INSTRUCTION TO APPLICANTS
1.0
BACKGROUND OF DEVELOPMENT
The Penang Development Corporation (PDC), a state owned Development
Corporation, intends to develop an Arts District (hereinafter referred to as the
“Development”) on the adjoining lands of PDC and the State located off Gat Lebuh
McCallum and Lebuhraya Tun Dr. Lim Chong Eu, as shown in the Key Plan, Location
Plan and Site Plan attached hereto (“the Area”) in Attachment 5.
PDC invites proposals for the development which will be home for the arts and creative
businesses in Penang. The allocated funds for this development is offered at the
amount of Ringgit Malaysia Thirty Million (RM30,000,000.00) only but such amount may
vary depending on the proposal submitted by the Successful Tenderer which final
amount shall be decided at PDC’s discretion.
This pre-qualification document provides guidance on the preparation and submission
of application for pre-qualification for the Development and explains the procedures
for PDC’s assessment of the pre-qualification proposals.
This pre-qualification prepared by PDC is open to eligible companies to participate.
There will be a two (2) phase of the qualification process where tenderers are required
to meet the Pre-Qualification criteria before being invited to quote and submit their
tender for the Request For Proposal (“RFP”).
2.0
SCOPE OF WORK
The scope of the works covered by the present tendering (hereinafter referred to as
“the Works”) shall consist of the following components:
1.
Master Planning of the proposed development;
2.
Conceptual design of the proposed development; and
3.
To submit credential of the participating team members consist of:
(i)
Primary Team –
The Architect, C&S Consultant, M&E Consultant, Quantity Surveyor,
Landscape Architect and a Grade 7 Certified Builders.
(ii)
Supporting Team –
Heritage Consultant, Ecologist, Traffic Consultant, Lighting Consultant,
Wayfinding Consultant, and others as per the team’s proposal.

PROJECT OVERVIEW
3.1
Background
The Penang State Government has envisioned Penang Arts District (hereinafter
referred to as “PAD”) to be the creative hub of Penang’s contemporary arts
and culture, as an initiative to catalyse the economic growth of the creative
industry in Penang. With an existing dynamic arts scene in Penang that is
growing as a contemporary cultural centre, PAD will enhance the value of
Penang’s arts and culture by engaging artists, craftsmen, educators and the
community at large through the activation of creative spaces with interactive
art-related programmes.
PAD will be an incubation centre for aspiring and emerging artists who are
looking for support and opportunities to expand their creative career. It will also
be a creative network that unifies the dispersed arts scene in Penang. PAD will
host arts-related festivals and fairs established both locally and internationally
to promote opportunities for arts and creative exchange.
3.2
Physical Space & Programmes
Situated at a site area of 9.2 acres, the arts district will consist of innovatively
designed cluster of containers that are affordable, efficient and
environmentally friendly. With a gross floor area of 80,000 square feet, PAD is set
to be the largest container city in the world, housing galleries, arts spaces,
studios, workshops, artisanal retail stores, premium outlets and many more to
support the thriving creative industry in Penang. Refer to Attachment 6: Tenant
Mix (Preliminary Proposal) for a list of potential tenants and programmes for the
arts district.
With pockets of green park and dedicated open spaces showcasing public art,
PAD will serve as a community centre that attracts the residents of Penang to
explore their inner creative pulse and to cultivate a creative lifestyle. Moreover,
these public spaces are ideal venue choices for vibrant art related festivals and
events that are accessible to the public.
The arts district will be a hip and urban creative hub that connects the existing
arts spaces in Penang, connecting them to a greater audience. PAD is an
initiative by Penang for the people of Penang. It will be a recognizable icon in
Penang as the destination for both locals and visitors to explore the arts in the
midst of Penang’s rich cultural and heritage backdrop.
3.3
Ownership
The Land for the Penang Arts District’s Development will be alienated to PDC
by the state whereupon PDC shall be the registered proprietor to the land and
sole owner of PAD upon completion of the Development. The said land shall be
a leasehold land with a tenure for Ninety Nine (99) years. Upon completion of
assessment to the RFP by PDC, the tender contract (‘Contract”) based on the
Design and Build (D & B) concept will be awarded to the Successful Tenderer
whereupon, such contract shall bind PDC and the Successful Tenderer. Penang
Convention & Exhibition Bureau (PCEB), a wholly owned subsidiary of PDC, is
appointed to manage and coordinate the operation of PAD upon completion
of the Development.

DEVELOPMENT ON LAND
The development must consist of the following compulsory development components
and should comply with the following mandatory planning considerations and
planning requirements:

Compulsory Development
4.1.1
Master Plan
(i)
Multiple zoning based on programming, circulation and macro
context of the site;
(ii)
Area within the development is to be fully pedestrianised
whereby pedestrian friendly vehicles i.e. scooter, buggy, etc.
are allowed;
(iii)
Accessibility into and within the development is to be barrier free
for disabled and elderly persons;
(iv)
40-45% of the overall site is to be pockets of green park and
open spaces (refer to row 4 of Attachment 6: Tenant Mix
[Preliminary Proposal]); and
(v)
To propose site’s connectivity incorporating the proposed LRT
line, the proposed overpass at Lebuhraya Tun Dr. Lim Chong Eu
and the proposed overpass from Jalan Dr. Lim Chwee Leong
(refer to Attachment 3: LRT Alignment; and all other connectivity
in the forms of bus transit, bicycle lanes and direct pedestrian
links and access from George Town); and
Note: The proposed LRT line, the proposed overpass at
Lebuhraya Tun Dr. Lim Chong Eu and the proposed overpass
from Jalan Dr. Lim Chwee Leong mentioned above are
preliminary and unconfirmed at the date of release of this
document.
(vi)

To propose 2 options for car parking on site – over ground and
underground.
Conceptual Plan
(i)
To incorporate shipping containers with minimum build up area
of 80,000 square feet; and
(ii)
Other building elements are permissible subject to meeting
condition of item 4.1.2(i) above
Mandatory Planning Considerations
4.2.1
The development is to adhere to the rules, regulations and by-laws of
Majlis Bandaraya Pulau Pinang (MBPP) and all relevant authorities.

The successful Tenderer will be required to conduct all necessary
studies of the area. Such studies shall include but not limited to:
(i)
Land and location feasibility study;
(ii)
Area connectivity incorporating the proposed LRT line, the
proposed overpass at Lebuhraya Tun Dr. Lim Chong Eu and the
proposed overpass from Jalan Dr. Lim Chwee Leong, and all
other connectivity in the forms of bus transit, bicycle lanes and
direct pedestrian links and access from George Town;
(iii)
Site investigation and data collection for soil investigation and
utility mapping;
(iv)
Feasibility study and proposal to restore and rehabilitate the
adjacent JPS drain;
(v)
Dilapidation study, if proposal for an underground car park is
accepted;
(vi)
Required reports to accompany Planning Submission (if
exempted, an official letter from relevant authorities are
required);
a)
Heritage Impact Assessment (HIA) – the site is abutting
UNESCO buffer zone and hence, is considered a buffer to
buffer development;
b)
Environmental Impact Assessment (EIA) – the site is a
development connecting to the sea and JPS’s retention
pond. Tenderer is to consult Jabatan Alam Sekitar (JAS);
and
c)
Traffic Impact Assessment (TIA) – mandatory in all planning
submissions.
(vii)
If proposal for an underground car park is accepted, car park
design should adhere to the LRT development within the site;
and
(viii)
Supporting feasibility and market studies for the proposed
development.
The Development of PAD must be fully designed, constructed and
completed by the Successful Tenderer within 18 months from the date
of execution of the Contract Agreement.
Planning Requirements
The Development should:

Generate social, economic and other related benefits to the State of
Penang and PDC via the Development to the PAD;
4.3.2
Complement its surrounding area and activities at the same time to
not deviate from the main vision of the State towards PAD to be the
creative hub of Penang’s contempary arts and culture; and

Be commercially and environmentally sustainable and adhere to the
standards of the related industry to ensure the ability to attract,
facilitate and host arts-related festivals/fairs/events both locally and
internationally.
SUBMISSION FOR PRE-QUALIFICATION
5.1
Refer to PDC’s pre-qualification invitation for details on the method of
submission.
5.2
Tenderers are required to complete and submit all attached forms (as stated in
Attachment 1 and 2) which must be certified by the company secretary.
5.3
Tenderers are to submit Cost Plans with comprehensive cost breakdown for all
proposed options.
5.4
Tenderers are to submit Work Programs with detailed breakdown of milestones
for all proposed options.
QUALIFICATION AND ACCEPTANCE OF PRE-QUALIFICATION
6.1
This tender is open to all Sdn. Bhd. and Bhd. companies and/or Joint Ventures
(which are not debarred under winding up, receivership or judicial
management).
6.2
The tenderer shall possess the followings:

(i)
Experience in undertaking projects of similar size and scope and shall
have completed or placed in service at least one comparable project
in the Development proposal;
(ii)
Strong and positive reputation for reliability and commitment and shall
provide track records and curricular vitae for these experiences;
(iii)
Alternatively, has a core subsidiary business in operation of or related to
the development, operation and maintenance of a container
development or a creative driven development or ability in bringing
together a team or partners with experience in such area of expertise;
and
(iv)
Technical capability with experience in development, construction,
maintenance and management of a container development or a
creative driven development; and
(v)
Preferential is given but not limited to Penang companies based on
experience working on reclaimed land developments and design
sensitivity on local culture and context.
At this Pre-Qualification Stage, if the Proposal and Price Tender is submitted on
a joint venture basis using special purpose vehicle (“SPV”), each of all the
companies in the joint venture shall submit their Company Profile together with
a copy of the joint venture agreement.

The Pre-Qualification Proposal shall be signed by all Partners so as to be legally
binding on each member of the Joint Venture. The name of the signatory shall
be shown in print underneath each signature. A copy of the Joint Venture
Agreement that has been, or is intended to be entered into by Partners, shall
accompany the Pre-Qualification Proposal.
PRE-QUALIFICATION / STAGE 1
The Tenderer shall fulfil all the following conditions for eligibility to qualify for the next
stage:

Only companies of a financial capability with a minimum paid up capital of
Ringgit Malaysia Five Hundred Thousand (RM500,000) only or its equivalent
value are eligible to participate and shall submit the relevant company
registration documents showing the paid up capital.
7.2
Having a core or subsidiary business in operation of or related to the
development, operation and maintenance of a container development or a
creative driven
development including the marketing and promotion of
such facilities globally, and
7.3
Technical capability and experience in container specific development
including design and implementation of its space rental and usage which
include but not limited to arts and creative businesses.
AREA INSPECTION
The Area is open at all time for self-inspection purposes by tenderers who shall do so at
their own risk, cost and expense.
An official briefing shall be conducted by PDC to potential tenderers on 30th June 2016
at Penang Convention & Exhibition Bureau (PCEB) No. 14A &16A (First Floor), The
Whiteaways Arcade, Lebuh Pantai, George Town, 10300, Penang, Malaysia at 10:30
am to be followed by a site visit.

STAGE 2
9.1
Only tenderers who have met the evaluation criteria at the Pre-Qualification
stage (“Stage 1”) will be invited to participate in the next stage which is Stage
2 whereby the Tenderers will be required to purchase the RFP documents
consisting of both the Executive Summary and the Conditions of Tender.
9.2
The Executive Summary, Conditions of Tender and all other documents and/or
information is a continuing legal tender to the Pre-Qualification Stage.
9.3
Shortlisted Tenderers in Stage 2 will be granted monetarily with an amount of
Ringgit Malaysia Twenty Thousand (RM20,000.00) only to further develop the
proposals for the development of PAD.

1. 798 Art Zone or Dashanzi Art District, Beijing, China



A vast area of disused military factories built by the East Germans, the district is an Avantgarde home to Beijing’s contemporary artist community
The district frequently hosts international arts exhibitions and art activities as well as
fashion shows
Surrounded by walls with graffiti, enormous art sculptures, various galleries, bars and
eateries, it has become a destination for tourists to wander and to discover the arts




An arts and crafts enclave that has developed from a renovated residential area in the
French Concession area of Shanghai
The district comprises a neighbourhood of labyrinthine alleyways, home to boutique retail
stores, art galleries, studios, bars, restaurants and etc.
It is now a major tourist attraction and has more than 200 diverse small businesses

3. Aurora Cultural Arts District, Colorado, USA



A partnership of creative enterprises, individuals, local businesses, area residents and the
City of Aurora whose mission is to enhance the district’s neighborhoods and market it as a
destination through a variety of cultural and educational experiences
ACAD provides events for artists to share their work with the community via the annual
Aurora Art Festival and other special events throughout the year.
The city's vision for the arts district in north Aurora is to create an epicenter of activity where
residents can wander through the galleries and bars that surround the professional
performance studios and theaters

1. Common Ground, Seoul, South Korea






Korea’s first pop-up store built with shipping containers
approximately 57,000 square feet in scale and made up of 200 large containers
Located to close to a university, it became a great commercial destination for youths
New and trendy mid-sized shops by up and coming designers and editorial shops can be
found here
Various events such as exhibitions and performances are organised to entertain shoppers
while playing its role as a cultural space.
There are restaurants and eateries sprawled along the sides of the alley, and also food
trucks on market ground for light snacks and exotic gastronomic dining experience
2. Re:Start, Christchurch, NZ





A temporary mall built from shipping containers in Christchurch Central City in response to
the earthquake in February 2011
The mall was opened in October 2011, with an estimated 10,000 visitors on opening day
It started with 27 businesses which grew to well over 50 businesses today
There are market stalls, street performers and buskers
They have recently announced to shift the northern precinct to another part of the mall to
pave the way for a permanent new office and retail complex

BOXPARK is an urban lifestyle destination in Dubai offering a selection of unique retail
experiences and quirky dining concepts from around the world on a 1.2 km strip
220 shipping containers are put together to form a unique architectural design with an
eclectic mix of colours
The development features 44 retail, restaurant, cafe, and entertainment brands, blending
the best of local and international concepts appealing to the national and expatriate
community in the UAE
4. Quo Container Center, Buenos Aires, Argentina



Designed by Cecilia Bertezzolo from the Buenos Aires-based BZZ Architecture, the QUO
Container Center consists of 57 maritime shipping containers salvaged from a local port.
A remarkable balancing act between modern arts and small businesses, the community
features rows of restaurants, art shops, boutiques, cafes, and gallery spaces.
The three-story QUO Container Center is arranged so that visitors can enjoy plenty of open
spaces, and is topped with a 33,000-square foot vegetative roof, coupled with extensive
public green spaces.
