PEMBUKAAN
Departemen Pertahanan Keamanan Republik Indonesia dan Kementerian Pertahanan
Nasional Republik Korea (selanjutn:,:a dinyatakan sebagai : pihak-pihak).
Mengacu kepada Memorandum Saling Pengertian Kerjasama Logistik dan Industri
Pertahanan antara Departemen Pertahanan Keamanan Republik Indonesia dan
Kementerian Pertahanan Republik Korea, yang ditandatangani di Seoul pada tanggal
IO Oktober 1995.
Berkeinginan 11.ntuk bekerja sama seluas mungkin dalam memenuhi Jaminan Mutu
Pemerintah secara bersama untuk materiil pertahanan dan jasa yang diadakan melalui
kontrak, subkontrak atau pesanan untuk kepentingan pertahanan salah satu dari kedua
negara dan yang berada di bawah Wewenang Jaminan Mutu Pemerintah dari masingmasing pihak.
Kedua belah pihak telah mencapai kesepakatan sebagai berikut :
PASAL I
DEFINISI
Istilah dan definisi berikut ini digunakan untuk keperluan Perjanjian Pelaksanaan ini.
Jaminan Mutu Pemerintah : adalah suatu proses yang dilaksanakan oleb pejabat
pemerintah yang berwenang untuk membangun kepercayaan mengenai persyaratan
kontrak yang berkaitan dengan mutu yang telah ditetapkan.
Pemasok :
adalah pabrik kepada siapa pesanan diberikan.
Istilah "pemasok" dan
" kontrl'.lktor" adalah sama artinya
Pembeli : adalah pihak, organisasi atau perusahaan yang memberikan pesanan kepada
pemasok.
Pesanan : adalah kontrak yang diberikan oleh satu pihak, organisasi atau subkontrak
yang timbui darinya, yang diberikan oleh suatu perusahaan kepada pemasok.
Delegator : adaiab badan nasional yang berwenang dari satu pihak yang mengajukan
Taminan Mutu Pemerintah di ncgara pihak yang lain.
Pelegas1 : adalah badan nasional yang berwenang dari satu pihak yang memberikan
laminar.. Mutu Pemerintah di negaranya sen<liri.

PASAL U
RUANG LI GKUP
Delega~i akan menyediakan jasa Jarninan Mutu Pemerintah untuk semua bidang
pasokan pertahanan dan jasa atas permintaan Delegator di negerinya sendiri sesua1
kondisi dan definisi yang tercantum dalam Perjanjian Pelaksanaan ini .
2.
Perjanjian Pelaksanaan ini tidak membatasi kedua belah pihak untuk membuat
perjanjian yang iebih khusus mengenai penerimaan bersama Jaminan Mutu Pemenntah.
3.
Perjanjian Pelaksanaan ini juga berlaku untuk subkontrak dari materiil pertahanan
dan jasa yang berasal dari pesanan salah satu pihak, atau yang berasal dari pesanan
negara lain di mana satu pihak telah menyiapkan Jaminan Mutu Pemerintah, asalkan
izin dari negara pembeli sebelumnya telah diberikan.
PASAL Ill
PENGAJUAN
Permintaan untuk Jaminan Mutu Pemerintah akan dibatasi pada kasus-kasus di
mana mutu tidak dapat dibuktikan secara memuaskan setelah penerimaan atau apabila
Jaminan Mutu Pemerintah di negara pemasok dipP-rlukan.
PASAL IV
KEWENANGAN
Di1jen Matfasjasa Dephankam RJ merupakan pejabat yang bertanggung jawab di
Indonesia dalam pelaksanaan Perjanjian Pelaksanaan ini.

Direktur Defense Quality Assurance Agency (DQAA) Kem enterian Pertahanan
Nasional Republik Korea merupakan pejabat yang bertanggung jawab di Korea dalam
pelaksanaar. PerJanjian Pelaksanaan ini.

PROSEDUR PERMINTAAN

Pengaj uan Jaminan Mutu Pemerintah akan disampaikan ke alamat sebagai
berikut

Permintaan Jaminan Mutu Pernerintah akan disarnpaikan oleh Delegator ke
Delegasi sebelum pelaksanaan kegiatan. Contoh perrnintaan Larnpiran " A".

Permintaan untuk Jaminan Mutu Pemerintah berisi sernua informasi yang
herkaitan, tetapi tidak terbatas pada, narna dan alarnat ke mana kornunikasi teknis
harus disampaikan, persyaratan khusus berkenaan dengan sertifikat, dan sebagainya.
4.
Selanjutnya, Delegator akan meyakinkan bahwa Delegasi dilengkapi 3 (tiga)
fotokopi dari pesanan, yaitu spesifikasi yang berlaku, gambar-gambar, persyaratan
mutu khusus, dan dokurnen penting lainnya yang perlu untuk penunjukan permintaan
Jarninan Mutu Pemerintah dan apabila diperlukan dapat dilengkapi dengan terjemahan
bahasa lnggris yang disetujui oleh pembeli dan pemasok. Apabila tidak tersedia pada
saat penyarnpaian pengajuan, akan diatur kemudian oleh Delegator.
PASAL VI
PENERIMAAN PERM INTAAN JAMINAN
MUTU PEMERINTAH
I.
Pada wakt.u penerimaan permintaan Jaminan Mutu Pemerintah, Delegasi akan :
a..
Menerirna perrnintaan tersebut, dengan atau tanpa komentar dan kualifikasi
serta menyampaikan persetujuan tertulis kepada Delegator, atau
b.
Mengalihkan/meneruskan permintaan tersebut kepada badan Jaminan Mutu
Pemerintah yang berwenang lainnya di negerinya dan memberi tahu Delegator
tentang tindakan yang akan diambil, atau

c.
Memberitahukan Delegator bahwa Jaminan Mutu Pemerintah tidak dapat
dilakukan karena alasan-alasan seperti yang disebutkan dalam jawaban.
2.
Delegator akan memberitahu pemasok meialui Delegasi pada waktu keputusan 1a
atau I b dalam pasal ini diambil.
3.
Apabila materiil dan jasa yang tercakup di dalam permintaan itu memerlukan
kegiatan Jaminan Mutu Pemerintah secara khusus di luar kemampuan Delegasi, akan
diadakan pengaturan khusus untuk kegiatan tersebut.
4.
Apabila ketidakmampuan Delegasi untuk memberikan perwakilan Jaminan Mutu
Pemerintah berdasarkan dengan Perjanjian Pelaksanaan ini terjadi karena keadaankeadaan khusus, seperti · apabila permintaan untuk suatu jasa khusus yang
melibatkan badan jaminan mutu nasional tidak memungkinkan untuk disetujui, karena
alasan waktu yang tidak dapat diperkirakan atau ditentukan, Delegasi akan memberi
tahu Delegator secara tertulis tentang keadaan-keadaan yang menghalangi penerimaan
tersebut.
PASAL VII
KF.TENTUAN-KETENTUAN KONTRAK
1.
Pesanan akan memuat persyaratan yang tepat bagi pemasok yang akan
memungkinkan Delegasi sebagai perwakilan yang berwenang dari Delegator
untuk mempunyai semua akses yang diperlukan dengan pihak pemasok maupun
Subkontrakornya, hak untuk menjalankan jaminan mutu yang diperlukan, dan hak
untuk menggunakan fasi litas dan akomodasi seperlunya, sesuai dengan prosedur
normal atau khusus dari Delegasi sebagaimana diatur di antara Delegator dan Delegasi.
2.
Pesanan akan menetapkan cara yang akan digunakan untuk setiap konversi antara
sistem "British" (ft.lb) dan sistem metrik (m.kg) terhadap ukuran-ukuran yang mungkin
diperlukan selama pemeriksaan dan pengukuran.
3.
Pesanan akan menetapkan bahwa pemasok (termasuk subkontraktornya)
bertanggung jawab untuk mempertahankan pengawasan yang efektif terhadap mutu
pasokan dan jasa, untuk persyaratan fasilitas pengujian dan penunjukan inspeksi yang
mendasar guna menunjukkan kesesuaian sepenuhnya terhadap pasokan-pasokan untuk
mengontrak kebutuhan pemeriksaan kualitas dan untuk ketetapan dari bukti yang
objektif bahwa pengawasan dan pemeriksaan telah berlaku secara efektif sebelum
penawaran pasok?.n untuk penerimaan. Untuk tujuan dari pemenuhan paragraf ini,
Delegator akan menggunakan dokumen AQAP (Allied Quality Assurance Publication)
atau kesepakatan bersama yang setara.

PASAL Vlll
PROSEDUR UNTUK JAMINAN MUTU PEMERINTAH
l.
Setelah rnenyetujui suatu perrnintaan akan Jarninan Mutu Pernerintah, Delegasi
akan melaksanakan program jaminan mutu yang rnencakup perencanaan Jaminan Mutu
Pemerintah, evaluasi terhadap prosedur jaminan mutu kontraktor dalam memenuhi
persyaratan kontrak, pengaturan Jaminan Mutu Pemerintah bagi pekerjaan yang
disubkontrakkan, apabila diperlukan; tindakan pencegahan untuk mengoreksi
kekurangan; komunikasi Delegasi/Delegator, prosedur untuk pemrosesan
penyimpangan dan pengecualian serta perubahan-perubahan. Apabila diperlukan,
Delegator dan Delegasi dapat secara bersama-sama menyusun persyaratan-persyaratan
khusus Jaminan Mutu Pemerintah.
2.
Apabila pemasok pada salahsatu negara memberikan suatu subkontrak yang
memerlukan Jaminan Mutu Pemerintah terhadap pekerjaan subkontraktor tersebut,
prosedur berikut ini harus diikuti.
Delegasi akan melaksanakan Jaminan
a. Subkontrak di negara Delegasi.
Mutu Pemerintah sesuai dengan prosedur nasionalnya, kecual i prosedur lain
yang ditetapkan.
b. Subkontrak di negara Delegator.
Delegasi akan menyampaikan
Mutu Pemerintah kepada Delegator, yang akan
permi.ntaan Jaminan
melaksanakan Jaminan Mutu Pemerintah sesuai dengan Perjanjian Pelaksanaan
ini, kecual i prosedur lain yang ditetapkan.
Apabila salah satu pihak mempunyai

perjanjian tentang Jaminan Mutu Pemerintah di negara ketiga, Delegasi akan
memberitahu Delegator tentang rincian perjanjian tersebut dan apabila Delegator
menyetujui, Delegasi akan mencoba meminta ketentuan dari perjanjian tersebut
sesuai dengan prosedur standar yang ditetapkan. Apabila perjanjian seperti itu
tidak ada, Delegasi akan memberitahu Delegator tentang hal itu dan akan
memberikan saran untuk jaminan mutu. Berdasarkan atas usu! Delegasi,
Delegator kumudian akan memutuskan tindakan yang diambil dan memberitahu
Delegasi tentang ha! tersebut.

PASAL IX
PEMBERITAHUAN TENTANG
KONDISI YANG T IDAK MEMUASKAN
Apabila Delegasi menemukan bahwa, pada setiap saat setama bertangsungnya
pesanan, ia tidak dapat melanjutkan fungsinya sebagai Jaminan Mutu Pemerintah
disebabkan oleh kekurangan di dalam sistem pemasok (contoh : Pengujian pemasok
yang diperlukan tidak dapat ditaksanakan karena kurangnya fasi titas pengujian,
peratatan pengujian menggunakan cara kalibrasi yang tidak dikenal, kuatifikasi, atau
persetujuan "engineering" tainnya tidak dilakukan, dan sebagainya) atau produk
(termasuk suku cadang materii l atau proses) dan kekurangan semacamnya merupakan
hat yang penting atau dapat mengakibatkan penundaan, Detegasi akan segera
menyarankan kepada Delegator perihal tersebut dengan menggunakan formutir yang
tersebut pada Lampiran "C" Perjanjian Pelaksanaan ini.
PASALX
SERTIFIKA T KESESUAIAN
I.
Sebagai bukti Jaminan Mutu Pemerintah, akan digunakan formutir "Sertifikat
Kesesuaian" seperti tersebut pada Lampiran "B" Perjanjian Pelaksanaan ini. Delegas1
akan menyampaikan dua tembar fotokopi Sertifikat Kesesuaian kepada Detegator dan
lima tembar fotokopi kepada pemasok, yang akan metampirkannya pada pengiriman
dokumen yang sesuai sebagaimana dipertukan oteh kontrak.
2.
Datam hat subkontrak, satu tembar fotokopi Sertifikat Kesesuaian akan
disertakan pada nota pengiriman dan dua lembar fotokopi copy akan diajukan oleh
Detegasi kepada Detegator.
PASALXI
PERSETUJUAN UNT UK PENGIRIMAN
Persetujuan untuk pengiriman materiit dan peratatan yang tetah dijamin sesuai
prosedur di atas, akan diberikan sesuai cara yang diterangkan dalarn permintaan
awal Detegator. Biasanya persetujuan untuk pengiriman diberikan bersamaan dengan
diterbitkannya Sertiftkat Kesesuaian. ( A:mex B).

PASAL Xll
PENYIMPANGAN DAN PENGECUALIAN
Kontrak Utama. Kecuali diarahkan lain oleh Delegator, Delegasi akan diberi
kuasa untuk mengabulkan permohonan izin dari pemasok untuk keluar dari persyaratan
teknis dalam kontrak, kecuali bila hal itu akan mempengaruhi keselamatan,
kemampuan atau biaya.
Delegator akan diberitahu untuk setiap permintaan yang
dikabulkan oleh Delegasi. Permohonan untuk penyimpangan dan pengecualian yang
tergantung kepada keputusan Delegator (dijelaskan dalam kontrak), akan diajukan oleh
pemasok kepada Delegator melalui Delegasi.
2.
Subkontrak.
Permintaan untuk penyimpangan dan pengecualian pada
subkontrak yang tidak dapat dikabulkan oleh Delegasi akan diajukan oleh pemasok
melalui Delegasi kepada Delegator untuk penanganan sesuai dengan persyaratan
kontrak
PASALXIll
KEIKUTSERTAAN DELEGATOR
Delegator diperbolehkan melakukan kunjungan kepada pemasok yang
bersangkutan selama berlangsungnya pelaksanaan kontrak atau subkontrak. Kunjungan
semacam itu akan diatur melalui Delegasi yang akan mendampingi Delegator.
PASALXIV
KOMUNIKASI
I.
Delegator akan memastikan bahwa Delegasi segera dilengkapi dengan setiap
amandemen, modifikasi, atau perubahan pada dokumentasi yang disampaikan sesuai
dengan Pasal 5 paragraf 3.
2.
Setiap korespondensi antara Delegator dan pemasok sehubungan dengan jaminan
mutu, akan dikirimkan melalui Delegasi.
3.
Delegasi dan Delegator akan saling berkomunikasi dalam setiap masalah yang
timbul yang kemungkinan akan mempengaruhi mutu materiil atau jasa.

BIA YA
Apabila tidak ada perjanjian bersama, Delegator tidak harus membayar langsung
kepada Delegasi biaya yang berkaitan dengan Jaminan Mutu Pemerintah yang
diberikan oleh Delegasi di bawah pengertian Perjanjian Pelaksanaan ini.
2.
Bila terjadi biaya besar yang tidak seperti biasanya, biaya yang sesuai dapat
dinegosiasikan antara Delegator dan Delegasi.
PASALXVI
PERTANGGUNGJAW ABAN
Walaupun Delegasi telah menanda tangani Sertifikat Kesesuaian (Annex B), hal
tidak akan melepaskan pemasok dari pertanggungjawaban untuk melengkapi
materiil, peralatan, dan jasa dalam memenuhi seluruh spesifikasi pesanan. Bila

PASAL XVII
PERTUKARAN INFORMASI
Apabila diperlukan, perwakilan kedua belah pihak akan bertemu untuk bertukar
informasi dan pengalaman dalam permasalahan Jaminan Mutu Pemerintah dan
berdiskusi bersama tentang setiap permasalahan.
PASALXVID
KETENTUAN PENGELUARAN INFORMASI
I.
K.ecuali suatu kesepakatan tertulis khusus yang disepakati oleh kedua belah
pihak tentang penyampaian informasi dan tidak menyimpang dari ketentuan pada Pasal
XX maka ketentuan berikut ini akan ditenipkan dalam penyampaian informasi antara
kedua belah pihak dalam Perjanjian Pelaksanaan ini :

a.
lnformasi akan diperlakukan/disampaikan dengan saling p~rcaya.
b.
Informasi ini akan digunakan pihak per.erima hanya untuk kepenti ngan
jaminan mutu yang sudah dikeluarkan.
c.
Informasi ini hanya diberikan kepada personil dalam lingkungan pihak
penerima yang perlu mengetahui k:ecuali diizinkan menurut paragraf 2 dari pasal
mt.
2.
Delegator yang menyampaikan informasi kepada Delegasi seperti Pasal 5
paragraf 3 dan Pasal 13 paragraf I akan menyiapkan secara tertulis rencana informasi
yang akan disampaikan kepada pihak ketiga terutama kontraktor atau subkontraktor.
PASALXIX
PENGATURANTAMBAHAN
Sepe11i diketabui bahwa pengaturan tambahan akan diperlukan dari waktu ke
waktu untuk pelaksanaan yang lebih baik rlari ketetapan Perjanjian Pelaksanaan ini.
Hal ini akan dipengaruhi oleh amandemen yang sesuai untuk Perjanjian Pelaksanaan

KERAHASIAAN
I.
Pengaturan kerahasiaan keseluruhan untuk tujuan Perjanjian Pelaksanaan ini akan
disesuaikan dengan Persetujuan yang mengatur Perlindungan lnformasi Militer yang
bersifat rahasia antara Badan Intelijen Angkatan Bersenjata Republik Indonesia dan
Sadan Intelijen Pertahanan-Kementerian Pertahanan Nasional Republik Korea yang
telah ditandatangani pada I Juni 1994.

Penyampaian informasi teknis kepada negara ketiga, baik itu rahasia atau tidak,
seperti tertera pada Perjanjian Pelaksanaan ini, harus dengan persetujuan Pihak pemilik
informasi, kecuali ditentukan oleh persetujuan tertentu antara kedua belah pihak.
PASALXXI
PENYELESAIAN PERSELISIHAN
Suatu kesalahpahaman sehubungan dengan pengertian atau pelaksanaan
Perjanjian Pelaksanaan ini akan diselesaikan dengan konsultasi antara kedua belah
pihak dan tidak akan dibawa ke dalam pengadilan lntemasional atau melalui pihak
ketiga untuk penyelesaiannya.
PASALXXII
PEM BERLAKUAN, PERUBAHAN DAN PENGAKHIRAN

Perjanjian Pelaksanaan ini berlaku sejak tanggal ditandatangani.

Perjanjian Pelaksanaan ini dapat ditinjau kembali atau dirubah kapan saja dengan
persetujuan tertulis antara kedua beiah pihak.
Perjanjian Pelaksanaan ini dapat diakhiri oleh salah satu pihak, dengan

menyampai-kan permintaan yang ditulis dalam waktu 3 (tiga) bulan setelah
pemberitahuan.
4.
Seluruh permintaan untuk GQA diterima sebelum pemberitahuan pengakhiran
yang telah disampaikan akan disepakati berdasarkan Perjanjian Pelaksanaan ini.
5.
Kewajiban yang diatur pada Pasal XX Perjanjian Pelaksanaan ini akan tetap
berlaku walaupun Perjanjian Pelaksanaan ini telah berakhir

SEBAGAI BUKTI, yang bertandatangan dibawah ini, sesuai kewenangan kedua belah
pihak, telah menandatangani Perjanjian Pelaksanaan ini.
DIBUAT di Jakarta pada tanggal 7 Oktober 1999, dalam dua naskah asli, dalam bahasa
Indonesia, bahasa Korea dan bahasa Inggris, kedua naskah mempunyai kekuatan
hukum yang sama.
Dalam hat terdapat perbedaan penafsiran, naskah dalam bahasa lnggri s yang
menentukan.

Government Quality Assurance (GOA) is t he process by which the
appropriate government authorities establi s h co nfidence that the
co ntra ctua l req uir e ments relating to quality are met .
Supp lier is the manufacturer on whom an Ord er 1s placed .
" Supp lier" a nd " Contractor" are sy non ymo u s .
The terms
Pur c haser is the Party, organization o r co mpan y pl aci ng a n Ord e r on a
Sup pli er.
Ord e r is the co ntract placed by the Party, organi zat io n or the su b-c ontract
ari sin g therefrom pla ce d by a c o mpany on a Suppl ie r .
D e legator is the appropr iate nat io nal authority of o ne P arty re que sting
Government Qual ity Assurance in the cou ntry of the other P a rty .

Government Quality Assuranc e in his ow n co~ ntr y .
ARTICLE II
SCOPE
l.
The Delegatee wi ll provide in hi s own country, upon request by the
D elegato r , GQA Services in all areas of defense supply and services,
subject to the cond ition s and definition contained in this Implementing
Arrangement .
2.
Noth ing contain ed in thi s Implementing Arrangement will prevent
the Parti es from making more s pecific ar rangements for the mutual
acceptance of GQA .
3.
Thi s Impl e mentin g Arrangeme nt is al so applicable to su bcontracts
for defen se materi e l and se rvices which arise from Order one of the
P arties , or w hi c h arise from Orders from another country for which one
P arty ha s ar ranged GQA , pro v ided that the prior permission of the
purchasing co untry has been given.
ARTICLE III
APPLICATIONS
A request fo r GQA in Supp li e r country w ill be restricted to tho se cases
where quality cannot be ver ified sati sfac torily after receipt of the specific
equip ment or w he n GQA at sou rce is considered essential by the
Purchaser.
ARTICLE JV
AUTHORITIES
I.
The Director Gen e1al for Mate riel , Facilities and Services will be
the responsibie au th or ity for the Department of Defens e and Sec,urity of
the Republi c of Indonesia for the implementation of this Implementi ng
Arrangeme nt .

2.
The Director of Defense Quality Assurance Agency (DQAA) will be
the respons ible authority for the Ministry of Natio nal Defense of the
Republic of Korea for the impl ementation of this Implementing
Arrangement .

A request for GQA will be fo rwarded by the De legato r to the
D e legatee sufficient time prior to the need for actual act iv it ies . Example
of a request is attached hereto marked as Annex A .

Requests for GQA will contain al l pertinent in formation including
but not limited to , the name and address to which techn ical
communication should be forwarded , special requirements with regard to
certificates, etc .
4.
Further, the Delegator shall ensure that the D elegatee is su pplied
with three copies of Order, applicab le specifications, drnwings , speci fi c
quality requirements and other doc~1me n ts essential to the performance of
th e requested GQA with translation to English approved by the Purchaser
and the Supplier. if necessary.
If it is not provided at the time of
submission of the request , the Delegator will arrange for them to be
upplied by the Supplier to the D elegatee .
A RTI CLE VI
ACCEPTANCE OF REQ UEST FOR GQA
I.
On receipt of a request for GQA , the Delegatee will , as the case
may be :
Accept the reque st, with o r without co mments and
a.
q ualificati ons and forward to the Delegator su c h acceptance m
writ ing , or
b.
T ra nsfer the request t o another GQA Auth or ity in his co untry
informi ng t he D e legator of the actio n taken , o r
Inform the Delegator that t he GQA ca nn ot be performed fo r

reasons s tated in the response .
The Oelegator will inform t he Supplier t hrough t he O e legatee w hen

3.
If the materiel and serv ices cove red by the request req uire specific
GQA acti v itie s beyond the capabilities of the Delega tee, special
ar range ments for th is activities will be made .
4.
l f the Oelegatee ' s inabi lity t o pro vi de d elegated GQA in accordance
with this Im ple menting Arrangement is lik e ly t o be due to mo re than an
exceptiona l circumsta nces, e .g . if requ est fo r a particu lar se rvice o f those
involving a part icular Nat ional Quality Assu rance Authority are unlikely
to be acceptab le for either a foreseeab le or a n indefinite period, t h e
Del egatee co nce rn ed will notify the Dele gator in writin g of the
ci rcum sta nces precl u ding acceptabilit y.
ARTICLE VII
C ONTRACT UAL PROVIS ION S
I.
The Order wi ll conta in an appropriate requirem e nt on the Sup pl ier
which will e nable the Delegatee as the authorized rep rPc;e ntati ve of the
Delegator to ha ve a ll nece ssary access to both the Supp li e r 's and his
subcontrac tor ' s premises, the nght to perform the require d quality
assuran ce, and the rig ht to use adequate fac ilit ies and acco mmodations , in
accordance wit h t he D e legatee' s no rmal or su c h s pec ia l procedure as may
o therwi se be arra nged between th e Del ega tor and the De legatee .

2.
The Order will define the method to be used for any conversion
between the foot-pound and metric system of measurements which may be
required in the course of checking and mea suring .
The Order will pro v ide that the Supp li er (including his

sub contractors) is responsible for maintaining effect ive co ntrol of the
qua lity of supplies and services, fo r the provision of test fac ilities and the
performan ce of inspections essential to demonstrate the full confo rm ance
of the su pplies to contract quali ty contro l requirements a nd for the
provi s ion of objective evidence that controls and inspections are effective
prior to offering the supplies for acceptance .
For the pur pose of
fu lfilling this paragraph, the Del egator will make use of Alli e d Quality
Assurance Publi cation (AQAP) documents or a jointly acce ptable
equivalent.
A RTIC LE VIII
PROCEDURE FOR GQA
I . H av ing accepted a request for GQA, the De legatee will implement a
Quality A ss urance Program which includes planning for GQA: evaluation
of the co ntract or's Qualit y Assurance P rocedure for co mplianc e w ith the
contract u al requirements , verification of the confo rm ity of the materiel or
se rvices with contractual requirements , GQA ar ra nge me nt s for
subcontracted work, when necessary , provision for the correction of
defi c ie ncies ,

and the Del egatee ma y jointly establish special requirements for the GQA .

If a Supplie r in o ne of the two count ri es awards a subcontract,
which requires GQA at the subcontractor's works the fo ll owing procedure
is to be fo ll owed:
a.
Subcontracts in the Delegatee's Country .
The De legatee
will perform GQA in accordance with hi s national procedures unle ss
ot her procedures are decided upon.
b.
Subcontracts in the Oelegato r 's Coun try.
The Delegatee
will make a request fo r GQA to t he D e legator who will carry out
GQA in a cc ordance w it h this Implementing Arrangement unless
ntb e r procedures are decid e d upon .

c.
Subco nt rac t s in a t hird country .
If e ither Pa rt ies have an y
a r rangemen t s rega rdi ng GQA in a th ird country, th e D elegatee wi ll
inform the D e leg ator about t he detail s of the arrangeme nt a nd , if
the D elegator appro ves, the D elegatee will seek to invoke t he
prov isions of that a rra ngement in accordance w it h sta11dard
procedu res therein prescr ibed .
If t here is no such arrangeme nt ,
then t he D e legatee w ill infor m t he D eleg ato r accor ding ly a nd w ill
make suggestions for Quality Assuranc e. Base d o n t he D e leg at ee' s
suggest io n, t he D elegato r w ill th e n decid e o n th e measure to be
take n a nd info rm t he De legatee acco rdingly.
ARTICL E IX
NOTIFICATION OF UNSATISFACTORY CONDITION S
If the D elegatee finds that , at any t ime during the cou r se of t he
Order, he cannot proceed with hi s function of GQA be cause of
deficiencies in the Supplier 's system (e.g . R equ ired Supplier testing
cannot be pe rforme d because of Jack of test faci lities , test dev ices are not
in a known state cali bration , qualificat io n or other eng inee ring ap p roval is
no t pe rfo r med, etc.) o r products (inc lu di ng pa rts, mat eria ls o r processes)
and su c h d eficiencies a re of major im po rtance o r will b e a cau se o f d elay ,
the Delegatee will immediate ly advise the D elegator of these fa c t s u sing
t he for m co rrespo nding to Annex C of t hi s Implement in g A rran ge me nt .
ARTI C LE X
CERTIFICATION OF CONFORMITY
As evide nce of GQA , us e w il l be made of the " Ce rt ifi cate of
Conform ity " in a form correspo nding to Annex B of t hi s Imp leme nt ing
Arrangement . Th e D e legatee w ill provide two copies of t he Ce rt ificate
o f Conformity to t he D elegator and fi ve copies to the Supp lier, w h o will
attach them to the appropriate de li v ery docume nts req ui red by the
co nt ract.

ARTICLE XI
RELE ASE FOR D EL IV ERY
Release for delivery of materiel and equipment whose quality has been
assured by the above procedures will be given in the manner pr escribed in
the Delegator's initial reque st.
No rma ll y, release for delivery will be
simu lt a neous with the issue of the Cert ificate of Conformity (A nnex B) .
ARTICLE XII
DEV IATIONS ANO WAIVERS
1.
Prim e Contracts.
Except where otherwise directed by the
Delegato r , the Delegatee shall be empowered to grant request s by t he
Supp li er for permission to depart from t he tec hnic al requi rements of the
contract unless such departures will affect safety, reliability,
maintainability, interchangeability, storage life, performance and cost.
Th e Delegator w ill be notified of any request g ranted by the Delegatee.
T he applications for t he deviations o r wa ive rs which are subject to the
decisions of the Delegator ( to be determ ined in the contract ) will be
fo rwarded by t he Supplier to the Delegator via the De legatee .
2.
Subcontracts.
R equest for deviations and wa ivers on subcontracts
which cannot be granted by the De legatee (to be determined in the
contract ) wili be forwarded by the Supplier via the D elegatee to the
Del egator for action in accordance with the contractual requ irements.
ARTICLE XIII
D ELEGA TOR 'S PARTI C IPATION
The Dele gator will be permitted to make vis it s to the Supplier concerned
during the co urse of the performance of the contract or sub- contract.
Any su c h visits w ill be arranged t hro ugh t he Delegatee who w ill
accompany the D elegator.

ARTICLE XIV
COMMUNICATIO NS
l.
The Delegator shall ensure that the Delegatee is furnished prompt ly
with any amendments, mod ifications or changes in documents originally
su ppli ed in accordance with Article V pa ra 3.

Any correspondence between the D elegator and t he Sup pli er,
pertaining to quality assurance will be t ransmitted through the D elegatee .
3.
The Delegatee and D elegator wi ll consult together on any event of
an expected c haracter which is like ly to affect the quali ty of materiel or
se rvices .
ARTICLE XV
CHA RG ES
I.
Unless otherw ise mutually agreed, the Delegator w ill not have to
pay d ir ect ly to Delegatee the charges related to the GQA re ndered by th e
D elegatee under the terms of the present Implemanting Arrangement.
2.
In the event of heavy costs being incurred, appropriate charges may
be negotiated between the Delegator and t he Delegatee.
ARTI CLE XVI
LIABILITY
The fact that the Delegatee has signed a Certificate of Conformity (Annex
B) will not relieve t he Supplier from the responsibility for furnishing
supp lie s that meet all the s pecifi cations of the Order.
I n the event that
defects a re discove red o n or subseque nt to deli ve ry of materiel and
serv ices, no liability wil l be attached to the Delegatee.
Howe ver, the
Ddegatee will assist the Delegator in the investigatio n of suc h defect s.
The Delegator will prov ide the D elegatP.e with a fu ll description of
defectc; , with supporting evidence and , if possib le, a samp le of t he
defective part .

AR T I CLE XV II
EXC H ANGE O F I NFO R MAT ION
As the need arises, representatives of the Parties will meet in order to
exc hange infor mat ion and experiences on GQA matter and to discuss
jointly any problems .
ART I C L E XV III
I NFORM AT IO N R E L EASE C O NDI T ION S
I.
Unless spec ific w ritten arrangements to th e co ntrary are concluded
between both Parties to cover particular re lease of information and
without derogat ing from the provisions of Art icle XX , th e followin g wi ll
app ly to information transferred betwee n both Par ti es und er this
Implementing Arrangement :

The informatio n is to be t reated as relea sed in co nfiden ce.
The infor mati on will be used by the recipient Party only for

A Delegator who releases information to a Delegatee under Article
Y, Para 3 and Article XIV, Para I will stipu late in writing at the time of
th e relea ~e th e arrange ments whi ch are to apply to any release of the
info rm atio n to thi rd parties and , in parti cu lar, to co ntracto rs or
sub co ntracto rs .
ART I CLE XIX
SU PP LEMENTA R Y ARRANGEMENTS
It is recognized that suppl ementa ry arrangements may be ne cessary fr om
time to time for the proper execution o f the provisio ns of this
Impl eme nt ing Ar ra nge ment. These will be effected by appropriate
ame ndmen ts to this Impleme nting Arrange ment .

C O NF IDE NTIALITY
I.
The overall confidentia lit y arrangement for the purpose of this
Implementing Arrangement w ill be in accordance with the Agreement
governi ng the Protection of Classified Military Informat ion between th e
Armed Forces In telligence Agency of the Republic of Ind o nes ia and the
Ministry of National Defen se -D efense Intelligence Agency of the Republic
of Korea , s igned on June 1, 1994 .

ARTICLE XXI
SETTLEM EN T OF DI S P UTES
An y misunderstanding regarding the interpretation or app li cation of this
Implementin g Arrangement will be resolved by consultation between both
Parti es and wi 11 not be referred to an international tribunal or third party
for se ttlem e nt .
ARTICLE XXll
ENTRY I NTO FORCE, AMENDMENT AND TE RMI NAT IO N
I.

This Impl ementin g Arrangement can be reviewed or amended at any
time by mutual written agreement between both Parties.

This Impl ementing Arrangement can be terminated by either Party,
giving the order on written 3 (three) months after notice.
4.
All r equests for GQA accepted before the notice of termination has
been delivered wi ll be dealt with in according with the provisions of this
Implementing Arrangement .
The ob li ga ti ons set forth in Article XX of th is Implementing

Ar rangement s ha ll remain effective even after the te rmin ation of this
Implementin g Arrangement.
I N W ITNESS WHEREOF, the undersigned , being dul y authorized by
