JANUARY/FEBRUARY/MARCH 2011 Charitable Bingo Receipts for Calendar Year 2010 Highest Ever Calendar year 2010 was the highest grossing ever for charitable bingo since the game was legalized in 1981. Total receipts exceeded $699.3 million, and players won a record $526.6 million in prizes. “The total receipts of $699.3 million are an increase of more than $6 million over the previous year,” said Charitable Bingo Division Director Phil Sanderson. “Despite the fact that distributions to charitable organizations had increased every year from 2002 to 2009, last year we saw a downturn of $2.1 million in distributions compared to the previous year, going from $36.0 million to $33.9 million. Total distributions since 1981 now exceed $971 million.” The chart below compares charitable bingo activity during the last two calendar years. Attendance at bingo occasions exceeded 664 million since the game was legalized in 1981. “Overall, the attendance for 2010 was down from the same period in 2009, while we did see a slight increase in the number of occasions,” Sanderson said. “The average attendance per bingo occasion is slightly down; however, the average amount spent per player did increase slightly over the previous year. Despite a slight decline in attendance, charitable bingo is still fun for players of all ages, especially longtime players who enjoy playing not only because the game is entertaining, but also because it gives them a chance to socialize with other long-faithful aficionados who feel the same way.” During 2010, 1,181 nonprofits conducted charitable bingo games. On March 31, 2011, the Texas Lottery Commissioners adopted one new Charitable Bingo Administrative Rule and amended four other existing Charitable Bingo Administrative Rules. These rule changes take effect April 24, 2011. The following is a brief summary of the changes that were made to each of the rules. A complete copy of all Charitable Bingo Administrative Rules is available on our website at www.txbingo.org under the Regulations & Statutes menu item. Rule 402.203 – Unit Accounting (Rule Amendment) 1.The designated agent is required to make available all unit accounting records to any member of a licensed authorized organization whose organization is a member of the account unit within 15 calendar days of the request. 2.The designated agent is required to provide a copy of all unit accounting records to the bingo chairperson of a licensed authorized organization whose organization was a member of the account unit within 30 calendar days of the date of separation. 3.Requires that all net proceeds remaining in an organization’s former bingo account at the time it joins a unit must be disbursed by the organization for its charitable purposes by the last day of the quarter following the date the organization joined the unit or transferred to the unit bingo account. 4.Requires an organization to report on a form prescribed by the Commission the final disposition of all proceeds in its bingo account for the quarter following the quarter it was last required to file a Texas Bingo Quarterly Report apart from the unit. 402.205 – Unit Agreements (Rule Amendment) 1.Deletes duplicative definitions for “Act” and “Rules” which are specified in 16 TAC 402.100. 2.Requires a unit to notify the Commission of a change in unit membership on a Commission-prescribed form, seven (7) calendar days prior to the date the unit membership changes. 3.Requires a unit to provide the Commission of the executed amendment to a unit agreement within twenty-five (25) calendar days of the effective date of the change. 402.501-Charitable Use of Net Proceeds (Rule Amendment) 1.Deletes Rule 402.501 Distribution of Proceeds for Charitable Purposes 2.Clarifies Texas Occupations Code 2001.454 related to a licensed authorized organization’s use of net proceeds for charitable purposes and sets forth that net proceeds of conduction bingo and any rental of a premises for same shall be devoted to the exempt purpose under which an organization qualifies as a nonprofit or otherwise authorized organization. 3.Sets forth the circumstances where a licensed authorized organization may not use net proceeds. 4.Addresses donation of funds. 5.Addresses documentation to substantiate use of proceeds. JANUARY/FEBRUARY/MARCH 2011 402.502 – Charitable Use of Net Proceeds Recordkeeping (Rule Amendment) 1.Changes the name of the rule from “Charitable Use of Proceeds” to “Charitable Use of Net Proceeds Recordkeeping.” 2.Adds or changes requirements of what an organization must maintain and make available to a representative of the Commission, including a copy of the organization’s organizing documents and a copy of the organization’s four most recently filed IRS From 990s. 3.Requires the licensed authorized organization to have documentation for all proceeds used for charitable purposes consistent with the exempt purposes of the licensed authorized organization. 4.Identifies documentation that must be maintained by accounting units to verify that disbursed funds were used for its charitable purposes. 402.604 – Delinquent Purchaser (Rule Amendment) 1.Adds new language that if a purchaser is on the Delinquent Purchaser List, a manufacturer or distributor my only provide bingo equipment or supplies to them upon terms requiring immediate payment by the purchaser. 2.Adds new language clarifying what is considered immediate payment, 3.W hat are the new deposit requirements, notice that a licensee or unit must have adequate funds to cover they payment it its bingo account on the date the check is initially presented for payment, and 4.Notice that if the payment for leased bingo equipment is not timely received, the manufacturer or distributor must deactivate the bingo equipment within 24 hours. Charitable Bingo Allocations to 157 Jurisdictions in Fourth Quarter of 2010 Exceed $2.9 Million During the final quarter of 2010, Charitable Bingo activity in 157 jurisdictions brought those communities allocations of $2.98 million, as required by law. The state’s General Revenue Fund also received more than $3.3 million from the Charitable Bingo Operations Division of the Texas Lottery. Allocations in the fourth quarter were down from the previous quarter, but up slightly compared to the same quarter in 2009 when allocations were $6.27 million. Allocations are the result of prize fees collected from players who won bingo prizes in October, November and December in games conducted by non-profit organizations. State law requires withholding five percent of a prize awarded to a winner and deposited in a non-dedicated account in the General Revenue Fund. Cities and counties that imposed the gross receipt tax on a local-option basis on or before January 1, 1993, receive quarterly payments of up to 2.5 percent of the prizes won by bingo players in their jurisdictions. Silver, Vice-Chair BAC The Bingo Advisory Committee (BAC) held a meeting on March 9, 2011, to discuss current issues dealing with the Bingo industry. Phil Sanderson informed the Committee of the new email subscription service offered by the Charitable Bingo Operations Division (CBOD). Visit www.txbingo.org and click on the email/text update link that is in the middle of the page. This is a great resource for tracking up-to-the-minute changes in the industry. The Texas Legislature is in session. This is an important time for our industry. There are several pieces of legislation that we need to keep our eye on that can impact bingo: HB700, HB2424, HJR719, SB1212 and SJR35. Please visit Texas Legislature Online to track these bills. Three draft rules were discussed during the meeting: 1 6 TAC §402.103 Sales of Bingo Products to a Bingo Player 16 TAC §402.512 Bingo Occasion Records Requirements 16 TAC §402.211 Games of Chance There were a few comments to all of these rules prior to the meeting. However, there were several comments made during the meeting. The CBOD will take the verbal comments offered by individuals as well as committee members into consideration. I encourage everyone to attend the BAC meetings if at all possible so your voice can be heard so that the BAC is able to advise the commission on the needs and problems of the state’s bingo industry. The BAC NEEDS YOU! Nominations are now being accepted for three term vacancies on the BAC and to fill one unexpired term. The three BAC positions each have a 3-year term beginning September 1, 2011, and represent the following bingo interest groups: Commercial Lessor representative-1 position Charity representative-2 positions Additionally, currently there is a vacancy for a Charity/Lessor representative with an unexpired term that ends August 31, 2012. Nomination forms are available on the CBOD’s website (www.txbingo.org) under the About Us/Bingo Advisory Committee menu path. Deadline for submission of nomination forms is April 30, 2011. JANUARY/FEBRUARY/MARCH 2011 Interest Rate Change On Delinquent Tax (Prize Fee and Rental Tax) 2011 Effective January 1, 2011, the interest rate on delinquent tax (prize fee and rental tax) is 4.25 percent (0.0425) per annum. Delinquent taxes accrue interest beginning 60 days after the due date. The rate of interest is based on the prime rate plus 1 percent, as published in the Wall Street Journal on the first day of each calendar year that is not Saturday, Sunday, or a legal holiday.
