Philippine Fiesta

The Philippine Fiesta of Victoria Inc
( PF V I ), led by it s Cha i r person Ross
Manuel and his Committee of Management (COM), filed a third party court
notice against The Philippine Times
(TPT) in relation to the defamation case
filed against the Fiesta by the plaintiff,
the Concerned Members of Philippine
Fiesta of Victoria (Concerned Members).
In the August 2013 edition of TPT,
the letter of Fiesta’s former lawyer Ian
Finch was printed detailing his response to TPT’s queries about the expulsion of PFVI’s 16 members and the
selling of the Laverton property. The Fiesta (the defendant in the case) argued
that the printing of the said article in
both the print and online
publications was published
w it hout Ma nuel a nd h is
COM ’s ex pr essed consent. Hence, if the article
did constitute an injurious falsehood and caused
loss a nd da mage to t he
C onc e r ne d M e m b e r s, T P T
should indemnify the Fiesta
for the legal costs to pay the
Concerned Members.

Ilonggo Association marks 30th anniversary
A fitting backdrop to its
annual Mother’s Day gala
dinner at the Grand Star
Receptions in Altona on 14
May, the Ilonggo Association of Victoria Inc (IAVI)
marked its 30 years of active community service
in Victoria. Five hundred
fifteen supporters, guests,
friends and community
representatives attended
the event. IAVI President Melvin
Espiga welcomed everyone and gave them the
latest good news on the
Association’s projects and
partnerships with other organisations in Australia and
the Philippines. One of the
highlights this year is the
formation of a younger(ish)
group, the Group of Ilonggo
Young Adults (GIYA) that
will cater to the activities
of youth and young adults. Philippine Honorary
Consul to Victoria, Felix
Pintado graced the event
with a short inspirational
message highlighting the
value and enduring love of
mothers. Michelle Trifeletti and Jerson Trinidad
rendered a number of very
fitting song for the occasion and Matthew Fabbianno and Kristina Flores
showcased their talent in
ballroom dancing. Past presidents were honoured on the night for their
valuable contributions.
There were prizes, raffles
and lots of dancing for the
guests. The masters of ceremony were Nenette Wallis
and Dominic Lobriza, both
officers of the club. It was an enjoyable night
and the guests gave the
organising committee a big
round of applause for their
commitment and job well
done. The Ilonggo Association will hold its annual
Father’s Day celebration in
September.

in our own issue. The Philippine Fiesta of
Victoria Inc (PFVI) filed a third party notice
against The Philippine Times in view of the
defamation case filed by the Concerned
Members of the PFVI against PFVI. The
PFVI argued that the publication of a response by their then lawyer Ian Finch to
questions regarding the expulsion of the 16
Concerned Members and the selling of the
Laverton property in the print and online
editions of TPT did not have the expressed
consent of Ross Manuel, PFVI Chair and his
Committee of Management (COM).
Manuel and his COM said that if the article
would be found to cause damage to the PFVI
and they lose the case brought by the Concerned Members, then TPT should indemnify
the PFVI to pay the Concerned Members.
We will not use this space to defend our
cause, because there will be appropriate
bodies to discuss the matter. However,
we will invoke our right to freedom of
the press and the right of our audience to
know the truth. We will not be cowed to
ask the questions, answers of which the
community deserves to know.
We will continue to give our readers a
comprehensive view of issues by presenting the different sides of the story. Like
those who are genuinely concerned and
supportive of the community, we will be
vigilant in watching the developments in
our community. We will present a comprehensive report to give everyone a fair
chance to air his or her side of the story.
We will be cheerleaders when our community members attain great achievement or
make a significant contribution to society,
but we will also be the watchdog to expose
corruption, wrongdoing and unethical and
immoral behaviour.
Equally important in delivering the
truth is affording our audience a wide
spectrum of viewpoints from across all
walks of life. We may have differing
opinions as far as religion, lifestyles
and views on success are concerned, we
should be open to listening to stories
and learning from people on the opposite side of the road treading a different
path. Just because they do not share our
views on life makes theirs invalid. That’s
the beauty of a multicultural society. We
get to experience life in so many levels
by interacting with them, or just simply
vicariously living their lives by reading
about them.
The Philippine Times is your ally in sharing the Filipino story—the good, the bad

truth in our pages, and a hefty allocation

“The boy has grown,” says
a nearby patron as we all
eagerly look up to see Eran
James enter the room. I
pause between mouthfuls
of food and watch as the
soul and blues singer make
his way across the candlelit
space, past the dining area
to the stage. He’s taller,
broadly shouldered, and
stubble covering his face.
He doesn’t walk but saunters.
“Is that him?,” asks Jenni, pointing discreetly with
her eyes.
“Yes, the one and only.”
It’s late Wednesday evening. Away from the warm
confines of home, braving
the cold, the two of us are
enjoying wine with a generous degustation dinner at a
city laneway bar. We aren’t
the only ones to do so with
many others seated around
the room. All here to hear
Eran sing.
I became a fan of Eran
in the early years of 2000
when his debut album was
released to high critical acclaim. Soulful and mature,
he struck a unique sound.
One that belied his age,
then only a teenager.
Fast-forward to now and
I’m finally seeing him perform live. An opportunity
I couldn’t pass up and one
I had to share with Jenni,
seeing that we had similar
taste in music. Amongst
other things.
“He’s so much better
looking in person.”
I nod at Jenni.
“Thanks for this, by the
way.”
“What for?” my curiosity
greeted by her warm smile.
“For dragging me out to
these places. I never would
have done anything like
this.”
Jenni and I met through
work, mine not hers. A
habitual exerciser before
the crack of dawn, she

health club I used to work
at. An innocuous question
about staying around for
the club’s complimentary
breakfast one early morning led to a close friendship
that’s been through plenty.
“Sure, you have. Besides,
it’s a special occasion.
We’re celebrating your divorce and your new home.”
“Still, thanks.” We raise
our glasses and toast.
Eran steps in front of the
microphone and the room
goes quiet.
“Ain’t no sunshine when
she’s gone...”
His voice fills the room,
booming and commanding.
Jenni and I listen as Eran
infuses his own unique
style to Bill Wither’s seminal hit.
“ . . . I k n o w, I k n o w, I
know...”

begins a new song from his

“Have I ever told you
how I first clicked on that
you were gay?”
I turn to Jenni. “No, you
haven’t.”
“Well, actually I didn’t
have any clue especially
during those early days
when we had breakfast
together almost every day.
I just thought how lovely
you were and how you’d
make a great partner.”
I blush. “Oh, go on!”
“No, really! But then you
said something that planted my suspicion, which
inevitably led me to asking
you if you were.”
“What was it?”
“You were talking about
moving into your new
house and how you had a
lot that needed sorting out.
Then you said, ‘I need to
find the perfect candles for
these candelabra I’ve just
bought’. I knew from then.”
A pause.
“Candles, huh?”
“Yes. Candles.”
We look at each other,
grinning, and then both
promptly burst out in fits
of stifled giggles. Wiping
tears from my eyes, she
turns to me signing to be
quiet. She points towards
the stage. Eran is looking in
our direction, watching us
both. He smiles but keeps
on singing. I look back at
her and shake my head.
We listen to him for the
next hour as he croons and
mesmerises the crowd.
Eventually, he sings his last
song for the evening. Another soul standard, Marvin Gaye’s What’s Going
On. Eran somehow makes
it seem fresh and new.
As the applause dies
down and he steps off the
stage to mingle with the
crowd, I grin at Jenni.
“Wow.”

We sit in silence for a
little longer, soaking the
atmosphere and the performance that was. We watch
the room and the crowd.

glow of the candles, burning brightly in enclosed
glass housings placed at
every table.
“I think I know the perfect thing to get you for

“Oh,” her turn to look

“Why,” I say smiling,

of course!”
We laugh heartily and,
for the last time that evening, raise our glasses and
toast.

Melbourne’s suburbs inspire
“Comfort Zone” exhibit
The paintings in jigsaw
puzzle depicting urban
parks and landscapes of Melbourne’s westerns suburbs
line the exhibit of Edward
Puzon in his first solo show
called “Comfort Zone”. It
opened on 27 May and will
run until 26 June at Sunshine
Art Spaces, 2 City Place.
Edward drew inspiration
from these places, reminiscing the time he spent growing up and traveling around
the areas near his home and
while moving about on his
way to work. According to
Edward, “the jigsaw pattern used in the series is a
metaphor for a playful connection, as well as helping
the viewer connect to their
memories.”
Further, he says, “The purpose in exhibiting this series
is to share the suburban landscapes I found comfort in…a
comfort that no matter where
we’ve come from, there will
always be that place, that
zone, our home, a familiar
surrounding that connects
us within.”

Filipino artist Caesar Sario will showcase his paintings in an upcoming show
titled “Untamed Australia”
between 10 June and 9 July at
Hunt Club Community Arts
Centre, 775 Ballarat Road,
Deer Park.
Caesar Sario’s paintings
reflect his interest in the conservation of the environment
and our many endangered
species. He draws inspiration from the concept that
human beings are one with
nature with all species having a function and an effect
with the rest of the environment no matter how small or
futile it seems.
The work in Untamed
Australia uses oil paint applied in a decorative style to
create a sense of vastness and
movement. His inspiration
behind these works is that
man must live in harmony
with nature and that nature
will provide humankind
with what it needs.
Sario was art director for
40 years in large advertising
and publishing companies
including McCann Erick-
son and News Limited in
Australia, the Philippines
and Middle East. His works
hangs in galleries and private
collections worldwide and
he has exhibited in Australia,
Singapore, Hong Kong, the
Philippines and Middle East.
He was a Fine Arts scholar
at the University of Santo
Tomas in Manila, Philippines, He has won over 30
major awards in painting,
sculpture, poster design
and photography including
the prestigious Benavides
Award.

HAVE CHANGED?
Make your vote count this federal election.
At this year’s federal election, the way you vote
for the Senate has changed and it’s important
that you understand how to vote correctly.
If you choose to vote below the line, you must
number at least 12 boxes, from 1 to 12, for individual
candidates in the order of your choice.
On the large white Senate ballot paper, you can
choose to vote either above or below the line.
Voting for the House of Representatives has not changed.
On the green ballot paper, you must number every box,
starting with the number ‘1’ for your first choice, ‘2’ for your
second choice and so on until you have numbered every box.
If you choose to vote above the line, you now need to number
at least 6 boxes. Put the number ‘1’ in the box for the party
or group that is your first choice, a ‘2’ for your second
choice and so on until you’ve numbered at least 6 boxes.
‘How to vote’ instructions will be clearly displayed on your
ballot paper. Don’t worry if you make a mistake — just ask
for another ballot paper.

Cebuano Association marks 4th year
On the 21 st of May, the
Cebuano Association of Australia celebrated its fourth
Annual Gala Night. Held at
the Freccia Azzura Club in
Braeside, the formal event
commemorated the anniversary of the association, which
was founded four years ago.
The night kicked off with
words from the former president of the Cebuano Association, Mr. Sinforiano
‘Boy’ Lawa who presented
the newly-elected President,
Mr Harold Mollaneda, followed by the induction of
the newly-elected officers
and committee members.
The audience was entertained with a dance number
presentation by the Be Dazzle dancers which captivated
them with their take on a
traditional Filipino dance,
followed by a rock and roll
number.
As usual, the event had
a fashion show and bestdressed awards, showcasing
the beautiful ladies in their
gowns and the well-dressed
men in their suit and ties.
Overall, the night was successful, fun and entertaining for all. The association
thanks those who attended
and looks forward to seeing
more faces both new and
familiar in future events.

of every speaker especially
for an unknown author like
me, is not the fear of talking
in front of the audience, but
the possibility that no one
will be attending. Fortunately for my author talk on
the 19th of May at the Max
Webber Library Blacktown,
I had a decent audience
who came—young and old,
Christians, Muslims, and
people from all walks of
life. Shayne Bray, the chief
librarian was the one who
introduced me, and closed

went well; I was able to connect with the audience. With
humour injected a few times
during my speech, I saw and
heard their laughter. For the
serious topics discussed,
I can feel that they are all
interested and were able to
digest what I was saying.
My talk lasted for more
than an hour, 5.30 to 6.45pm,
discussing passages and significant episodes from my
two books: My Innermost
Thoughts and My Passion
My Calling. I read some chosen passages from my third
book, a novel that I am writing at present. Hopefully, it
will be released late in 2017.
Overwhelmed and humbled I felt, when after my
talk a lady who attended
my event, disclosed to me
how my books had changed
her life. She learnt to start
believing in herself.
I wish that I can continue
to reach and touch people, as
many as I can, through my
talks and through my books
and writings. Overall, I can
say that it was a successful
event.

Arise City Church
launches worship venue
The Arise City Church of
Victoria (ACCV), under the
Pastorship of Ps Ben Hadlos
and assisted by Pastors Michael Fernandez and Roger
Cortez, inaugurated their
recently-opened church facility with a well-attended
fundraising event last 21
May 2016. The church venue is located at Unit 4/21
Greens Street, Doveton.
According to Pastors Ben
and Chit Hadlos, the church
was established in December
2009 and is affiliated with
the United Baptist Church
of Victoria. It has also established a satellite Arise City
Church (Philippines) in the
province of Pampanga. The
ACCV currently counts at
least 60 regular members
during its weekly services
at 2pm every Sunday. A few
European-Australian spouses of its members also attend
the church and their number
is growing, according to Ps
Ben and Chit Hadlos.

Bringing books to the Philippines

Early this year, I noticed
an inspiring video of a man
named Nanie Guanlao in
Manila who turned his home
into a library. I contacted
WorldRemit who posted the
video on Facebook and expressed interest in donating
books to Nanie. They requested to film me and offered to
cover the cost of shipping the
500 books I collected.
The filming
In the heat of Manila’s summer, I met the WorldRemit
staff and film crew for a
briefing before the short
drive to Nanie’s library in
Barangay La Paz in Makati.
The camera captured me
and Nanie’s interactions for
the afternoon. I was quite
enthralled while listening to
his story that I forgot that I
was being filmed!
The ‘Aklatan sa Bangketa’
(sidewalk library) started
with 50 of Nanie’s own
books, which grew to the
thousands that currently fill
his double story house. It
was this path in life that Nanie followed after giving up
employment in various jobs.
In this, he experiences a deep
fulfilment simply through
giving books to others.
The beauty of books
Nanie perceives books as the
hard work of intelligent people that have recorded their
ideas, knowledge and stories
with a common purpose to be
shared. He also sees written
words in books as ‘powerful
tools’, ‘weapons’, ‘lessons’,
that are relevant in many
aspects of life.
Nanie compared the essence of his work to mine as a
librarian in Australia. He was
extremely happy to receive
donations from Yarra Plenty
Regional Library (Eltham
Library), and Penguin Books
(thanks to Julie Meredith,
Irma and Mike Modesto).
Several books were immediately distributed outside
Manila to an Aeta tribe in
Pampanga, where they were
received with tremendous
appreciation!

AMSSG holds Santacruzan
The Australian Multicultural Senior Support
Group Inc (AMSSG) was
assigned for the third consecutive year to be in charge
of the Flores de Mayo or
Santacruzan. Santacruzan
is a religious historical
beauty pageant held in
many cities, towns and even
small villages throughout
the Philippines during the
month of May. It is one of
the most colourful Maytime festivals in the Philippines. This festival was introduced by the Spaniards
in the Philippines and since
became part of the Filipino
traditions.
The procession was held
at The Holy Family Church
at Moreton Street Frankston
North on 15 May 2016. A

Excelsis holds concert
The Excelsis Choir recently staged ‘Songs for
Sanctuary’, a choral concert at St Paul’s Cathedral
on 2 April in support of the
Asylum Seeker Resource
Center.
Exelcis is a Melbournebased Catholic choir which
sings primarily for liturgical events and also gives
occasional concerts and
performances. Its repertoire is composed of sacred
music. It is a traditional four-part mixed choir
which has 42 members.
Excelsis does not sing for
a single parish but maintains a monthly rotation of
parishes in which it sings
for the Sunday Mass. Tom
Buchanan is the choir’s
conductor.

My granddaughter
brought home a balloon one
day from a kids’ party. With
delight, she watched it flew
mightily towards the ceiling.
The next day, I observed how
the balloon slowly but surely
descended until it dropped
on the floor. Within the day,
it was rendered useless so it
was popped and discarded.
We all experience “glory”
days- enthralling times
when we are on top of the
world, as a result of success,
achievement, accomplishment, victory, triumph or
celebration. During those
moments, we are high on
glee, pleasure, elation, applause, approval, enjoyment,
laughter, bliss, gratification,
“heaven on earth” jubilation.

From glory to glory
Indeed, it is a mountain top
experience.
We tend to forget that from
glory to glory has a valley
in between, the low point
where we travel down the
mountain back to ground
level. After such an awesome
event, we encounter opposition, persecution, criticism,
feedback (positive and negative), and sometimes a sadness that the event which
challenged us and planned
with excitement for months
had come to an end. The
enemy, the devil, can easily jump in to rob us of our
peace and joy, and irritate us
with guilt or regret that we
did not do things perfectly
and messed up a few steps.
We are tempted to create
another glory day immediately to re-capture our euphoria, hiding behind more
activities so we do not have
to deal with the growth area
of the previous experience.
Instead of using the down
time to reflect, be grateful
for all the blessings, rest,
restore and bring our bodies
and emotions back to a state
of balance (homeostasis), we
rush on to the next bustle.
The low time is a humbling
reminder that nothing
lasts and everything is vanity
(according to
Ecclesiastes)
and teaches us
detachment.
It reminds
us not to
be puffed
up of any
achievement
we have accomplished as everything passes away.
The last few months were
very much a learning time
for me. I asked the Lord to
deal with me with any impurity in my heart, in the area
of envy and jealousy, in the
desire to be approved and
acknowledged.
I needed to go to the Sacrament of Reconciliation to
ask forgiveness for raining
on one’s parade. I gave some
feedback that was uncalled
for, thinking I was doing
the organisers a favour, as
process of improvement.
But the Lord revealed to me
my intention
was not really
pure. I then
asked forgiveness from the
person I hurt.
It was one time
I did not really
consult the Lord
rushing into
things, as I
was won
over by my
carnal nature.
One of the ways He
showed me was to spend
more time with Him, instead
of seeking things beyond
my calling. I have always
equated serving the Lord as
a priority – thinking that it
is the better way to prove
my love for Him. But He
corrected me – spending
time in His presence comes
first and the rest is serving.
After all, the strength that I
will use to serve others must
come first from the Source.
To seek God foremost is a
much better approach than
to wait for a crisis to take
place, and then run to Him
to have it fixed.
My mom who passed
away in 2012 left this message in a card she gave to my
sister for Christmas:
Silence is at the root of our
union with God and with
one another. For the fruit of
silence is prayer, the fruit
of prayer is faith, the fruit
of faith is love; the fruit of
love is service and the fruit
of service is peace. (Mother
Theresa)
Today, I do not go out of
my home without kneeling
before God and asking Him
to anoint me. Only then can
I move on to do whatever
errands He appoints. These
jobs can be various- from
household chores, to grocery shopping, to writing,
to counselling someone,
visiting the sick, sitting with
the bereaved, organising or
emceeing an event, catching
up with friends, coping with
pain or illness, attending
meetings, caring for family members, responding to
emails, travelling on public
transport, dealing with the
plumber, walking at the
park, cooking, praying for
others, or just resting. I have
learned that these ministries
have one requirement- to do
them all with a stable heart.
Every task is indeed a divine
assignment and if done with
love and thanksgiving, they
become sacred moments.
Let the brilliant days transfigure us, and the downhill
moments renew us. From
glory to glory then becomes
a journey of peace.

A tribute to life

First Santacruzan in Meredith
Flores de Mayo (Spanish
for “flowers of May”) is a festival held in the Philippines
in the month of May. It is
one of the May devotions to
the Blessed Virgin Mary and
lasts for the entire month.
The Santacruzan (Spanish
for “holy cross”) is the ritual
pageant held on the last day
of May.
A Santacruzan was held
for the first time at St Joseph’s Church in Meredith,
Victoria on 22 May. Mass
started at 1.30pm, afterwhich a procession was held
which went around the
block of the church pushing
the Mother Mary statue on
a cart with all the Reynas/
Queens. There were dif-

ferent queens such as the
Queen of Virgins the Queen
of Charity and the Virgin
Mary and more who were
accompanied by Angels and
King Constantine, which
ended back at the church for
a final blessing. A feast and
bonding activity was held to
end a fantastic day.
The Santacruzan was organised by Fr Boy Galdo,
Imelda and Shane Ross. Two
hundred sixty people come
along on a windy Sunday
afternoon to watch and participate. Guests came from
Bendigo, Ballarat, Geelong,
Dandenong, Werribee, Hoppers Crossing, Melbourne,
Taylor’s Lake, Shelford, Colac and Winchelsea.
Waking up each day is a
celebration of life. A life of
new beginning. To be able
to cherish once again, and
enjoy life itself. It becomes
routine and normal for all of
us to wake up each day and
we have taken it for granted.
Then one day we learn that
there are those who are not
given a chance to do it all
again. Instead they have
succumbed to deep slumber, the pangs of death came
and life has been taken away
from them; leaving loved
ones, families and friends
in pain and sorrows. Let’s
appreciate each day, waking up thankful that we
are still here, enjoying the
breath of life… Let’s pray for
those who were not given a
chance to do so.
I vividly remember, during my university years, I
had a close friend. She was
petty, smart, and belonged
to a wealthy family. She
was very popular in our
engineering campus, and

being an only child she
had everything in life. On
our final exam there was
shocking news, she had
died in her sleep. We were
all devastated.
This experience made me
see life from a different perspective. Treasuring and enjoying each moment shared
with families and friends.
Before and after waking up
acknowledging and thanking God for all the blessings received for the day. I
always say “I love you” to
my loved ones, because I do
not know if there will be a
chance to say it tomorrow.
Each day, I try to do things
that I am passionate about
such as tickling the ivory
keys, writing, gardening,
and appreciating everything
that I have. At times, we
should try to help others,
especially those who need it
the most. But there will be
instances when you will get
frustrated and upset when
you are generous and people
will try to take advantage
of you, one ugly side of hu-
man nature. Indeed, we all
have our weaknesses and
imperfections. However, being aware of it and trying to
overcome it is much better
than doing nothing at all.
As the popular saying
goes, “life is too short to be
miserable,” so let’s live life

Rap-So-D
The new sensation in
Melbourne’s entertainment
Emerging into the Australian Entertainment scene
in 1989, Rap-So-D went
through a few phases. Starting as a duo, then morphing
into a sequencer based fourpiece band, Rap-So-D has
enjoyed one successful year
after another, throughout its
journey.
Once very famous The
Fawkner Club in South Yarra, Beverley Hills Club in
South Melbourne, Lats Bar
in Melbourne CBD and Peppers in Ringwood are some
of the many clubs in which
the band held long residencies. In addition to this,
Rap-So-D has performed at
hundreds of corporate functions, weddings and dinner
dances (balls), enthralling
audiences of all ages.
In 2010, Rap-So-D had a
major facelift and expanded
into a full-fledged six-piece
outfit, under the leadership
of Carl Jayasinghe. They also
invested in a state-of-the-art
sound system, digital mixers
and stage lighting, ready to
take on gigs of any size. What
followed then was the most
successful era for the band,
yet! They have now become
the most sought after dance/
party band in Melbourne.
This current outfit of RapSo-D performs for around
25 to 30 gigs a year. From
small weddings and parties
to large dinner dances with
over 500 people, they cover
them all. It costs more to hire
them than most of their competitors, but it’s money well
spent if you do book them.
The current line up of
members, all have over 30
years of experience in the
music industry. They have
all performed in many different bands, who have made
a name for themselves, over
the years. It is this wealth of
experience that you can see
coming through, when this
outfit is on stage.
What makes Rap-So-D
different from most bands is
two-fold. Firstly, their wide
repertoire that allows them
to pull out songs from the
60s, 70s, 80s and the 90s
all the way up to the current chart hits, to suit any
kind of audience, without
warning. Secondly, the fascinating stage performance
of Alli and Ash. These two

ence attention, the moment

The rising star of
the concert scene
Restless, possibly one
of the most in-demand
bands in the Filipino community in Victoria and
rocketing in popularity, has
performed its first major
show this year on 4 June at
Kindred Studios, Yarraville.
Restless is composed of
Warren Ribates (vocals),
Abe Baccay (drums), Frederick Ursua (lead guitar)
and Gabriello del Rosario
(bass). Archie Villaluz was

Attended by an audience
of more than a hundred,
the band played songs by
Eraserheads, Apo Hiking
Society, Toto and others.
They also performed two
original songs titled Halika
Na and Weather. The crowd

Stevie Wonder.
The show was produced
by AECC Global and directed by CJ Tamale.
The following week, the
band performs at the Kuatro
Kantos Konsert with three
other bands, on 11 June.
The band is performing
at the Freestyle Concert
Tour on 21 August and at
the Tiara Gala 2016 on 10

New chess club coming to Sunshine

For many years now, there
were a few members of the
Filipino community that really wanted to form a chess
club. Unfortunately, it never
materialised due to other
pressing needs.
An opportunity arose
when Danny Basobas, the
current president of the
Bandicoot Chess Club based
in Hume City, offered to assist in forming a chess club
in Sunshine, working closely
with the Hope of Life Community Church. The idea
came out that, aside from
coaching and teaching chess,
it would also be a community
outreach project.
On the 23rd of May this
year, the new Sunshine
Chess Club was born! The
club officers are as follows:
President – Ronald Enano;
Vice-President – Arnold Gabriel; Secretary – Danny
Basobas; Treasurer – Louie
de Sagun; Communications/
Promotions – Robert Midderham; and Adviser - Pastor
Rick Raimundo.
The vision of the club is to
help the members improve
their skills and get to know
the King of kings. It is open
to all ages, and the regular
session is every Saturday
at 1-3pm. There will be a
coaching session and tournaments (using shorter time
controls). There will also be
a dedicated chess tutor for
the juniors, and another tutor (four-time club champion
and three-time lightning
champion at Hobsons Bay
Chess Club) for the adults.
The club can also run a tournament with a maximum of
eighty players.
The city of Sunshine is
really going forward, and
the chess community is also
going in the same direction.
We have a vision that we
can also produce a group of
junior players in the western
suburbs who will someday
join those who dominate the
Australian chess scene.
Sunshine Chess Club will
have its inaugural opening
on the 25th of June at 1pm.
There will be a simultaneous
chess exhibition with prizes
and a sausage sizzle. The
venue is at Hope of Life Community Church, corner Watt
and Corio Streets, Sunshine.

Satisfying Schedule 3 criteria
To be forewarned is to be
forearmed. To avoid refusal,
it is important that onshore
prospective visa applicants
who are on a Bridging Visa,
or unlawful at the time
of application, should be
aware of Schedule 3 criteria
before lodging application.
One of our clients, on a
bridging visa at the time
his partner visa application
was lodged, was required
to satisfy Criterion 3004.
His previous application
for Working Holiday Visa,
which he lodged himself,
was refused for failure to
submit evidence of working
in Australia. He worked as
apple picker under a Working Holiday Visa when he
first entered Australia. He
was only paid in cash and
did not receive any pay
slip for the payment of the
services rendered. At the
time he applied for a new
Holiday Working Visa, he
was not able to submit to
the Immigration any proof
that he worked.
To satisfy Criterion 3004,
he found his employment
contract as apple picker
with his former employer
and he submitted this to
support his ongoing Partner
Visa application. He did
not violate any provision
of his visa. As a matter of
fact, he did not work after
he lodged his new Holiday
Working Visa and relied
on his fiancée for support
because as a holder of a
Bridging Visa, he was not
allowed to work.
For partner visa applications lodged within Australia, if you are not the holder
of a substantive visa at the
time of lodging your Partner
visa application, you must
satisfy additional Schedule
3 criteria 3001, 3003 and
3004, in addition to satisfying the standard Partner
Visa criteria.
Criterion 3001 states that
the applicant has 28 days to
make a new visa application after the day of holding a substantive visa, or
from the day of becoming
unlawful.
At the time of application, Schedule 3 criteria
are required for onshore
subclass 820/801 partner
visa. It does not apply to
offshore Partner Visas, and
failure to satisfy Schedule 3
does not prevent applicants
from lodging sc 309/100
Partner application outside
Australia.
Schedule 3 criteria may
be waived where there are
compelling reasons such as:
there are Australian-citizen
children from the relationship; or the applicant and
the sponsor are already
in a long-standing spouse
relationship for at least
two years; or the applicant
has made honest mistakes
on the application due to
misconceptions of visa
provisions.
Applicant should submit
to Immigration: history
of non-compliance by the
applicant, length of time
and reason why applicant
has been unlawful, reasons
why the applicant did not
seek to regularise his/her
status sooner, what steps, if
any, the applicant has taken
to regularise his/her status
other than applying for a
Partner visa.
For persons who do not
hold a substantive visa,
criteria 3001 set time limits
of 28 days, and 3002 set 12
months, within which to
apply. If an applicant does
not hold a substantive visa
at the time of application,
and if 3001 or 3002 criteria for the visa subclass
are being considered, then
they must apply before the
end of 28 calendar days (if
3001 applies) or 12 months
(if 3002 applies) where an
applicant for permanent
residence ceased to hold a
substantive visa on or after
1 September 1994.
Criteria 3003 and 3004
are additional requirements
to be met by applicants
for some subclasses who
do not hold a substantive
visa at the time of application. They apply in many
visa subclasses, often in
combination with criterion
3003, or 3002 and 3005.
Criteria 3003 and 3004 are
essentially the same criteria
but apply (respectively)
to applicants who do not
hold a substantive visa and
were illegal entrants on 31
August 1994 or held an entry permit valid only until
31 August 1994, or ceased
to hold a substantive or
criminal justice visa, which
he applied for himself or
entered Australia unlawfully on or after 1 September 1994. Criterion 3005
provides that an applicant
can be granted waiver only
once.

Bullying or adverse action claim?
This is the decision the
applicant has to make. But,
it will need particular guidance for anyone to make
the decision. It is not for
ordinary person unless this
person has particular knowledge of the law or by experience, to know what to do
otherwise he or she has to
seek proper advice to make
up his or her mind as this
may not help her or him.
Under section 789 FD of
the Fair Work Act (2009) (‘the
Act’) it says as follows,
“789FD when is a worker
bullied at work?
(1) A worker is bullied at
work if:
(a) While the worker is
at work in constitutionally-covered
business:
(i) An individual; or
(ii) A group of individuals;
Repeatedly behaves unreasonably towards the worker,
or a group of workers of
which the worker is a member; and
(b) That the behavior creates a risk to health
and safety.
(2) To avoid doubt, sub section (1) does not apply
to reasonable management action carried in
a reasonable manner.”
The end purpose of this bullying legal measure is to make
an Order to stop bullying
under section 789 FWC and
nothing else. However, if it
continues, then FWC may
make an Order it considers
appropriate (other than an
Order requiring payment of
pecuniary amount) to prevent
the individual or the group
from being bullied at work
and can consider the terms of
an Order accordingly.
Whereas, if the action is
made under section 340 of
the Act which we call general protection dispute or
adverse action claim because
he or she happens to exercise
his or her workplace rights
under section 341 of the Act.
If proven that the applicant
suffered damages as result
of his/her claim, then he/she
can recover damages accruing from such dispute and
it is the court not the FWC
that will make the proper
decision after conciliation
failed before FWC.

cooperation. Australia’s development assistance to the
Philippines is focused on
economic growth, education, social protection and,
where necessary, humanitarian assistance.”
The Executive Director
of the National Historical
Commission of the Philippines Dr Vic Badoy also
shared “The historical ties
between Australia and the
Philippines are deep. Since
the 1890s, Filipinos worked
in the pearling industry of
Northern Australia. More
recent ties are from educational exchanges – from the
Colombo Plan scholars of
the 1960s and 1950s, to the
10,000 Filipinos studying in
Australia in recent years.”
The Ambassador also reflected on the Filipino community in Australia. “I am
heartened by our warm people to people bonds. About
a quarter million Filipinos
now call Australia home. This means one in every
100 Australian is Filipino,”
added Ambassador Gorely.

number of realities that
organised groups in the
Philippines should pay attention to. Organised groups
are any institutionalised and
established groups, such
as the churches, business,
unions, NGOs, and civil society groups that have social/
economic/political missions.

the real history of the
Philippine nation.
This should include
changing the history
books and inculcating
in them some level of
nationalist and patriotic values without losing their cosmopolitan
values.

Significant leadership
change
Having just come back recently from the Philippines
and having witnessed some
evidence of the worsening state of the economy
in terms of unemployment
level, crime rate, drug use,

Federalism is possible but
very unlikely to happen given
the attitude of our politicians.
In order for Duterte to succeed with his plan, he will
have to declare martial law

President
President Rodrigo Roa Duterte
represents the forgotten Filipinos especially from Mindanao
who suffered years of oppression, poverty, discrimination,
inequality and corruption. It is
long overdue for the Bisaya to
reside in Malacañang. “Bisaya
na pud” may be the answer
to the change Filipinos are
longing for.
President Duterte portrays
toughness and bravery; if
he uses it to build a strong
leadership with compassion,
he can put an end to the conflict in Mindanao. So many
soldiers and ordinary citizens
have died and suffered due
to the failure of the government to implement the right
solution to the problem. They
have neglected to listen to the
outcry of sufferings from the
poor people because they are
blinded with ignorance, greed
and power. Rampant drugs
and corruption will only be
stopped by a leader who is
not scared of implementing
new laws and ready to die for
his country.

Game
THAD MANGALINO
I remember one time I
woke up in the middle of
the night from a dream; I
dreamt that I was in heaven.
St. Peter greeted me at the
gate and he acknowledged
me and urged me to move
forward. He asked me my
name, and I answered, “my
name is Thaddeus and I am
on the guest list.” The gates
suddenly opened and I was
met by the great architect
of the universe, and I was
asked, “what did you do
with the time I allocated
for you on earth? Did you
do your best? If not, why
not?” Before I could answer,
I woke up.
I was grateful that it was
only a dream and I was
still alive. At 3am in the
morning, I realised that life
is short, and I was really
bothered by the question I
was asked. I was bothered
because there were parts
in my life at the time that
I was not giving my best.
I was what others would
say “phoning it in”. I was
going through the motions
and not necessarily hitting the home run. My attempts were half-assed and
it resulted in mediocre outcomes.
It was literally a wakeup
call. I know that my current
situation is a result of the
decisions I made in the past.
My status quo was based on
my actions and non-actions
and the only one who could
turn this around was me. No
tapes, motivational quotes,
books or seminar was going
to change it for me. I had to
make the change and take
the disciplined actions as
no one else could do it. That
inner conversation made
me realise that I need to do
something and do my best
with what I had in front of

me. I had to stop blaming
others for my situation and
lacklustre result. I had no
one else to blame but the
person who put me in that
situation which was me.
I felt like He-Man, because it occurred to me
that I was the master of my
universe. It was inspiring
and scary at the same time
because I know there was
a way out, but at the same
time I know I had to roll up
my sleeves and start to make
things happen. Realise that
our time is short, our circumstances differ from our
neighbours and our ideal
outcomes all vary. My question to you is, are you giving
it your best to get you closer
to your outcome? If not, why
not? It’s time to wake up!
