Board of Directors
The Board of Directors received and accepted
a letter of resignation from Director Patrick
McCarthy. The Board awarded Patrick with the
Emeritus status for his years of service on the
Board. Mahalo Patrick for all your service, you
will be sorely missed.
At the January meeting, the Board requested
nominations for consideration to fulfill the
remaining two years of Patrick’s term. Three
nominations were received and two interviews
conducted in person. Past nominations were
reviewed, and one telephone interview was
conducted. E. John Carlson was selected and he
accepted appointment to the Board.
The January election retained incumbents for
each building. Please read the minutes for the
full results found on page 3 of the Annual
Meeting minutes.

What is our Return on Investment for Solar?
There was no upfront cost to the Association. An investor
provided the upfront costs for the photovoltaic system, new
roofs and all installation. We have an active Power Purchase
Agreement with the option to purchase after the first 13 years.
Our energy expense has decreased by $160,000 from August
2013 to December 2015, an average of $5,500 per month.

The year is off to a great start with the recent recognitions the resort
has received.
Lawai Beach Resort received the Hawaii Magazine Readers Choice
Awards Best of Hawaii in the top 15 Best Timeshare Vacation
Properties. In the March/April 2016 Timesharing Today, we rank #5
in the top 25 Independent Resort resales. AWESOME!
We completed installation of the new ranges, dishwashers, washers
and dryers in Alii. The over the range microwaves will be installed
over the next few months. Painting of the railings on the lanais and
exterior hallways were approved at the January meeting. This has been
scheduled to begin on March 21st and will continue over the next few
months. YAY!
The Banyan renovations continue with 40 units completed. The
delivery and installation of the new washers & dryers are complete,
with the exception of the ADA units. New entertainment centers were
approved and ordered for the Executive Suites.
Did I mention there was a multitude of projects at Coral? Here we go:
kitchen light fixtures were replaced in 28 units, tile replacement
completed in 13 units, installation of 47 out of 50 ranges completed,
3 units received new overhead kitchen cabinets and over the range
microwaves, and 3 units are sporting the new wall color scheme.
Engineering is working on installing grab bars in the Lika Lani new
showers. We completed installation of the new dishwashers, washers
and dryers. Due to a continued problem with the west side hedge, we
will replace it with a chain link fence. The Star of Jasmine vines will
be planted for continuity with the front of Lika Lani. And we are nearly
completed with the solar project, just awaiting the final approval from
Kauai Island Utility Cooperative.
The winter Verti-cut of the resort lawns had many owners concerned
with the browning that occurred. I am glad to report, the green is back
and it is hearty! The lawns and gardens continue to flourish under the
direction of Wesley Pagador. Our landscaping team has been very busy
with the recent high winds blowing leaves throughout the property, and
after they just cleaned the parking lots!
An offsite storage was recently obtained for renovation supplies,
allowing the clearance of more parking spaces.

We notice that there is a huge flock of birds that roost in our
coconut trees every night. What are they and where did they
come from?
They are wild Rose Ring Parakeets. This flock arrived in our area
in September 2015 and has not left since. We have trimmed our
coconut trees back to prevent them from roosting to no avail.
We continue to research options to get them to move on. These
parakeets are a popular pet and though it is illegal to release any
non-native animal into the wild, it has obviously been done.
Hawaii’s invasive species problem is the most severe of any
State.

Buying a Foreclosure

We have our few weeks every year, and we would like to pick up one more for the Kids, Grandkids, Mother-in-Law, or for us to be gone
from them a week more every year!
We all are familiar with traditional real estate services, and there are some really good ones on Kauai, including Jeff right here on the
property.
In simple terms, traditional agent involved real estate purchases put a willing seller and a willing buyer together along with the agent’s
expertise to make the transaction as safe, legally compliant and smooth as possible. If issues come up during the process, the agent is there
to provide advice and support, and is paid a commission for his time.
This has worked countless times with everything from timeshares to multi-billion dollar properties, probably since the first family needed
a bigger cave for their growing family!
However, there is another way here at Lawai Beach Resort that has a potential advantage to the buyer (purchase price) and definitely for
the resort (getting the unit back to an owner who will pay the annual maintenance fees)
That would be buying a week from the annual foreclosure auction.
You see, every year LBR forecloses on weeks owned by people, trusts, and estates etc. who for various reasons have stopped paying
the annual maintenance fees. The proportionate costs for these units become the responsibility of the Associations, since there is no
responsible party paying them, thus foreclosure is pursued.
My point is that when one buys from a foreclosure auction, the Associations begin to collect the maintenance fees once again, reducing the
burden on the rest of us. If you buy through the traditional real estate process, a seller who is current, sells to a buyer who remains current,
which is good, but we still have the weeks that produce zero income.
So how do we buy a foreclosure week? Here’s how:

Consult the list when it is published on the resort website, usually early in the new calendar year.
Identify the building and frequency (E/O-odd-even or EY-every year) that you might be interested in.
Note the minimum bid, which is the total of delinquent fees etc.
Do some homework, and determine what the fair market value is for the week you are interested in.
Decide on your maximum price for a single offering, and go get a cashiers check made out to “Old Republic Title & Escrow”
Write to Malia Freitas (and include your check) and tell her what you are interested in (a phone call first may be a good idea too).
Malia can represent you on the foreclosure process by presenting your offer with your maximum bid at the actual foreclosure sale administered by the foreclosure commissioner.
Malia can only represent one owner for each property on the listing, so get your check and request into her as soon as possible before the sale date.
Your work is done, and now all you have to do is dream about your newest week in paradise!
If you are the successful bidder, Malia will contact you a few days after the sale date (there are hundreds of sales from all over the island
transacted that day, so be patient)
You will soon know your actual purchase price, will need to decide on whether to buy title insurance (cost: $275) and then need to wait for
as much as six to seven weeks for the Title company to process your transaction.
Old Republic will work with resort staff to get the deed transferred to your name, and when that is completed, you will be able to reserve
your new week using the usual reservation process. Just remember that for the first year or two, the most popular months are reserved up
to 2 years in advance, so it’s kind of “catch as catch can” for a while until you get synchronized with the 2 years out (midnight emails).
And remember, the first year or two make great opportunities for exchange weeks all over the world, perhaps a “cooler” idea than Kauai in
August.

Hanapepe Relay for Life
The American Cancer Society Relay For Life is a life-changing event that gives everyone in communities
across the globe a chance to celebrate the lives of people who have battled cancer, remember loved ones lost,
and fight back against the disease. At Relay, teams of people camp out at a local high school, park, or
fairground and take turns walking or running around a track or path. Each team is asked to have a
representative on the track at all times during the event. Because cancer never sleeps, Relays are overnight

Celebration Festival in Lihue at Rice Street and Historic County Building
Lawn - Fabulous Floral Parade event with traditional Pa'u riders representing each
island, Hawaiian organizations in full regalia, the Kamehameha Court led by Ali'i
Nui Pa'u Marshall Grand Marshall Pa'u Queen. All starting at the Vidinha Stadium
near the airport and traveling up Rice Street to the County's Historical Building Lawn
where there will be entertainment, crafts, demonstrations and lots of food and fun.
Please join us in celebrating our Hawaiian Heritage. Parade starts at 9:00am at the
Vidinha Stadium and proceeds up Rice Street. Hoolaule'a at the Historical Building

Kauai Hospice Concert in the Sky
The Kauai Hospice Annual Concert in the Sky on July 4 at Vidinha Stadium, will again be the largest 1 day event on
Kauai. Over 6,000 people are expected to attend and that of the ticketed attendees, 40% will be visitors from out of state.
The event will provide both visitors and residents with a local style Independence Day celebration with Hawaiian
entertainment by local musicians and halau dancers. This event will be a shining example of the kind of event that public/
private partnerships can achieve. It will provide opportunities for interaction between residents and visitors with a unique
experience as this is the largest aerial fireworks event on Kauai on the 4th of July. Visitors will get to celebrate our
