ORDINANCE 99-8622
AN ORDINANCE AMENDING SECTION 1.2 OF THE CHARTER OF THE CITY OF NAPLES,
FLORIDA, IN ORDER TO ANNEX A 319.67-ACRE PARCEL, LOCATED AT 4001 GOODLETTEFRANK ROAD, MORE PARTICULARLY DESCRIBED HEREIN, AND TO REDEFINE THE BOUNDARIES
OF THE CITY OF NAPLES TO INCLUDE SAID PROPERTY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Chapter 171.044 of the Florida Statutes allows owners of real
property in an unincorporated area of a county which is
contiguous to a municipality and reasonabl ,, compact to petition
to annex into the City; and
WHEREAS, Royal Poinciana Golf Club, Inc., owner of the subject 319.67-acre
parcel, has petitioned to annex into the City in accordance with
Chapter 171.044 of the Florida Statutes; and
WHEREAS, Contemporaneous with annexation of the subject property into the
City of Naples, Royal Poinciana Golf Club, Inc. and the City of
Naples will enter into a Development Agreement; and
WHEREAS, following a public hearing, the Planning Advisory Board has
considered the recommendation of the staff and the public input
and has recommended by a vote of 6 to 0 that Voluntary Annexation
Petition 99-AX3 be approved; and
WHEREAS, after considering the recommendation of the Planning Advisory
Board and City staff, following a public hearing on the subject,
and providing the petitioner an opportunity to speak, the City
Council has determined that the petition should be granted;
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NAPLES, FLORIDA:
Section 1. That the 319.67-acre parcel, located at 4001 Goodlette-Frank
Road, more particularly described on the attached Exhibit "A", is
hereby annexed to the City of Naples.
Section 2. That Section 1.2 of the Charter of the City of Naples is hereby
amended to include within the described boundaries of the City
that property legally described in Exhibit "B", attached hereto
and incorporated herein.
Section 3. The City Clerk is hereby directed to forward a certified copy of
this ordinance to the Circuit Court Clerk and the Department of
State.
Section 4. The City Clerk is hereby directed to publish notice of the
annexation in the newspaper once a week for two consecutive
weeks.
Section 5. This ordinance shall take effect immediately upon adoption at
second reading.
