Dear Applicant:
The Prince William County Office of Housing and Community Development is pleased
to provide this First-Time Homebuyer (FTHB) Application Packet. The FTHB Program
provides financial assistance for downpayment and closing costs for income eligible
First-Time Homebuyers living or working in the Prince William Area (Prince William
County, the City of Manassas or Manassas Park). The FTHB Program funds are
secured for thirty years through a 2nd Deed of Trust against the property that has been
purchased.
Enclosed are items necessary should you wish to apply to the FTHB Program.

Based on the information provided, your application will be screened for preliminary
eligibility requirements. If all requirements are met you and all adults in your household
along with your Lender and Realtor [Team] will be scheduled to attend a mandatory
FTHB Program Informational Session.
You must not write a contract to purchase until after the Informational Session where
specific program requirements will be explained.
Only completed FTHB Program Application Packets will be processed. No FAX or
electronic submissions will be accepted.

Readiness Self Check
Please take this simple self check before you register for the required Homebuyer Education or submit a FTHB
Program Application. This will help you determine if you meet some of the basic eligibility criteria. If you

Income standards at 80% (see Attachment)
For purposes of determining eligibility the income, assets and circumstances of all individuals, persons, families or households
currently residing together (whether related by blood, marriage, adoption, or unrelated), and others anticipated to occupy the FTHB
Property must be considered. Gross income is defined as all sources of income (before taxes and other deductions) of all
household members. Income includes, but is not limited to the following: annual income from employment, plus bonuses,
overtime, pay differential, self employment, dividends, interest, pensions, sick pay, disability payments, Social Security benefits,
Veterans Benefits, Alimony, Child Support, Public Assistance, Unemployment Benefits, income from Trusts. Interest from assets is
added to income in determining eligibility. Interest on assets over $5,000 is imputed @ the HUD determined passbook rate
currently 2%. For assets over $5,000, the greater of the actual interest earned, or interest imputed at the passbook rate is included
as income. Gross household annual income is projected forward for one year from date of settlement. Actual or anticipated
increases in income such as cost of living, merit increases which can be verified must be included.

Can you provide verification of a minimum 1% borrower contribution towards your maximum sales price as determined by your
Lender? If your answer to question 6 is yes, proceed to question 7. If no,
eligibility criterion.

The FTHB Program provides between 23% and 33% of the approved Sales Price as determined by OHCD and Lender for
downpayment and closing cost assistance, based upon gross household income. You must be able to qualify for a first trust
loan from a VHDA approved Lender in order to apply for the FTHB Program. Contact a Virginia Housing Development
Authority (VHDA) approved Lender to determine if you have sufficient income and credit to qualify for a First Trust loan at interest
rate within 1% of VHDA’s current market rate? VHDA approved lenders can be located at www.vhda.com click on “Find a Lender”.
Ask the VDHA lender to complete the attached Pre Qualification Lender Information Form and submit along with a Good Faith
Estimate with your FTHB Program Application Packet. If the VHDA approved Lender determines you have sufficient income and
credit to qualify for First Trust financing within the FTHB Program Guidelines proceed to question 7.

Complete the FTHB Application for each person currently residing together to include those persons anticipated
occupying the proposed First-Time Homebuyer Property. The FTHB Program Application Packet must be signed
and dated and submit copies of all required documents for each household member to OHCD.


Copy of Birth Certificates or USCIS Documents to verify legal residency for each person currently residing in
the household or others anticipated to occupy the housing unit that may be purchased through the program
Copy of Social Security Cards for all household members
Copy of Valid Driver’s license, or other legally acceptable picture ID for all adult household members
Copy of current Rental Lease Agreement
Copy of Deed of Trust for each property owned and real estate tax statement
Copies of 3 months recent consecutive pay stubs for each job, and each person employed, or Employment
Contract for the current year
Self-employed Applicants must have a minimum of two (2) years of self-employment with the same company
and in the same line of work. In addition, the following information is required:
o Federal income tax returns (personal, partnership or corporate if applicable) for the most two recent
years including all schedules and
o Balance sheets and current profit and loss statements covering the period since the most recent tax
return
Current Verification of other household income (child support, alimony, benefits, Social Security, disability,
Workman’s Comp, Veterans, Military, Retirement, Pension, Unemployment, etc.) which cannot be older than
6 months
Recent Bank Statements for checking, savings, mutual funds, retirement accounts, stocks, bonds, etc. (3
months consecutive statements or last quarterly which must include verification of minimum 1% borrower
contribution of funds)
Copy of Federal Tax returns and W-2s for the previous three (3) tax years for each adult
Copies of current tri merge Credit Report(s) which must include all 3 scores for all applicants, spouse or other
household member(s) who will legally share the financial responsibility for the 1st trust financing Credit
Reports may be no older than 30 days
Copy of Bankruptcy Discharge Documents
Copy of Satisfied Collections/Judgments and satisfactory letters of explanation

Community Development as part of the FTHB Program Application Packet.

Purchase Process
Purchaser makes formal loan application with
Lender. Upon final loan approval and issuance of
Lender Loan Commitment OHCD will be notified
and provided required documentation to include
the Purchaser Under Contract Lender Form
necessary to determine final FTHB Program
eligibility. If the first trust loan terms are
acceptable to the FTHB Program a final Approval
letter will be issued.
OHCD issues Closing Instructions to the
Lender and Settlement Agency. OHCD must
review a final HUD 1 Settlement Statement 7-10
days prior to closing so FTHB funds can be
requisitioned .
An Attorney or Settlement Agency prepares
all of the necessary legal documents for the 1st
Trust Loan and OHCD will prepare all of the
necessary legal documents for the 2nd Trust
Lien. These documents are signed at the
settlement and complete the transfer of the
property from the seller to the purchaser.
After settlement you are the
official owner of the property
and can move into your own
home!

Program
First-Time Homebuyer (FTHB) Program
provides homeownership opportunities for low and
moderate-income persons living or working in the
Prince William Area (Prince William County, City of
Manassas or City of Manassas Park) with incomes
at or below 80% of Area Median Income through the
use of federal funding. The Program provides
assistance to eligible households for downpayment
and closing cost assistance, with maximum assistance between 23% -33% of the approved sales
price as determined by OHCD and Lender subject to
income limits. Escalation Clauses are not permitted
under the FTHB Program. All financial assistance is
made available to eligible households on a nondiscrimination basis subject to the availability of
funds.
Open Application Period
During the Open Application Period the First-Time
Homebuyer Application Packet will be available on
the Prince William County website www.pwcgov.org/
housing or call 703-492-2301. Only completed FTHB
Program Application Packets will be processed. No
FAX or electronic submissions will be accepted.
To begin the process review the Readiness Self
Check to determine if you and your household meet
the basic eligibility criteria. The application will be
screened for preliminary eligibility requirements. If all
requirements are met you and all adults in your
household along with your Lender and Realtor [Team]
will be required to attend a mandatory FTHB Program
Informational Session.
Sales Contracts written prior to FTHB Approval
are not eligible for funding.
Loan Qualification
Application and
Purchase Process
FTHB Program Applicants are free to work with the
lender of their choice provided the lending institution
meets Virginia Housing Development Authority (VHDA)
lender requirements, and are actively on VHDA’s
Approved Lender List, with office located in Virginia.
Phase I: Application Process
Applicant must complete the FTHB Program
Application and submit all required documentation,
including Certificate of Completion for the Financial
Education and Housing Counseling and Pre-Qualification
Lender Information Form along with a Good Faith
Estimate. Only completed applications with all required
documentation will be reviewed. Applications will be
screened for income and program eligibility by OHCD
Staff and provide evidence of 1% borrower contribution.
Purchaser will make formal loan application with
Lender to obtain the maximum First Trust Loan for
which they can qualify with income/debt ratios not to
exceed 32/40. The First Trust Loan must be a VHDA,
FHA, Conventional or VA product with No Adjustable
Rate Mortgages (ARMs), Balloons or Interest Only.
Sufficient income and good
credit are essential in order to
qualify for the First-Time
Homebuyer Program and a First
Trust Mortgage Loan.
Before You Apply
First: Complete the FTHB Application Readiness Self
Check.
Second: Applicant, spouse or other household
member(s) who will legally share the financial
responsibility for the 1st trust financing must have a
Certificate of Completion of Financial Education and
Housing Counseling issued by Prince William Virginia
Cooperative Extension. Go to www.pwcgov.org/vce/

Third: Make formal loan application with a VHDA
Approved Lender to obtain the maximum First Trust
Loan for which you can qualify. Lender must complete
the Pre-Qualification Lender Information Form and a
Good Faith Estimate.
Fourth: Submit complete FTHB Application along
copies of all required documentation.
Phase II: Information Session
If all requirements are met you and all
adults in your household along with your
Lender and Realtor [Team] will be
required to attend a mandatory FTHB
Program Informational Session. A
Certificate of Readiness Agreement will be issued and
signed to outline program terms, conditions and authorize
search for the home of your choice.
Phase III: Property Selection
Based on the Pre-Qualification Lender Information
Form you will be advised of the maximum 1st Trust Loan
amount based upon your households income and ability
to repay. With the assistance of a Realtor you can now
locate and write a Sales Contract for a property located in
Prince William County or the City of Manassas. Sales
Contracts must be in compliance with FTHB Program
requirements.
Phase IV: Ratified Contract through Settlement
The Ratified Sales Contract, Good Faith Estimate
(including 2nd Trust Cost), Purchaser Under Contract
Lender Form , Professional Home Inspection and HUD
Housing Quality Inspection (HQS) and Amendments
pertaining to failed inspection items is submitted to OHCD
for review of compliance. Based upon these items OHCD
will make a Reservation of FTHB Program funds based
upon availability of funds.

subordinated at anytime during the deferral period to a Home Equity Loan, other loan, or refinances of
the first loan that result in removal of equity from the property for any reason (i.e. cash, loan

The signatures below certify our understanding that the household must be income eligible up to and
including the day of settlement. We agree to report all changes in our incomes within five days of our
notification of any change. When determining eligibility, OHCD projects income forward which means
pay raises, bonuses, overtime, and pay differential, may result in ineligibility as this is updated until
date of settlement of the property. Interest from assets is added to income in determining eligibility.
Interest on assets over $5,000 is imputed @ the HUD determined passbook rate. For assets over
$5,000, the greater of the actual interest earned, or interest imputed at the passbook rate is included
as income.
The signature below certifies our understanding that if approved for purchase through the FTHB
Program the property will be maintained as the households’ primary and exclusive place of residence
and that the property may not be rented to a third party. Therefore the property must be owner
occupied at all times.

The Fair Housing Act prohibits
discrimination in housing because of:
• Race or color
• National origin
• Religion
• Sex
• Familial status (including children under
the age of 18 living with parents or legal
custodians; pregnant women and people
securing custody of children under 18)
• Handicap (Disability)
What Housing Is Covered?
What Is Prohibited?
The Fair Housing Act covers most housing.
In some circumstances, the Act exempts
owner-occupied buildings with no more than
four units, single-family housing sold or
rented without the use of a broker and
housing operated by organizations and
private clubs that limit occupancy to
members.
In the Sale and Rental of Housing: No one
may take any of the following actions based
on race, color, national origin, religion, sex,
familial status or handicap (disability):
• Refuse to rent or sell housing
• Refuse to negotiate for housing
• Make housing unavailable
• Deny a dwelling
• Set different terms, conditions or
privileges for sale or rental of a dwelling
• Provide different housing services
or facilities
• Falsely deny that housing is available for
inspection, sale or rental
• For profit, persuade owners to sell or rent
(blockbusting) or
• Deny anyone access to or membership
in a facility or service (such as a multiple
listing service) related to the sale or
rental of housing.

In Mortgage Lending: No one may take any
of the following actions based on race, color,
national origin, religion, sex, familial status or
handicap (disability):
• Refuse to make a mortgage loan
• Refuse to provide information
regarding loans
• Impose different terms or conditions on
a loan, such as different interest rates,
points, or fees
• Discriminate in appraising property
• Refuse to purchase a loan or
• Set different terms or conditions for
purchasing a loan
In Addition: It is illegal for anyone to:
• Threaten, coerce, intimidate or interfere
with anyone exercising a fair housing right
or assisting others who exercise that right
• Advertise or make any statement that
indicates a limitation or preference based
on race, color, national origin, religion,
sex, familial status or handicap (disability).
This prohibition against discriminatory
advertising applies to single-family and
owner-occupied housing that is otherwise
exempt from the Fair Housing Act.

Additional Protection
If You Have A Disability
If you or someone associated with you:
• Have a physical or mental disability
(including hearing, mobility and visual
impairments, cancer, chronic mental
illness, AIDS, AIDS Related Complex and
mental retardation) that substantially
limits one or more major life activities
• Have a record of such a disability or
• Are regarded as having such a disability
your landlord may not:
• Refuse to let you make reasonable
modifications to your dwelling or common
use areas, at your expense, if necessary
for the disabled person to use the housing.
(Where reasonable, the landlord may
permit changes only if you agree to restore
the property to its original condition when
you move.)
• Refuse to make reasonable accommodations
in rules, policies, practices or services if
necessary for the disabled person to use
the housing
Example: A building with a “no pets” policy
must allow a visually impaired tenant to keep
a guide dog.
Example: An apartment complex that offers
tenants ample, unassigned parking must honor
a request from a mobility-impaired tenant
for a reserved space near her apartment if
necessary to assure that she can have access
to her apartment.
However, housing need not be made available
to a person who is a direct threat to the health
or safety of others or who currently uses
illegal drugs.

Requirements for New Buildings: In buildings
that are ready for first occupancy after
March 13, 1991, and have an elevator
or four or more units:
• Public and common areas must be
accessible to persons with disabilities
• Doors and hallways must be wide enough
for wheelchairs
• All units must have:
– An accessible route into and through
the unit
– Accessible light switches, electrical
outlets, thermostats and other
environmental controls
– Reinforced bathroom walls to allow later
installation of grab bars and
– Kitchen and bathrooms that can be used
by people in wheelchairs
If a building with four or more units has no
elevator and will be ready for first occupancy
after March 13, 1991, these standards apply to
ground floor units.
These requirements for new buildings do not
replace any more stringent standards in State
or local law.

Housing Opportunities
for Families
Unless a building or community qualifies
as housing for older persons, it may not
discriminate based on familial status. That is,
it may not discriminate against families in
which one or more children under 18 live with:
• A parent
• A person who has legal custody of the child
or children or
• The designee of the parent or legal
custodian, with the parent or custodian’s
written permission.
Familial status protection also applies to
pregnant women and anyone securing legal
custody of a child under 18.
Exemption: Housing for older persons is
exempt from the prohibition against familial
status discrimination if:
• The HUD Secretary has determined that it is
specifically designed for and occupied by
elderly persons under a Federal, State or
local government program or
• It is occupied solely by persons who are
62 or older or
• It houses at least one person who is 55 or
older in at least 80 percent of the occupied
units, and adheres to a policy that
demonstrates an intent to house persons
who are 55 or older.
A transition period permits residents on or
before September 13, 1988 to continue living
in the housing, regardless of their age, without
interfering with the exemption.

If You Think Your Rights
Have Been Violated
HUD is ready to help with any problem of
housing discrimination. If you think your
rights have been violated, you may write a
letter or telephone the HUD office nearest you.
You have one year after an alleged violation
to file a complaint with HUD, but you should
file it as soon as possible.
What to Tell HUD
• Your name and address
• The name and address of the person
your complaint is against (the
respondent)
• The address or other identification of the
housing involved
• A short description of the alleged violation
(the event that caused you to believe your
rights were violated)
• The date(s) of the alleged violation

What Happens When You
File A Complaint?
HUD will notify you when it receives your
complaint. Normally, HUD also will:
• Notify the alleged violator of your complaint
and permit that person to submit an answer
• Investigate your complaint and determine
whether there is reasonable cause to believe
the Fair Housing Act has been violated
• Notify you if it cannot complete an
investigation within 100 days of receiving
your complaint
Conciliation: HUD will try to reach an
agreement with the person your complaint
is against (the respondent). A conciliation
agreement must protect both you and the
public interest. If an agreement is signed,
HUD will take no further action on your
complaint. However, if HUD has reasonable
cause to believe that a conciliation agreement
is breached, HUD will recommend that the
Attorney General file suit.
Complaint Referrals: If HUD has determined
that your State or local agency has the same
fair housing powers as HUD, HUD will refer
your complaint to that agency for investigation
and notify you of the referral. That agency
must begin work on your complaint within
30 days or HUD may take it back.

Play A Role?
If you need immediate help to stop a serious
problem that is being caused by a Fair Housing
Act violation, HUD may be able to assist you
as soon as you file a complaint. HUD may
authorize the United States Attorney General
to go to court to seek temporary or preliminary
relief, pending the outcome of your complaint,
if:
• Irreparable harm is likely to occur without
HUD’s intervention
• There is substantial evidence that a violation
of the Fair Housing Act occurred
Example: A builder agrees to sell a house
but, after learning the buyer is black, fails
to keep the agreement. The buyer files a
complaint with HUD. HUD may authorize the
Attorney General to go to court to prevent a
sale to any other buyer until HUD investigates
the complaint.

What Happens After
A Complaint Investigation?
If, after investigating your complaint, HUD
finds reasonable cause to believe that
discrimination occurred, it will inform you.
Your case will be heard in an administrative
hearing within 120 days, unless you or the
respondent want the case to be heard in
Federal district court. Either way, there is no
cost to you.
The Administrative Hearing: If your case
goes to an administrative hearing HUD
attorneys will litigate the case on your
behalf. You may intervene in the case and
be represented by your own attorney if you
wish. An Administrative Law Judge (ALJ)
will consider evidence from you and the
respondent. If the ALJ decides that
discrimination occurred, the respondent
can be ordered:
• To compensate you for actual damages,
including humiliation, pain and suffering.
• To provide injunctive or other equitable
relief, for example, to make the housing
available to you.
• To pay the Federal Government a civil
penalty to vindicate the public interest. The
maximum penalties are $11,000 for a first
violation, $27,500 for a previous violation
within the preceding five year period and
$55,000 for two or more previous violations
within the preceding seven years.
• To pay reasonable attorney’s fees and costs.
Federal District Court: If you or the
respondent choose to have your case decided
in Federal District Court, the Attorney General
will file a suit and litigate it on your behalf.
Like the ALJ, the District Court can order relief,
and award actual damages, attorney’s fees
and costs. In addition, the court can award
punitive damages.

You May File Suit: You may file suit, at your
expense, in Federal District Court or State
Court within two years of an alleged violation.
If you cannot afford an attorney, the court may
appoint one for you. You may bring suit even
after filing a complaint, if you have not signed
a conciliation agreement and an Administrative
Law Judge has not started a hearing. A court
may award actual and punitive damages and
attorney’s fees and costs.
Other Tools to Combat Housing
Discrimination:
• If there is noncompliance with the order of
an Administrative Law Judge, HUD may
seek temporary relief, enforcement of the
order or a restraining order in a United
States Court of Appeals.
• The Attorney General may file a suit in
Federal District Court if there is reasonable
cause to believe a pattern or practice of
housing discrimination is occurring.
