INTRODUCTION The conference on Tanzanian Mining and Energy under the theme Utilizing Tanzania’s resources as the engine for sustainable development and economic integration was organized by the Tanzanian Ministry of Energy & Minerals in collaboration with AME Trade Ltd. The conference was held over 2 days on October 19-20, 2011, at the Ngurdoto Mountain Lodge, Arusha. The objective of the Conference was to promote Tanzania’s Mining and Energy industries and create a forum to establish business partnerships. It was also intended to evaluate achievements and successes obtained in the mining and energy sectors and explore new opportunities. The conference brought together policy makers, investors, industry experts, development partners and other key stakeholders in Tanzania’s mining and energy sector. The conference was sponsored by AngloGold Ashanti, Zantel, IMX Resource, Shell, African Eagle Resources Plc, CANACO, Deloitte, Kibo Mining PLC, Songas, BG Group, SCANIA, PANAFRICAN Energy and ZIMZAM Labour Group. 334 participants from 28 countries attended the conference. There were a total of 38 exhibitors. 2. CONFERENCE PROGRAMME AND SPEAKERS The conference discussed a wide range of issues pertaining to Mining and Energy sectors in Tanzania. Besides the opening and closing sessions, the conference was organized around 9 substantive sessions, which included the presentation of 31 papers and a roundtable discussion. The objectives of the conference were introduced by the organizers of the conference. The opening was addressed by high government officials and a representative of Anglo Gold, one of the lead sponsors. This was followed by substantive sessions in the conference. A summary of the Programme is as follows: 3. SOME OF THE ISSUES HIGHLIGHTED Significant issues were brought up during the conference. Among these are the following: Opening Session Eliakimu Chacha Maswi, Acting Permanent Secretary of the Ministry of Energy made an introductory remark. The speakers expressed his delight to welcome such a distinguished gathering of eminent persons to Arusha. He acknowledged sponsors and organizers of the conference. He stated that the object of the conference is to promote Mining and Energy potentials in Tanzania and share knowledge and experience in the sectors. He informed the panel that this is a momentous conference while Tanzania is celebrating its 50th anniversary of independence. The second speaker Mahad Ahmed, Managing Director, AME Trade Ltd made a brief remark highlighting the importance of the conference in providing a platform for partnership between the public and private sectors. He thanked sponsors of the conference and introduced conference programs and social functions. The opening speech was delivered by Ambassador Ami Mpungwe (Ret.), Chairman, Tanzania Chamber of Minerals and Energy. The Ambassador said that Tanzania is a resource reach country and Mining has been an engine to the country’s development. He underscored the commitment of the government in improving social and physical infrastructure to advance these sectors. He pointed out the contribution of the sectors for Tanzania’s economy. Despite the achievements, the country potential largely remains underexplored. Another speaker at the Opening Session was Gary Davis, Managing Director, Geita Gold Mine/AngloGold Ashanti. He briefed on the values adhered by the company and its positive impacts on the local community. He called upon the panel to discuss the challenges and opportunities in the Mining and Energy Sector. Hon. William M. Ngeleja, MP and Minister for Energy officially opened the conference and delivered a speech. He joined the former speakers in welcoming guests to Arusha. He gave an overview on the achievements and challenges faced by the government in the Mining and Energy sectors. The Minister acknowledged the importance of private public partnership for Tanzania’s economic development. He assured the panel that the government is ready and committed to improve policies, infrastructure and ensure transparency to make Tanzania a viable destination for investors. SESSION ONE: Key Projects and Future Development Strategy for Tanzania Mining Industry Gary Davies, Managing Director of Geita Gold MineLtd (Anglo Gold Ashanti), presented a paper on Geita Gold Mine: Expanding Tanzania’s Gold Horizons for a Brighter Future. Mr. Davis briefed on the historic evolution of mines from 1896 to date. He specifically emphasized on Getita’s gold production between the years 2000 to 2009. Geta has made contributions to Tanzania’s economy and benefited local communities by providing employment opportunities and improving local services. Geta was further involved in the TEITI reporting in aimed at ensuring transparency and accountability in the sector. He underscored the need for risk assessment, intensive stakeholder engagement and broader partnership for sustainable development. Bianca Manzi, General Manager of IMX, made a presentation on Exploration IMX Resources: IMX in Tanzania Project Updates. She introduced IMX projects in Australia and East Africa including projects in Tanzania. She gave a brief overview of Nachingwea Ni- Cu Jv projet and Mibango Ni-CU-PGE project in Tanzania. She further explained the phases of exploration between 2009 and 2011. She finally elaborated IMX’s strategy which includes becoming a multi mine owner. The presentation by Ebrahim Takolia, Mining Advisory leader and Anton Torlutter, consultant addressed the theme Deloitte: The requirements for the successful development of mining projects. The agenda of Deloitte was clearly stated. The presenters outlined four requirements to develop successful mining projects. These are 1) Mineral Resources and technical Audit process 2) A technically sound feasibility study 3) Review of capital efficiency 4) Operational readiness planning at the pre-production stage. Stephan Vermaak, Principal Investment Officer Oil, Gas, Chemicals and Mining Division, IFC made a presentation entitles IFC equity and debt financing supporting sustainable mine development in Tanzania. The presenter noted that there is a global hunger for resources, which attracts investment flows into Africa’s Mining sector. The most significant challenges currently facing the sector in Africa are resource nationalism, skill shortage, infrastructure access, corruption and maintaining social licenses to operate. International Financial Corporation (IFC) is a cornerstone investor and it is willing to support in challenging circumstances based on the availability of large resource potential and Transparency. SESSION TWO: Key Developments in Tanzania’s Oil and Gas Sector Neil Gilmour, General Manager, Floating LNG, in his presentation on Shell: industry trends and Shell capabilities in fLNG and LNG discussed how natural gas can benefit Tanzania. He pointed out that natural gas provides affordable supply, reduces blackouts during periods of drought and creates value in terms of tax revenues and job creation. He stressed the utilization of natural gas for Tanzania’s power market. Neil stated that Shell partnering with National Oil Companies is making immense contribution to national development. Matt Wilks, Country Manager, British Gas Group discussed the topic: Tanzania Deep Sea Exploration –an Update. He stated that there is a potential in energy in Tanzania. The country has large frontiers with sizable blocks and it is favourably located to India and Asian-Pacific Markets. BG has significantly invested in the exploration of gas in Tanzania and has three successful wells. The speaker pointed out that BG gas fields have sufficient reserves for increasing domestic demand. The speaker stated that BG is challenged by lack of sufficient services and skilled manpower, and urged Tanzania to build its capacity. Sabestian Shana, Tanzania Petroleum Development Corporation, in his presentation The Outlook for the Development of Oil and Gas Industry in the Country outlined the roles and achievements of Tanzanian Petroleum Development Corporation. He indicated that the corporation’s exploration history dates back to 1950s. He noted that petroleum exploration and production in Tanzania are governed by the 1980 Act and outlined TPDC main roles and activities under the act. A 4th licensing round will be held in April 2012 and the examples of Songo Songo Gas Field and Mnazi Bay Gas were discussed. According to the speaker, there was no single gas molecule flowing in Tanzania before 2004 and the country has had very little gas to power generation capacity. PanAfrican Energy is engaged in exploring, producing and selling Gas from the Songo Songo Island and 80% of the gas is used for power generation, which is providing alternatives source of energy in Tanzania. According to the presenter, the company intends to increase productivity, build additional infrastructure and continue to invest in community development activities. SESSION THREE: Delivering Social, Environmental and Commercial Responsibility Laurent Coche, VP, Africa Region, Anglo Gold Ashanti presentation was on GGM Aligned: Mining for Sustainable Growth and Achievement of the MDGs. The presenter underlined that companies have social responsibilities. He stated the fact that companies often focus on short term development projects rather than planning longterm strategic engagement to address deep rooted problems. He further noted that development activities executed by companies are largely disconnected from government development plans. He finally suggested that companies should engage with stakeholders and identify local development plans to benefit local communities. He further urged the stakeholders to use MDGs as a standard or an indicator to measure intended targets. Les Taylor, Operations Manager, Resolute Tanzania Limited spoke on the issue of Mine Closure &Future Plan. The speaker gave a brief overview of Golden Pride Mine project. The company has been operating for over 13 years in Tanzania and will cease to operate in 2011. The speaker emphasized that Mine closure process requires due consideration and plan to mitigate the negative impacts on local communities, employees and maintain company’s reputation. Accordingly, the company prepared a Statutory Mine closure plan, which was endorsed by the government in 2011. The plan incorporates strategies on rehabilitation, handing over facilities, relinquishing land and sustainable community development activities. Tim Morgan, Business Development Manager EMEA, Minelab talked on the topic Delivering Accessible Technology for ASM Community Development. Artisanal Small Scale Mining is predominant in Africa including Tanzania. According to the speaker nearly 50 million Africans are dependent on ASM. Nonetheless, Artisanal and Small Scale Mining is largely marginalized, labour intensive and technologically poor. Accordingly, small scale miners are damaging the environment and they are neither benefiting commercially. The speaker proposed the use of Milelab technology or Metal detector for Alluvial Gold Miner and briefed the panel about the social and environmental benefits of using the technology. John Brennan, President & CEO, talked on the issue of Decision Intelligence International: The Impact and consequences of the new anti- bribery & corruption legislation of the United Kingdom and increased enforcement activity of the US Department of Justice on the Tanzanian energy and mining industries. The presenter voiced his concern that the price of doing business in Africa is high due to corruption. Africans loses up to 25% of their GDP and US $148 billion to corruption each year. The presenter pointed out that the UK and the US laws which criminalize offences of paying bribes are being reinforced and companies engaged in corruption are increasingly subjected to serious punishment. He strongly asserted that companies can no longer say corruption is the way of doing business in Africa and urged all companies to be cautious and develop internal procedure to prevent corruption and bribery. The importance of corporate social responsibility was highlighted by John M Nayopa (Eng.), Project Manager - sustainable Management of Mineral Resources Ministry of Energy and Minerals in his presentation on The Quest for delivering benefits to local communities: A case study of large scale mining in Tanzania. The presenter indicated that there is a substantial improvement in Mining operations in Tanzania and it is significantly contributing to the country’s economy. However, corporate social responsibilities are perceived to require further improvements and progress.He finally called up on all stakeholders to enhance partnership for future progress. SESSION FOUR: Tanzania’s Power Sector: Generation, Transmission and Distribution Nazir Kachwamba, Senior Manager, Hydro Generation presented a paper on Power and Development in Tanzania representing William Mhando, Managing Director, Tanzania Electric Supply Company. TANESCO established in 1930s generates, transmits, purchases and distributes electricity in Tanzania. The presenter acknowledged the fact that there is a big deficit in Tanzania’s power demand and supply. TANESCO has designed short and long term projects and it is trying to reduce the generation costs to deal with the problem. The presenter finally called upon the private sector to invest in Tanzania’s power sector, acknowledging that fact that government lacks financial capacity to execute all planned projects. The presentation on Providing reliable and stable energy for Tanzania: The Role of IPP was made by Malcolm Taylor, Gas Infrastructure Manager, Songas Limited. He highlighted a 7 year record of achievement of Songas by marking that Songas supplies approximately 1/3 of Tanzania’s power. He further outlined the conditions that make conducive environment for IPP. These include; a clear strategic energy sector plan, a stable and transparent legal and regulatory framework and a multi-faceted interaction with the government. Moses Banda, Director, Kalahari Geo-Energy Ltd made a presentation on Exploring for Geothermal Power in the East Africa Rift Valley: The Case of Kalahari Geoenergy In Zambia. Kalahari is a company that is engaged in mining and exploration for geo-thermal power. He explained the importance of geo- thermal power by pointing the fact that African economies are making unprecedented growth and that there is an increasing demand for power. Talking on the entry of geo-thermal power by Kalahari geoenergy, the director noted that Kiwara resources exploration asset were disposed off on late 2009 and works on geo-exploration were initiated in July 2010. He further discussed the work plan of Kalahari geoenergy against time lines. Some of the challenges pointed were, the question of the role of the government whether as a regulator or investor. Finally, he pointed out new market prospects for Kalahari geoenergy by drawing into attention the opportunities in Malawi, Uganda and Tanzania. SESSION FIVE: Recent Technological Innovations and Applications Mr. Christer Engemoen, Project Manager Mining, Africa and Middle East Scania Tanzania Ltd presented on Scania CV AB Sweden: The Scania solution. SCANIA is a truck manufacturing company and has 120 years of experience. The presenter outlined the advantages SCANIA by pointing out that the trucks are fuel efficient and low cost. He strongly stressed that SCANIA provides the right vehicle in the right place. A presentation on Modern Drilling support technologies in conventional Oil & Gas wells was delivered by Nick de Blocq, Business Development Manager, Schlumberger. The speaker noted that oil and gas exploration has becoming an increasingly difficult task requiring advanced technology and huge financial resource. The presenter introduced new technologies that can be used in Drilling Support Services. The presenter called upon stakeholders to use new technologies to satisfy the growing energy demand and increase efficiency. SESSION SIX: The Legal Framework in Mining and Energy Sectors Jospeh Sheffu, Country Managing Partner, Ernst & Young presented on Creating the win win scenario the role of the government and the investor in compliance: the Auditor’s perspective. He noted that mining sector contributes to over 50% of export earning but only around 5% of GDP. He outlined the realities at the ground in the mining and energy sectors saying that Mines and Energy are highly politicized and easily linked to corruption. Some of the investor’s expectations discussed were; clarity on the rights of all parties, stability of fiscal regime and reduction of controls on mineral exports. On the other hand; government expectations included compliance to regulations, capital inflow and the promotion of local communities and environmental care. He concluded by stating that a good regulation requires a good process. To attain “A Win Win situation”; a good regulatory regime, transparency and good fiscal policy need to be maintained. Under the theme of The New Mining Act: One Year On, Tabitha Maro, Partner, Rex Attorneys, briefed on the categorization of prospecting licenses under the Mining Act of 1998 and that of 2010. She underlined the improvements under the new Act. She also pointed out the mineral rights granted under the respective Acts. Various types of licences were also discussed. However, she also voiced her concern that the provisions of these laws could lead to unintended end. Finally, she asserted that stakeholders need to work together continuously and transparently and need to be abided by the rule of law. Ally B. Samaje (Eng), Ag Commissioner for Minerals, Ministry of Minerals and Energy presented The fiscal and legal regimes in Tanzania’s Mineral Sector. He made an overview of policies and legal reforms by noting that the current legal and fiscal regimes for the mineral sector are the result of policy reforms that were initiated in 1980s. Policy reforms have resulted in liberalization of trade, privatization and decentralization. He noted that, the mineral policy of 2009 aims to attract private investment in these sectors and to promote public participation in mining. The Mining Act of 2010 and associated Regulations were also discussed. He informed that the Explosive Act was put in place in 1963 and the Explosive Regulations of 1964 has been amended in 2009. The salient features of Mining Act 2010 were also discussed broadly by the presenter. Mineral categories under the Mining Act include metallic minerals and energy minerals. Mineral rights and dealers licenses were also outlined. Mr. Samaje finally underlined that no Tanzanite will be exported without the Certificate of Origin so as to control smuggling. REPORT · Tanzanian and Energy Conference and Exhibition · Ngurdoto Mountain Lodge Arusha, United Republic of Tanzania · 19-20 October 2011 19 - 20 October 2011 Mining Ngurdoto Mountain Lodge Arusha, United Republic of Tanzania SESSION SEVEN: Financing options for Tanzania Mining and Energy Sectors Godfrey Mwindaare, Chief Investment Officer, Private Sector Department, AfDB, delivered a presentation on Accessing DFI Financing: What you need to know. The speaker noted that, Africa is a new supply hot spot as a result of depletion of global mineral reserves. While explaining DFI’s involvement in the private sector, he stressed that the private investment is strongly associated with economic growth and that the private investment has marked significant growth as compared to the public investment in developing countries. In the area of project development, DFI takes up the role of advisor, honest broker and investor. As an investor, projects that lie at the public-private interface are identified as the best strategic fit. He further discussed the selection criteria for the Bank’s involvement and the characteristics of the projects. Gasper Njuu, Deputy Managing Director, Citibank Tanzania Ltd, emphasized on the theme of financing energy projects. His presentation was entitled Financing options for Tanzania Mining & Energy sector. The presenter mentioned that the banking sector in Tanzania was liberalized in 1980s allowing private and foreign banks to operate. Currently, there more than 40 banks operating in Tanzania and the sector is stable and well regulated. The banking sector provides funding to permissible regulatory limits. The speaker shared the experience of Citibank’s transaction and challenges. Tanzania EITI: EITI Initiation and Implementation in Tanzania was discussed by Lightness Joel Mnzava(Dr.) from the Ministry of Energy & Minerals. She stated that 25% of the foreign earning of Tanzania emanates from the mineral sector qualifying Tanzania to join the global Extractive Industries Transparency Initiative. Over 800,000 KM square of the country is endowed with potential mineral resources. In many countries, money from oil, gas and mining are associated with poverty, corruption and conflicts due to lack of transparency and accountability. Tanzanian EITI sets the standard of transparency and accountability of the Extractive Industries in Tanzania. It enhances transparency and accountability of payments made by the companies and revenues collected by the government from these sectors. TEITI promotes involvement of stakeholders, benefits companies and investors and provides information to the public. Tanzania has produced the 1st report, which among other issues, identified and explained the discrepancies. The speaker also noted that the 2nd report is under preparation. SESSION EIGHT: Investment Opportunities in the Mining and Energy Sector Prof.Abdul Mruma, CEO Geological Survey of Tanzania, spoke on Opportunities for investing in Tanzania in the development of Earth Resources. He pointed that good policy and governance, political stability and peace in the country as some of the prerequisites for attracting investment in earth resources. He noted that, Tanzania is a peaceful and stable country that has adopted a multiparty democratic system. The government of Tanzania has adopted an economic policy in the 1990’s promoting the private sector to take part in all economic sectors. The presenter largely discussed the geological endowment of the country. He also highlighted the social and economic infrastructures as well as the support services in Tanzania. He finally added that Tanzania has many tourist attractive sites and invited investors to come to Tanzania. Fadili Kileo, Senior Geologist, Ministry of Energy and Minerals, gave an overview of the Tanzania’s energy sector in his presentation on Investment opportunities in Tanzania’s Energy Sector. He stated that Tanzania has vast potential in renewable and non-renewable energy: hydro power, coal, natural gas, bio fuels and others. He, however, said that the energy sector is not well explored and access to electricity is still minimal especially in rural areas. The speaker indicated that the availability of financial resource to develop the energy sector is very challenging and called up on the private investors to utilize ample opportunities in the sector. He underscored that the government is committed to invite the private sector. Andrew Smith, CEO & President, Canaco Resources Ltd, Canaco Advancing the Handeni Project toward Feasibility in a New, Emerging Gold District in Tanzania. CANACO is a Goldfocused exploration company. The presenter indicated that the region has been overlooked in Gold exploration. The company has active exploration projects in Tanzania. The initial exploration result indicates that there is a substantial potential of gold in Tanzania in areas targeted by the company. Gold Exploration in Tanzania was discussed by Louis Coetzee, Chief Operating Officer, Kibo Mining Plc. Kibo is an Irish registered company established in 2008 to focus on exploration and development of gold and nickel in Tanzania. Kibo is operating in Tanzania because the country is among the top four gold producing countries in Africa. Tanzania is endowed with world class gold mines and there are opportunities of new gold mine discoveries. Haneti and Morogoro are the areas where Kibo projects are located. Exploration time lines and budget for exploration were also elaborated by the presenter. REPORT · Tanzanian and Energy Conference and Exhibition · Ngurdoto Mountain Lodge Arusha, United Republic of Tanzania · 19-20 October 2011 19 - 20 October 2011 Mining Ngurdoto Mountain Lodge Arusha, United Republic of Tanzania Mark Parker, Managing Director, African Eagle Resources PLC, made a presentation on Dutwa: a unique nickel deposit in Tanzania. He made an overview of African Eagle and assessed nickel market by looking into the global nickel production verses the production. Dutwa is located at the south east corner of Lake Victoria. It is engaged in very large oxide nickel deposit and utilizes exceptional metallurgy, easy mining and strong economies. However, the issue of transport remains to be a challenge to the project. The company has also identified a new target; Zanzui which is 15 kms away from Dutwa. Shanta Mining Company Ltd. in his presentation on Shanta Mining Company introduced that Shanta is engaged in gold mine exploration. In 2005 Shanta was an exploration company and now has moved to a mining company. He outlined mining projects: Mgusu, Shingid, and New Luika Gold Mine. He recognized that local communities often do not benefit significantly from mine development. However, he underlined that Shanta intends to focus on leaving in place community trust and also discussed the funding model of closure. He finally called for commitment on the part of the government and the community in the utilization of funds and community projects. SESSION NINE: Building Partnership for the Development of Mineral Sector • The final session of the conference was a roundtable discussion on Building Partnership for the Development of Mineral Sector. Participants were Emmanuel W. Jengo, Executive Secretary, Tanzania Chamber of Minerals and Energy, Christopher Sheldon, Mining specialist, World Bank Group World Bank Group and Godfrey Mwindaare, Chief Investment Officer, Private Sector Department, AfDB. The discussion explored ways of encouraging corporate social responsibility. Panelists also encouraged local manufacturing and beneficiation. They deliberated on building trust through communication, dialogue and transparency. CLOSING SESSION The closing session was addressed by Hon. William Ngeleja (M.P.), Minister of Energy and Minerals. He noted that, this is the first time that the Ministry of Mines and Energy in partnership with private companies has successfully prepared a forum for the government and investors to conduct dialogue and exchange views on mining and energy potentials in Tanzania. The Minister stated that Tanzania has been a prospective area for natural resources exploration, but the rate of exploration has not been comparable with the potentials that exist in the country. He asserted his belief that this conference has greatly helped efforts towards increased exploration and development in the two sectors. He also assured investors that apart from incentives that are offered in the mining and energy sectors, there is no political risk in investing in these sectors. At the end, he acknowledged organizers of the conference, AMETrade and the Ministry of Mines and Energy, for the brilliant organization of the Conference. He also appreciated participants of the conference for sharing their knowledge and experiences in the sectors. Finally he gave a brief summary of the main points raised at the conference, and thanked the speakers and participants for contributing to the conference. Conclusion and Recommendation • The global hunger for resources made Africa a hot spot for Mining and energy supply. Tanzania has substantial mining and energy potential. There is a substantial improvement in Mining and energy operations in Tanzania contributing to the country’s economy. Despite these encouraging developments, the country’s potential remains largely underexplored. The government designed favorable legal frameworks and policies to attract investors. • The conference pointed out ways of overcoming the supply challenges by suggesting alternative sources of power such as gas exploration and Geo-termal power • The conference agreed on the importance of corporate social responsibility. The practice so far is satisfactory but needs further improvement.
