The TMHC Olympics 2007 will be
held from 4-6 p.m., Friday, June 1 during the
TBA Annual Picnic.
This team-building event pits one team
against another from various property management companies. Teams will compete for
the gold in many different competitive events
based on the associate vendors respective
fields. Winners will be announced at the
TMHC Banquet July 26!
To qualify, each team must consist of a
regional manager, residential manager, leas-
ing consultant, maintenance supervisor and
a maintenance technician (or grounds or
housekeeper) from within the same management company.
The cost is $125 per team, which includes picnic/food and all associated activities. Spectators cost $19 per person and include picnic/food and all associated activities.

Build the Vote hosts elected
officials during spring reception

On April 11, TBA was honored to have
Congresswoman Thelma Drake as the guest
speaker at the second annual Build the Vote
Spring Reception. (See photo from event on
page 10.)
In recognition and support of this important program, Congresswoman Thelma Drake
stated during her remarks, “In 2006 [TBA]
identified 8,500 votes. I won my race by 5,000
votes.The possibility that I might not have won
it without your votes is something I want to
thank you for.”
Thanks to the work of the TBA Build the
Vote Task Force and its Chairman, Jeff Wermers, the Build the Vote program continues to
gain momentum gathering employee lists from
all TBA members as we head into the state
mid-term election cycle.
Since the beginning of the program in
2005, the TBA Build the Vote Program has
been working to gather employee lists from
TBA members. To date, TBA has received the
participation of nearly 200 member firms, with
nearly 100 of those companies having already
submitted their lists. These companies have
helped expand the TBA voter outreach program to more than 10,000 voters.
There has never been a more important
time to get involved with the Build the Vote
Program. This past session, TBA saw the industry come under attack as impact fee authority
was granted to virtually every locality throughout the state. While this was certainly a loss
this past session, the battle rages on.
We must show our elected officials that
TBA is more than just a contributor or an
empty endorsement around election time. We
must show that we also represent a large number of voters across the region who are concerned enough about their livelihood to vote
for elected officials that support polices for
the industry and likewise vote against those
who support laws that make it difficult to do
business.
The first step in achieving our goal to
make a difference in this year’s mid-term elections is to expand our voter database of TBA
members and their employees that can be encouraged to vote in November.While the voter

submitting plans to local cities.
ADVOCATE: Art Ross, president of Art Ross Designs, Ltd.
ISSUE:
Ross was having a difficult time differentiating which cities required certain
information on plans and where the essential information was to be placed on the plans
when submitting to the cities for review.
ACTION TAKEN: At the request of Ross and other members, a meeting was
arranged by Claudia Cotton, TBA Staff Vice President of Builder Services Division. The
meeting involved TBA members including Ross and Javier Gonzalez of Art Ross Designs
along with Bob Smalley, Building Code Official of Chesapeake, and Rick Burkhart also
with the building official’s office of Chesapeake.
The purpose of the meeting was to discuss a “checklist” of requirements that
the city needs and the location of the information on submitted plans. The meeting
produced a new concise list that will be accessible on the city of Chesapeake’s Web site.
Further changes to the list will not be made until the 2006 International Residential
Building Code is adopted, with meetings to be held prior to adoption so all parties can
review any changes to the checklist that will be necessary.
RESULT: The checklist, when followed, should include nearly all information (in
most cases), needed for plans review and approval. While Chesapeake may require more
information than other cities, this list can be compared to other cities requirements/
checklist and help reduce the number of rejections and resubmittals of plans, ultimately
saving builders time and money.

Detailing new home warranties
– rights and responsibilitie

Scifres, a partner in the Virginia Beach office of the
law firm of Williams Mullen, is Tidewater Builders
Association’s general counsel. This column features
legal issues of interest to TBA’s members.
When a new dwelling is sold, whether a
single-family home or condominium unit, certain express and implied
warranties as to construction defects can apply. Determining whether such warranties apply,
the scope of the warranties and the time period
within which a lawsuit
must be commenced to
enforce those warranties requires an examination of the sales contract and familiarity with
the Code of Virginia.
Express Warranties.
The contract of sale between seller and
buyer of a new home or condominium unit
can contain express warranties negotiated between the parties. If there are no express
warranties regarding construction
defects contained in the contract of sale, then no express
warranties exist between
seller and buyer.
Implied Warranties
Virginia law, however, specifically provides
for implied warranties in
connection with sales of
new single-family homes
and condominium units. In
the case of a sale of a new
single-family home, the seller
is deemed to warrant to the
buyer that the home and all of its
fixtures are “free from structural defects, so
as to pass without objection in the trade, and
constructed in a workmanlike manner, so as to
pass without objection in the trade.” Va. Code
§55-70.1.
If the seller also is in the business of
building or selling new single-family homes,
then the seller is deemed to further warrant
that the new home and all of its fixtures are
“fit for habitation.” These warranties continue
to apply even if the initial buyer subsequently
sells the property to a third party. Similarly,
these warranties are in addition to any other
express or implied warranties applying to the
property, its materials or its fixtures.
Waiver of Warranties
The statutory warranties on sales of new
single-family homes may be waived, modified
or excluded in the contract of sale if the requirements of the statute are met. These requirements include that the language must be
conspicuous, set forth on the face of the contract in capital letters which are at least two
points larger than the other type face in the
contract and specifically describe the warran-
ties being waived, modified or excluded. If all
warranties are to be waived or excluded, then
the legend on the first page of the contract
must indicate that the home is being sold “as
is.” If a seller plans to have the contract waive
these warranties, then the seller should discuss the waiver requirements with an attorney.
Such requirements will be strictly construed.
Counsel’s insights
Term of Implied Warranties
The statutory implied warranty for new
single-family dwellings extends for a period
of one year from the date of the recordation
of the deed or the date of the buyer taking
possession, whichever first occurs; provided
that the implied warranty that the foundation
is free from structural defects, so as to pass
without objection in the trade, extends for a
period of five years from the date of recordation of the deed or the buyer taking possession, whichever occurs first.
Statute of Limitations
If a homebuyer has a claim
for breach of any of the
implied warranties, then
before the buyer has
grounds to bring a lawsuit to enforce the warranty claim, the buyer
first must provide the
seller written notice
stating the nature of the
warranty claim. The seller then has a reasonable
period of time, not to exceed six months, to cure the
defect described in the notice.
Any lawsuit to enforce an implied
warranty claim in connection with a sale of a
new single-family home must be filed not later
than two years after the breach of the warranty occurs.
Condominium Units;
Term of Warranty
There are similar, but not identical, statutory implied warranties made by the declarant
in connection with sales of new condominium
units. A declarant is deemed to warrant that
the condominium unit is free from structural
defects and that the unit is fit for habitation and
constructed in a workmanlike manner so as to
pass without objection in the trade for a period of two years after the date of conveyance
of the condominium unit to buyer. Va. Code
§55-79.79. As in the case of new single-family
homes, implied warranties transfer when the
initial buyer of the unit sells the condominium
unit to a third party.

Remodeling Month
Have you ever wondered how big the remodeling industry really is? NAHB estimates that
Americans spent $233 billion in home remodeling in 2006, up from $215 billion in 2005.
Some quick facts to consider: remodeling accounts for 2 percent of the U.S. economy and 40
percent of all residential construction; do-it-yourself accounts for approximately 27 percent of all
expenditures; and remodeling is expected to overtake new home construction by dollar volume
within the decade.
So you may be asking, who is it that is remodeling? NAHB research has found that 91 percent
of remodelers report Baby Boomers (aged 41-64) as clients, compared to 26 percent for Gen X
(aged 30-40), 13 percent for seniors (aged 65+), and two percent for Gen Y (under 30).

be filed within five years after the date the warranty
period began (i.e., conveyance of the condominium unit
by the declarant). However, a condition precedent to
maintaining a lawsuit for breach of warranty is providing the declarant with written notice of the nature of
the alleged defect at least six months prior to the filing
of the lawsuit. This provides the declarant with an opportunity to cure the alleged defect within a reasonable
time but not more than six months.
The statute further provides that once notice
of the warranty claim is provided to the declarant,
the time period within which a lawsuit enforcing the
breach of warranty must be filed is tolled for a period not to exceed six months. This same provision
does not exist in the case of statutory implied warranties for sales of new single-family homes.
Virginia law provides obligations for sellers and
rights for buyers. However, if a buyer wishes to enforce these rights, the law also sets certain time limits and requires the buyer to first give the seller the
opportunity to cure the alleged defect within a reasonable period of time not to exceed six months.
Whether you are a seller, homebuilder or buyer,
knowledge of the statutory warranty provisions will
help you when dealing with potential construction
defects.

10,000 voters, the industry represents approximately 30,000 voters across South Hampton
Roads. It is important that the program expand
the database to reflect these numbers as we
approach the fall elections. There will be many
closely contested elections across the region
this November and every vote truly does
count.
To see the vast importance of this program all one has to do is look at the slim margins of victory for Bob McDonnell in 2005 and
Jim Webb in 2006. These elections clearly illustrate that every vote truly does count.

2007 academic scholarship committee gears up

TBA Scholarship Foundation Director
Over 230 applications were received from
area high school seniors vying for one of ten
Tidewater Builders Association Scholarships to
be awarded this May. Currently, the applications
are all in the hands of the Scholarship Selection Committee chaired by Pete A. Kotarides
of Kotarides Builders who also will be the 2007
Scholarship House builder.
Assisting Kotarides in this effort are committee members Tuck Bowie of Terry/ Peterson
Residential, who is the 2007 Tidewater Multifamily Housing Council Scholarship Apartment
Revenue contributor; Edward Sadler of Sadler
Building Corp., who is the 2006 Scholarship

TMHC, test your EPA knowledge
TBA and The Home Depot Supply are offering an EPA Preparation class and exam from
8:30 a.m. to 4:30 p.m., Thursday, June 28.
The morning is spent on preparation with the test given in the afternoon. Class run seven
hours and includes lunch.
All aspects of the EPA Section 608-certification exam are covered including refrigerants.
Students must purchase the exam book for $9.95, available in both English and Spanish, three
weeks in advance.
