25th ANNUAL HOLIDAY PARTY HELD
The 25th Annual Holiday Party was recently held at the Marina del Rey Caterers. “Hundreds
of members, friends and real estate professionals from throughout the New York metropolitan
area attended the popular event to renew old friendships, establish new business contacts or just
have a good time,” noted Kathy Zamechansky, Holiday Party Chairperson. “Network for success
is the slogan which best describes this professional trade association and it is reinforced with
each successful event”, added Nunzio Del Greco, RCE, Chief Executive Officer. “Reservations
included 4 ½ hours of unlimited food, drinks, music and networking at a reasonable price which
is a major attraction,” added Matthew Engel, CPM, 2010 President.

Cox Golder told a congressional
panel.

Services, Golder said that the
FHA program is fiscally sound
with responsible underwriting,
and needs enhancements not
radical reform. She urged
Congress and the administration
to tread lightly before making
changes to a program that has a
profound impact on economic
recovery and serves the nation’s
families.
“With the collapse of the
private mortgage market, the
importance of the FHA mortgage
insurance program has never
been more apparent. Thus far
in 2009, nearly 80 percent of
all FHA insured purchasers are
first-time homebuyers. And
if you take a closer look at
the numbers, you’ll see that
program is doing exactly what it
was designed to do—make more
affordable mortgage financing
available to homeowners,” said

She pointed out that this
year almost 50 percent of nonwhite Hispanic borrowers used
FHA insurance or the Veterans
Administration’s loan guaranty
for home-purchase loans and
21 percent used the FHA or VA
program to refinance a home

Special recognition is extended during this Holiday Season to

Bronx-Manhattan North Association of Realtors (BMAR) is greatly
appreciated especially in these challenging times. With your support
and cooperation, together we will continue to provide valuable
programs, services and networking opportunities to cultivate more
business in 2010 and beyond.
We value your membership, friendship and look forward to your
active participation in the organization. BMAR has a rich history
with an extraordinary culture of inclusiveness, camaraderie,

companies that are active members of BMAR throughout the New

Even though 2009 was another challenging year for
the real estate industry, our BMAR events continued to
be very popular. Our 2009 year closed out with our 25th
Annual Holiday Party, with its attendance up from 2008.
Many firms chose to make our Party, their Party and the
mood was upbeat with active networking continuing for
hours into the night.
As we usher in the 2010 New Year, we begin to plan
for our 86th Annual Banquet to be held on April 15, 2010.
The Banquet, our banner event of the year continues to
draw impressive Keynote Speakers and an assortment of
distinguished honorees, year in, year out. The Event is
one of the highlights of the annual New York City real
estate calendar. Recent Keynote Speakers have included
Senator Hillary Clinton, Mayor Michael Bloomberg,
NYPD Commissioner Ray Kelly and NYC Comptroller
Bill Thomson. Please plan on joining us and supporting
this event in April.

loan. Last year, more than 60 percent of
home-purchase loans and about 45 percent
of refinance loans to black homebuyers
were insured or guaranteed by either
FHA or VA.
“As the leading advocate for
homeownership and housing issues,
NAR knows that without FHA mortgage
insurance, our housing market could never
start to recover,” Golder said.
FHA’s decline in reserves is in part
a reflection of a projected change in
home price values, and is not tied to
excessive increases in defaults or unsound
underwriting practices, she said. In citing
the recent FHA audit, Golder said, “If
FHA makes no changes to the way it does
business today, the reserves will actually
exceed 2 percent in the next several years.
FHA has sufficient reserves.”
FHA cash reserves and capital reserves
give the agency combined assets of $30.4
billion—enough to pay all claims over a
30-year period. Most banks are required
to hold reserves sufficient to pay only
one year of claims. “Realtors® strongly
believe that FHA is taking the necessary
steps to assure its financial solvency,”
Golder said.
“We look forward to working with
the Department of Housing and Urban
Development. We have confidence that
FHA Commissioner Dave Stevens will
do what’s needed to ensure the financial
health and stability of the FHA fund. We
encourage FHA to take steps that will have
the least impact on FHA borrowers who
are such an important part of our housing
and economic recovery,” said Golder.
NAR strongly opposes H.R. 3706,
the “FHA Taxpayer Protection Act of
2009,” which would increase FHA’s
downpayment requirement. The bill
would not add anything to FHA reserves
but would put homeownership out of
reach for many creditworthy borrowers.
“Realtors® believe that the best way
to ensure FHA’s success is to strengthen
it,” she said.
Golder also thanked Chairman Barney
Frank (D-Mass.) and the committee for
passing legislation to extend the higher
loan limits through 2010, but urged the
committee to make the higher limits
permanent. “The higher limits are not just
for a few states with high median prices.
There are currently 245 counties in 28
states that have high cost limits—this is
a national issue,” she said.

largest trade association, representing 1.2
million members involved in all aspects of
the residential and commercial real estate
industries.
Hundreds of toys were donated by
guests and over $1,500 was contributed to
purchase additional toys. The gifts were
delivered to Casita Maria; The Rainbow
School for Child Development; and
Saint Dominic’s Home for Abused and
Neglected Children. Each year, members
and friends attending the Holiday Party
donate unwrapped toys for abused or
neglected children. “Donating Christmas
and Chanukah gifts is a good way of
making the spirit of the holiday season
memorable to children less fortunate than
our own”, added Engel, 2010 President.

State News
Governor Paterson signs bill to save
property taxpayers money
This past week, Gov. David Paterson
signed legislation into law to create a new
tier of pension benefits for New York’s
public employees. The measure brings
landmark structural reforms to New
York’s public retirement system that will
save state and local governments nearly
$35 billion over the next 30 years. Those
reforms include: raising the minimum
retirement age; increasing the minimum
number of years of service required to
draw a pension; and capping the amount
of overtime that can be considered in the
calculation of pension benefits. The cost
to subsidize the current public retirement
system have grown out of control and
property taxpayers have been crippled
by mounting property tax bills to support
the system. NYSAR applauds the
governor for making structural reforms
to the pension system that will translate
into meaningful savings to New York’s
overburdened property taxpayers.
NYC Council passes ‘Green Building’
legislation
The New York City Council passed
a package of “Green Building” bills as
part of Mayor Bloomberg’s PLANYC
agenda. Those bills deal with audit and
retrofit; energy code; benchmarking;
and lighting. In response to concerns
raised by NYSAR and other interested
parties about the financial ramification
for property owners, the bills have been
largely modified from their original
version.
State court blocks eminent domain
power in Columbia University
expansion plan
A New York appellate court had
rejected the state and Columbia
University’s effort to take property from
businesses in Harlem and give them
to Columbia University for campus
expansion. The harshly worded ruling
said: “The exercise of eminent domain
power to benefit a private elite education
institution is violatitive” of the United
States and New York State constitutions
and should not be allowed. The Empire
State Development Corporation (ESDC)
and Columbia University attempted to
establish that the area in question was
“blighted” and as a result, a candidate for
eminent domain. The court, however,
called that argument a “scheme” cooked
up by the university and ESDC. The
ESDC said the decision was in direct
conflict to past decisions that allowed for
eminent domain in blighted areas, most
recently in Brooklyn for the Atlantic
Yards project. ESDC plans to appeal the
ruling to the NYS Court of Appeals, the
state’s highest court. New York State
has been criticized for abusing eminent
domain, leaving the state legislature in
the position to fix this problem through
legislation that has yet to be hammeredout.

New RESPA rule takes effect January
1
The
Real
Estate
Settlement
Procedures Act (RESPA) was enacted
in 1974 to provide consumers with
improved disclosures of settlement
costs and to reduce the costs of closing
by the elimination of referral fees and
kickbacks. Through the years, the
Department of Housing and Urban
Development (HUD) has issued
regulations and policy statements to
provide RESPA guidance to industry
and consumers alike. On November 17,
2008, HUD published a new final rule
“To Simplify and Improve the Process
of Obtaining Mortgages and Reduce
Consumer Settlement Costs.” The rule
mandates use of a new Good Faith
Estimate (GFE) and HUD-1 which go
into effect on January 1, 2010.
