Attendance Policy
ABSENCE INFORMATION
Education is important. Students who are not attending school will miss out on valuable
learning opportunities and quickly fall behind. Therefore, it is important that all students—with
the support of their families—make their best effort to attend school every day.
Every absence reported during the school day automatically generates a phone call to the
home phone number of the student. Educational Code 48260(a) dictates that 4 or more
unexcused absences in a single class is excessive. Educational Code 48260(a) allows only
three 30 minute periods of unexcused absence before a student is considered truant. All
absences must be cleared within 72 hours and may require documentation from an
outside agency.
California Educational Code recognizes certain excused absences, including: medical
appointments, illness with a medical note, immediate family death/funeral, court appointments
with documentation, approved short term independent study, participation in a religious service
or event, or a school-sponsored activity. Excessive absences, excused or not, may result in
referral to the Student Attendance Review Board (SARB).
CUT POLICY
Any absence not excused within 72 hours is considered a cut. Absences that occur without
an off-campus pass are also considered cuts. No student may leave campus without an
off-campus pass. Discipline consequences will be assigned for a student’s cumulative total
of cuts for all periods (1st – 6th).

8 Cuts = Saturday School & Social Probation
12 Cuts = Saturday School, Social Probation & SARB
If a student misses an assigned Saturday School s/he will be assigned a 1-day suspension.
TARDY POLICY
A tardy is defined as the late arrival to class. Excessive tardiness will result in a discipline
consequence. Students seeking to excuse a tardy that is the result of an emergency must
provide verification, such as medical, legal, or other verifiable evidence of circumstances.
3 Tardies = ParentLink warning
10 Tardies = Detention
16 Tardies = Saturday School
22 Tardies = Saturday School, Parent Meeting and Contract w/ Admin
28 Tardies = Saturday School, Parent Meeting & Site-based SARB
If a student misses an assigned Saturday School s/he will be assigned a 1-day suspension.
To provide students with an opportunity to improve and be removed from attendance contracts
and/or social probation, the tardy/cut count will reset every 6 weeks.

18 Year Old Attendance
Students age 18 and over may clear their own absences. However, MHS administration
reserves the right to enforce its attendance policy in order to mitigate excessive absences
and/or abuse.
Students may check themselves out of school for medical, dental, or other documented
appointments. All permits to leave must be accompanied by a note from a doctor or an
agency. If a parent or relative needs a student, a note must also accompany the request to
leave. If a student becomes ill and must leave campus, he/she must see the health clerk to
validate the legitimacy of the request.
Breathalyzers
In order to maintain a safe environment during extracurricular events, the Board of Education
allows site administrators to test students for the presence of alcohol. Breathalyzers detect the
presence of alcohol in the bloodstream. All students who attend a dance will be tested. Those
who do not comply will not be permitted to enter the dance. A confirmed positive reading will
result in parent contact and the student will be suspended from school.
Dance Procedures
All coats, jackets, bags of any kind and purses must be checked in at the dance site. These
items can only be accessed when at student leaves the dance. Students will only be allowed to
leave a dance at the pre-designated end time. There is no readmission to the dance.
No student on social probation will be permitted to enter the dance.
Dress Code – General
Milpitas High School students must dress appropriately for school. A student’s apparel or lack
of apparel should not distract from the educational process. Clothing that depicts violence
and/or obscene words/pictures, sexually suggestive statements, or drugs/alcohol are
considered inappropriate and will not be allowed at Milpitas High School. Clothing that reveals
cleavage, belly, back, or underwear disrupts the educational process. Shoes must be worn at
all times. Any student dressed inappropriately will be sent to the office.
Students who violate the dress code will be given the following options:
• Accept the T-shirt provided by the school administration in exchange for the offending
clothing item. Clothing item will be given back at the end of the school day when the
t-shirt is returned.
• Call their parent and the parent brings appropriate clothing or the student is sent home.
A t-shirt will be offered so the student does not miss instructional time.
Students must maintain high standards of cleanliness and personal hygiene. The MHS
administration will intervene when cleanliness and/or personal hygiene cause a disruption or
are deemed to be unsafe.

Dress Code - Gang Specific
If a student associates ("hangs out") on the Milpitas High School campus with another student
who has been validated (considered) a gang member by the Milpitas Police, and is wearing
any clothing that is considered gang related (due to color, writing style, words, numbers,
shoes, bandanas, do-rags, etc.) by Milpitas High School Administration, the following will
occur:
1st contact by Milpitas High School Administration - student will be warned that she/he is
associating with a validated gang member and that if she/he continues to wear the gang
related clothing, s/he will be placed on a color contract.
2nd contact by Milpitas High School Administration - student will be placed on a color contract
and parent will be notified. The color contract stipulates that the student must:
• not wear any clothing/shoes/belts/accessories/hat/backpack/sportswear of a certain
color (to be determined by administrator)
• have no gang related writing on clothing or backpack or books/binder
3rd contact by Milpitas High School Administration - every violation of the color contract will
result in a 1-day suspension. The item that was in violation of the color contract will be
confiscated and returned to student at the end of the school day after parent is contacted.
Note: Any student who is validated (considered) a gang member by Milpitas Police will be
automatically placed on a color contract.
The duration of the color contract is as follows:
•
(one) school year for those students on color contract but who are not validated
(considered) gang members by Milpitas Police.
•
All school years at Milpitas High School for those students on color contract and who
are validated (considered) gang members by Milpitas Police.

Electronic Device Policy
TEACHERS WILL:
1. All Teachers will review the electronic device policy during the 1st week of school
with all classes.
2. A Teacher will confiscate any electronic device that is seen or heard during
instructional time. The teacher will call security immediately, and have the device
transported to the office. Before handing the device to security, the teacher will write
the students name, ID #, as well as their name on a piece of paper for identification.
3. If a student refuses to give up the device, security will escort the student to the
office. He/she will be processed for a 2-point defiance offense.

Filming Any Act That Is Illegal
or Violates School Policy
Filming any act that is illegal or violates school policy is prohibited unless a student films such
acts for the express purpose of submitting the video to the administration. Those in violation
will be suspended for up to 5 days depending upon the circumstances.
ParentLink
ParentLink is an automatic service that allows administration to communicate efficiently with
the extended Milpitas High School community. When necessary, households will receive daily
input concerning attendance as well as important messages concerning activities, programs or
events taking place at the high school.

Homework/Leave/Independent Study Requests
Homework: To request homework assignments for a student who is expected to be out ill for
a minimum of three (3) days and maximum of ten (10) days, please contact the appropriate
attendance secretary. Please allow 24 hours from the time of your call to when assignments
will be available for you to pick up. Homework requests will be placed in teacher boxes at the

Vacation Leave and Independent Study: Any Milpitas High School student needing to take
an extended vacation during the normal school year must apply one week in advance for an
Independent Study Agreement. This agreement form is available through the attendance
secretary. The length of the agreement shall be no less than five (5) days and no more than
ten (10) days.
NO EXCEPTIONS: A student MUST return on the 11th day. Failure to do so will result in a
“0” for all Independent Study work and disenrollment from school. A student may re-enroll
upon return, but he/she will receive a “0” for all work missed during the disenrollment
period.
Requirements for Independent Study Agreement:
1. Homework assignments are required for each class.
2. Appropriate signatures from student, parent and teachers must be obtained
before student leaves.
3. A student can only request an Independent Study Agreement once per school year for
a maximum of ten (10) days.
Absences due to vacation leave WILL count against the student until the Independent Study
Agreement is completed when the student returns. All work must be completed upon student’s
return.
Off-Campus Pass Requirements
Any student leaving campus during the school day must obtain an off-campus pass from the
Main Office. FAILURE TO DO SO WILL RESULT IN AN AFTER SCHOOL DETENTION.
Personal Property
Bring personal property items to school at your own risk. Milpitas High School is not liable
for the theft or loss of any personal property. The school will only investigate incidents of
stolen personal property where the perpetrators have been identified.
Drop Off Policy: Drop offs will NOT be accepted in the front
office between the hours of 9:00 am – 2:00 pm.

Science Camp Counselor
Milpitas High School recognizes that high school students are needed to help for elementary
sponsored Outdoor Education Program, commonly called Science Camp. This is considered a
district sponsored event and as such the following procedures below must be followed if a
student wishes to participate.
ONLY seniors may participate as counselors with an Outdoor Education/Science Camp that is
sanctioned by the Milpitas Unified School District. A sanctioned Outdoor Education
Program/Science Camp is one that has Milpitas Unified School District elementary students in
attendance the week the senior would be serving as a counselor.
A senior may only attend a sanctioned Outdoor Education/Science Camp for a 1 week period
and only 1 time during the school year.
Students should sign up with a sanctioned Outdoor Education/Science Camp on the dates and
times that have been arranged through Joanna Butcher, Activities Director at Milpitas High
School.
A student should secure a progress form from their counselor and circulate it amongst his or
her teachers. Teachers will indicate academic and behavioral progress.
The teacher will provide make-up work for the student if the teacher has signed the progress
form granting permission for the student to miss class. If a student has academic or
attendance concerns, a teacher will not sign to “release” the student. A teacher will provide
the reason that s/he is not “releasing” the student for the parent’s information.
When the progress form is completed, the student will bring this form home for review by their
parent. A parent will then make the decision whether to allow their child to attend Outdoor
Education/Science Camp as a counselor. The parent will sign for permission also. A student
must have both the parents and teachers’ signatures for this activity to be considered district
sponsored and for make-up work to be given.
Students must follow the Milpitas High School behavioral policy while in attendance at the
Outdoor Education/Science Camp.
Students may receive up to 25 community service hours toward their graduation requirements
for the non-school hours while at Outdoor Education Program/Science Camp.
(8:00 AM – 3:00 PM are considered school hours.)

Textbooks/Chromebooks
TEXTBOOK/CHROMEBOOK CHECK OUT - All textbooks (including novels) and
chromebooks must be checked out to each student at a bookroom station in E, F, G, L,
bookroom G12 or Library using a “scanner.” All students are responsible for the
textbooks/chromebooks that they check out during the school year. When books are checked
out, the student should write his or her name on the inside front cover of the book and make
sure that they do not switch books with another student.
TEXTBOOK/CHROMEBOOK CHECK IN - Students are responsible for checking each of their
books/chromebooks in to one of the bookroom stations in E, F, G, L, bookroom G12 or the
Library using a “scanner.” Each textbook/chromebook is barcoded. If students return
books/chromebooks with a barcode different from the one that was checked out to them, they
will be charged for the book/chromebook they checked out. Students are responsible for
verifying that the book/chromebook they check in has the same barcode as the one they
checked out. Students should never give books/chromebooks to a teacher to check in or
leave books/chromebooks in a classroom.
LOST TEXTBOOK/CHROMEBOOK - Once a textbook/Chromebook is checked out, the
student is responsible for the textbook/chromebook for all circumstances, including theft and/or
vandalism of locker.
Unattended Classrooms
STUDENTS SHALL NOT ENTER CLASSROOMS THAT ARE NOT
SUPERVISED BY A MILPITAS HIGH SCHOOL STAFF MEMBER.
Unacceptable Network Behavior Policy
Any student committing an act, that is in violation of the Electronic Information Resource
Agreement established by the school district, will automatically have their internet privileges
suspended for 6 weeks. In addition, they will receive a 1-day suspension. A second offense
will result in a 3-day suspension and a loss of internet privileges for 12 weeks. A third act will
result in a 5-day suspension and loss of internet privileges for the remainder of the school
year. This includes inappropriate behavior using social media, such as Instagram, Twitter
and Facebook. Depending upon the circumstances, it may fall under the category of
Harassment/Intimidation/Cyber-bullying and may carry the consequences under that category.
Work Permits
Work permits are a privilege. Students must maintain a 2.0 GPA each grading period to be
eligible for a work permit. A work permit may be revoked at any time for academic reasons.

Milpitas High School Honor Code
The Milpitas High School students and staff shall maintain the highest level of integrity and
honesty to create an ethical and moral educational environment.
VIOLATIONS & ACADEMIC CONSEQUENCES
1. A student who plagiarizes the work of another person will be given an automatic
“F” on that assignment or test. (This includes inappropriate use of a shared Google doc.)
Example: Sam has a two page written report on a book written by John Steinbeck. He
looks up a book report written by another person and uses the information verbatim in
his report. He takes the information such as found in the “Cliff Notes” or internet sites,
and copies it. Without giving due credit to the original author of information used in his
report, he has taken credit for ideas and thoughts which are not his own. This is called
plagiarism.
2. A student caught cheating on an assignment, quiz or test will receive an
automatic “F” on that assignment or test.
Example: Student A goes to the bathroom during a test and sends a text message on
his cell phone to student B with answers to the test.
3. A student copying the work of another student, such as homework or a written
assignment, will receive an “F” on that assignment. The student whose work has
been copied will receive an “F” also.
Example: Sam does his homework and Joe wants to copy it and turn it in for credit.
Both Sam and Joe will receive an “F” for the assignment; Joe because he copied the
work and Sam because he allowed it to take place.
4. A student caught stealing a test, answer sheet, or teacher edition of any MHS
textbook will be withdrawn immediately from the class with a “W/F” grade
(Withdrawal/Failure). The class must be made up the following semester or through
summer school, Adult Education, regular school or a college summer course.
5. All teachers will report all acts of cheating to the MHS Administration by using
a Student Referral form.
6. A second act of dishonesty within the same class will result in an automatic
“W/F” grade (Withdrawal/Failure) from the class.
STUDENTS MUST BE AWARE OF THE CONSEQUENCES FOR THEIR

The Class of 2010 has achieved much success. In an effort to make our graduation dignified and memorable it is imperative

Bank / Payment of Fees / WebStore
The MHS BANK is located in Room J02, where students can pay for numerous items, such as
class donations, AP tests, PSAT test, sports transportation fees, parking permits and ID cards.
The Bank is open daily to students before school, during break and lunch and for half an hour
after school. The bank is not open to students during class time.
The bank is open to parents and staff between 7:30 am and 3:30 pm.
You can reach the student bank staff from 7:30 am to 3:30 pm at 408-635-2800;

Cash and checks are acceptable for purchases. All checks must be made payable to MUSD
(Milpitas Unified School District) or MHS. Please note that there is a $25.00 service charge for
any returned check. Should an individual have a check returned, all privileges to pay future
fees by check will no longer be honored.

Our WebStore allows you to easily purchase student items, pay for student activities and
debts, all securely via the internet. Here you will be able to pay for all of your students needs

Bookroom
The MHS Bookroom, located in Room J2 is available to students to check out a textbook,
chromebook or workbook required for a class. A computerized book control system is in place
to track items assigned to students. Items may be checked out, checked in, and fines may be
cleared in the bookroom 30 minutes before school, at break, lunch or 30 minutes after school.

Career/College Information
The Milpitas High School Counseling staff has a wealth of information available to students.
They provide college and university applications, military information, scholarship information
and applications and college testing dates. There are also college catalogues and
miscellaneous reference guides. Career speakers and college representatives make
appearances throughout the year. Sign-ups for these events are announced through the Daily
Bulletin. For assistance from the Counseling staff, please call the Counseling secretary at
635-2800 ext 4128 or call your student’s counselor directly.

Communication among parents, staff, and students is one of the most important factors in
students having a successful and productive experience at Milpitas High. There are several

are usually held in the evening for parents to attend. There are three Sport Parent Orientations. This is
an informational meeting, which describes the extra-curricular Sport Programs. They are held in the
fall, winter and spring. Grade Level Parent Orientations are hosted by Administration and the PTSA.
These grade level orientations provide valuable information to parents concerning academics, college
planning, career opportunities, and issues pertinent to the success of their student during the current
school year. Please refer to the Calendar of Events for dates, times, and locations.
The Trojan News : MHS announcements will be broadcast daily.
The Trojan Newsletter is published 2 times a year is available on the MHS website and includes
updates of campus events and programs.
The Union is the student newspaper produced by our journalism class. It contains news about student
activities, sports teams, and opinion columns by The Union staff, etc. Parents can get a student’s view
of Milpitas High through this publication. Mr. Jeff Colburn is the faculty advisor for the school
newspaper.
Saga is the Milpitas High School yearbook that stands as a history of the year and also as a focus for
student academic, sports and extracurricular achievements. Ms. Fiona Walker is the faculty advisor
for the yearbook class.
ParentLink Includes an auto-dialer and email function. This is the main source for direct school-tohome communication. Please make sure to keep your phone and email information current in order to
receive this valuable communication.
School Loop is our online communication system where parents and students may access student

Back-to-School Night is held every year during the third or fourth week of school. Parents convene in
the large gymnasium to be greeted by the administrators, PTSA President and Associated Student
Body President. Then, following their child’s schedule, parents spend 10 minutes in each classroom.
Back-to-School Night is probably the best opportunity parents will have to meet all six teachers in a
single evening and learn the policies, grading practices, and requirements of each one, as well as
simply seeing the face that goes with the name. The entire MHS staff hopes all parents will visit us
often, but if you only set foot on campus once during the entire year, Back-to-School Night is the time to
do it.

See James Hollenback in the Student Bank to find out how much you owe for outstanding
fines, Sandy Scrempos in the Bookroom for textbook fines and LeighAnn McCready for Library
fines. Any senior with outstanding fines will not receive his/her diploma until fines are paid.
Health Office
If your son or daughter requires any medication, including inhalers, during school hours, a
“PERMIT TO TAKE MEDICATION IN SCHOOL” form must be completed and on file with our
health clerk. Our health clerk is located in the Main Office and has the forms readily available.
Our health clerk, by law, cannot provide any over-the-counter medications. These include
aspirin, Tylenol, Motrin, or any allergy remedies. These types of medications must be
accompanied by a medical doctor’s approval for a student to take as needed during school
hours.

Independent Study Program
The Milpitas High School Independent Study Program is an optional alternative instructional
strategy by which students may reach curriculum objectives and fulfill graduation
requirements. The Independent Study strategy entails an agreement among the student,
parent/guardian, and teacher that allows students to complete assignments independently at
home. They then meet with certificated personnel on a weekly basis to receive feedback and
additional work. For additional information on this program, please contact the Assistant
Principal at 635-2800 x-4123.
Library
The MHS Library Learning Center is open daily when school is in session. Regular Hours are
Mon-Tue-Thu 7:30 am - 4:00 pm, Wed 7:30 am - 2:00 pm and Fri 7:30 am - 3:00 pm.
Occasional schedule changes are posted with signs and on the library webpage
(librarymhs.blogspot.com). Books may be checked out for three weeks and may be renewed
twice. Students that don’t take responsibility to return books on time may be charged a late
fee. The library provides digital resources and eBooks 24/7 with student logins and passwords

Lockers

A locker will be issued to all students with a signed parent permission form.
It is understood that lockers may be used only before and after school and during break
and lunch. Lockers are secured behind locked gates during non-school hours.
Outside book lockers and P.E. lockers are not theft or vandalism proof.
IT IS RECOMMENDED THAT NO VALUABLES BE PLACED IN LOCKERS.
Students and their parents are responsible for, and will be charged for, any damage to
or loss of school property that may result through the use of lockers. This includes any
loss as a result of vandalism. Lockers have been subject to weekend and after school
vandalism. The school will not replace any personal property brought to school or
placed in lockers.
A parent’s signature on the permission form indicates acceptance of liability for any school
property damage/loss as a result of the use of lockers.
Lunch/Brunch Prices
The Food Court offers an International selection of options that include Mexican, Italian,
Chinese, American Grill and Deli. A deluxe lunch is $3.50 (Regular meal plus bottled water).
A regular lunch is $3.25 and includes an entree, fruit/vegetable and milk. If a student eats in
the food court, a salad bar is available with any meal. A variety of “a la carte” items are
available from $.75 to $4.00. Brunch offers many breakfast foods on Monday, Tuesday,
Thursday, and Friday. The price for brunch is $1.75.
Parents can access a convenient, easy and secure online prepayment service to deposit
money into your child’s school meal account at any time. Just click on the Online School Meal
Payments link on our homepage at https://mhs.musd.org.
Your family may be eligible to receive meals free or at a reduced priced. Over the summer an
application packet will be mailed to each household. Instructions for submitting the application
online will be included. If you prefer not to submit your application online, it can be completed
and returned at registration or to the Registrar’s office. Please complete only ONE application
for all children in one household. Any questions, contact Student Nutrition Services at
635-2894.
Physical Education Uniforms
For P.E. classes, students are required to dress every day for class. A gray t-shirt is required,
along with a pair of navy blue shorts. These items may be purchased through the P.E.
department or at any store of your choice. If purchased through the P.E. department, the cost
of the shirt is $12; the cost of the shorts is $13. T-shirts must not have any pockets, no tall
tees, no fitted shirts and no logos or designs on the shirt. A navy blue, black or gray sweatshirt
and/or sweatpants is recommended for outdoor activities during cold weather. In addition,
each student will need a combination lock to secure their belongings. Locks may be purchased
through the P.E. department for $6. Uniforms will be sold during the first week of school,
during your student’s P.E. class. The total cost for a shirt, shorts and a lock is $31. Please
make check payable to MHS. No valuables are to be kept in P.E. lockers.

Parking Permit & Procedures
Personal cars driven to school require the student to purchase a Parking Permit. The cost of a permit
is $30 per school year and can be purchased at registration or at the Student Bank. Students must
have a current parking permit to park in the Milpitas High School parking lot. Students must park in their
corresponding numbered space issued by the Student Bank. Parking spaces are issued on a first-come
first served basis. NO REFUNDS. To purchase a parking permit, you must provide a valid California
Driver's license, current proof of insurance, a current Milpitas High School I.D. card, and the completed
form with a parent signature regardless of age.
PARKING PERMITS ARE CONDITIONAL BASED UPON THE FOLLOWING:
1. Only vehicles displaying a current year's parking permit will be allowed to use the designated parking stall.
2. The permit must be clearly visible on the driver's side of the dash or hanging from the rearview mirror.
3. Driver must strictly observe all posted parking safety rules. The speed limit in the parking lot is 10 miles/hour.
Excessive speed in the parking lot will result in the confiscation of the parking permit without a refund.
4. This permit is NON-TRANSFERABLE!
5. Driver will only park in his or her designated parking space, not in the visitor or staff parking lots.
6. Should the vehicle's insurance or the driver's license expire during the school year, the student must provide
updated and current information to the Student Bank. Only those with current proof of insurance and a valid
driver's license will be allowed to park on the Milpitas High School campus.

Parking violations will be enforced! Consequences of infractions are:

Students who drive to school should refer to “Parking Permits” above. Many Milpitas High School
students depend on the Valley Transportation Authority (VTA) for their commute to school. Students
should purchase a Clipper card. Clipper® is an all-in-one transit card that can be loaded with up to
$300 in cash value at one time. Cash value on your Clipper card can be used to ride any participating
transit system. Cards can be purchased online as well as at most Walgreens stores. For more

Also, check out the innovative new service - School Pool. School Pool helps us to reduce car trips to
and from school and other activities, thus reducing traffic-related congestion and greenhouse–gas
emissions. We encourage families to register online to join a School Pool to carpool, walk, or bike

DROP OFF ZONES
Parents dropping off and picking up students should use the official drop off zone in the student
parking lot. This allows parents to exit onto Arizona Avenue, away from the traffic flow.
There is a 3-minute drop off and pick up zone also marked on Escuela Parkway. The signs posted in
front of Milpitas High School are strictly enforced by the Milpitas Police Department.

If you have moved, you must notify the Registrar in writing within ten days.
A change of address form needs to be completed and you must also
bring two proofs of residency so we may verify your new address.
*Please note: Your mail will not be forwarded to your new address. All documents
mailed from Milpitas High School to the old address will be returned to the Registrar.
