of the SEBA members
and our friends during
this holiday season. I hope
that everyone stays safe.
I would like to thank the
volunteers and staff that
helped to make Shop with
a Cop a huge success again
this year. Without your
help and donations we
would not be able to help the 500+ children that participated in the event this year.
This has been a very busy year for SEBA, with all of
the units that were in negotiations with the County and
I
the others
that are still in
negotiations.
It has been a
challenging
year for all involved in the
negotiation process
and it will continue
to be for those units still in the process. The challenges will not stop there. As we all know there were
several issues on the ballot this year that have the potential to affect all of us. Those issues range from pension
reform to attacks on all public employees at every level.
SEBA will continue to monitor all of these issues and will
fight the issues that will adversely affect any SEBA members or public employees as a whole.

A Year in Review

I
decided to write
this month’s
article from my
personal experience.
2012 was a tough year
for the labor movement. It is no secret
that the economy has
been in the dumps for
a while however, what
occurred in 2012 was unconscionable. We witnessed an assault on
public employees and their pension
benefits. What was once sacred
became the target. Politicians from
every level of government jumped
on the bandwagon of demonizing
public employees. Costa Mesa, San
Diego and San Jose have been hit
with an all-out assault on rank and
file employees. Statewide we saw
a campaign by billionaires to quiet
organized labor’s
voice with Proposition 32. Although
we were victorious
in defeating proposition 32, we need to
remember this was
their third attempt
at silencing organized labor. We need
to be proactive in
assuring there isn’t a
fourth attempt.
Specialized Fire Services
Unit Negotiation Update
On December 10th SEBA and
the County met and conferred over
a successor MOU for the Specialized Fire Services Unit. We were
unable to come to an agreement,
therefore SEBA has requested factfinding. The fact-finding should
occur by the end of the year. SEBA

Always consult with an association representative/lawyer
before responding to any report, letter, memo and/or questions
concerning an investigation which could possibly lead to
punitive action. If ordered to do so ask to have it recorded and
read the following:
NON-WAIVER STATEMENT: “I have been refused the right
to have a representative of my choice. I understand that I
am being ordered to make a report or answer questions and
that if I do not comply with the order, I may be disciplined
for insubordination. Therefore, I have no alternative but to
abide by the order. However, by so doing, I do not waive my
Constitutional rights to remain silent under the 5th and 14th
Amendments to the United States Constitution, under the
protections afforded me under case law.”

DUI
W
ith the holiday season upon us, there
is always an increase
in DUI arrests involving our
members. Remember you are
not exempt from being cited and
booked. Not only will the court
fine you, you will also be disciplined if not terminated by your
department. I don’t know how to express this enough;
if you’re going to drink get a driver, it’s not worth it.
If you are arrested for DUI, please give us a call. We
can assist you in the administrative interview and any
subsequent hearings. You should get an attorney for the
criminal portion of it. You will be given a 30 day temporary license. Please read that form carefully. After
the 30 days, your license will be suspended. You will
have to make arrangements with your department on
what your options are until you go to court and receive
a restricted driver’s license. It is important that you retain your driving privileges.
Tape Recording
This is a topic I think needs to be addressed. The
California Penal Code states:
632(a) Every person who, intentionally and without the
consent of all parties to a confidential communication,
by means of any electronic amplifying or recording
device, eavesdrops upon or records the confidential

communication, whether the communication is
carried on among the parties in the presence of one
another or by means of a telegraph, telephone, or other
device, except a radio, shall be punished by a fine not
exceeding two thousand five hundred dollars ($2,500),
or imprisonment in the county jail not exceeding one
year, or in the state prison, or by both that fine and
imprisonment. If the person has previously been
convicted of a violation of this section or Section 631,
632.5, 632.6, 632.7, or 636, the person shall be
punished by a fine not exceeding ten thousand dollars
($10,000), by imprisonment in the county jail not
exceeding one year, or in the state prison, or by both
that fine and imprisonment.
633. Nothing in Section 631, 632, 632.5, 632.6, or
632.7 prohibits the Attorney General, any district
attorney, or any assistant, deputy, or investigator of the
Attorney General or any district attorney, any officer
of the California Highway Patrol, any chief of police,
assistant chief of police, or police officer of a city or
city and county, any sheriff, undersheriff, or deputy
sheriff regularly employed and paid in that capacity by
a county, police officer of the County of Los Angeles,
or any person acting pursuant to the direction of one of
these law enforcement officers acting within the scope
of his or her authority, from overhearing or recording
any communication that they could lawfully overhear
or record prior to the effective date of this chapter.
This means you cannot tape record someone without their knowledge. Here are some examples that
would apply to our members. If you are called in to
speak to a supervisor you cannot turn on a tape recorder that is in your pocket or in a bag or anywhere
else without the permission of the parties involved in
the meeting. You must ask for permission to tape record. If you are denied you cannot hide it. You cannot
tape record your co-workers in the work place. The
only way you can tape record without permission is if
you are interacting with inmates or conducting investigations.

The Discipline Process

M
aybe you have been
one of the lucky ones
who have never had
to go through this process, but
I thought I would address this
issue just in case you find yourself the focus of an investigation.
Employees can become the focus
of an investigation that was initiated by a citizen, an employee, or by administration. A
citizen alleging that a deputy, probation corrections officer, or any other classification SEBA represents engaged
in misconduct files a citizen’s complaint. The incident
could have occurred either through the citizen’s contact
with one of our members while the member is on duty,
or it may even occur while off-duty. For example, the
complainant could allege that a deputy used excessive
force in the arrest of a suspect, or that the member while
off-duty used his or her position in the Department to
intimidate the citizen. In an employee complaint, the
employee is usually alleging that another employee is
subjecting the complainant to a hostile work environment. Management usually files an administrative complaint when he or she becomes aware that one of our
employees may have violated the County’s rules.
I usually tell the member who is the focus of a citizen’s complaint not to worry. Administration has an obligation to investigate every complaint made by a citizen.
If not, they may be subjecting the County to liability.
If the member did not engage in misconduct, the likely
result is that the complaint will be unfounded, the member exonerated, or the findings inconclusive.
An employee could file a complaint alleging that
his or her co-worker is engaging in discourteous treatment towards the complainant. A word of caution, the
complainant needs to be sure that he or she did not also
engage in discourteous treatment because the complainant could find himself or herself to be the recipient of
disciplinary action from information obtained during the
investigation.
In an administrative complaint, management may ask
Professional Standards (PS) or Internal Affairs (IA) to
conduct an investigation of one of our members. An example could be that the member used excessive force in
subduing an inmate and/or a minor.

If you are the focus of the investigation, you will be
given a notice informing you that you are under investigation. Don’t panic! Call your SEBA representative
and we will inform you of the process. Normally, PS,
IA or one of your Sergeants at the station will be the
interviewer(s). There shall be no more than two interviewers asking you questions. The interview will be
tape-recorded. You are entitled to have your representative present to insure that your Peace Officer Bill of
Rights are not violated. In some cases the interviewers
will Mirandize you. You will answer that you understand
your Miranda rights, but that you are not waiving them.
The interviewer will then order you to speak, or else you
will be found insubordinate. They will tell you that you
must be honest and answer their questions to the best of
your recollection. Never guess! If you don’t recall, then
say so. They will also admonish you not to discuss the
case with anyone other than them, your representative,
or your spouse. It is extremely important that you obey
this order. If you don’t, and management finds out, you
will be disciplined for insubordination! It is imperative
that you not waive your Miranda rights and that you are
ordered to speak. The reason for this is that a coerced
statement cannot be used against you in a criminal proceeding.
I often hear from the members that they were unsure
if they should call SEBA. He or she didn’t think representation was necessary, did not want to waste our time,
or believed it was a sign of guilt to request representation. Believe me when I tell you that it is in your best interest to call SEBA. Our job is to represent you! No, it is
not a sign of guilt when you ask to have a representative
present. The interviewers expect it.
If you are called for an interview as a witness you are
also entitled to have a representative present. Remember information obtained from the interviews could later
be used against you and you could then become the
focus.
The process, from the time you are served with your
notice until the investigation is concluded with findings
made may take months. This may appear to be a rather
long time especially for the accused/focus of the investigation. However, when you consider the County has
to interview all the witnesses, has to provide you with a
summary of what each witness said, and has to make a
decision on the appropriateness of discipline, then the
length of time is understandable particularly in cases

with multiple witnesses and multiple
allegations.
For the Sheriff’s Department,
once the investigation is concluded
and alleged violations are deemed
to have occurred, your Captain
can propose discipline of up to five
days. In my experience, this is seldom done. Usually members are
scheduled for a Board of Chief’s
hearing, or a Mini-Board. The Board
of Chiefs consists of the Assistant
Sheriff, three (3) Deputy Chiefs,
the Captain from your station, and
the Lieutenant from Internal Affairs. The Mini-Board consists of the
member’s Deputy Chief, Captain,
and the Lieutenant from Internal
Affairs. Mini-Boards may be utilized when the proposed discipline
is expected to be a ten (10) day
suspension or less. The hearing is
your chance to respond to the allegation (s) before discipline is
ordered. Only one Board member
may ask you questions unless you
waive this option. Your waiver would
then allow for any of the Board
members to question you regarding
the allegation(s). It will be taperecorded. Your representative will
present your position on why you
believe you are not guilty of the violations, or if you are guilty, inform
them of any mitigating circumstances. You may also speak on your
behalf if you choose to do so. Approximately less than a week later,
you will be notified of their decision
and served with the proposed order
of discipline. If you choose to accept
their decision and discipline you do
not have to appeal it. However, if
you believe you are not guilty of the
violations found, or if you believe
the discipline is too severe, you can
begin the appeal process. You have
five working days in which to file
an appeal to the notice of proposed
discipline. So make sure and contact
your SEBA representative as soon as
you are served.
For the Sheriff’s Department, the
Assistant Sheriff hears the appeal
(Skelly). The Chief Probation Officer hears the appeal for the Probation Department. If you are still not
satisfied with the decision rendered
at this level, you have the right to
appeal it to the Civil Service Commission, or a hearing officer.
The part of the appeal process
takes additional time. This is usually due to scheduling as the appeal
process includes several decision
makers.
It sounds complicated, but if you
call us as soon as you are contacted
by PS, IA or your sergeant, we will
guide you through the process. Your
SEBA representative will do his or
her best to protect your rights, provide you with the best representation possible, and keep you informed
of the status of your case. SEBA

S
he is only 14 years old and she could be your
daughter or mine. She has had a life filled with
hurt and sadness but you would never know it
when you see that megawatt smile on her face. Martha
has the bubbliest personality of any teenage girl I have
ever known and she also has Cystic Fibrosis which will
claim her young life in less than a year.
I wanted to help this sweet little lady the best way I
knew how and enlisted the services of the Best Buy team
in Beaumont Store #1441.
First of all she needed a new iPod Touch with Bose
headphones to enjoy all of her favorite tunes while she
was taking treatments at Loma Linda. When she arrived home after a two week stay in the hospital she was
greeted by the Geeksquad from Best Buy and enjoyed
watching as they installed her new 50-inch Samsung
LED television and Blu Ray Player. I bought her over 20
of her favorite movies to watch and also had them install
Martha with DCMF Executive Director Corky Bell.
Apple TV so she could listen to her music over her new
television and Samsung Soundbar.
Martha can now relax in the comfort of her own bedroom in her adopted parent’s home and hopefully enjoy
her last days with her great new toys. Just meeting Martha has enriched my life more than she will ever know
and I hope I made a small difference in hers as well. SEBA

SBPD Rumors – Many rumors regarding the future of
San Bernardino Police Department have been circulating
throughout the Department and news sources. To this date,
City officials have submitted a request for a proposal of
Sheriff’s services only. This is viewed as normal contingency
planning.
SEBA’s Christmas Open House - Dec. 13, 2012 – All
members are invited and encouraged to attend the annual
SEBA Christmas Open house on Thursday, December 13th,
2012 from 11am to 3pm at the SEBA office.
Board of Director’s Conference - Jan. 9-10, 2013 – The
SEBA 9th Annual Board of Directors Conference will be
held on January 9th and 10th at the Morongo Casino Resort
and Spa. Among the topics covered will be By-Laws, Station
Director Responsibilities and Peace Officer’s Bill of Rights.
All Directors are encouraged to RSVP and attend.
CCLEA Meeting – The President of CCLEA was recently
re-elected.

suggestions for the monthly Star & Shield Magazine. Considerations are being made on magazine content and distribution frequency. All members are encouraged to contact

The PORF Trust Committee will

Written Report – A written labor report was provided to Board members.
Specialized Fire Negotiations – There
have been 3 meetings thus far. November 12th is the next scheduled meeting.
Negotiations seem to be progressing.
West Valley Detention Center Vacation Schedule – During the month of
October, a Department memo was released to WVDC members. The memo
appeared to be in conflict with fair vacation practices. A letter was written by
SEBA’s attorneys indicating such and
the Department retracted their directive.

among the Board about staffing levels at
various work locations.
