Certification of Eligible Candidates

Greg Guisti, Department Head, UC Cooperative Extension
Mr. Guisti informed the Commission that there is a current vacant posit ion for Office Service s
Supervisor within his department. After interviewi ng the five names on the certif ication list an d
determining that none of the candid ates met the Departme nt’s needs, he requested additional
names. Hu man Resou rces decline d, siting Civil Serv ice rule VII, section 2, B Certification of
Candidates.
Mr. Losak, County Council, advised the Commission that the entire premise of the Civil Service
system is t hat applican ts are certified based on receiving the highest scores. Ms. Cranmer
provided information regarding the certification process for the Commission.
Ms. Weselsky, provided clarificat ion that the Of fice Services Supervisor is a support position
used by many depart ments county wide an d therefore has a broad job description. Th
e
Certification List in que stion has in dividuals who have the basic skill set to succe ed, with the
training provided in the probationary period.
Commissioner Feth-Michel asked w hat the prot ocol was if the Department Head didn’t feel the
class spe cification or exams fit the department needs. Ms. Cranmer stated that a ccording to
CSC Rule III, the Dep artment He ad is aske d to attach a job description spe
cific to the
department when submitting a staffing request. But exams can not be changed every time to be
specific to individual departments, and are left broad within the scope of the job.
Discussion ensued with the Commi ssion que stioning whether granting a variance t o the Civil
Service rules as request ed by Mr. Guisti was appropriate as opposed to using the p robationary
period as defined in Civil Service rules.
COMMISSION ACTION: Upon motion by Commissioner Harden, seco nded by Commissioner
Poplawski, and carried (5/0); IT IS SO ORDERED that the Department s request fo r a variance
of the certification be denied.

Application Appeal – Facility Project Specialist I – Lewis
You have before you an appeal from Michael Lewis, applicant for Facility Project Specialist I. The
applicant’s application was screened in accordance with Civil Service Rule IV; Section 2.C and was
subsequently disqualified in accordance with Rule IV, Section 3.A(1), for failing to demonstrate
possession of the minimum qualifications for the class.
Pursuant to Civil Service Rule IV, Section 3.B, the applicant filed a written appeal for the
disqualification from the recruitment.
Facility Project Specialists manage the County’s capital improvement and construction projects from
inception to completion, including, ensuring projects are constructed in accordance with plans and
specifications, the public contract code, and prudent construction project management procedures.
Performing space assessments and financial and administrative studies related to capital improvement
projects, exercise technical and functional supervision of contractors, consultants and support
personnel.
This classification requires an equivalent to graduation from an accredited four-year college or
university with major coursework on construction management, facilities planning, engineering
administrations, construction technology or closely related field. This classification allows experience
to be substituted for up to two years of the education at a rate of two years of experience to one year
of education. Additionally, the Facility Project Specialist I requires four (4) years of progressively
responsible experience in construction project management and capital projects planning; managing
the construction and design of small to moderate size capital improvement and construction projects,
($50,000 - $300,000).
Mr. Lewis did indicate possession of a High School Diploma and some college, but did not provide
degree information or number of units or specific college coursework. The class specification clearly
states the requirements are the equivalent to graduation from an accredited four-year college and the
substitution of experience is for up to two (2) years of the education. While Mr. Lewis has
demonstrated four (4) years of experience to substitute for (up to) two (2) years of education and the
four (4) years of progressively responsible experience, he has failed to demonstrate the required two
years of college-level education (Associate’s degree or equivalent in course units).
Applicant Pool
The applicant pool from this open recruitment consisted of 23 applications; 12 of which were
disqualified for lack of possession of minimum requirements; 11 applicants were accepted for
examination.
Recommendation

as that "two years field experience equals one year of college”. At no time in job description does it
state 'a college degree' is required (possibly inferred, but not required), as such I would submit that my
experience more than fulfills the requirement for this entry level position as described in the Job
Summary, Distinguishing Characteristics and Duties listed in the recruitment. While this may seem to be
a legal technicality, it is extremely relevant in this case.
As my resume demonstrates, I have worked in the construction field for over 28 years. I have extensive
experience managing projects, planning, scheduling and budgeting. By using my knowledge of
construction methods, was able to get the jobs done on or under budget. I have participated in projects
from assembling specifications, validating conceptual design through breaking ground, setting

You have be fore you an appeal of exam ination from Or ell Massey , exam inee for Sheriff’ s Sergeant
examination conducted on February 4, 2014. Pursuant to Civil Service Rule V.5.D, Mr. Massey filed a
written appeal within five (5) calendar day s of re ceiving notific ation of his passing exam score and
ranking on the eligibility list. Examinees may appeal on the grounds of:
a) Erroneous scoring of examination.
b) Unfair or improper conduct of examination.
c) Fraud, bias, or error in rating resulting from
physical or medical examination.

Mr. Massey has appealed on item a) Erroneous scoring of examination.
As stated in his appeal (attached), Mr. Massey
h as appealed for not receiving Veteran’ s Preference
points in his final passing score. Mr. Massey did no t submit form DD214, as stated on the application
(see page 2 of Mr. Massey ’s applic ation attached ), nor di d he subm it hi s DD214 on or by the
examination date of February 2, 2 014, as required b y Civil Service Rule IV, Section 4.A. Mr. Massey
did not submit his DD214 with his appeal dated February 13, 2014. However, it was received by Human
Resources on February 18, 2014.
After review of the appeal and the corresponding ap plication processes and Civil Service rules, HR was
unable to substantiate an d grant Mr. Massey ’s app eal of erroneous scoring in the exa mination. See
attached response to Mr. Massey, dated March 12, 2014.
Recommendation
It is respectfull y requested that you uphold the denial of Mr. Massey’s appeal of Sheri ff’s Sergeant
examination.
