Annual show focused on Florida
Here we are again, it is time for the Florida pool
show otherwise known as the Everything Under
the Sunsm Expo. The Expo starts with education
on Wednesday, February 10 and goes through
Saturday, February 13.
This is our 39th annual show that is put on by
FSPA and is directly focused on the Florida market.

Association on February 11 at 10:00 a.m. at Falcon’s Fire Golf Club.

Legislative Update
The Florida Legislative Session began January 11, though committee
meetings had already been underway since September. January 20-21
FSPA members and staff traveled to Tallahassee for the annual Legislative
Days event and met with many members of the House and Senate as well
as regulatory agencies that impact FSPA members. A full report on the event
and on session will be in the March issue. To get the latest on legislation that

COMMERCIAL CONNECTION
As many of you know, change is in the air. The "Holy Grail" of
the public pool industry is about to change. Chapter 64E-9
has finally undergone its makeover, as mandated by the legislation passed in
2012. HB 1263 mandated government oversight of public pool construction be
handled by local building departments. This mandate promulgated the complete
re-write of 64E-9, removing construction provisions and leaving them solely
in Florida building code 454.1. Members of the FSPA and the commercial
council, along with the Department of Health (DOH), and other leading members
of the pool industry, convened on numerous occasions to help separate the
construction and operational standards from the existing rule (pre-2012) to a
workable, enforceable standard. The new Florida building code, (2013 edition)
reflects these changes and includes the construction standards of all public
pools, spas, and water features.
The revised 64E-9, recently published for public comment, will continue to
include the operational standards required by the Florida Department of Health.
It should go into effect by the end of February 2016.
Florida Building Code 454.1 still has most of the same standards we have
come to know and follow, along with the typical and expected changes brought
on by new technology and techniques. The challenge to many of us will be the
awareness of these standards by the local building departments. Many of these
departments and their respective officials have not been previously involved
in public pool construction and fail to recognize or understand the operational
relationship to construction standards. This often leads to a misunderstanding
of the dynamics or purpose of these building standards and delays permitting,
causes failed inspections, and in general, may delay the entire construction
process. But the standards are still there, they are essentially the same, and
they still produce the safest pools in the nation, and maybe the world. As one
who has been deeply involved with the re-write processs, I will also tell you
that the building officials have really tried to be involved and to understand the

new process. They have used their newsletters and publications to get the
word out and help educate their members and they take part in monthly calls
with FSPA, UPSA and DOH. So as contractors with a large stake in the game,
it only benefits us to also assist in the process and promote further swimming
pool knowledge of local building inspectors.
The re-write of 64E-9 has dramatically changed the process and enforcement
capabilities of our state health officials and inspectors. As soon as the public
comment process is complete and the new inspection forms are finalized,
many of us will see a different level and method of enforcement of operational
standards of existing vessels. The time frame for correction of items in disrepair
may change. The number of overall items inspected and commented on by the
DOH inspectors will change. The DOH is developing and distributing a guidance
document to the local offices to assist in their interpretation of the new inspection
forms and what they consider "closable" offenses.
I urge everyone with a connection to public pools, whether it be new
construction, extensive remodeling, or service and repair, to re-familiarize
themselves with these new documents. And to work hand-in-hand with these
departments to continue to help the Florida pool pros in constructing and
maintaining the safest and most enjoyable pools, spas and water features in
the nation!
CPSC awards safety grants in Florida
U.S. Consumer Product Safety Commission (CPSC) Chairman Elliot F. Kaye
and U.S. Rep. Debbie Wasserman Schultz (FL-23) announced the awardees of
a first-of-its-kind grant program aimed at preventing pool and spa drownings and
drain entrapments. Five local governments will receive more than $780,000 in
Pool Safely Grant Program (PSGP) funds. This funding will provide assistance
to local governments for education, training, and enforcement of pool safety
requirements that are intended to save lives and prevent serious injuries. Two
of the five are in Florida! Broward County and Lake County are both receiving
a grant, Broward receiving the largest of all five at $250,000.

Opportunities and challenges in 2016

THE SCOOP ON SERVICE
As we move into 2016, we are facing new opportunities and challenges. One
main challenge service companies face every day is how to get the message
that you are a full service repair, remodeling and service company across to
your customers.
We assume that it should be unwritten as we are at our customer’s house
at least weekly, and in some cases two or more times a week. It should be
a no-brainer, right? However, how many times does your service tech come
back to you and say that the Smiths are remodeling their pool, or that the
Jones got a new filter or pump. Your company may have been cleaning that
pool beautifully for years, yet they did not think to call you. Can we blame the
customer? That may be the easy answer but the reality is that we did not get
our message across. Short of calling every customer we have every month
to let them know all of the services you provide, what is the answer?
What is the solution? Personal contact is great, of course, but we may not
have the manpower to accomplish this, or our customer may not want to hear
from us all the time, as they are busy as well. There is a fine line between
good communication and being a nuisance.
There are ways to get our message across that are subtle, effective and
relatively inexpensive as well. Here are a few:
1. An on-hold message made to relay all of the services you offer can be
fairly inexpensive for not much money. Google “custom phone messages”
to see what comes up.
2. If you try and direct customers to your website, that should include
everything that you do.
3. Your leave behind envelope should have a list of all of the services you
provide. To help you pay for this, all of the manufacturers you work with have
co-op dollars to help you spread your message with their product. Millions of
dollars go unused every year for co-op. Contact your major manufacturers
and start advertising.

4. To follow up with number three, you can provide statement stuffers every
month to your customers advertising a certain product or service. Again,
almost every major manufacturer in our industry has these readily available.
Don’t mail statements, but email them? You can provide the same thing in
a PDF.
5. Lastly, we all need to get up to speed on social media as advertising. I
am talking groupons, twitter, Facebook, etc. My FSPA chapter, Broward, is
holding a meeting in March on that subject. It will not answer every question,
but it will give our members enough information to get started.
The more your name is out there and the more a homeowner associates you
with the full service great company you are, the better it is for your business.
Just think, if you could sell one more item to every customer you already have,
without significantly increasing your overhead costs, how much more profitable
would you be. Let’s all do more with our existing customers this year and see
how much better off we will be!

Control your insurance destiny continued...

INSURANCE UPDATE
Last month we discussed how much of what happens with the Florida
economy and in Tallahassee (with the exception of wonderful FSPA lobby
efforts) may be out of our control. However, there are things we can do to
control aspects of our individual destiny. That includes the “destiny” of a
company’s insurance program.
We discussed taking steps to make yourself more attractive to insurance
companies such as 1) Reducing avoidable claims, 2) Developing a true safety
culture, and, 3) Cooperating with the carriers safety, claims departments, etc.
The insurance carriers look at all of this when evaluating you as a prospective
policy holder and determining rates and coverages.
In addition to these suggestions, here are two more good steps to follows.
Selection of subcontractors, management and controls of those subs,
including through the implementation of legal contracts with strong protective
language is important.
Most businesses hire a subcontractor from time to time. Each time you do,
your company is at risk. Ultimately, you can be held accountable, or liable, for
many of the actions of your subcontractor. Whether it is determined legally in
court, or simply the opinion of your good customer, you often will be involved
with any issues which may arise out of your subcontractor’s work.
Therefore, we should take the relationships with subcontractors very
seriously and structure good controls. You should seek the counsel of a good
construction attorney. It is suggested, at the very least, that you mandate that
all subcontractors comply with the following:
1.Maintain the same General Liability limits you do or higher ($500,000 per
occurrence minimum and $1,000,000 for excavation, gunite and shotcrete)
2.Add your company as an Additional Insured to their General Liability policy
3.Provide a Workers’ Compensation insurance policy in their company name
if an employee, laborer, helper, etc. is at the jobsite. A valid Workers’
Compensation Exemption is sufficient when it is only that person working

on your jobsite. This is critical.
4.Execute a formal written contractor-subcontractor agreement which requires
a Waiver of Subrogation from the subcontractor and includes a Hold
Harmless clause in your favor.
Most of this (with the exception of the written agreement) is evidenced in
the Certificate of Insurance provided by the subcontractor.
Always require a valid Certificate of Insurance be provided before the
subcontractor performs any work. Don’t wait until the job is done and you
are ready to pay the sub to confirm he has insurance. If they don’t have the
proper insurance coverages, it cannot be backdated. So, if it is June 1 and
the work was performed before May15, any new insurance will be effective
on, or about, June 1. Therefore that time your sub worked he was uninsured,
which may cost you dearly should a claim occur as a result of anything related
to the work that sub did for you.
You should also expect good jobsite safety practices of your subcontractors
to maintain a safe, secure, and clean jobsite. Requiring the subcontractor to
adhere to the same strict safety standards that you hold your employees to is
a good practice.
Managing your auto exposures is the other way to help reduce costs. The
ease with which we can all be distracted is increasing every day and roads
are more crowded with less experienced drivers.
Florida is a growing state once again in both commerce and in people
relocating here to live. Our roads are filled to capacity with the full spectrum
of drivers and differing driving experience.
Just about everyone now uses a smart phone. They are regularly used to
phone, text, read email, browse the internet, and play music. Restricting this
usage by your employees is critical! Having them sign a driver agreement
where they promise not to do so in a moving vehicle can be a valuable tool for
you to manage and monitor drivers as well as to prevent accidents. Distracted
driving is the number one cause of accidents and most of these are preventable!
In closing, many of the rates and premiums of your insurance policies have

some subjectivity to them. The underwriter has the ability to discount rates
and premiums if warranted based on superior risk qualities. Therefore, rate
differences can be based on the factors outlined above. There can also be
differences in coverage forms from insurance carrier to carrier.
Control your “insurance” destiny by doing as much as you can to ensure
your company is the recipient of the broadest coverage and most attractive
pricing the marketplace can offer.

The journey of a lifetime
DIGGING UP IDEAS

One year ago Best Pools of Brevard, Inc. embarked on a journey of a
lifetime. One fateful day in July 2014 we were asked to bid on a remodel of
the pool located at the Ascension Island Air Force Base. Ascension Island is
located in the equatorial waters almost halfway between South America and
South Africa. The swimming pool had been abandoned for almost ten years,
due to a lack of funding. If awarded, this was going to take place relatively
quickly and sight unseen! Our primary method of pricing was pictures and pdf
renderings. We accepted the challenge.
The time schedule and paperwork was brutal, to say the least! Before we
could even think about proceeding, there were necessary online training,
background and physical checks for each team member. In the meantime, all
items required for the project had to be ready for cargo shipment by September
2014. There are no hardware stores, so we
had to check and double check anything
that we would need. Since the items were
preceding us in travel, we also had to predict
what we could do without while still working
here in the USA!
Finally, the day of travel was here in January 2015. It was important that
we complete the tasks at hand on time. There is one flight out of Brevard on
Mondays. There is one flight out of Ascension on Wednesdays. The plan was
to complete the job in eight days, leaving two days for packing and clean up.
If we didn’t make it, we would have to stay another full week waiting on the
next flight out. We arrived early on a Tuesday
morning and started right to work. The task
at hand: Re-tile and re-plaster the 30 x 60
pool, replace lights, install a medallion in the
bottom of the pool, replace the old equipment,
and install 4,200 square feet of pavers. The

entire task was complete in an amazing five days with the talented crew of 16
people doing all the tasks together as a team.
While the pool was filling, the entire small island was buzzing over the revival
of their long-neglected swimming pool.
On our flight home on Wednesday, ten days later, we were almost sad to
be leaving. While we were proud of the accomplishment, we will never forget
the memories that we made on that remote, desolate, volcanic island. Nor
will we forget the men and women who keep our country safe, who are now
enjoying some well-deserved comfort and relaxation in their own pool!

Orange County Convention Center to meet Rowdy and learn about his passion

membership meeting in February. The Chapter Board of Directors meeting
will be held Thursday, February 18 (subject to change), information will be sent

the March Chapter meeting on Thursday, March 24 (since the regular night
meeting date is St. Patrick’s Day). A CE course is planned for the meeting.

Mark your calendar for the Everything Under the Sunsm Expo, February 12-13
at the Orange County Convention Center in Orlando. It is the premier event of
the swimming pool industry in the southeastern US. The annual event attracts
thousands of industry professionals from all over the United States as well as
the Caribbean. The show has Everything Under the Sunsm - new products,
networking opportunities, excellent education courses and opportunities to
meet directly with manufacturers. Don’t forget to take advantage of the free

Happy New Year! Hope everyone has recovered from the holidays and is
ready to get back to work!
A reminder that the Chapter still has a membership campaign taking place.
If a member recruits a new member, the new member will receive a $150 gift
card and the referring members will receive a $50 gift card. The new member
must pay their dues in full to qualify. This is held to the first 10 new members.
Congratulations to Brian Curts for recruiting Breakwater Construction and
Susan Landregan for recruiting My Ty Designs. Brian and Susan each
earned $50 and our two newest members each earned $150.
A five question survey has been sent to all vendors and attendees for
feedback on the Table Top. If you have not done so, please complete the survey
and send it back so we can continue to make this event better and better!
Our first meeting of the new year was held January 14. We were fortunate
to have Steve DeSorbo, Coordinated Benefits, and Ron Pellum, CPA
with Ennis, Pellum & Associates, provide us with a great deal of important
information.
February 12-13 is the Everything Under the Sunsm Expo in Orlando – we

need volunteers! The Show Education policy states that the Chapters will be
required to provide volunteers for education at the Expo equaling the number
of seats the Chapter has on the Board, with a minimum of three volunteers
per Chapter. Each volunteer will be required to volunteer for a minimum of
two classes. We have six seats and we still need five volunteers! If you are
taking a class, please sign up to be an ID checker or to monitor the class you
are taking. For more information, please contact Mary at the state office at
1-866-930-3772.
On March 3 the Chapter will have employer/employee training. In April will
be the annual golf tournament. The plan for May is a CE class and Water
Safety Day at the Zoo on the 7th or 14th. In June the Chapter plans on hosting
an activity but in July and August there will be no Chapter meetings. September
will offer a CE class and November is the Member Appreciation/ Table Top.
Just a reminder of who your new Board of Directors consists of: Rick
Schmitz will remain as president, Brian Curts will remain as vice president
and Kim Quintal will remain as treasurer. Your Directors are: Paul Roth,
Greg Bowers, David Pruette, Stephanie Mitchell, Jack Manilla, John
Garner, Susan Landregan, Kyle Martin, and Troy Hershner. A By-Laws
Committee has been formed with Jack Manilla heading the committee along
with Dave Pruette, Mark Turner and Rick Schmitz. Kim Quintal is heading
the Scholarship Committee.

Energy Systems of Brevard, new building before attending Legislative days
in Tallahassee. The Solar Energy Systems office in Melbourne is beautiful and

We have developed the calendar for the year and will be presenting
it in the next newsletter. For now, the Space Coast members are
excited about the Everything Under the Sun sm Expo in Orlando
