MOTION TO VACATE AND/OR TO RECONSIDER ORDER AND FOR A REHEARING Come now the plaintiffs through their attorneys and respectfully request that this Honorable Court vacate and/or reconsider the judgment filed and entered on July 5, 1979, denying plaintiff's request for expert witness, attorney fees, and costs against the defendant, Tennessee Valley Authority, and in support thereof, state: :i 1. That the award of costs and fees in this matter is appropriate. 2. That the request for costs and fees in this matter was timely 3. Arthur v. Nyquist, ,• 426 F Supp 194 (D. N. Y.- 1977). Further, plaintiffs would like to point out to the Court that, far from having an adverse impact upon the public weal, plaintiffs' lawsuit under the Endangered Species Act has actually saved the taxpayer's money. Because of the legal rulings in this suit, the General Accounting Office as well as the University of Tennessee,.were asked to reevaluate the Project. :,1 l Three hearings :·I! were held in the Senate and two were held in the House. ,,11" ( Another ~ il hearing of the Project is presently scheduled in the House. All i of these hearings have indicated that Valley development is the most beneficial alternative. Further, plaintiffs'lawsuit has also resulted in renewed ;: !: consultation between the United States Department of Interior and 1 the Tennessee Valley Authority which produced an Alternatives '· !i i• :· Study which again pointed out the greater benefits of Valley ;, development. ,, Plaintiffs' lawsuit has also resulted in a cabinet level ·I I. 'I I review of the project by the Endangered Species Co~~ittee which unanimously found that the Project was not justifiable as a 1i I reservoir. Charles Schultz , a member of the Endangered Species !; I' 1: Committee as well as Chairman of the President's Council of I : 1 ;;1 Economic Advisors, said during the hearings on the Project: 1: ,l Here is a project that is 95% complete and if one takes just the costs of finishing it against the total project benefits, it doesn't pay, which says something about the original design. ;' !I ' i:I I;I !:., Tennessee Valley Authority li! additional 1 .,,, itself.estimates that an $30-$40 million remains to be spent to complete the Project . Thus, plaintiffs insist that their efforts have been a paradigm of citizen participation which has saved the taxpayers millions of dollars and therefore, the award of costs and fees in this cause is appropriate. -2- ,. !! i: p ,! II. PLAINTIFFS' REQUEST FOR FEES AND COSTS WAS TH1ELY J! FILED !~ As was repeated-ly mentioned in defendant's brief, li plaintiffs did not file a request for fees and costs with the il :; Appellate Court. ii However, defendant fails to mention that at the time of such appeals, defendant and plaintiffs were working under .! ,, iL il an agreement signed by plaintiffs' attorney and defendant's general counsel that " . the plaintiffs will defer any claim 'i for costs, expenses, and attorneys fees until the appeal process l:.! is concluded before the Supreme Court of the United States, I!,. unless matters at issue are otherwise prior thereto concluded." " ' ;1 (See Exhibit 1) Apparently, defendant mistakenly overlooked this \i , agreement while formulating :i its brief to this Court. ,,,, Further, plaintiffs were not obligated to claim their !ili ' fees and costs in the Appellate Courts. The defendant's ' reliance upon Briggs v. Pennsylvania Railroad, 334 US 304 (1948) ii is misplaced. The test which this Court must use in determining whether attorney fees and costs are appropriate is that found in Newman v. Piggie Park Enterprises, Inc., 390 US 400 ,.'; ;: ,,'· 11 (1968) (". . that one V'7ho succeeds in obtaining an injunction under that title should ordinarily recover an attorneys fee unless special circumstance s would render such an award unjust." 390 US at 402). (Defendant's brief page 8) I; that only Defendants are correct when they say . reasonable attorney fees may be allmved." n Defendant is also correct when i t insists that here the fee, is not a contractual one, "but one imposed upon an involuntary 1: client." l: But it must be remembered that this "involuntary :; client" had i! >i ,,·i imposed'itself upon an unwilling public (as represented by Congress) when it ignored Federal Law. In fact, a strong motivating factor for the Supreme Court's presumption of awarding attorneys fees in Nevnnan v. Piggie Park Enterprises, Inc., 390 US 400 (1968) was that costs would be taxed not against normal civil litigants, but against'those who violate Federal Statutes. The request for attorney fees in this case by Professor :• Plater and Hr. Dougherty is extremely reasonable under the circumstances. l\-1r. Dougherty is a highly experienced trial and appellate attorney in Knoxville, Tennessee, has practiced before this Court upon many and varied occasions and is one of the -4-· distinguis hed attorneys in this state. approxima tely 18 years. He has practiced law for Professor Zygmunt J. B. Plater is a former professor of law _at the University of Tennessee College of Law and is currently a professor at Wayne State Universit y. He has published numerous scholarly works concerning Federal Environme ntal Law, is a recognized expert in the field of Environme ntal Law, and has received many awards for distinguis hed achieveme nt in these areas. As noted in plaintiff s' Verified Bill of Costs, the vast majority of Professor Plater's time to this case has been donated pro bono. Further, the only periods for which 1: compensat ion is claimed is his own personal time during vacations ~! ;: or otherwise . II Few cases have presented more novel or difficult legal questions than the present case from inception to completio n. The case was without precedent . 1 political significan ce. In light of the time and labor involved, however, a substanti al preclusiv e effect is undeniabl e. (Emergency School The $75.00 per hour rate is competitive •;-Jith pre- vailing rates in this community. ll Plaintiffs' request remains reasonable in light of the li ji '''·!eighth factor set forth in Johnson. ,t The efforts of counsel :r ultimately yielded the exact relief prescribed by Congress and desired by plaintiffs. u of The permanent injunction against closure the Tellico Dam has preserved the Snail Darter for legislative resolution of the issue. Further, plaintiffs efforts thoughout this lawsuit have ultimately saved the tax payers millions of dollars. Finally, determining reasonable attorney fees requires consideration of the undesirability of the caae. Dam controversy polarized public opinion. ,,i'l The Tellico Emotions ran high on both sides of the issue throughout the surrounding area. Despite the vJOrthiness of plaintiffs 1 cause, public pressure, fueled by extensive media coverage, was intense. Serving as counsel in such a case inevitably risks the alienation of a large segment of the community.
