Prostitution is allowed in Germany. Many women work as prostitutes voluntarily. If you are one of them this is the decision of your own, whether you would like to work as a prostitute and on what terms. Therefore it is important to be informed about German laws. On the following pages we provide you with some details in this connection. It is not allowed in Germany to force women to work as prostitutes, to place pressure upon them, to exploit or threaten them. Such actions are accusable. In Germany all victims of penal acts – perhaps YOU are one of them – have the right to defense and help! If you have questions or need help, please consult (anonymously) the institutions, places of refuge and information centers in Kiel represented here or the investigation group Milieu of the police of Kiel. Here you will find the detailed information on legal questions of the Federal Association of Sex Workers (Bundesverband Sexuelle Dienstleistungen e.V): http://www.busd.de. HEALTH IS IMPORTANT! Unprotected sexual intercourse can lead the prostitutes and their clients to the infection with HIV/AIDS and other sexually transmitted diseases. However, if women are being forced to prostitution they become the victims of a number of significant crimes: human trafficking, forced prostitution, procuration of women, physical abuse, sexual assault. If you do not possess German citizenship and do not come from one of the countries of the European Union (EU) you have to observe the right of residence. THE RIGHT OF RESIDENCE If you are a foreigner and would like to live and work in Germany you need a temporary visa and residence permit (Aufenthaltstitel and Aufenthaltserlaubnis). Your temporary visa will be put on your national passport (in a form of a stamp or a label). There one can also find information, whether you are allowed to work in Germany. If you have come to Germany as a tourist you are not allowed to work here. After that you will receive by mail the certificate of your right of residence: the so-called certificate of freedom of movement (Freizügigkeitsbescheinigung). If you work as a prostitute the employer deducts the income tax from your wages and pays it to the Revenue office. If you work independently you have to register at the Revenue office yourself. You will be given a tax payer’s account number and a tax certificate. You can have a tax consultant assist you. This also includes the protection of prostitutes from violence of procurers or clients. The police have NO intention to prevent the prostitutes from working. The police have the right to inspect the brothels. In doing so they have the right to identify you and to enter your room anytime: even at night. In case of commission of crime the police have the right to conduct a search of the room and to fingerprint and photograph you.
