption that such person has knowledge of the general usage of the industry.”
DLS v. Almo et al. 24 DOS 87 at 3.
The disclosure requirement of section
175.7 are similar to the disclosure requirements under NY RPL § 443 insomuch as it
is intended to protect the public from
undisclosed arrangements which could
affect a broker’s fiduciary responsibility to
his or her principal. See generally, DLS v.
Seplow, 24 DOS 95. It is well settled that a
broker’s disclosure complies with NY RPL
§ 443 upon presenting the statutory disclosure form to the parties to the transaction.
DLS v. Tenteromano et al. 25 DOS 95. In
addition, the broker must always be cognizant of: “[t]hose fiduciary duties
[imposed by the agency relationship
which] include three fundamental obligations: of obedience that instructs the real
estate broker to comply with the legal
directions of a principal; of full and fair disclosure that places an affirmative duty
upon the real estate broker to fully and fairly disclose to a principal every fact known
to the agent that might affect the principals’
interests in the agency...; and of good faith
and undivided loyalty that forbids the real
estate broker from advancing any interest
in an agency relationship that is adverse to
the interests of the principals without the
principals’ informed consent.” Seplow.
From the foregoing, it would appear that
so long as the broker who is attempting to
facilitate a co-broker split makes it
absolutely apparent who that person is representing in the transaction and how much
they are receiving in the co-broker split, the
disclosure obligations would be fulfilled
and the general intent to safeguard against
undisclosed interests which could affect he
agent’s obligations is satisfied. Therefore,
19 NYCRR § 175.7 does not require that
when such a co-broker split is made that
the buyer’s broker disclose to the seller and
the seller’s agent all the material terms of
their agreement provided that all the parties, including the broker’s principal, are at
least made aware of the agreement and the
amount which is being offered in the split.
Homeowners Take First-Ever Tax
Deduction for Mortgage Insurance
Many qualified taxpayers are preparing
to claim their first-ever tax deduction for
mortgage insurance premiums on home
loans that closed in 2007.
The tax deduction was first approved by
Congress in late 2006 and applied to loans
with mortgage insurance that closed in
2007. In an important move to further assist
borrowers, Congress voted in December of
last year to extend the mortgage insurance
tax deduction through 2010. Extension of
the tax deduction for mortgage insurance
premiums was part of the Mortgage
Forgiveness Debt Relief Act of 2007.
The deduction allows households with an
adjusted gross income of $100,000 or less
to deduct the full cost of their government
or private mortgage insurance premiums on
their federal tax returns. Families with
incomes between $100,000 and $109,000
are eligible for a reduced deduction.
“For the first time, many low- and moderate-income families who purchased
homes with private or government mortgage insurance, will be able to deduct those
premiums when they file their 2007 federal
tax returns next month,” said Kevin
Schneider, President of the Mortgage
Insurance Companies of America (MICA).
“On average, this year‚s tax break could be
worth $350 per taxpayer — an annual
deduction that qualified homeowners can
take each year through 2010.”

Proposed RESPA Rule Published
On March 14, 2008, the Federal
Register published HUD’s long awaited
proposed regulation on the Real Estate
Settlement Procedure Act.
The 94-page proposed regulation
includes, among other things, a mandatory four-page Good Faith Estimate (GFE)
and a modified HUD-1/1A, a required
“closing script” that must
be read orally at settlement, enhanced disclosures and new rules concerning volume discounts, average cost pricing and “Required use.”
There will be a 60-day public comment
period which expires on May 13, 2008.
NAR will study the proposal and file formal comments with the Department of
Housing and Urban Development.

Commission Disclosure
The increase in complexity in the
Brokerage market place corresponds to
more disputes between Realtors concerning who is entitled to the commission in
particular cases. These disputes are fairly
and quickly resolved through LIBOR
Mediation and Arbitration. If you are
involved in one of these proceedings,
there is an important rule you should
know. Each party to an arbitration must
provide the opposing party with a copy of
all documents they intend to use to prove
their case, and the names of all persons
who they intend to call as witnesses, at
least ten days prior to the date of the hearing. This is done by sending copies of the
documents and the names of the witnesses to LIBOR. The documents can be sent
by mail, fax, or e-mail. A failure to abide
by this requirement could result in the
panel rejecting that evidence at the hearing with the result that you might lose a
case you would otherwise have won.
This rule may seem harsh, but its purpose is to protect the party against whom
the evidence is to be submitted from surprise. By exchanging all the documents
and the names of all the witnesses, each
party can adequately prepare their case
and the arbitrators are provided with the
full information necessary for them to
make a wise and fair decision. It is of
utmost importance that all parties are
treated fairly and get the opportunity to
fully present their case.
What happens then when one of the parties submits evidence less than ten days
prior to the hearing date? The Arbitration
Chair will decide whether or not to accept
the evidence for consideration at the hearing. The burden is placed upon the party
introducing the evidence to convince the
Hearing Panel that it should be accepted.
That means that if you have not sent the
documents or the names of the witnesses
to LIBOR as the rule requires, you must
explain why you failed to do so. The Chair
will consider the reasonableness of your
excuse in deciding whether or not to allow
you to put the document in evidence or to
call the witness. Other factors which will
influence the Chair’s decision are how late
was the exchange. There is a difference
between a document which was
exchanged one day late and a document
which is first shown to the other party at
the Hearing.
The Chair will also consider the relevance and materiality of the evidence being
offered, and the opposing party’s opportunity to adequately review that evidence and
meet it with his or her own evidence. That
is whether or not there was real harm to the
party against whom the late evidence is
being offered. The Chair will consider
whether or not the late document was
already in the possession of the opposing
party or whether the undisclosed witness
was known and available to both parties. If
there is no surprise or harm in allowing the
document to be considered by the
Arbitrators or allowing the witness to testify, the Chair may allow the evidence even
though it is exchanged late. The Panel will
also want to know whether or not the
opposing party had already submitted
rebuttal evidence, whether in the form of a
document or a witness, to that evidence
which is being submitted late. The Chair
will weigh all these factors in deciding
whether or not to allow the evidence to be
part of the case.
Today’s commission disputes often
involve tens of thousands of dollars. With
that much money at stake it is foolish to run
the risk that an important part of your arbitration case may never be considered by the
Arbitrators simply because you did not
comply with the ten day rule. DON’T LET
THE TEN DAY RULE BITE YOU!! If you
are a party to arbitration, make sure that you
submit your evidence to LIBOR at least ten
days prior to the date of the hearing.

Case #3-7: Time at Which
Modification to Offer of
Compensation is
Communicated is a
Determining Factor
REALTOR® A listed Seller X’s home
and filed the listing with the MLS. The
property data sheet indicated the compensation REALTOR® A was offering to the
other Participants if they were successful
in finding a buyer for Seller X’s home.
During the next few weeks, REALTOR® A authorized several Participants of
the Multiple Listing Service, including
REALTOR® C, to show Seller X in discussing possible means of making the
property more salable, agreed to reduce the
listed price. REALTOR® A also agreed to
lower his commission. REALTOR® A
changed his compensation offer in the
MLS and then called the MLS Participants
who had shown Seller X’s property to
advise them that he was modifying his
offer of compensation to cooperating brokers. Upon receiving the call, REALTOR® C responded that he was working
with Prospect Z who appeared to be very
interested in purchasing the property and
who would probably make an offer to purchase in the next day or two. REALTOR®
C indicated that he would expect to receive
the compensation that had been published
originally in the MLS and not the reduced
amount now being offered to him, since he
had already shown the property to Prospect
Z and expected an offer to purchase would
be made shortly. REALTOR® A responded that since Prospect Z had not signed an
offer to purchase, the modified offer of
compensation would be applicable.
The following day, REALTOR® C
wrote an offer to purchase for Prospect Z.
The offer was submitted to the Seller by
REALTOR® A and was accepted. At the
closing, REALTOR® A gave REALTOR®
C a check for services in an amount reflecting the modified offer communicated to
REALTOR® C by phone. REALTOR® C
refused to accept the check indicating that
he felt REALTOR® A’s actions were in
violation of the Code of Ethics. REALTOR® C filed a complaint with the
Board’s Grievance Committee alleging
violation of Articles 2 and 3 on the part of
REALTOR® A citing Standard of Practice
3-2 in support of the charge.
During the hearing, REALTOR® C stated
that REALTOR® A’s modification of the
compensation constituted a misrepresentation through concealment of pertinent facts
since he had not provided REALTOR® C
with specific written notification of the modification prior to the time REALTOR® C
began his efforts to interest the purchaser in
the listed property. REALTOR® A defended his actions by indicating that timely notice
of the modification of compensation offered
had been provided to REALTOR® C by
telephone prior to REALTOR® C obtaining
a signed offer to purchase. REALTOR® A
also indicated that his modified offer of compensation had been bulletined to all
Participants through MLS REALTOR® A
also noted that in accordance with Standard
of Practice 3-2, the modified compensation
offer had been communicated to REALTOR® C prior to the time the purchaser
signed an offer to purchase. REALTOR® A
also commented that had REALTOR® C
produced the signed offer to purchase prior
to REALTOR® A communicating the modified offer, then REALTOR® A would have
willingly paid the amount originally offered.
Based on the evidence presented to it,
the Hearing Panel concluded that REALTOR® A had acted in accordance with the
obligation expressed in Standard of
Practice 3-2 and consequently was not in
violation of Articles 2 or 3.
Case#16-13: Dealings Initiated
by Another Broker’s Client
REALTOR® A, a residential broker,
had recently listed a home. REALTOR®
A’s marketing campaign included “open
houses” on several consecutive weekends.
One Sunday afternoon Buyer B came to
the open house. REALTOR® A introduced
herself to Buyer B and asked whether Buyer
B was working with another broker. Buyer
B responded that he was, in fact, exclusively
represented but went on to add that he was
quite familiar with the property as it had
been previously owned by a close personal
friend. REALTOR® A told Buyer B that she
would be happy to show Buyer B through
the home but reminded Buyer B that she represented the seller and not Buyer B.
After viewing the home, Buyer B indicated that he had pressing business travel
plans, was seriously interested in the property, and requested REALTOR® A’s assistance in preparing a purchase offer.
REALTOR® A assisted Buyer B in filling
out a standard form purchase contract and
later that day presented the offer to the
seller who accepted it.
REALTOR® A was subsequently
charged with violating Article 16 for dealing and negotiating with a party who had
an exclusive relationship with another
REALTOR®.
The Hearing Panel agreed with REALTOR® A that she was the seller’s exclusive representative and had not represented the buyer and concluded that her conduct had not violated Article 16, as interpreted by Standard of Practice 16-13.

Avoid slang, and be aware that idioms
can confuse the newcomer to English.
Idioms are expressions in which words take
on meanings that are quite different from
their dictionary definitions.
I know first-hand the difficulty of comprehending idioms and slang. I learned English
as a second language after I came to this
country. Idiomatic expressions that make perfect sense to people who grew up speaking
English can be bewildering to someone who
grew up speaking another language.
For instance, when you say "I give up,"
you mean "I surrender," "I quit," or "I yield."
But the newcomer to the English language
may be puzzled. What does it mean to make
a gift in an upward direction?
Idioms are important tools of communication, and newcomers to English must learn
them just as they must learn individual
words. But be aware that you may occasionally have to explain carefully what you mean.
4. Provide thorough orientation.
Be sure your new employees are
acquainted with the roles of the key people
they'll be dealing with. Who is the team
leader? Who is the supervisor? Who is the
department head? Let them know whom to
go to for advice, instructions and answers to
questions.
5. Learn about minority cultures.
When you're dealing with people from
another background, learn as much about
them as you can. Go to the encyclopedia or
to the card catalog at the library. Find out
whether there are ethnic organizations that
might provide some information.
Ask for help from a member of that ethnic group who has already fully adapted to
the American culture. And ask the newcomers themselves.
6. Assign mentors.
Mentoring can be used as an adjustment
tool for immigrants. The ideal mentor would
be one who is familiar with both cultures.
If such a person is not available, then
look for someone with an abundance of
friendliness, tolerance and tact. Give mentors good orientations into the minority culture and let them know what to expect in
the way of behavior or reactions.
7. Seek their suggestions and comments.
This can give minorities a sense of
belonging to the group.
Some people may be reluctant to provide
open criticism, even in the non-threatening
environment of a focus group. So the wise
executive will provide a system for employees to make comments and suggestions
anonymously. That way, you get the benefit
of feedback and nobody loses face.
8. Maintain cultural profiles.
If a number of different cultures are represented in your work force, it might be
helpful to prepare cultural profiles for each
employee from a minority culture.
Make this profile a part of the employee's
personnel records. The profile might contain
information on language, religion, food customs or restrictions, the political system in the
homeland, national and religious holidays,
and customs that might affect work habits.
Diversity has always been a part of our
national strength. You can make it a part of
your corporate strength, too.

our cultural diversity is a reflection of global diversity on a grand national scale.
The 30 million African-Americans
among us outnumber the populations of 42
of the 47 countries on the African continent.
Only four countries in Latin America
have populations greater than the Hispanic
population of the United States, which now
numbers 22.5 million people.
Non-Hispanic whites still constitute the
majority of the American population, but at
some point during the 21st century, they will
simply be the largest of several minorities.
The growing diversity in the work force
poses many challenges for employers. The
language barrier is an obvious one.
In many cases, companies have found it
advantageous to offer their employees courses
in English as a second language. The
Honeywell Corporation instituted English-language courses for the Vietnamese, Laotians
and Cambodians in its Minneapolis work
force; it also provided instruction in Asian languages for its American-born personnel.
One way to establish lines of communication with other cultural groups is to organize special-interest groups for ethnics
within the work force. You then can meet
with them and let them tell you about their
problems and concerns.
Remember that people from different
backgrounds send and receive messages
through cultural filters.
I've learned that words, expressions and gestures that mean one thing in a given culture
may mean something else in another culture.
A term that may seem perfectly harmless
to you may be offensive to someone from
another ethnic group. A gesture that may be
offensive to you may be a friendly communication to someone from another culture.
How can we know what to do and say
when dealing with people of other ethnic
and cultural groups?
First, find out what terms and expressions
are offensive to minority ears. Avoid slang
words that refer to people of different
racial, ethnic or national minorities. Don't
use them, even in joking. English is a precise language, but it is perceived as blunt by
many speakers of other languages.
Americans often pride themselves on
"straight talk" and "telling it like it is." This
is a turn-off to Japanese workers, who practice "ishin-denshin" — communication by
the heart.
To the Japanese, the truth lies in the
things you imply, and is not openly stated.
Vagueness is preferred to precision. If
you're too explicit with the Japanese, they
take that as the mark of a know-it-all.
"Saving face" is an important consideration
in some cultures, and this may influence the
way people respond to you. If you say "Do you
understand?" to someone from an Asian culture,
you may get a polite "yes" when the employee
has no idea what you're talking about.
If they say "No," it can only mean one of
two things to many Asians: They're too dense
to comprehend or you are a poor instructor.
In such cases, it's important to watch the
face. It's hard to disguise puzzlement, and
it's usually easy enough to tell whether the
face comprehends.
Here are some other suggestions for dealing with multi-cultural challenges in the
work place:
1. Ask for feedback.
If your listener repeats what you've said
exactly in your words, you probably didn't get
through.
2. Listen for questions.
