BY-LAW NO RCM-44-2012
BY-LAW CONCERNING TRUCK AND TOOL-VEHICLE TRAFFIC
Meeting of the Council held in the Council Chamber, 60 Martin Avenue, Dorval,
Québec, on January 21, 2013;
---oOo--The municipal Council decrees and ordains the following:
SECTION 1. In the present by-law, the following words mean:
Truck: a vehicle other than an emergency vehicle with a gross vehicle
weight of 4500 kg or more designed and equipped mainly for the
transportation of goods or of the machinery with which it is permanently
equipped and its accessories. Are also trucks, combination of street
vehicles in which at least one vehicle has a gross weight of 4500 kg or
more.
Local delivery: a delivery carried out in a zone where such traffic is
prohibited and marked by a sign authorizing truck and tool-vehicle drivers
to travel in this prohibited traffic in order to:





Make a pick-up or delivery;
Provide a service;
Perform a job;
Have the vehicle repair;
Return a vehicle to its home base.
Home base: the company’s place of business, that is the vehicle’s storage
site, office, warehouse, garage of the company’s parking lot.
Emergency vehicle:a road vehicle used as a police car in accordance
with the Police Act (Chapter P-13.1), a road vehicle used as an ambulance
in accordance with the Act respecting pre-hospital emergency services
(R.Q.S, c. S-6.2), a fire department road vehicle, or any other road vehicle
which meets the criteria established by regulation for recognition as an
emergency vehicle by the Société de l’assurance automobile du Québec
(SAAQ).
Road vehicle: a motorized vehicle that can be driven on roads, other than
a vehicle that runs only on rails, a power-assisted bicycle or an electric
wheelchair. A trailer, a semi-trailer and detachable axles are equated with
road vehicles.
Tool-vehicle: a street or road vehicle, other than a vehicle mounted on a
truck chassis, manufactured to perform work and the work station of which
is an integral part of the driver’s compartment. For the purposes of this
definition, a truck chassis is a frame equipped with all the mechanical
components required on a road vehicle designed for the transportation of
persons, goods and equipment.
SECTION 2. Truck and tool-vehicle traffic is prohibited on the streets listed in annexed
Schedules « A » and illustrated on the plan annexed as Schedule « B ».
SECTION 3. Section 2 does not apply to trucks and tool-vehicles having to carry out
local delivery.
Furthermore, it does not apply to :
a. Oversized vehicles circulating by virtue of a special operating permit
expressly authorizing access to streets to which access is normally
prohibited;
b. Agricultural machinery, farm equipment and farm tractors;
c. Tow trucks;
d. Emergency vehicles.
SECTION 4. An yone who contravenes with section 2 is guilty on an offence and is liable
to a fine identical to that provided in the Highway Safety Code.
SECTION 5. The present by-law shall come into force on the date of its publication after
it has been approved by the Minister of transports.
