TENTANG
PROGRAM PERTUKARAN BUDAYA UNTUK TAHUN 2015-2018
Kementerian Pendidikan dan Kebudayaan Republik Indonesia dan Kementerian
Kebudayaan India untuk selanjutnya disebut sebagai "Para Pihak".
Berkeinginan untuk memperkuat hubungan persahabatan yang sudah ada di
antara kedua negara dan kerja sama yang erat di antara kedua Negara dan
warganya;
Merujuk pada Persetujuan antara Pemerintah Republik India dan Pemerintah
Republik Indonesia tentang Hubungan Keb udayaan yang ditandatangani di
New Delhi pada 29 Desember 1955 dan Pernyataan Bersama antara Republik
Indonesia dan Republik India tentang Pembentukan Kemitraan Strategis Baru
yang ditandatangani di New Delhi pada 23 November 2005.
Mempertimbangkan perlunya untuk mengembangkan dan membina hubungan
kebudayaan dan kerja sama antara kedua negara;
Sesuai dengan hukum dan peraturan perundang-undangan yang berlaku di
kedua negara;
T elah menyepakati hal-hal sebagai berikut:
Pasal 1
Tujuan
Tujuan dari Pengaturan ini adalah sebagai kerangka hukum untuk kerja sama
kebudayaan khususnya pada bidang bahasa dan kesusastraan, museum,
visual dan seni pertunjukan, film , sejarah, arkeologi, antropologi, folklor,
pameran,
penelitian
bersama,
pengembangan
sumber
daya
manusia,
konservasi dari objek warisan kebudayaan, dan pertukaran informasi.
Pasal2
lmplementasi
Detail dari program-program atau proyek-proyek yang dilaksanakan di bawah
Pengaturan ini akan diatur pada kasus per kasus melalui saluran diplomatik
yang akan mengatur di antaranya mengenai tujuan, program dan kegiatan,
lokasi dari proyek atau program, durasi, lembaga yang terlibat, ketentuan
finansial dan detail tindakan spesifik yang dilakukan oleh semua partisipan yang
terlibat di bawah Pengaturan ini. Detail dari yang disebutkan sebelumnya akan
menjadi bagian tidak terpisahkan dari Pengaturan ini.
Pasal3
Bahasa, Kesusastraan
1. Para Pihak akan mendorong penerjemahan dari kesusastraan klasik dan
modern dari setiap Pihak. Detail dari program-program atau proyek-proyek
akan diselesaikan melalui saluran diplomatik.
2. Para Pihak akan mendorong pertukaran peneliti dan pengajar untuk
mempelajari bahasa dan kesusastraan lokal yang secara bersama-sama
diidentifikasi dan disetujui oleh Para Pihak.
Pasal4
Museum
1. Para Pihak akan berpatisipasi di dalam seminar dan pameran yang
diselenggarakan di masing-masing negara.
2. Para Pihak akan memfasilitasi pameran bersama dari koleksi Museummuseum.
3. Para
Pihak
akan
mempertimbangkan
penyelenggaraan
pameran
kebudayaan pada waktu yang sesuai di Indonesia dan India.
4. Para Pihak akan melakukan pertukaran ahli di bidang Museum dan
Konservasi.
Pasal5
Seni Visual
1. Para Pihak akan mendorong pertukaran lukisan anak-anak dan partisipasi
dari anak-anak dari kedua negara di festival , kompetisi atau pameran ya ng
diselenggarakan di kedua negara.
2. Para Pihak akan bertukar salinan microfiche , salinan reprografi misalnya
slide~
foto, gambar dari objek seni, mural, lukisan, patung , desain gratis,
desain, dll untuk keperluan pameran .
3. Para Pihak akan bertukar atau memfasilitasi pertukaran kerajinan (tekstil ,
spesimen), topeng dan wayang (baik wayang kul it dan boneka tal i) dan
baju-baju tradisional untuk memperkaya koleksi institusi untuk tujuan
belajar.
Pasal6
Seni Pertunjukan
1. Para Pihak akan memfasilitasi pertukaran informasi terkait pertunjukan
wayang ku lit, perekaman audio-video, foto , slides, musik yang telah direkam
dan publikasi-publikasi pada Seni Pertunjukan.
2. Para Pihak akan memfasilitasi pertukaran tenaga ahli wayang kul it untuk
bersama-sama bertukar pengalaman.
3. Para Pihak akan memfasilitasi pertukaran delegasi dalam bidang tari
tradisional dan kontemporer, musik, teater dan kolaborasi dari seni
pertunjukan.
4. Para
Pihak akan
mengeksplorasi
kemungkinan
studi
banding
dari
pementasan wayang kulit.
Pasal7
Sejarah, Arkeologi dan Antropologi
1. Para Pihak akan bertukar tenaga ahli dalam bidang sejarah, arkeologi,
antropologi, dan konservasi begitu pula restorasi.
2. Para Pihak akan bertukar publikasi-publikasi dari hasil kegiatan penelitian
dalam bidang sejarah, arkeologi dan antropologi khususnya dalam area
yang diminati bersama.
3. Para Pihak akan bertukar kunjungan delegasi yang terd iri dari sejarawan,
arkeolog, antropolog, epigraf dan konservator selama dua minggu untuk
mengidentifikasi area-area spesifik yang diminati dan disepakati bersama
dengan partisipasi dari tenaga-tenaga ahli dari kedua negara.
4. Para Pihak akan mengadakan seminar-seminar dan workshop-workshop
pada area-area terkait yang diminati dan disepakati bersama dengan
partisipasi dari tenaga-tenaga ahli dari kedua negara.
5. Para Pihak akan mengeksplorasi kemu ngkinan Program-program bersama
untuk periode yang disepakati oleh Para Pihak dalam bidang:
a. Pengembangan dari metode-metode program pelatihan dalam bidang
arkeologi
b. Konservasi dan restorasi dari candi-candi Hindu/Budha yang terbuat dari
batu, Seni Batu bata
Pasal8
Film
1. Para Pihak akan mengatur festival film di masing-masing negara dengan
partisipasi delegasi dengan jumlah tidak lebih dari lima orang dengan
maksimum waktu penyelenggaraan selama lima hari.
2. Para Pihak akan mendorong seminar-seminar/ program-program pelatihan
dengan waktu penyelenggaraan tidak lebih dari lima hari serta kunjungankunjungan dari delegasi pemerintah dengan jumlah tidak lebih dari lima
orang yang bekerja di bidang perfilman untuk bertukar pandangan dan
pengalaman.
3. Para Pihak akan saling mengundang untuk berpatisipasi dalam Festival Film
di negara masing-masing dengan dengan jumlah delegasi tidak lebih dari
lima orang dan maksimum waktu penyelenggaraan selama lima hari.
Pasal9
Hak Kekayaan lntelektual
1. Meskipun terkandung hal di dalam Pengaturan ini yang pelaksanaannya
mempengaruhi
perlindungan
hak
dan
terhadap
kepentingan
hak
kekayaan
suatu
Pihak
intelektual
dan
serta
mengingat
kerahasiaan
dokumen-dokumen, informasi dan data. maka Pihak tersebut dapat
menempuh langkah-langkah yang diperlukan dengan berkonsultasi dengan
Pihak
lain
untuk
memastikan
bahwa
hak-hak
dan
kepentingan-
kepentingannya terlindungi dan terjaga.
2. Setiap
kegiatan-kegiatan
yang
bidangnya
merupakan
subyek
dari
Pengaturan ini akan dilaksanakan sesuai dengan hukum dan peraturan
perundang-undangan tentang perlindungan hak kekayaan intelektual yang
berlaku di masing-masing wilayah Para Pihak.
3. Para Pihak akan mengakui keberadaan dan meningkatkan perlindungan
yang efektif terhadap pengetahuan tradisional dan folklor serta hak-hak Para
Pihak untuk mencegah segala bentuk eksploitasi, penyimpangan dan
penyalahgunaan terhadap pengetahuan tradisional dan folklore Para Pihak.
4. Para Pihak akan menyusun pengaturan yang terpisah tentang hak kekayaan
intelektual yang dihasilkan dari setiap kegiatan dan kolaborasi yang
dilakukan di bawah Pengaturan ini.
Pasal 10
Peraturan Keuangan
Pengaturan keuangan untuk mendanai pengeluaran-pengeluaran dari k,egiatankegiatan kerja sama yang termasuk dalam kerangka Pengaturan ini akan
disetujui bersama oleh Para Pihak secara tertulis setiap kasus per kasus
mengacu pada ketersediaan dana dan personel.
Pasal 11
Pembatasan Kegiatan Personel
1. Semua orang yang terlibat di dalam kegiatan yang berkaitan dengan
Pengaturan ini wajib menghormati kemerdekaan politik, kedaulatan, dan
integritas wilayah negara tuan rumah dan akan bertindak sesuai ruang
lingkup di dalam Pengaturan ini.
2. Setiap pelanggaran dari Paragraf 1 dalam pasal ini dapat menyebabkan
pencabutan semua ijin dari orang terkait dan hal-hal yang diperlukan lainnya
sesuai dengan hukum dan peraturan perundang-undangan dari negara tuan
rumah.
Pasal 12
Penyelesaian Sengketa
Setiap sengketa dan/atau perbedaan yang timbul dari penafsiran dan
pelaksanaan dari Pengaturan ini akan diselesaikan secara bersahabat melalui
konsultasi atau perundingan antara Para Pihak.
Pasal13
Amandemen
Salah satu pihak dapat meminta secara tertulis untuk mengamandemen atau
mengubah bagian apapun dalam Pengaturan ini. Setiap amandemen atau
pengubahan yang disetujui oleh Para Pihak akan menjadi bagian tidak
terpisahkan dari Pengaturan ini. Amandemen atau pengubahan tersebut akan
mulai berlaku pada tanggal yang ditetapkan oleh Para Pihak.
Pasal 14
Mulai Berlaku, Masa Berlaku dan Pengakhiran
1. Pengaturan ini mulai berlaku sejak tanggal penandatanganan dan akan
terus berlaku sampai 31 Desember 2018.
2. Salah satu Pihak dapat mengakhiri Pengaturan ini dengan memberitahukan
secara tertulis kepada Pihak lain enam bulan sebelumnya melalui saluran
diplomatik.
3. Pengakhiran Pengaturan ini tidak akan mempengaruhi sampai selesainya
setiap program dan proyek yang dibuat di bawah Pengaturan kecuali Para
Pihak memutuskan berbeda.
Sebagai bukti, yang bertandatangan di bawah ini. telah menandatangani
Pengaturan ini.
Ditandatangani dalam rangkap dua di Jakarta pada tanggal 2 November 2015
dalam Bahasa Indonesia, Bahasa Hindi dan Bahasa lnggris, semua naskah
memiliki kekuatan hukum yang sama. Apabila terdapat perbedaan penafsiran,
maka naskah dalam Bahasa lnggris yang berlaku.

THE REPUBLIC OF INDIA
CONCERNING
CULTURAL EXCHANGE PROGRAMME FOR THE YEARS 2015 - 2018
The Ministry of Education and Culture of the Republic of Indonesia and the Ministry
of Culture of the Republic of India (hereinafter referred to as the "Parties");
Desiring to strengthen their existing friendly relations and closer cooperation
between the two countries and their peoples;
Referring to the Agreement between the Government of the Republic of India and
the Government of the Republic of Indonesia concerning Cultural Relations signed
at New Delhi on 291h December 1955 and the Joint Declaration between the
Republic of Indonesia and the Repub lic of India establishing New Strategic
Partnership signed at New Delhi on 23rd November 2005.
Considering the need to develop and foster cultural relations , as well as the
cooperation between the two countries;
Pursuant to the prevailing laws and regulations of the two countries;
Have agreed as follows:
Article 1
Objectives
The purpose of this arrangement is to provide a legal framework for cultural
cooperation particularly in the field of language and literature, museums, visual
and
performing
arts,
film,
history, archaeology, anthropology,
folklore,
exhibition , joint research , human resources development, conservation of
cultural heritage objects, as well as exchange of information.
Article 2
Implementation
The details of the programmes or projects conducted under this Arrangement
shall be regulated on a case to case basis through diplomatic channels, which
will specify, inter alia the objective, programmes and activities, location of the
project or programme, duration, the agencies involved, financial provisions and
other details related to the specific action conducted by all participants involved
under this Arrangement. The aforesaid details shall form an integral part of the
Arrangement.
Artic le 3
Language, Literatu re
1. The Parties shall encourage the translation of classical and modern literature
of each Party. Details of the programmes or projects shall be worked out
through diplomatic channels.
2. The Parties shall encourage the exchange of researchers and lecturers to
study local languages and literature as may be mutually identified and agreed
by both Parties.
Article 4
Museums
1. The Parties shall participate in seminars and exhibitions to be organized in the
respective countries.
2. The Parties shall facilitate joint exhibition of Museum collections.
3. The Parties shall consider organizing cultural exhibition at a mutually convenient
time in Indonesia and India .
4. The Parties shall exchange experts in Museology and Conservation.
Article 5
Visual Arts
1. The Parties shall encourage the exchange of children 's paintings and the
participation of children from both countries in the festival , competition or
exhibition held in both countries.
2. The Parties shall exchange microfiche copies, reprographic copies, e.g., slides,
photographs, drawings of art objects, murals, paintings, sculpture, graphic
design, etc. for the purpose of exhibition.
3. The Parties shall exchange or facilitate the exchange of handicrafts (textile,
specimen), masks and puppets (both shadow and marionette) and traditional
clothes to enrich the collection of specialized institution for learning purpose.
Article 6
Performing Arts
1. The Parties shall facilitate exchange of information regarding shadow puppet
shows, audio-video recording , photographs, slides, recorded music and
publications on Performing Arts.
2. The Parties shall facilitate the exchange of shadow puppet expert to mutually
exchange of experience.
3. The Parties shall facil itate the exchange of delegations of traditional and
contemporary dance, music, theatre and collaboration of performing arts.
4. The Parties shall explore the possibility of comparative study of performing
wayang or shadow puppet.
Article 7
History, Archaeology, and Anthropology
1. The Parties shall exchange experts in the field of history, archaeology,
anthropology and conservation as well as restoration.
2. The Parties shall exchange publications of the result of research activities in the
field of history, archaeology and anthropology particularly in areas of mutual
interest.
3. The Parties shall exchange visits of delegations consisting of historian,
archaeologist, anthropologist, epigraphist and conservator for a period of two
weeks to identify specific areas of activity of mutual interest to be agreed upon
with participations of experts from both countries.
4. The Parties shall arrange Seminars and Workshops on related areas of mutual
interest to be agreed upon with participation of experts from both countries.
5. The Parties shall explore the possibility of joint Programmes for the period
mutually agreed by the Parties in the fields of:
a. Development of training programme methods in archaeology.
b. Conservation and restoration of Hindu I Buddhist temples made of stone and
brick Rock Art.
Article 8
Film
1. The Parties shall organize film weeks I film festivals in each other's country with
participation of a delegation not exceeding five members for a maximum period
of five days.
2. The Parties shall encourage seminars I training programmes for a period not
exceeding five days and visits of delegation of officials, not exceeding five
members, working in film to exchange views and experiences.
3. The Parties shall extend invitation to each other to participate in the Film
Festival in their respective countries by a delegation not exceeding five
members for a maximum period of five days.
Article 9
Intellectual Property Rights
1. Notwithstanding
anything
contained
in
this
Arrangement,
where
the
implementation of this Arrangement affects any Party's rights and interest with
respect to the protection of intellectual property rights, as well as confidentiality
and secrecy of documents, information and data, that Party may undertake
appropriate steps in consultation with the other Party to ensure that its rights and
interests are protected and safeguarded.
2. Any activities in the fields which are the subject of this Arrangement shall be
conducted in line with the laws and regulations concerning the protection of
intellectual property rights in the respective territories of the Parties.
3. The Parties shall recognize the existence and promote the effective protection of
traditional knowledge and folklore as well as the rights of the Parties to prevent
any exploitation, misappropriation and misuse of the traditional knowledge and
fol klore of the Parties.
4. The Parties shall conclude a separate arrangement on intellectual property
rights resulting from any activity or collaboration done under this Arrangement.
Article 10
Financial Provision
The financial arrangement to cover expenses for the cooperation activities
undertaken within the framework of this Arrangement shall be mutually agreed
upon in writing by the Parties on a case to case basis subject to avai lability of
funds and personnel.
Article 11
Limitation of Personnel
1. All persons engaged in activities related to this Arrangement shall respect the
political independence, sovereignty, and territorial integrity of the host country
and shall act within the scope of this Arrangement.
2. Any viol ation of the paragraph 1 of this article may result in revocation of all
permits of the person concerned and other necessary measures in accordance
with the prevailing laws and regulations of the host country.
Article 12
Settlement of Dispute
Any
dispute
and/or
difference
arising
out
of
the
interpretations
and
implementations of this Arrangement shall be settled amicably through
consultations or negotiations between the Parties.
Article 13
Amendment
Either Party may request in writing for an amendment or modification of any part
of this Arrangement. Any amendment or modification agreed upon by the Parties
shall constitute as an integral part of this Arrangement. Such amendment or
modification shall come into effect on the date as may be determined by the
Parties.
Article 14
Entry into Force, Duration, and Terminati on
1. This Arrangement shall enter into force on the date of its signing and shall
remain in force until 31 December 2018.
2. Either Party may terminate this Arrangement by giving written notice to the other
Party 6 (Six) months in advance.
3. The termination of th is Arrangement shall not prejudice the completion of any
ongoing programmes and projects under this Arrangement unless the Partiec
decide otherwise.
In witness whereof, the undersigned, have signed this Arrangement.
Done in duplicate at Jakarta on 2 November 2015 in two originals, each in
Indonesian , Hindi, and English languages, all the texts being equally authentic. In
case of any divergence of the interpretation of th is Arrangement, the English text
shall prevail.
