MINUTES SPECIAL MEETING on January 4, 2016 Licensing/Permit Committee A meeting of the Licensing/Permit Committee was held on January 4, 2016, in Room 301 of the Kenosha Municipal Building. The meeting was called to order at 6:45 p.m. by Chair Wilson. At roll call, the following members were present: Alderpersons Juliana, Wicklund, and Ruffolo. Alderperson Bogdala was excused. 1. Applications for new Operator (Bartender’s) licenses, with a recommendation from the City Attorney to deny, based on: - material police record: a. Amber Bergman – present and spoke b. Bradley Mays c. Cheri Sinkovec – present and spoke - material police record and false application: d. Chauncey Body, Sr. – present and spoke It was moved by Alderperson Juliana, seconded by Alderperson Wicklund to concur with the recommendation of the City Attorney. Motion carried unanimously. 2. Application of Ashley Roe, for a new Operator’s (Bartender) License, with a recommendation from the City Attorney to defer. It was moved by Alderperson Ruffolo, seconded by Alderperson Juliana to defer to the meeting on January 11, 2016. Motion carried unanimously. 3. Application of Cast, LLC, (Paul Campagna, Agent), for an Outdoor Dining Area With Outdoor Extension located at 5623 & 5621 6th Ave., (Sazzy B & The Buzz), with a Request to Waive the Fencing Requirement and a Request to Change the Closing Hours to 1:30 a.m., with no adverse recommendations. (District 2) It was moved by Alderperson Juliana, seconded by Alderperson Wicklund to defer to the meeting on January 11, 2016. Motion carried unanimously. 01/04/16 L&P Minutes 1 4. Assistant City Attorney Matt Knight was present. Citizen Comments – None. Approval of the minutes of the regular meeting held December 14, 2015, and the special meeting held January 4, 2016. It was moved by Alderperson Juliana, seconded by Alderperson Wicklund to approve. Motion carried unanimously. (District 2) Applicant was present and spoke. It was moved by Alderperson Ruffolo, seconded by Alderperson Juliana to approve. Motion carried unanimously. 7. ALDERPERSONS’ COMMENTS: Alderperson Bogdala commented on the reports that the Police Department provide regarding the results of Tavern Squad stings for each applicant, and that he appreciates having that pertinent information available to review. Alderperson Wicklund concurred with Alderperson Bogdala. There being no further business to come before the Licensing/Permit Committee, it was moved, seconded and unanimously carried to adjourn at 7:07 p.m. 01/11/16 L&P Minutes 2 MINUTES January 25, 2016 Licensing/Permit Committee A meeting of the Licensing/Permit Committee was held on January 25, 2016, in Room 202 of the Kenosha Municipal Building. The meeting was called to order at 6:30 p.m. by Vice-Chairperson Patrick Juliana. At roll call, the following members were present: Alderpersons Wicklund, Bogdala and Ruffolo. Chairperson Wilson was excused. Deputy City Attorney Matt Knight was present. Citizen Comments – KPD Chief Morrissey spoke regarding the significant amount of calls for service to Brat Stop Too, and the establishment has become a concern to residents and surrounding businesses. He requested that Brat Stop Too be called before the Licensing/ Permit Committee for discussion of their activities. Approval of the minutes of the regular meeting held January 11, 2016. It was moved by Alderperson Wicklund, seconded by Alderperson Bogdala to approve. Motion carried unanimously. (Deferred from the meetings on January 4 and January 11, 2016) It was moved by Alderperson Ruffolo, seconded by Alderperson Bogdala to defer to the meeting on February 8, 2016. Motion carried unanimously. 3. Application of Red Iguana By Rosie’s, LLC, for a Yearly Cabaret License located at 4814 Sheridan Rd., (Red Iguana By Rosie’s), with an adverse recommendation from the Police Department. (District 2) (Deferred from the meeting on January 4, 2016) Applicant was present and spoke. Alderperson Juliana passed the gavel and spoke. Alderperson Wicklund spoke. Attorney Knight spoke. It was moved by Alderperson Juliana, seconded by Alderperson Wicklund to deny based on 1) substantial negative impact to surrounding properties and neighborhood, 2) existing plan character of neighborhood, 3) applicants compliance and performance of licensing laws, and 4) false application. Motion carried unanimously. 4. Renewal application of David D. Fude for a Pet Fancier Permit located at 3123 55th Ct., #51, with no adverse recommendations. (District 5) It was moved by Alderperson Wicklund, seconded by Alderperson Bogdala to approve. Motion carried unanimously. 5. Application of Gloria J. Zdanowicz for a Pet Fancier Permit located at 1927 62 nd St., with no adverse recommendations. (District 3) It was moved by Alderperson Ruffolo, seconded by Alderperson Wicklund to approve. Motion carried unanimously. 6. Application of Apollo’s Doggy Day Care, Inc., for a Kennel & Pet Shop License located at 7600 75th St., (Central Bark Doggy Day Care), with no adverse recommendations. (District 16) Applicant was present and spoke. Alderperson Bogdala spoke. It was moved by Alderperson Wicklund, seconded by Alderperson Bogdala to approve. Motion carried unanimously. 7. ALDERPERSONS’ COMMENTS: Alderperson Bogdala spoke about Chief Morrissey’s comments regarding Brat Stop Too and hoped to have the establishment listed as a discussion item on the next agenda. He also inquired as to why the additional deferment of the Brat Stop revocation hearing hadn’t been handled through the committee. He proposed that a policy on deferment actions be put on the agenda as a discussion item. Alderperson Wicklund thanked Chief Morrissey for bringing Brat Stop Too to the attention of the committee. Alderperson Ruffolo stated that all licensed establishments involved in revocation hearings should be treated equally. There being no further business to come before the Licensing/Permit Committee, it was moved, seconded and unanimously carried to adjourn at 7:07 p.m. 01/25/16 L&P Minutes 2 MINUTES February 8, 2016 Licensing/Permit Committee A meeting of the Licensing/Permit Committee was held on February 8, 2016, in Room 202 of the Kenosha Municipal Building. The meeting was called to order at 6:33 p.m. by Chairperson Curt Wilson. At roll call, the following members were present: Alderpersons Juliana, Wicklund and Bogdala. Alderperson Ruffolo was excused. Deputy City Attorney Matt Knight and special counsel Steve Cain were present. Citizen Comments – KPD Chief Morrissey spoke on the complaints and misinformation circulating regarding the purpose of the Tavern Unit. He provided 2014-2015 statistics on the amount of inspections performed, the amount of violations, and the amount of citations issued. Shirley Willie, Richard Willie, Alderperson Bob Johnson, Frank Carmichael and Cidney Bindelli spoke in support of the Brat Stop and the unfairness of the demerit point system. Approval of the minutes of the regular meeting held January 25, 2016. It was moved by AlderpersonJuliana, seconded by Alderperson Wicklund to approve. Motion carried unanimously. Discussion of the Class “A” Beer License of K-D Food Mart of WI, Inc., located at 5806 6th Ave., (K-D Food Mart). (District 2) Attorney Knight and Alderperson Juliana spoke regarding filing a Complaint. No action taken. 6. Discussion of the Class “B” Beer/“Class B” Liquor License of R & V Development, Inc., located at 5513-5515 6th Ave., (Brat Stop Too). (District 2) Chief Morrissey, PO Tetrick, and Alderpersons Juliana, Wicklund, Bogdala and Wilson spoke. The general consensus was to have Chief Morrissey do nothing at this time. 7. Complaint by the City Clerk seeking revocation of the Class “B” Beer/“Class B” Liquor License of STT Lighthouse, LLC, d/b/a Breakwater Bar & Grill, (Laura Saarnio, Agent, 5130 4th Ave.). (District 2) City appeared by Deputy City Attorney Knight. Licensing/Permit Committee appeared by Special Counsel Steve Cain. Licensee did not appear. It was moved by Alderperson Juliana, seconded by Alderperson Wicklund to revoke the Class “B” Beer/“Class B” Liquor License. Motion carried unanimously. 8. Motion carried 3-1, with Alderperson Bogdala voting nay. ALDERPERSONS’ COMMENTS: Alderperson Wicklund spoke regarding compliments paid to the Kenosha Police Department from citizens in attendance at the Public Safety & Welfare meeting. He also apologized to the Tavern Squad for deferring item 4, but felt it was necessary that they appear.
