at registration. Checks must be made
payable to Bryan Cundiff Company. The
successful bidder's check will be retained as a non-refundable down payment with the balance due at closing
within 30 days. All other real estate down
payment checks collected at registration
will be returned immediately following
the conclusion of the auction.

Real Estate Auction Terms & Conditions
1. REGISTRATION: A valid drivers license is required for registration. All bidders must register and
receive a bidder number. No bid will be acknowledged without a bidder number. All real estate
bidders must present a cashier’s, certified or official bank check in the amount of $35,000.00 at
registration. The successful bidder’s check will be retained as a non-refundable down payment. All
other checks collected at registration will be returned immediately following the auction.
2. AUCTIONEER RESERVES THE RIGHT: To determine acceptable bid increments; to reject the bidding of
anyone whose conduct, actions, bidding or comments are not in the best interest of the seller; and
to resolve any dispute over any matter at the auction. The auctioneers decision is final. Tritech
Auctions, Inc. and Bryan Cundiff Co. are agents for the seller only. Auctioneer/Broker or any member
of their staff may bid on any property for their own account.
3. INJURY & DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage
caused by bidder and further agrees to hold seller, auctioneer and seller’s agents harmless for any
personal injury or property damage.
4. NO WARRANTY: All properties are sold “as-is, where-is.” No warranties expressed or implied.
Advertising and oral statements are not to be construed as a warranty.
5. BUYER’S PREMIUM: A 10% Buyer’s Premium will be added to the winning bid to determine the
contract selling price of the property.
6. DOWN PAYMENT: The winning bidder shall make a down payment in the amount of $35,000.00.
Down payment is to be by cashier’s, certified or official bank check.
7. CONTRACT: The winning bidder will sign a written Auction Sales and Purchase Contract. A copy of
the contract is available for inspection.
8. CLOSING: Closing shall take place within 30 days of auction.
9. Announcements made by the auctioneer take precedence.
