REACHING AGREEMENT WITH RUSSIAN CUSTOMS
A
lot of foreign jewelry
companies would like to gain access to the
Russian market, but as the well-known
proverb has it, “It’s not safe to wade into
unknown waters.” So how should one test
the waters? The most well-worn track is to
participate in jewelry exhibitions to gain
understanding of Russian customers’
needs, tastes and preferences and, if one
is lucky, to find actual partners to work
with. If this is the way one chooses to
proceed, it makes little sense to import big
consignments of goods. One should bring
just enough items for a decent exhibit that
can be taken down and shipped home
afterwards.
Under Russian customs law, this
is known as a “temporary import.” To
qualify for this clause, a company must
agree not sell to the goods at the
exhibition and
to re-export
them
immediately afterwards. There are two
ways of doing this:
1.
Via Carnet ATA, an
international customs document used
instead of the standard customs
declaration, and guaranteed by the
Chamber of Commerce and Industry of the
Russian Federation. This method allows
for rapid, simplified and duty free
registration of goods for display at
exhibitions, fairs or conferences. It can
include
professional
equipment,
containers, trays, packaging supplies,
samples, or goods with an educational,
scientific or cultural purpose.
It’s important to note that any flaw
or inaccuracy in the documents can
disqualify a company wishing to use this
method, a problem that cropped up for
several exhibitors at the latest edition of
“New Russian Style” in Moscow.

To use a customs broker
or transport company that can deliver
goods door to door, picking them up at the
company’s offices, bringing them right to
the exhibition booth and making the return
delivery. These services can solve
practically any problem while taking on the
responsibility for dealing with the Russian
customs authorities.
The difference between these two
methods is only technical, but importing
through a broker is safer. Either way, the firm
must fill in all the documents accurately. The
organizer of the French pavilion at New
Russian Style said in his application that no
fewer than five French companies that had
previously participated in the exhibition for
two years in a row could not return this year
because the customs authorities rejected their
documents without giving a reason.
“We have not had such problems
before with clients who had all participated in
the “New Russian Style” and “Moscow Fine
Art Fair” exhibitions. Besides, the customs
authorities are not supposed to say no without
giving a reason. Under the customs law, there
must be grounds for any refusal,” said Alexey
Kozlov, marketing director, TBSS.
The description of the goods in the
customs documents should include the UPC
number, quantity and a detailed description,
including hallmarks on precious metals and all
features of the diamonds or precious stones
used. The value and weight of the diamonds,
precious stones and precious metals must be
specified with an accuracy of 10 milligrams
(equivalent, for diamonds and precious
stones, to 0.05 carats). The weight of jewelry
and precious stones as measured in foreign
companies’ offices has been known to differ
substantially from that determined by the
Russian customs authorities.
It is also mandatory to attach a
picture of the item. Inadequate declarations
can lead to severe penalties. “Eighty percent
of success in customs clearance is in properly
composed documents that provide all the
information required by the customs
authorities and other control bodies,” said.
Kozlov.
To help with this process, TBSS has
developed a set of step-by-step instructions
and accompanying software for the exhibitor
to use in preparing products and documents.
In general, there are two major parts
to the process of customs clearance of
jewelry and gemstones in Russia, as set forth
in Presidential Decree #742 of June 21, 2001,

First, customs clearance is done
only at a handful of specialized customs
posts. These are located at;

Second, obligatory inspection is
carried out by the Federal Assay
Controllers (for jewelry) or Gokhran of
Russia (for gemstones). “Specialists
examine and appraise each item,” noted
Kozlov.
All
the
foreign
companies
participating in New Russian Style 2006
complained about the lengthy waiting
period they had to undergo to clear their
goods. The foreign jewelers’ complaints are
understandable, as their collections, which
were only going to be on display for four days,
took up to six weeks to clear customs.
According to the foreign participants, they had
to present their products for inspection 15 to
20 days or even one month before the
exhibition, and then wait for them to be
returned for a similar amount of time
afterwards.
TBSS says that customs officials
need lots of time to inspect goods. One group
of comptrollers can inspect about 500 items
per day. In any exhibition of any size, several
thousand items may need to be inspected.
That is why it is necessary to furnish the
goods for inspection well in advance.
Foreign companies’ desire to give their
products exposure on the Russian market is
quite natural, but if the current customs
procedures are not improved, this desire may,
wither away. However, there are Western
companies that are absolutely determined to
carve out a niche in the Russian consumer
jewelry market, and have learned to tolerate
the
cumbersome

customs
procedures.
