History of Canada
Over the past 400 years, Canada has evolved from a
sparsely populated trading post to the tenth-richest sovereign
power in the world. It stands alone as the only country to separate from its colonial power through peaceful means.
The political boundary of what is now known as Canada recorded thousands of years of history before European colonization, but was one of the last places on Earth to host human
habitation. While modern Homo sapiens emerged from the eastern region of Africa 200,000 years ago, most scientists agree
that it took another 175,000 years for humans to find their way
across the ice bridge that once joined Alaska and Eastern Siberia. The land that now constitutes Canada has seen the longest
period of human habitation in the New World: from the original
migration 25,000 years ago came all the indigenous cultures of
North and South America including the Arctic Inuit, Blackfoot,
Cree, Algonquin, Dene, and Iroquois League of Five Nations.
Estimates put the number of native peoples in the United States
and Canada before European contact at about two million.
Columbus may have been given credit for the “discovery” of
America in 1492, but proof exists that Vikings voyaged to Greenland and further west as early as 982 A.D. Archeological evidence points to Norse settlements in Newfoundland at L’Anse
aux Meadows dating back to approximately 1000 A.D., making
Canada the actual site of the European discovery of North America. The Vikings, however, were not concerned with permanent
colonization, only Canadian natural resources. By the time Christopher Columbus arrived, the Norse settlements had been
abandoned.
With Christopher Columbus came the European fervour of
colonizing the New World. Seeking a way to circumvent the long
land trade routes to Asian goods by crossing the Atlantic to what
he thought was India, Columbus inadvertently began the Age of
Discovery. European powers established colonies, seeking
spice, gold, slaves, and new crops, as well as the promotion of
Christianity among the native peoples. The earlier colonies,
mostly Spanish and Portuguese, were concentrated in South
America, Central America, and the Caribbean. England and
France, however, turned their attention north. John Cabot, an
Italian-born English explorer, is credited as being the first European explorer after the Vikings to set foot in North America. Although this exploration occurred only five years after Columbus’s
discoveries, it was not until 1605 that permanent settlements
were established. Many explorers, including Henry Hudson, still
attempted to find the Northwest Passage, a reputed waterway
through the New World to Asia. The reasons for this 100-year
gap have more to do with European affairs than those of the
New World.
Two events slowed the colonization of North America: religious unrest and war in Europe. In 1517, Martin Luther distributed his list of 95 grievances against the Catholic Church by
means of a new invention, the printing press. Thus began the
Protestant Reformation. This schism was to have far-reaching
consequences across all of European history, but in the short
term, it created rancorous religious strife. Most of Europe turned
inward to deal with unrest and religious crisis. Escalating political
conflicts enveloped most of Western Europe for decades, drawing resources away from colonization efforts. The French Wars
of Religion, the Italian Wars, and popular uprisings combined
with new religious uprisings to turn the attention of Europe away
from the New World for more than a century.
France looked to North America as the best possible source of
wealth and power and as a relief from war debt. When French explorer Jacques Cartier sailed up the St. Lawrence River in 1534,
he claimed the territory for France, and gave it the name it still
bears today: Canada. Once fur traders arrived in Eastern Canada
in the 1500s, France monopolized the fur trade. While the French
made an effort to establish friendly trading relations with the native
population, the Iroquois in particular proved openly hostile. Conflicts with local tribes soon convinced the crown that if traders were
to make a profit in Canada, a permanent military and civilian presence was essential. King Henry IV sent his royal “hydrographer,”
Samuel de Champlain to map the region.
In 1605, after exploring the coast of North America as far
south as Cape Cod, Champlain established the first permanent
French settlement at Port Royal, and in 1608 he founded Quebec City. New France, as it was then called, grew slowly, mainly
due to disinterest from the mainland and war with the Iroquois.
The settlers survived attacks from native peoples through their
alliance with the Algonquin, Montagnais, and Huron peoples.
These alliances not only secured their survival, but greatly increased France’s control of the fur trade. Europeans had little
experience in the thick wilderness of the area, an expertise that
the native peoples supplied.
Once again religious tensions in Europe interfered with Canada’s settlement and growth. By the mid-seventeenth century,
while England’s American and Caribbean colonies grew selfsufficient, New France remained underpopulated. The struggling
colony drained France’s resources. The French crown decided
to take action by creating land incentives for emigrants to New
France. Only one caveat stood in the way: all settlers must be
Roman Catholic, or convert to Roman Catholicism before leaving
Europe. This change of policy, undertaken at the urging of the
fanatical Catholic Cardinal Richelieu, closest advisor to King
Louis XIII, created friction. Previously, French Protestants, especially the persecuted sect known as Huguenots, had fled to New
France to escape religious persecution. Cardinal Richelieu’s new
edict would have a lasting impact on the religious and political
makeup of modern Canada.
In the late seventeenth century, English and French colonies
in the New World began to take a stronger foothold. Both nations
finally saw a large-scale financial return on their investments, but
a war in Europe again infringed on Canada’s nascent growth.
New France, already in the middle of brutal intertribal warfare
with the Algonquins, conflicted with the Iroquois confederacy opposing them. With the War of the Grand Alliance in 1688, which
pitted France against almost all of continental Europe, the Iroquois began to receive English weapons as part of government
policy. This escalation by the English heightened the already
bloody warfare. English armies and their Iroquois allies captured
Port Royal, but were turned back from Quebec City, due mainly
to a decimation of forces by disease. The war eventually petered
out, and a peace was signed in 1697. The Iroquois, however,
continued the fight without British help, and eventually suffered a
series of major defeats, forcing them to sue for peace four years
later.
New France, and thereby Canada, seemed securely in the
mother country’s domain following the end of the War of the
Grand Alliance. However, France’s control of the region was not
to last. Queen Anne’s War, which began only a year after the
French peace with the Iroquois, lead England to claim Nova
Scotia and Newfoundland, as well as the rights to the land surrounding Hudson Bay. Fighting broke out again three decades
later in 1744, in a battle known as King George’s War, but neither side was able to enlarge their colonial positions.
By 1754 the long-standing animosity between the English and
French seeped into the New World, culminating in the Seven
Years War, known in the Americas as the French and Indian
War. The causes of the conflict were threefold. The lucrative fur
trade, rich fishing grounds, ample lumber, and mineral deposits
all promised great wealth to whoever controlled Canada. Secondly, the fiercely anti-Catholic British felt that the Protestant
French were heretics, a feeling that was reciprocated by the
French. Thirdly, possession of colonies overseas could be used
as diplomatic bargaining chips should the war in Europe go
badly.
The Seven Years War was the first worldwide war, fought on
five continents: North America, South America, Africa, Europe
and Asia. More than a million died, and the war resulted in a
complete change in the power structure of the New World. Britain gained all of France’s colonial possessions in North America,
and Canada became a British colony. However, 150 years of
French colonization didn’t disappear overnight. Even today,
French-English relations in Canada can be contentious.
Henry Hudson arrived in Arctic waters in 1610 determined to find the Northwest Passage. He explored Hudson Bay and the mouth of the Bay. His crew mutinied and abandoned him in 1611 and returned to Europe. This map

In 1875, the Supreme Court of Canada was created by an Act of
Parliament. The Court is a general court of appeal, which
consists of nine judges. The Governor in Council appoints the
judges, who remain in the position until the age of 75. There is a
Chief Justice of Canada, plus seven puisne judges. A Registrar
is also appointed by the Governor in Council. The Registrar is
responsible for all the administrative work in the Court, &
answers directly to the Chief Justice. There are approximately
200 employees of the Supreme Court. The Supreme Court sits
in Ottawa where, each year, three sessions are held.
Approximately 80 appeals are heard by the Court every year.
The hearings are open to the public. Cases for review come
from the provincial & territorial appellate courts & the Federal
Court of Appeal, in criminal, civil, constitutional & administrative
law matters. Decisions of the Supreme Court of Canada may be
unanimous, or a majority may decide. In July of 2016, The Right
Hon. Justin Trudeau announced a new selection process for
Supreme Court Justices. A seven-member, independent,
non-partisan advisory board will identify suitable candidates. Any
qualified Canadian lawyer or judge will be able to put forward
their name for consideration by the board.

The Court Martial Appeal Court of Canada was established by
the Parliament of Canada, pursuant to its authority under section
101 of the Constitution Act,1867. The Court administers the
National Defence Act & the Criminal Code. The Court Martial
Appeal Court of Canada hears appeals from military courts.
Military courts, known as courts martial, try members of the
Canadian Forces, as well as civilians accompanying military
personnel abroad, for crimes & offences against the Code of
Service Discipline. The Code of Service Discipline is found in
Part III & Part VII of the National Defence Act. Military personnel
are subjected to military law, except when the offence has little
to do with their military role. Offences, such as murder &
manslaughter, are tried in civilian courts. There is a right of
appeal to the Supreme Court of Canada from the Court Martial
Appeal Court of Canada on questions of law.
