2. PERMISSION TO APPLY FOR TRANSPORTATION ALTERNATIVE PROGRAM (TAP) GRANT
FUNDING THROUGH THE FLORIDA DEPARTMENT OF TRANSPORTATION(FDOT) FOR THE
DIXIE HIGHWAY SIDEWALK EXTENSION (WRIGHT BLVD TO GREEN RIVER PARKWAY)
PROJECT
The City has requested that the County utilize its Local Agency Program (LAP)
certification and eligibility to participate in the FDOT’s Transportation Enhancement
Program (TAP) for the Dixie Highway Sidewalk Extension Project and will contract for
construction of the Project on the City’s behalf. Upon FDOT funding approval, the
County and City of Stuart will execute an Interlocal Agreement for the Project.







Project Description – This project consists of the construction of an 8’ wide
sidewalk along the westerly right-of-way of NW Dixie Highway from the north
terminus of the sidewalk constructed with the Wright Boulevard turn lane
project to the southerly terminus of the sidewalk completed with the County’s
Green River Parkway project. The City of Stuart’s proposed NW Dixie
Highway project is part of the East Coast Greenway (ECG) alignment in the
“Northern Gap” portion of Martin County. This alignment was discussed at
workshops with the Martin MPO’s advisory boards in 2014 and 2015. The NW
Dixie Highway project would help connect the Green River Parkway portion of
the ECG with the middle and southern portions through Martin County,
connecting to existing and proposed ECG-designated trails in Palm Beach
County.
Requested Grant Award – The total estimated project cost is $464,517
($379, 261 grant funds and $85,256 of local/City of Stuart funds).
Budgetary Impact – None. The City acknowledges and agrees that it will be
solely liable to the County for all costs associated with the Project, upon
funding approval from FDOT. Prior to the County’s issuance of a Notice to
Proceed to the Contractor, the CITY agrees to provide: 1) the total Bid Award,
including a fifteen percent (15%) contingency amount, 2) twelve percent (12%)
of the total Bid Award for Construction Engineering & Inspection (CEI)
services, and 3) a Four Thousand Five Hundred Dollar ($4,500.00) nonrefundable Contract Administration Fee.
Annual Operating Cost - Staffs time to administer the grant which is funded
by the City of Stuart (via an Interlocal Agreement) as part of the nonrefundable contract administration fee.

COOPERATIVE FUNDING PROGRAM (CFP) GRANT FOR THE ENGINEERING IRRIGATION H2O
CONSERVATION PROJECT






Requestor – Field Operations Division / Engineering Department
Granting Agency – South Florida Water Management District (SFWMD)
Project Description – This project involves water conservation upgrades to
the irrigation systems at eight enhanced right of way landscape sites in the
County. These sites are irrigated with potable water, and were identified
because they have the highest water consumption rates of the Engineering
Department sites.
The project includes replacement of existing battery operated controllers with
solar powered controllers, and installation of soil moisture sensors in each of
the zones of the landscape sites. Recent studies indicate that incorporation of
soil moisture sensors into irrigation system can reduce water consumption by
20-40%.
This grant request is for 50% of the estimated total replacement cost.
Requested Grant Award – $10,000
Budgetary Impact – The estimated total cost for this project is $20,000. If
successful in obtaining this grant, $10,000 would be used as match, and would
come out of the Field Operations contracted services budget.
Annual Operating Cost – Expected O&M costs is for maintaining the
irrigation is expected to remain static. Monthly irrigation inspections already
occur at all of the sites, and will continue at these sites.
ALTERNATIVE ACTION:
 Programmatic Implication if not approved – The purpose of the replacement
is to improve water conservation efforts and reduce the Field Operations
Division costs of irrigation.
 Financial Fiscal impact if not approved – None

The CR-707 sidewalk Project is an FDOT Grant funded City of Stuart project that is

subject to an Inter-Local Agreement between Martin County and the City. Martin
County manages such projects for the City because Martin County is FDOT LAP
Grant Certified.
Per the Interlocal Agreement, the City acknowledges and agrees that it will be solely
liable to the County for all costs associated with the Project. Prior to the County’s
issuance of a Notice to Proceed to the Contractor, the City agrees to provide: 1) the
total Bid Award, including a 15% contingency amount, 2) 12% of the total bid Award
for Construction Engineering & Inspection (CEI) services to be performed by Martin
County staff, and 3) a $4,500 non-refundable Contract Administration Fee.
The City of Stuart has submitted a check to the BOCC for $331,083.67 for this
project.

funds are used to fund driver education programs in public and non-public schools in
Martin County. These funds are distributed to public and non-public schools through
a grant process.
The Martin County School Board has applied for this grant. The Budget Office has
reviewed the request and determined that it complies with the requirements of
Section 318.1215 Fla. Stat. and Section 47.153, General Ordinances, Martin County
Code.




WHEREAS, the Federal Transit Administration has been delegated authority to award federal financial
assistance for public transit projects; and
WHEREAS, the grant or cooperative agreement for federal financial assistance will impose certain
obligations upon Martin County, and may require Martin County to provide a portion of the local share of the
project cost; and
WHEREAS, Martin County has or will provide all annual certifications and assurances to the Federal Transit
Administration required for the project;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Martin County, Florida
a designated recipient as defined by 49 U.S.C. 5307 (a)(2);
A. This Board hereby authorizes the Chair of the Martin County Board of County Commissioners, or

The Martin Metropolitan Planning Organization (MPO) is pleased to provide one
application for the Transportation Alternatives Program (TAP) to be reviewed for
funding in FY 2019/20.

Martin MPO advertised a 'Call for Projects' on January 26 h 2016, and distributed
application materials, deadline schedules and program infonnation to all community
partners, local jurisdictions, and advisory committees. On March 11th 2016, MPO staff
facilitated a screening committee meeting consisting of multidisciplinary staff members
to solicit input regarding project feasibility, opportunities and challenges.
The City of Stuart submitted an application for the NW Dixie Highway Sidewalk
Project. This project was deemed in compliance with the comprehensive program
goals and project evaluation criteria. Staff notes that the City' s project will complete a
missing link of sidewalk that is also part of the East Coast Greenway alignment through
Martin County. This project proves to be an excellent candidate for TAP funding.

Dear Ms. Beltran:
Subsequent to the MPO TAP review committee meeting last Friday, March 11, 2016,
enclosed, please find the Revised City of Stuart application for the referenced project
which incorporates the comments and suggestions provided.
As you know, the Green River Parkway in Jensen Beach is designated as a portion of the
East Coast Greenway, the 2,9oo+ mile national trail between Maine and Key West A
section of the ECG runs through the Seabrancb State Preserve in Hobe Sound, and another
portion is located in Jonathan Dickinson State Park.
The City of Stuart's proposed NW Dixie Highway Project is part of the ECG alignment in
the "Northern Gap" portion of Martin County. This alignment was discussed at workshops
with the Martin MPO's advisory boards in 2014 and 2015. The NW Dixie Highway
Project would help connect the Green River Parkway portion of the ECG with the middle
and southern portions through Martin County, connecting to existing and proposed ECGdesignated trails in Palm Beach County.
Specifically, this project consists of an 8' wide concrete sidewalk along the westerly rightof-way of NW Dixie Highway from the north terminus of the sidewalk constructed with
the Wright Boulevard Tum Lane Project to the southerly terminus of the sidewalk
completed with the county's Green River Parkway Project.
This project will complete the missing link of sidewalk connecting Federal Highway,
Baker Road, Savannah Road and Cardinal Avenue to the northerly gateway to Historic
Downtown Stuart

Jurisdictional Transfer of a Portion of SR 707 From FOOT to City of Stuart
Summary Explanation/Background Information on Agenda Request :
During the design phase of the Green River Parkway (GRP). a roundabout was considered for the
intersection of GRP and SR 707 . The concept was for a single lane roundabout which resulted in the
Florida Department of Transporlalion (FDOT) requiring a two lane roundabout.
FDOT sugges ted a jurisdicllonal transfer of the segment of SR 707 from south of the drawbridge to NE
Savannah Road to either the City of Stuart or Martin County, including the Old Roosevelt Bridge and
perpetual operalion of the drawbridge. would be required in order for a single lane roundabout to be
constructed . Thi s proposal wa s not accep table to either local governments and the intersection design
was then completed as a signalized 'T' intersection.
Recenlly, city staff approached FDOT as to the poss1b1lity of a jurisdictional transfer of the segment of SR
707 from sou th of the Old Roosevell Bridge lo NE Savannah Road to the City of Stuart. excluding the
bridge section. FDOT staff was amenable to the suggestion and has provided a "Desktop Analysis and
Reconnaissance Survey for the Proposed Jurisdictional Transfer of Stale Road (SR) 707 from the SR 5
Underpass (MP 20.702) lo NE Cardinal Avenue/NE Savannal1 Road (MP 22.675) to City of Stuart. Martin
County. Floridi!".
Staff met with. and discussed In delail. the proposed transfer agreement with John Spivey and Carolyn
Gish of FDOT on Thursday. March 29. 2012
As a component of the transfer. and a l the request of city staff. FDOT stall has committed to filling a
portion of the fenced retention pond located adjacent to Riverside Shops in order to create 6:1 side
slopes which will allow removal of lhe (unsighlly) chain link fence.
With all things considered. having local jurisdiction of the described segment of SR 707 provides much
greater opportunities for roadway beautification and bicycle & pedestrian enhancements. along with the
potential for less restrictive development and redevelopmen t constraints along t11is corridor.
Staff fully supports the 1urisd1ctional transfer of this roadway segment from FDOT to the City of S1uart.

Annual Stuart Boat Show. In addition, the wet rete ntion area at the t ouchdown of the Roosevelt
Bridg e on Dixie Hwy, will be used by the City as a poc ket p ark locntion for individuals wa lking or
running in the area.

This letter serves as a form.al notification of the approval for the jurisdictional transfer of the
subject roadway between the Florida Department of Transportation (FOOT) and' be City of Suart.
The transfer, effective June 6, 2012, is in accordance with Chapter 335.0415, Plorida Statutes.
The FOOT and the City have mutually agreed upon th is transfer.
Our District Maintenance Office will remove relevant State Road signs as appropriate. As
contained in the Roadway Transfer AgreemenL, existing deeds or maps documenting Right-ofWay title transfer will be recorded, by the Department, in the Public Records of Manin County.
Enclosed for your records are copies of the signed Roadway Jurisdiction Transfer, County
Resolu tion and Transfer Agreement. If you should have any question or need additional

po les that are erected on the Old Roosevelt Bridge (also depicted on Exhibit A) shall

GRANTOR does hereby reserve and retain unto itself an easement for equipment and ingress and
egress hereto (hereinafter "Exclusive Equipment Easement" ) and reserves and retains unto itself
ownership of all tangible property of GRANTOR, its successors and assigns located now or
hereafter in the Exclusive Equipment Easement. GRANTOR does hereby retain this permanent and
perpetual Exclusive Equipment Easement t o operate, maintain, excavate for, construct, install,
reconstruct, add, relocate, replace, and/or remove such systems of communications, facilities or
related services as GRANTOR may from time to time require and to access them as set forth below
(" Facilities" ) upon, over, across and under the Exclusive Equipment Easement. GRANTOR retains
and reserves exclusive right to itself install, or allow any other person, firm, or corporation to
install, cable or conduit or other appurtenances upon, across, and under said easement for any
purposes, including without limitation, communications, power, water, sewer or other utility
services. Ingress and egress shall be unrestricted 24-hour, 7 days a week, access into Exclusive
Equipment Easement for itself and its licensees, agents, successors, assigns, and allied and
associated companies and the right to allow any other person, firm, or corporation the same
access. The GRANTEE shall coordinate with GRANTOR any construction within the Exclusive
Equipment Easement. In the event GRANTEE desires to relocate any portion of the Exclusive
Equipment Easement, GRANTEE shall pay any costs incurred by GRANTOR as a result of the
relocation.
GRANTOR HAS NOT MADE, DOES NOT MAKE AND SPECIFICALLY REVOKES ANO
DISCLAIMS ANY REPRESENTATIONS, WARRANTIES, PROMISES, COVENANTS, AGREEMENTS OR
GUARANTEES OF ANY KIND OR CHARACTER WHATSOEVER, WHETHER EXPRESS OR IMPLIED,
ORAL OR WRITTEN, PAST OR FUTURE, OF, AS TO, CONCERNING OR WITH RESPECT TO (A) THE
VALUE, NATURE, QUALITY OR CONDITION OF THE PROPERTY, INCLUDING, WITHOUT LIMITATION,

The grant funding will fund new facilities that exceed the adopted levels of service for new
growth during the next five fiscal years by either: (a) providing excess public facility capacity that
is needed by future growth beyond the next five years; or (b) providing higher quality public
facilities than are contemplated in the County’s normal design criteria for such facilities. (Please
circle one).

The grant funding will provide funding for a facility not described above but that the County is
obligated to complete, provided that such obligation is evidenced by a written agreement
approved by the Board of County Commissioners.

All facilities scheduled for construction or improvement in accordance with the above shall be
evaluated to identify any plans of State agencies or the South Florida Water Management
District that affect or will be affected by the proposed County capital improvement.

Project evaluation may also involve additional criteria that are unique to each type of public

GRANT CONTRACT
This Contract made on October 1, 2016 by and between Martin County, a political subdivision of the State of Florida, (hereinafter referred to as
the "County") and Martin County School Board a political subdivision of the State of Florida, (hereinafter referred to as the "Recipient").
BACKGROUND:
1.
Recipient has applied to the County for a grant of money ("Grant") for the fiscal year 2016/17 ("Grant Period" October 1 - September 30) on
the terms and conditions set forth herein.
2.
The County has agreed to provide $85,000 for the Grant Period on the terms and conditions set forth herein.
NOW, THEREFORE, in accordance with the mutual covenants hereinafter contained and other good and valuable consideration, the receipt and
adequacy of which are hereby acknowledged, the parties agree as follows:
1.0
Disbursement and Use of Fund
1.1
Disbursements for the Grant Period will be made in accordance with the schedule set forth in Exhibit "A" attached hereto and
incorporated herein by this reference. Provided however, disbursements are specifically contingent upon the amount of funds
collected by the Clerk for this program.
1.2
The Grant shall only be used for the purposes set forth in the Grant Application, attached as Exhibit "B" and incorporated
herein by this reference as well as the requirements of Section 47-153.General Ordinances Martin County Code and Section
318.1215 Florida Statue. Further requirements set forth in Exhibit “A”.
1.3
The recipient hereby certifies that the grant funds will be used solely for “enhancement and not replacement of driver education
program funds and that such funds shall be used for direct educational expenses and shall not be used for administration” as
required by Section 318.1215, Fla. Stat. The recipient hereby certifies that its driver education program funded by this grant
requires a minimum of 30% of a student’s time in the program be behind the wheel-training as required by Section 318.1215 Fla.
Stat.
1.4
The recipient shall maintain adequate internal controls in order to safeguard the Grant.
1.5
If the Recipient cannot use all or any portion of the Grant after the Grant has been disbursed, then all unused funds must be
promptly returned to the County.
1.6
On an annual basis, the Recipient shall submit to the County either: a) an Audit Report if grant funds exceed $50,000; b) a
Review Report if grant funds are between $25,000 to $50,000 (or an Audit Report if available); or c) a Compilation Report if grant
funds are below $25,000 as each of the foregoing terms is defined by the American Institute of Certified Public Accountants
(AICPA).
1.7
In the event the Audit Report, Review Report, Compilation Report, or financial records reveal that the Grant funds were not used
for the purposes set forth in the Grant Application, then the County may require the Recipient to return all unused funds and
reimburse the County for improperly used funds.
1.8
The Recipient shall maintain adequate records to fully document the use of the Grant funds for at least three (3) years after the
completion of this Contract. The County shall have access to books, records, and documents as required in this Section for the
purpose of inspection or audit during normal business hours, at the County's expense, upon five (5) days prior written notice.
1.9
The Recipient shall comply at all times with all applicable federal, state, and local laws, rules, and regulations.
1.10
Reports
The recipient shall submit an Annual Performance Report to the County within fifteen (15) business days following: June 30,
2017.
1.11
Transfer Of Funds Between Budget Categories
Recipient may transfer funds between budget categories as long as the total amount of transfer (increase or decrease) does not
exceed ten (10) percent of the total approved budget category and the transfer is made to an approved budget line item.
1.12
Prior Written Approval Of Changes To The Contract
Recipients shall obtain prior written approval from the County for the following changes to the items set forth in Exhibit B and failure
to comply shall be cause for the County to terminate this contract pursuant to Section 4.0 hereof:
a.
Change in project activities, or plans set forth in the approved Grant Application;
b.
Transfers of funds above the ten (10) percent cap shall be made only if a revisedbudget is approved by the County
Administrator or his designee.

Except to the extent limited by F.S. 768.28, the Recipient shall indemnify and save harmless and defend the County, its agents,
servants, and employees from and against any and all claims, liability, losses, or causes of action which may arise from any
misconduct, negligent act, or omissions of the Recipient, it agents, servants or employees in the performance of services under
this Contract.
Availability of Funds

Under no circumstances can transfers of funds increase the total budgeted award. Transfers do not allow for increasing
the quantitative number of items documente in any approved budget line item. (For example, equipment items in
Operating Capital Outlay or Expense categories or staff positions in the Salaries and Benefits category.)
The obligations of the County under this Contract are subject to the availability of funds lawfully appropriated for its purpose by
the Board of County Commissioners of Martin County.
Termination
4.1
This Contract may be terminated by either party in the event of a substantial failure by the other party to perform in
accordance with the terms of the Contract upon thirty (30) days prior written notice.
4.2
In the event the County terminates this Contract, the Recipient shall return all funds not used as of the date of termination to
the County within ten (10) calendar days.

Any notice, request, demand, consent, approval or other communication required or permitted by this Contract shall be given or
made in writing and shall be served, as elected by the party giving such notice, by any of the following methods:

Notice given in accordance with the provisions of this paragraph shall be deemed to be delivered and effective on the date of
hand delivery or on the second day after the date of the deposit with an overnight courier or on the date upon which the return
receipt is signed or delivery is refused or the notice is designated by the postal authorities as not delivered as the case may be if
mailed.
Successors and Assigns
6.1
The County and the Recipient each binds itself and its respective successors, administrators and assigns to the other party of
this Contract and to the successors, administrators and assigns of such other party.
6.2
Neither party shall assign or transfer its interest in this Contract without the prior writte consent of the other, which consent
shall not be unreasonably withheld. Nothing herein shall be construed as creating any personal liability on the part of any
officer or agent of the County which may be a party hereto, nor shall it be construed as giving any rights orbenefits hereunder to
anyone other than the County or the Recipient.
Remedies, Choice of Law, and Enforcement Costs
7.1
This Contract shall be governed by the laws of the State of Florida and any and all legal action instituted because of this
Contract shall be instituted in Martin County.
7.2
No remedy herein conferred upon any party is intended to be exclusive of any other remedy and each and every such remedy
shall be cumulative and shall be in addition to every other remedy given hereunder or now or hereafter existing at law or in

equity or by statute or otherwise. No single or partial exercise by any party or any right,power, or remedy hereunder shall
preclude any other or further exercise thereof.

If any legal action or other proceeding is brought for the enforcement of this Contract or because of an alleged dispute, breach,
default or misrepresentation in connection with any provisions of this Contract, the prevailing party shall be entitled to recover
reasonable attorney's fees, court costs and all expenses even if not taxable as court costs including, without limitation, all such
fees, costs and expenses incident to appeals, incurred in that action or proceeding, in addition to any other relief to which such
party or parties maybe entitled.
Nondiscrimination
The Recipient warrants and represents that all of its employees are treated equally during employment without regard to race, color,
religion, physical handicap, sex, age, national origin or ancestry.
9.0
Entirety of Contract
This Contract incorporates and includes all prior negotiations, correspondence, conversations, agreements, and understandings
applicable to the matters contained herein and the parties agree that there are no commitments, agreements, or under-standings
concerning the subject matter of this Contract that are not contained in this document.
Accordingly, it is agreed that no deviation from the terms hereof shall be based upon any prior representations or agreements, whether
oral or written. It is further agreed that no modification, amendment or alteration in the terms and conditions contained herein shall
be effective unless contained in written document executed with the formality and of equal dignity herewith.
10.0
Severability
If any term or provision of this Contract or the application thereof to any person or circumstance shall, to any extent, be held invalid or
unenforceable for the remainder of this Contract, then the application of such term or provision to persons or circumstances other than
those as to which it is held invalid or unenforceable shall not be affected, and every other term and provision of this Contract shall be
deemed valid and enforceable to the extent permitted by law.
11.0
Captions
Captions in this Contract are included for convenience only and are not to be considered in any construction or interpretation of this
Contract or any of this Contract provisions.

DISBURSEMENT SCHEDULE
Grantee shall invoice the County the amount of actual expenditures for the program on a reimbursement basis. The county shall pay quarterly in
the amount of up to $27,500.00 provided such amount is contingent on such funds being actually collected. If the funds are not available Grantee
acknowledges such quarterly payment will be reduced. The funds are to be used as enhancement NOT replacement of drivers education funds
only to be used for direct educational expenses and shall not be used for administration by the School Board of Martin County for our newest,
most inexperienced drivers. The Florida statue requires a minimum of thirty (30) percent of a student’s time in the program be in behind the
wheel training. Supporting documentation must be submitted with the School Board’s annual performance report, which clearly demmonstrates
compliance with the above requirements as well as Section 318.1215 Florida Statute.

Driver Education Grants Available for Martin County
Schools
The Martin County Board of County Commissioners is accepting grant applications
from Martin County public and private schools to enhance existing driver education
programs through April 29, 2016.
Through the Dori Slosberg Driver Education Safety Act created in 2002, the Martin
County Clerk of Court collects an additional $5 with each civil traffic penalty. These
funds are distributed to schools through a competitive grant process.
Applications are evaluated on the basis of the success of the proposed program and
other criteria. More information on the selection criteria and the grant application is
available online through the hot topic “Driver Education Grants” at www.martin.fl.us.
The deadline to apply is Friday, April 29 before 5:00pm.
Grant applications should be mailed to the Martin County Office of Management and
