SN SkilledNursing I-2 Nursing Homes Nursinghomesprovidecaretopersonswhoarechronicallyillorrecuperatingfromanillnessorinjuryandneed24hour nursingcareandotherhealthservicesbutnothospitalization.Theyusuallyproviderehabilitationprograms,assistancewith personal care, social activities, supervision, and basic room and food services. Nursing homes are licensed by the North CarolinaDivisionofHealthServiceRegulationandmostarecertifiedforMedicareorMedicaidreimbursement. Nursinghomeshaveanadministratorwhohastheresponsibilityofmanagingthefacility.AlicensednurseservesasDirector ofNursing(DON)andsupervisestheresidents’personalcare.CertifiedNursingAssistants(CNA’s)provideroutinecare.The numberofCNA’sondutydependsonthenumberofresidents.Socialworkers,activitycoordinators,physicaltherapistsand dietarystaffprovidespecificservicesinthefacility. TheDivisionofHealthServiceRegulation(DHSR)isapartoftheNorthCarolinaDepartmentofHealth&HumanServices (DHHS).DHSRinspectionsareconductedannuallyandcomplaintsareinvestigatedwhenreported.Facilitiesthataccept residentsreceivingMedicaidandMedicarearecertifiedbytheDivisionofMedicalAssistance(DMA)andmustposttheir inspectionreports.TheWesternRegionalOfficeoftheDivisionofHealthServiceRegulationislocatedinBlackMountain, (828)669-3373. Under North Carolina’s Nursing Home Bill of Rights, all residents are to be treated with respect, consideration, and full recognitionofpersonaldignityandindividuality.TheRegionalLong-TermCareOmbudsman(anadvocatefortheresidents) andyourlocalNursingHomeCommunityAdvisoryCommitteeworktoseethattheserightsarerespected. The Cost of Nursing Homes Thecostofnursinghomecareoftenseemsoverwhelmingtotheresidentandhis/herfamily.Facilitiestypicallycharge$3700 -$6000permonth.Thiscostcovers24hournursingcare,mealsandmostservices.Mostfacilitieswillchargeadditional monthlyfeesforaprivateroom.ResidentsreceivingMedicaiddonotpayanadditionalfeeforlaundryservices.Askthe appropriatefacilitypersonnelaboutthesecostsandcharges. Over70percentoftheresidentsinnursinghomesreceiveMedicaid–anentitlementprogramforthosewithlimitedincomes andresources.OftenresidentsenterafacilitywiththeirownresourcesandthenconverttoMedicaidwhentheirpersonal fundsarespent.AprivatepayresidentmaynotbedischargedfromafacilitycertifiedtoserveMedicaidresidentsonly becauseheorsheneedsMedicaidtoreimbursethefacility.Medicaidreimbursesfacilitiesforthe“costofcare”(which includeswheelchairs,medicaltransportation,bandages,etc.).Residentsshouldinquireaboutthecostsassociatedwiththeir carebeforetheypayforadditionalservicesfromtheirownfunds.CalltheMedicaideligibilityworkerattheDepartmentof SocialServicesifyouhavequestionsaboutwhatMedicaidcoversandtoseeifyouareeligible. Fewpeopleinnursinghomes(lessthan5percent)arecoveredbyMedicare-afederalhealthinsuranceprogram.Medicare onlypaysforspecificneedsandproceduresandforalimitedperiodoftime.Aphysicianmustcertifytheresident’smedical careneeds.TheresidentisevaluatedonadmissionandadeterminationismadethenaboutMedicarecoverage.Currently, Medicaremaycoverupto100daysofnursinghomecare;however,theresidentisresponsibleforaco-paymentafterthe 20thdayofMedicarecoverage.Thisco-paymentamountchangesannuallyandisapproximately20%.Iftheresidenthas aMedicaresupplementalpolicytheco-paymentmaybecovered,aslongasthephysiciandeterminesthattheindividual continuestoneed“skilledcare.” Someolderadultshaveinsurancepoliciesthatwillcoversome,ifnotall,ofthecostsofnursinghomecare.Thesepolicies shouldbereadcarefullytodeterminewhatlevelofcareiscovered.Veteransmayalsobeeligibleforassistancefromthe Veteran’sAdministration.Askifthefacilityhandlesinsurancebilling.ResidentseligibleforMedicaidwillreceiveasmall PersonalNeedsAllowancetopurchasepersonalitems.Mostfacilitieschargetheprivatepaydailyrateto“holdthebed” shouldtheresidenthavetobehospitalized. How to Apply for a Nursing Home TheAdmissionCoordinatorofthenursinghomewillassesstheapplicant’smedicalandsocialneedsandwillprovidethe necessary forms. A contract will include the cost of care and other services. All residents entering a nursing home are requiredtohaveanFL-2formcompletedbytheirphysician.ThisFL-2formmaybeobtainedfromtheCountyDepartmentof I-3 SocialServices,thephysician,orfromthenursinghomeitself. Anindividualcareplanwillbedevelopedtomeettheresident’smedicalandsocialneeds.Theresidentandfamilymembers shouldbeinvolvedinthecareplanningatthetimeofadmissionandthereafterattheresident’squarterlycareplanning meetings. Life in the Nursing Home Residentsinfacilitiesshouldbeallowedandencouragedtoparticipateintheactivitiesofday-to-daylifeasmuchasthey areable.AResident’sCouncilprovidestheopportunityforresidentstohaveinputintotheactivitiesofthefacility.Family, friends,colleagues,andchurchmembersshouldbeencouragedtovisittheresidentandcontinuetherelationshipsthat theyhavehadinthepast.Iftheresidentorthefamilyhasaconcern,he/sheshouldfeelfreetodiscusstheissuewiththe Administrator. ManyfacilitiesencouragefamilyinvolvementwithfamilynightsandFamilyCouncilmeetings.Residentswhoareprivate paymayleavethenursinghometovisittheirfamiliesaslongasthedailyrateispaidatthenursinghome.Thosereceiving Medicaidareallowedtotake60daysoftherapeuticleaveperyeartovisittheirfamiliesiftheyaremedicallyapproved. I-4 Assisted Living InNorthCarolina,anassistedlivingresidenceisdefinedbytheDivisionofHealthServicesRegulations(DHSR)as“Anygroup housingandservicesprogramfortwoormoreunrelatedadults,bywhatevernameitiscalled,thatmakesavailable,ata minimum, one meal a day and house-keeping services and provides personal care services directly or through a formal written agreement with one or more licensed home care or hospice agencies.” The Division may allow nursing service exceptionsonacase-by-casebasis.Settingsinwhichservicesaredeliveredmayincludeself-containedapartmentunitsor singleorsharedroomunitswithprivateorareabaths.” Therearethreetypesofassistedlivingresidences:adultcarehomes,adultcarehomesthatserveonlyelderlypersons,and multiunitassistedhousingwithservices.Asusedinthissection,“elderlyperson”means: a.Anypersonwhohasattainedtheageof55yearsorolderandrequiresassistancewithactivitiesofdailyliving,housing, andservices,or b.AnyadultwhohasaprimarydiagnosisofAlzheimer’sdiseaseorotherformofdementiawhorequiresassistancewith activitiesofdailyliving,housing,andservicesprovidedbyalicensedAlzheimer’sanddementiacareunit. Adult Care Homes and Family Care Homes AdultCaremaybetheanswerfortheolderpersonwhoisnotabletoliveindependently,butwhodoesnotneednursing homecare.Commonlyreferredtoas“RestHomes”or“AssistedLiving”,AdultCareHomesarelicensedbytheNCDHSRto provideassistancewithactivitiesofdailyliving(ADL). TwotypesofAdultCareHomesservedisabledandolderadults: FamilyCareHomes(FCH)aresmallhomesthatprovidecareforuptosixpeopleinafamily-likesetting.Thesehomesare oftenfoundinresidentialcommunitiesandhavearound-the-clockorlive-instaffthatpreparemeals,supervisemedications andprovidehelpwithdressingandotherneeds. LargeAdultCareHomes(ACH)orHomesfortheAged(HA)servesevenormorepeople.They,too,provideassistancewith meetingtheresidents’dailyneeds,andtheyhavestaffonduty24hoursaday.SomenursinghomeshaveHomefortheAged bedsonsiteforthosewhodonotneednursingcare.Often,theseHAresidentshavepriorityforthenursinghomebedsif theneedarises. AdultCareHomeshaveanadministratorwhoisresponsibleformanagingthefacilityandasupervisor-in-charge(SIC)who overseesresidentcare.Aidesprovideassistancetotheresident.Thenumberofaidesondutyisdeterminedbythenumber ofresidents.Licensednursesarenotrequiredinadultcarehomes,althoughsomehavenursesonduty. SpecialCareUnits(SCU)forpersonswithAlzheimer’sdiseaseorrelateddisordersmeansanentirefacility,wingorhallway withinanadultcarehomeseparatedbycloseddoorsfromtherestofthehome,oraprogramprovidedbyanadultcare home,thatisdesignatedoradvertisedespeciallyforspecialcareofresidentswithAlzheimer’sdiseaseorrelateddisorders. TheCountyDepartmentofSocialServicesmonitorsAdultCareHomesatleastbi-monthlyandmaybecontactedifaresident orfamilymemberhasaconcernorcomplaintaboutthecarebeingprovided.UnderNorthCarolina’sAdultCareHome BillofRights,allresidentsaretobetreatedwithrespect,considerationandfullrecognitionoftheirpersonaldignityand individuality.TheRegionalLong-TermCareOmbudsmanandthelocalAdultCareHomeCommunityAdvisoryCommittee worktoseethattheserightsarerespected. The Cost of Adult Care Homes Thecostofadultcarevariesfromfacilitytofacility,rangingfrom$1200-$6000amonth.Thisincludesthreemealsdaily, activities,transportationtomedicalappointments,laundry,personalcareandthesupervisionofmedicationadministration. I-5 A few facilities require an additional entry fee. For those on limited incomes, State/County Special Assistance (SA) may helpcoverthecostofadultcarehomes.Anindividual’sownincomeisappliedfirsttothemonthlycostofcare,thenSA supplementsthisincomeuptotheNCmaximumadultcarehomepaymentrate.ResidentsreceivingSpecialAssistance receiveasmallPersonalNeedsAllowance($66)monthlytocoverthecostofpersonalitems.ContactyourlocalDepartment ofSocialServicestofindoutifyouareeligible. SomeAdultCareHomesonlyaccept“privatepay”residentswhoareabletocoverthecostofcarethemselves.Othersaccept thosewhoareprivatepayaswellasthosewhoreceiveSpecialAssistance.Somefacilitiesincreasetheprivatepayratesas additionalpersonalcareisneeded.Allservicesprovidedinthemonthlyrateshouldbeincludedinthecontract.Aresident receivingSAshouldnotbechargedforadditionalservices. How to Apply for Adult Care Homes AllpeopleapplyingforadmissionintoanAdultCareHomearerequiredtohaveanFL-2form;aphysicianauthorizedmedical formdescribingtheresidents’carerequirements.Thisformmaybeobtainedfromthefacilityadministrator,apatient’sdoctor ortheCountyDepartmentofSocialServices.IfState/CountySpecialAssistanceisneeded,thepersonseekingassistance appliesattheDepartmentofSocialServicesinthecountywherehe/shelives.Otherwise,theresidentandthefacilitysimply enterintoacontractualagreement.Somefacilitiesrequireadeposit. Aguardianmustsignthecontractforresidentswhohavebeendeclaredlegallyincompetent. Life in an Adult Care Home Thedailyroutineinadultcarehomesshouldresemble,asmuchaspossible,routinesfollowedwhenlivingindependently. Activitiesareofferedandresidentsareencouragedtoparticipate.Someresidentsareabletoleavethehomeontheirown. Mostareabletoparticipateinorganizedactivitiesoutsideofthehomesuchasoccasionalshoppingtrips. Uponadmission,thehomewillprovidetheresidentwithacopyofitspoliciesonsmoking,visitationandothermatters. Privatepayresidentsmayleavethefacilitytovisitwiththeirfamiliesastheywish.ThosewhoreceiveSpecialAssistancemay leaveforupto30daysatatime. I-6 Multiunit Assisted Housing with Services “Multiunit Assisted Housing with Services (MAHS)” means an assisted living residence in which hands-on personal care servicesandnursingserviceswhicharearrangedbyhousingmanagementareprovidedbyalicensedhomecareorhospice agency,throughanindividualizedwrittencareplan.Thehousingmanagementhasafinancialinterestorfinancialaffiliation orformalwrittenagreementwhichmakespersonalcareservicesaccessibleandavailablethroughatleastonelicensedhome careorhospiceagency.Theresidenthasachoiceofanyprovider,andthehousingmanagementmaynotcombinecharges for housing and personal care services. All residents, or their compensatory agents, must be capable, through informed consent,ofenteringintoacontractandmustnotbeinneedof24-hoursupervision.Assistancewithself-administrationof medicationsmaybeprovidedbyappropriatelytrainedstaffwhendelegatedbyalicensednurseaccordingtothehomecare agency’sestablishedplanofcare.Multiunitassistedhousingwithservicesprogramsarerequiredtoregisterannuallywith theDivisionofHealthServiceRegulationandprovideadisclosurestatement.Thedisclosurestatementisrequiredtobea partoftheannualrentalcontractthatincludesadescriptionofthefollowingrequirements: a.Emergencyresponsesystem; b.Chargesforservicesoffered; c. Limitationsoftenancy; d.Limitationsofservices; e. Residentresponsibilities; f.Financial/legalrelationshipbetweenhousingmanagementandhomecareorhospiceagencies; g.Alistingofallhomecareorhospiceagenciesandothercommunityservicesinthearea; h. Anappealsprocess;and i.Proceduresforrequiredinitialandannualresidentscreeningandreferralsforservices. Purpose / Meals for Multiunit Assisted Housing ThepurposeofMultiunitAssistedHousingwithServicesistoprovidehousingandassistwithcoordinationofpersonaland health care services through licensed home care agencies. No resident monitoring or supervision is provided by facility staff. Likeanyindependent apartment setting,a multiunitassisted housing with services tenant commonly signs alease agreementandpaysmonthlyrent.Multiunitassistedhousingwithservicesmaybehousingwithorwithoutsubsidized rent.Supportiveservicesareoptionaltotheresident,andtheresidentmusthaveachoiceofcareproviders.Paymentsfor personalornursingcaremaynotbecombinedwithchargesforhousing.Onetothreemealsperdayareprovidedaccording toindividualcontractforservicesagreement. The Cost of Multiunit Assisted Housing NotethatMedicare,MedicaidandState/CountySpecialAssistance(SA)doesnotcoverthecostoflivinginmultiunitassisted housingwithservices.These residences are strictly private pay. However,theprovisionofpersonalandmedicalcaremay becoveredbylongtermcareinsuranceorNCHomeandCommunityCareBlockGrant,Medicare,orothermedicalinsurance iftheservicesmeetcoveragerequirementsofthespecifiedinsurancecompany. Types of Residents in Multiunit Assisted Housing Itisassumedthatallresidentswillbeindependentenoughtoarrangefortheprovisionoftheirpersonalcareorhavean agentactingintheirbehalf;willbecompetenttosignaleaseagreement;andwillnotrequire24hoursupervision. I-7 Continuing Care Retirement Communities (CCRC) Continuing Care Retirement Communities (CCRC) offer an attractive living alternative for retirement age individuals and couples.Alsoknownascontinuingcarefacilitiesandlife-carecommunities,thesecommunitiesdifferfromotherretirement optionsbyprovidinghousingandhealth-relatedserviceseitherforlifeorforaperiodinexcessofoneyear.“Continuing Care”isdefinedbyNorthCarolinaGeneralStatutesas,“...thefurnishingtoanindividual,otherthananindividualrelatedby blood,marriage,oradoptiontothepersonfurnishingthecare,oflodgingtogetherwithnursingservices,medicalservices,or otherhealthrelatedservicespursuanttoanagreementeffectiveforthelifeoftheindividualorforaperiodlongerthanone year.”Generally,prospectiveresidentsmustbecapableofindependentlivingwhentheyenterthecommunity. ThetypicalCCRCprovidesindependentaccommodationsthatmayincludefullorefficiencyapartments,villas,orcluster homesaswellascommunitydining,socialandrecreationalareas,andawiderangeofservicesincludingmeals,housekeeping, transportation, andhealth-relatedservices.InNorthCarolina,CCRCsoffereithernursinghomeoradultcarehomelevelof care,andmayprovideboth.Dependingontheindividualcommunity,theseaccommodations,activities,andservicesmay bepaidforinamonthlyfeeorpurchasedasneeded.Usuallyasubstantialentrancefeeischargedinadditiontomonthly fees.Entrancefeescanbenon-refundable,partiallyrefundable,orfullyrefundable.ThemajorityofCCRCsareprivatepay, althoughafewhavesomesubsidizedunits. Continuingcarecommunitiestypicallyofferone(ormore)offourtypesofagreementsorcontracts,asdefinedbelow: Extensive, or life care, contracts provide independent living and health-related services in exchange for a price, usually consistingofanentranceandmonthlyfees.Noadditionalfeesaregenerallyrequiredasonemovesfromonelevelanother. Modifiedcontractsprovideindependentlivingandaspecifiedamountofhealth-relatedservicesinexchangeforanentrance feeandmonthlyfees.Health-relatedservicesareprovidedatasubsidizedrateorarefreeforaspecifiednumberofdays. Fee-for-servicecontractsprovideindependentlivingandguaranteedaccesstohealth-relatedservicesinexchangeforan entrancefeeandmonthlyfees.Health-relatedservicesareprovidedatthegoing,fullperdiemrate. Equity contracts involve an actual real estate purchase, with a transfer of ownership of the unit. Health-related service arrangementsvary.
