June! Another school year come and gone.
And while that school year calendar doesn’t always relate to what we as business officials do
every day, it is the reason why we do it. When
we were in school, we might have known the
name of the superintendent, but I can certainly
say that I didn’t even know that there was a
business manager, let alone know that person’s
name. And now that I am that person, it’s OK
that no student knows my name. It’s actually
sort of a point of pride. If we as business officials do our jobs well, then that means that our
schools are running smoothly and our students

aren’t distracted from their learning. (At least

Working in the district business office, I must admit that I am fairly envious of those who do follow the school calendar. They get a true break. I
know teachers still do work over the summer, but not in the same routine
as during the school year. And not with the same people. Don’t get me
wrong, I love the people I work with, but I also love a break from them.
And I am sure that they feel the same towards me! And school year employees get a sense of a fresh start each August. I really think that is what
I envy most. Put things away in June, feed your body, mind, and soul for
eight weeks, and start fresh again in August. A new beginning each year.
But back to June. It is the end of the school year, but it is also the start
of summer. I love it. First, there is bike riding. There is an ice cream
stand in Goshen called the Chief. That’s about a fifteen mile round trip
from my house. I get some exercise and the best ice cream in Indiana.

Next, there’s heading to Lake Michigan. I grew up begging my mom
to drive us up to Warren Dunes for the day (ever climb a 260 foot sand
dune? Or better yet, ever
run down one?) Beautiful sand and waves just
meant to be jumped in.

And then, there is my
back porch. I watch the
birds in the bird bath or
the hummingbirds at the
feeder. And I try to keep
a few flowers blooming through the heat. And I just sit and do a crossword puzzle and soak up the sun or the stars and the feel of summer.
So, now that I think about it, I guess I get a fresh start too. Each of
these things that I love help to renew me and keep me plugging away at
the office. I don’t get eight week breaks, but I do get a chance to feed
my body, mind, and soul in short, delightful bursts. Oh, and speaking of
delightful bursts - I also get to feed my stomach with blueberries – lots
and lots of fresh blueberries.
I know that summer can be the busiest time for we twelve-monthers.
But if you can take just a little time to do the things that refresh and renew your spirit, it can do wonders. We can be ready for that new school
year and start fresh for all those hundreds or thousands of two-legged
reasons why we do what we do for public education.
This is my final Intercom article. Thanks to my husband, Mark, for
being my proofreader all year. It’s been fun, but I’m happy to pass the
torch (or the keyboard as it were) on to Joe Licata. Thanks to all for the
support that I’ve felt this year. Thanks to IASBO for being the fantastic
organization that all of you have made it.

With the change to balanced calendars or modified balanced calendars, the time school business officials have to get ready for a new school year continues to shrink. Remember the days when you had
three full months to get your buildings ready and
secure all of the new hires for the new school year?
That time has been reduced to 10 weeks in order to
get everything up to speed for the next time students
walk in your school buildings. I am amazed at how
school business officials adapt to new timelines
and still get the job done. You are all very remarkable folks in the various tasks you perform. And,
the ones who benefit are the students you serve and
the faculty you work with. I really don’t think the
school business office gets enough credit for all of
their efforts once school lets out. And, of course,
there is that pesky budget that you have to prepare,
too. From me, thanks for all that you do year round,
but specifically in the shorten summer time periods.
As we have reported earlier, the General Assembly has funded the Indiana School Business Officials Leadership Academy once more. I say once
more because the original Academy was held with
state funding back in 2007-08. The General Assembly deleted the appropriation for the Academy
plus numerous other programs in 2009 because of
the “Great Recession”. IASBO was able to continue the Academy in 2009 with some sponsorship
help, but could not sustain the quality of the program without the state funding. We have emailed
information on the Academy including the application form to all IASBO members. The information
is also included in this addition of the InterCom.
Please contact me if you have any questions regarding the Academy.
As we get to June every year, there is a passing of
the guard on the IASBO Board of Directors. IASBO officers’ terms of office are on a fiscal year basis. So, each July 1 we have the current Past President leave the Board. I want to thank Steve Sonntag
for his service to the association. He has done a
terrific job of leading the association as President
and being a strong leader his five years as an officer. Many of you know that Steve will be leaving

state. Steve, best of luck in your future endeavors and
thanks for all you have done for Indiana ASBO.
In my role as the IASBO Executive Director, I have
the great privilege to get to know members of the
Board of Directors on a personal basis. The officers
and I have the great opportunity to travel to ASBO International and state-wide meetings. You get to know
their families and share so much that is outside of the
school business management world. It’s always hard
to see one of these friends retire. For me, I will miss
seeing Kim Fox at the next IASBO function. As a
Past President of IASBO, we have had many great
experiences and fun on the various ASBO trips. For
the past several years, Kim has been on the IASBO
Board as the Chair of the Constitution & By-Laws
Committee so we had the opportunity to talk about
kids and grandkids at those meeting. She has been
a true leader of this association. Kim, you and Mark
enjoy your retirement and I know our paths will cross
again soon.
Indiana ASBO has had a terrific year. Our voice
was heard in the General Assembly on numerous
issues and we were able to get the funding for the
Leadership Academy. We have had a another great
year of professional development with our seminars
and certification courses. Felisia has done a super
job handling many of the professional development
chores in her first year with IASBO. Our membership continues to grow and IASBO’s foot print can be
found all across the state. Ella continues to do a tremendous job for me and the membership. Her efforts
are always to assist the school business management
community. We all enjoy what we do and we look
forward to another super year when for professional
development beginning in September.
I began this article for praising the membership for
doing so much in such a short period of time. Hopefully, you have found time to take some vacation
and R & R for yourselves and your families. Before
we know it, the students will be heading back into
the classroom. And, as we all know, that is why we
make the extra effort every day.

LEADERSHIP ACADEMY
Indiana ASBO is very pleased to announce that the appropriation for the Indiana School Business Officials
Leadership Academy is included in the next Indiana state biennial budget. House Enrolled Act 1001 of 2015 states
that the Department of Education shall distribute the appropriation in the state budget to the Indiana Association
of School Business Officials to create an academy designed to strengthen the management and leadership skills of
practicing school business officials. IASBO has developed the components of the Academy.
The Academy is designed to provide the participants with a wide-range of professional experiences. Fiscal
and school business management issues will be presented, but the emphasis of the Academy will be to build and
enhance leadership skills. These will be “out of the box” presentations to grow the management proficiencies of
the participants. There will be lecture time and interactive activities, plus field trips to expand the Academy experience. The Academy faculty are nationally known speakers who will be coming to Indiana from across the country
to participate.
Indiana ASBO has created an application process that includes the qualifications, application process, Academy
schedule and the Academy curriculum. The following details the essential elements of the Academy application
process.
**Qualifications for Participation**
1. Applicant must be a practicing school business official in Indiana and an IASBO member.
2. Applicant must have a minimum of five (5) years of school business management experience.
3. A superintendent does qualify if they are an IASBO member.
**Participation**
The Academy will be limited to 40 individuals. If more than 40 applications are received,
a selection committee has been formed to review the applications and recommend those
selected for the Academy.
**Academy Schedule**
1. The Academy is a two-year program.
2. There will be four (4) two-day sessions per fiscal year.
3. The program is for a total of 16 days and over 90 hours of instruction.
4. First day timeline: 10:00 a.m. to 9:00 p.m.
5 Second day timeline: 7:30 a.m. to 3:00 p.m.
6. 2015-16 Academy Schedule:
· September 29-30, 2015
· March 8-9, 2016

2. $800 commitment for the 2-year program.
3. Once participants are selected, IASBO will bill for the first year.
4. Housing will be paid by the participant.
5. The following meals will be provided each day of the Academy:
Day One – lunch and dinner; Day Two – breakfast and lunch.

INDIANA
COURT OF APPEALS DECISIONS
School board may not have provided sufficient
due process to a principal whose administrative
contract was terminated.
Although the principal was given notice of the reasons for the board’s consideration of his termination as
principal and a conference with the school board, the
Court of Appeals concluded the board failed to follow
the statutory procedures for cancellation of the regular teacher’s contract and therefore there were issues
of material fact for a trial court to decide. Hewitt v.
Westfield-Washington School Corporation, 24 N.E.3d
459 (Ind.App. 2014).
After Hewitt, a principal, admitted to engaging in a
consensual, sexual relationship with one of his teachers, the school board sought to cancel his contract as a
principal, but not to terminate his employment with the
school corporation. He was given written notice of the
reasons for the cancellation and the opportunity to have
a conference with the school board. When Hewitt requested the conference, he was advised in writing that
because the board was considering only cancellation of
his administrator contract, there would be no witnesses
or presentation of evidence at the conference. After
the conference, the school board voted to terminate his
principal’s contract and reassigned him to a teaching
position for the remainder of the school year.
Hewitt filed suit, alleging breach of contract and
denial of due process. The trial court granted summary
judgment in favor of the school corporation. Hewitt appealed to the Court of Appeals. At the appellate level,
Hewitt argued the school board breached his contract
by depriving him of a hearing and failing to establish
that his conduct constituted cause for the cancellation
of his employment contract. The court focused on his
claim that he was denied the opportunity for a hearing.
The court noted that Indiana law requires a principal
and school board to sign a regular teacher’s contract
and that the terms of that contract state that “all laws
governing the employment and dismissal of teachers shall be construed to be a part of this contract.”
The court thus concluded that “the statutes governing
the cancellation of teacher contracts – Indiana Code

chapter 20-28-7.5 – are incorporated into Hewitt’s contract.” The court then considered the teacher dismissal
statutes and noted that IC 20-28-7.5-2(g) permits a
teacher to present evidence in a conference with the
school board to refute the reasons for contract cancellation. In this case, since Hewitt was denied the opportunity to present evidence, the appellate court concluded
there were genuine issues of material fact as to whether
the school board failed to afford him the due process
procedures required by statute.
The school board argued that the teacher dismissal
statutes did not apply in this case since Hewitt was a
principal and it was only his contract as principal that
was being terminated. The school noted that there were
no Indiana statutes defining a process for the termination of just the administrator contract and therefore the

standard for cancelling an administrator contract should
be less demanding than the process school board had
the power to hire and fire principals, that power did not
override the express terms of the principal’s employment contract which required the school board to follow the statutory provisions applicable to teachers.
Concluding that the school board failed to carry the
“onerous burden” of showing there were no genuine
issues of material fact and that the school board was
entitled to a judgment as a matter of law on Hewitt’s
breach of contract and due process claims, the court
remanded the dispute back to the trial court.
Editor’s Note: The school board is seeking transfer of
this case to the Indiana Supreme Court.

TRIAL COURT DECISIONS
Court orders school corporation to transport
nonpublic school students who reside along the
regular bus routes established by the school corporation.
Concluding that Indiana law requires a public school
corporation to provide transportation to nonpublic
school students who reside along the regular route of a
public school bus, the court ordered the school corporation to pick up those students and transport them either
to the nonpublic school or a point on the regular route
that is nearest or most easily accessible to the nonpublic school from which the students can walk. Roman
Catholic Archdiocese of Indianapolis, Inc. v. Metropolitan School District of Lawrence Township, Cause
No. 49D14-1301-PL-3484, Marion Superior Court
(December 30, 2014).
Parents of several nonpublic school students sued
the MSD of Lawrence Township when the school
refused to transport them. The trial court concluded
that IC 20-27-11-1(b) requires the school corporation
to transport nonpublic schools who reside along the
normal school bus routes “to and from the nonpublic
school or to and from the point on the regular route that
is nearest or most easily accessible to the nonpublic

school from which the student can walk to and from
the nonpublic school.” The court further concluded
that the statute “presents an ‘either/or’ proposition” and
that the school corporation had to choose one of the
options. Thus, the trial court ordered the school corporation to establish its regular routes and bus stops to
accommodate the needs of the public school students.
Further, if there were nonpublic school students who
resided along those routes, the school corporation must
pick up the students and then either transport them to
the nonpublic school or to a point on the regular route
from which the nonpublic school students could safely
walk to their nonpublic schools.

PUBLIC ACCESS
COUNSELOR DECISIONS
Because the school corporation failed to
provide the audiotape of a school board meeting and improperly requested a copying fee, the
Public Access Counselor determined that the
school corporation violated the Access to Public
Records Act.
Noting that a recording of an open meeting should
not be subject to redactions and that a fee of $75 for
redacting such a tape appeared to be unreasonable, the
Public Access Counselor concluded the school corporation violated the Access to Public Records Act.

March 5, 2015.
A patron requested the audiotape of the school
board meeting held in December 2014 and a copy of
a consulting firm’s presentation at that meeting. The
school corporation provided some information, but
neither the tape nor the presentation materials. The
patron made a second request and was advised by the
school corporation that the presentation was not given
to the school board and that there was a fee of approximately $75 for the redaction of the audiotape of the
school board meeting. The patron then requested to
listen to the recording and the school again responded
a fee would be charged to listen to the recording. The
patron filed a complaint with the Public Access Counselor (PAC).
The PAC first stated that “a recording of an open
meeting should not be subject to redactions.” Since
anyone has the right to observe and record an open
meeting, “if confidential subject matter is discussed,
it has already been disclosed and loses its confidential
or discretionary status.” Further, the PAC noted that a
governing body does not have to record its meetings.
But, if it does, the recording becomes a public record
that is subject to inspection and copying.
Lastly, the PAC addressed the redaction fee of $75.
He first noted that the school corporation failed to
identify why or how its recording technology was so
limited that it could not reasonably isolate the meeting in question and duplicate it. Secondly, the PAC
indicated that he was familiar with recording technol-
ogy used by public agencies across the state and had
never encountered a system which incurred $75-$100
to generate a copy. In the opinion of the PAC, “by the
tone of WLSC’s response and the amount charged,
one can reasonably infer the fee set to copy a recording of an open board meeting was meant to frustrate
access based upon [the patron’s] history as a repeat
requester.” Thus, the PAC concluded the audiotape
should be provided to the patron without redactions
and the costs of isolating the meeting and/or duplicating the tape should be reexamined.
