Message from the President
This is to formally confirm my decision to retire as president and CEO of our state association on June 30, 2011.
Sustained by your wonderful support and with the encouragement of your worthy predecessors, I’ve had the great privilege of serving NYSBA and the radio and television broadcasters as well as our Associate members of this great Empire State for over 30 years.
It has been, in so many ways, a remarkable journey and I have only you and your fellow
Board members over the years to thank for it.
During the last four decades, NYSBA has become a major and respected player in the
affairs of New York State, all the while never losing sight of our essential Mission to protect,
defend and save the valuable instruments of communication which are in your care.
Our state association has also become a national model for enlightened advocacy on the great overarching
societal issues which affect our listeners and viewers – and all of us as citizens.
We have never hesitated to invest our resources and influence in many worthy causes and significant issues
quite removed from our own purses and parochial interests.
Free speech matters and the preservation of our First Amendment freedoms have always taken precedence
over pocketbook issues.
And by doing so, NYSBA has earned considerable respect in civic, educational, governmental, judicial and
public service circles as much more than an “industry lobby.” We’ve never forgotten that we are truly “at the
People’s Business.” And that pleases me.
One of our most significant accomplishments – and I hope future generations of broadcasters and the academics who study our profession will concur – was our completion of the 50 year history of the Association
titled appropriately: “Serving Our Communities.”
I am especially pleased with our success in securing sales tax relief on broadcast equipment as well as leading the fight – still not yet over – to allow cameras and microphones in the courtroom and in the halls of justice.
With it all, we have achieved a great many legislative and regulatory successes which have benefited our profession and strengthened our industry. And thanks to your generous contribution of airtime to our NCSA program, we are fortified by a substantial Reserve for future battles.
Our Association has always provided our Members with a sense of purpose and a sense of unity. We have
spoken resolutely and clearly and with great purpose and resolve – on fundamental issues.
NYSBA’s voice, your voice, is heard here in New York and in the halls of the Legislature, in judicial circles and
the Executive Branch. We have also been in the front ranks concerning national matters before Congress, the
FCC and a host of other regulatory authorities.
Be assured that although it is my intention to relinquish my day to day duties, I will be available to the Board
and our members on any and all matters in which I might be able to contribute. I also look forward to assisting
my successor with a smooth transition.
I also want to thank and acknowledge the support of our dedicated staff of professionals; Mary Anne, Dick,
Sandy and Carolyn who have made it a joy to come to work each day.
As I look back over our work of the last 30 years, by far the most satisfactory aspect – for me – has been the
many hundreds of friendships that have resulted from our long association.
NYSBA has also been the spawning ground for some of the most profound and meaningful relationships –
professional and personal – that many of us treasure.
So many of you have told me that of all your professional affiliations … NYSBA has been among the most significant and meaningful.
Please allow me to also thank you for your kindness to me personally and to my late wife Carol, among
whose passion was NYSBA … and also for the friendship you have bestowed on Lydia.
It has been a privilege to amplify your voice and an honor to carry your banner aloft …

For our TV members, there are plenty of new ondemand trainings being produced to respond to your
unique sales challenges and opportunities. In fact,

NYSBA Hall of Fame - 2010
Five more New York State broadcasters will be
inducted into the NYSBA Hall of Fame next year.
Ballots will be mailed to all New York State broadcasters. Candidates shall have worked in New York
State broadcasting or an associated professional
field. The NYSBA Hall of Fame will recognize individuals who have made a significant contribution to
broadcasting in the State of New York. All disciplines will qualify for consideration including ownership, management, news, engineering, production,
sales, promotion, on-air, programming and creative
services.

“This vehicle gives us a long overdue opportunity
to salute broadcast leadership statewide. It recognizes individuals who have made a significant contribution to the fields of radio and television broadcasting,” said Ed Levine of Galaxy Communications,
Chairman of the Hall of Fame Committee.
The Hall of Fame is open to individuals in all
aspects of the broadcasting industry including ownership, management, news, engineering, production,
sales, promotion, on-air talent, programming, creative services or associated professional fields. The
committee also considered such factors as maintaining a geographical balance as well as service to the
New York State Broadcasters Association.

to broadcast TV news stations and networks across New York State.
NYN has been serving New York State
broadcasters and the major networks for
over four decades. What began in 1967 with
a terrestrial microwave system among PBS
affiliates and SUNY campuses, later
emerged as SUNYSAT satellite transmission services in 1988. Today New York Network maintains an active teleport with
mobile uplinking services.
In recent years, NYN has partnered with
NYSBA on the NCSA program, helping to
expand citizen outreach efforts of NYS
agencies using non-commercial television
announcements. We’ve worked with
NYSBA’s leadership to webcast training
programs for member station sales staff,
and again this year we televised the
NYSBA awards ceremony at the Annual
Summer Conference.
From live telecasts of every Governor’s
“State of the State” and newsfeeds to the
daily NYS Lottery drawings and State
Emergency Management office’s EBS
alerts, NYN continues to serve clients in
state government and the citizenry of New
York State with satellite uplink services.
Today New York Network is integrating
broadcast services with the latest in web
technologies to make way for the next wave
of integrated transmission services. Rich
media via the web, enterprise level media
management and IP via satellite are part of
NYN’s expanding services to meet the
emerging needs.
New York Network is at the center of the legislative news in
Albany with crews, studios, fixed-base and mobile uplinking.

of news activity as a new governor and several new legislators take seats in their
respective chambers. NYN will continue to

The Forty-Fourth Awards for Excellence in Broadcasting

he NYSBA held its member awards competition for excellence in broadcasting this past summer. The
competition encourages professional performance and recognizes outstanding achievement among radio
and television stations in our state. The judging was done by the Missouri Broadcasters Association.
Judging is by market size, there are three separate competitive classifications; stations compete only with
others in the same color group. Red group (NYC stations), Blue Group (Albany, Schenectady, Troy,
Syracuse, Long Island, Rochester and Buffalo) and the Green Group (All other stations).

vigorously opposing the idea of a spectrum “giveback” because all of that spectrum is being, or will
soon be, put to efficient and effective use in the
public interest.
ur Nation’s free, local, ubiquitous, over-the-air
O
radio and television broadcast industry is just
beginning to see some light at the end of this
Great Recession tunnel. At the same time, the
broadcast industry is working hard to counter the
audience and advertiser fragmentation occasioned
by new technologies, the prospect of a “performance tax” on music radio stations, efforts to undermine television stations’ retransmission consent
rights, the “take-back” of valuable television spectrum, the risk of increased interference to the television reception due to FCC’s “white spaces” decision, and other initiatives that unduly burden
their broadcast operations.
Perhaps because it has been preoccupied with
the policy issues surrounding broadband and Net
Neutrality, the Commission has not grappled with
a number of issues that, depending upon how they
are finally resolved, could adversely affect broadcasters. The broadcast industry remains concerned that the FCC’s recent, initial “white spaces”
decision will have the effect of introducing millions
of personal devices that actually interfere with
over-the-air television reception, without any effective regulatory ability to identify the users of those
devices and shut them down.
On Capitol Hill, the NAB and the State Broadcasters Associations, including importantly The
New York State Broadcasters Association, have
done an outstanding job educating Members of
Congress and Senators as to the inappropriateness
of a “performance tax” and the substantial adverse
effects of such a “tax” on the radio broadcast industry and the public the industry serves. The leadership in Congress should be pleased with the very
constructive approach that the NAB is taking on
behalf of the radio broadcast industry.
On the content side of the ledger, the federal
courts continue to weigh the First Amendment
rights of broadcasters against the anti-obscenity/
indecency laws. It is clear that the FCC’s past
enforcement has chilled those rights and increased
the risk that over-the-air broadcasting will lose the
best and brightest of its writers and producers to
other distribution technologies whose First Amendment rights are viewed as more robust. Before the
FCC, there are pending a variety of proceedings
that could burden broadcasters as well as chill
their First Amendment rights. For example, the
use of FCC Form 355 would require television stations to engage in the burdensome tabulation of
tens of thousands of on-air minutes, and the hairsplitting differentiation of many different types of
programming and content within such programming. Under the FCC’s localism proceeding, the
FCC is considering requiring stations to maintain
main studios within their communities of license
even though stations are otherwise in compliance
with the existing main studio rules.
In support of the current retransmission consent
system established years ago by the Congress, the
NAB, the State Associations, the networks and
their affiliates, and others continue to make these
compelling points: retransmission consent is critical to the viability and vitality of the free, local,
over-the-air television broadcast industry, and the
retransmission consent process established by Congress and enforced by the FCC is not broken, and
thus there is no need to fix it.
The issue of deployment of broadband has been
a focus of the FCC during much of 2010. One idea
that has emerged from that review is the notion
that a substantial amount of television spectrum
should be freed up for broadband. Again under the
leadership of the NAB and with the help of the
State Associations as well as the networks and
their affiliates and station groups, the industry is

in Syracuse took second place for creating entertaining presentations about digital advertising
during his stations’ weekly sales meetings, leading to increased interest in and higher sales for
digital opportunities.

Each attendee was nominated by their managers for their success in digital sales, as well as
for acting as an evangelist for their station’s overall digital sales efforts.
Lesley McKinney from 7 News/Fox 28 in
Watertown won third place for her ugliest couch
contest involving broadcast promotion, photo submissions and online voting by viewers.
“The event was fantastic. Bottom line, it was
one of the best interactive events I’ve attended
and everyone there received a great deal of new
industry information, encouragement, and sales
ideas,” shared Nathan Kauffman from WHEC-TV
in Rochester.
Deborah Esayian, Co-Founder of Emmis Interactive held attendees captivated during two sessions as she shared case study after case study of
successful integrated broadcast and digital advertising campaigns.
John Lim, CEO of Mobile Card Cast, based in
Tarrytown kicked off the event with a keynote
address at the welcome luncheon. As more and
more broadcasters take advantage of this growing
sales opportunity he advises, “There are a lot of
misconceptions surrounding mobile capabilities
and unfortunately, many mobile vendors aren’t
looking out for the best interests of broadcasters,
so it’s crucial for radio and TV stations to do their
homework before teaming up with the right
mobile provider.”
The second day of the conference focused on
the complexities of sales management faced with
selling broadcast, online and now mobile. David
Widmer, President of Long Island Radio and past
Chairman of NYSBA; Pete Conti, SVP at Borrell
Associates and Mike Aronow, Vice President of
Digital Sales at CBS Radio shared their views on
challenges facing broadcast sales managers in a
panel discussion.
Sales ideas were flying around during the “Digital Sales Pitch Contest.” Each attendee had the
opportunity to share a new advertising opportunity, a new tool or technique for improving sales
or a new management approach to empower AEs.

sell digital media without selling it based on
impressions.

The Challenge of 2011
hoever is at New York’s helm come January
1, 2011 faces one hell of a challenge:
returning New York State to its former glory.
The winners of November’s elections must work
to overcome the numerous obstacles facing the
State, including its precarious fiscal condition,
the continuous State legislative turmoil, and the
public’s condemnation of political dysfunction.

Assembly Speaker Sheldon Silver’s strong hold
on the Assembly will continue in 2011. Even if
the Republicans peck away at his 108-42 majority
in November, it will not be enough to penetrate
the Speaker’s armor. However, the Speaker’s
relationship with the incoming Governor may
cause a chink. Published reports indicate no love
lost between gubernatorial hopeful Attorney General Andrew Cuomo and the Assembly Speaker.
Also, Republican candidate Carl Paladino’s plan
to bring a baseball bat to Albany to deal with
Speaker Silver has been widely publicized.
NY’s Fiscal Backdrop: The good news is that
New York closed the first half of the fiscal year
with a positive General Fund balance of over
$500 million. The bad news is that, according to
State Comptroller Thomas DiNapoli, New York’s
General Fund has maintained a negative daily
cash balance every day since the beginning of
September and the State has delayed more than
$3 billion in payments out of concern for its cash
position. In addition, the Division of the Budget
has begun implementing a plan to reduce local
assistance payments because the federal Medicaid payments were less than budgeted. Hospitals, nursing homes, local service agencies – anyone providing services for New York State – will
be receiving 1 percent less than anticipated.
Regardless of November’s individual outcomes,
the Legislature as a whole must step up to
deliver a balanced, responsible fiscal plan for the
State.
Comptroller/Attorney General Races.
Incumbent Comptroller Thomas DiNapoli battles
Republican candidate Harry Wilson and the
specter of disgraced former Comptroller Alan
Hevesi in his bid to continue to guide the New
York’s investment interests.
The responsibility for New York’s rise from fiscal insolvency will be placed squarely on the winners of November’s elections.
The coming year may bring significant changes
in the role of the State Comptroller, in an effort
to restore the public trust.
NYS Legislature. Recent poll results indicate
that the State Senate, where the Democrats hold
a 32-30 majority, could swing back to the Republicans in January. Republicans are making significant inroads in two marginal races (Long Island
and Watertown) potentially swapping the razorthin majority.
The winner of the State Attorney General race
– Senator Eric Schneiderman or Staten Island
District Attorney Danny Donovan – will play an
intrinsic role in the rebranding of Albany politics
in 2011.
National. Democratic incumbents Charles
Schumer, Kirsten Gillibrand, and Scott Murphy
must battle New York’s growing anti-incumbent
sentiment to return to Washington in 2011. The
successful candidates must continue New York’s
fight to secure federal funding to stem the downward fiscal spiral.
Given the resulting “slight” majority – whether
it be a Democrat or a Republican majority – party
unity will be key in 2011. With Senator Pedro
Espada’s loss in the September primary, Democrat unity may be less elusive in 2011 than in
previous years. But pending indictments and
federal investigations threaten other members of
the Democratic Senate. Meanwhile, Senate
Minority Leader Dean Skelos has a unified
Republican coalition, but he first must win the
vulnerable seats to regain the majority. To win in
November the Republicans must seize New York’s
