ALL FIELDS ARE REQUIRED. Rental Rates: Peak Season (December 1 through August 31) – $1,830/week; $3,950/month; $775/Weekend Getaway (arriving 3:00 p.m. Friday and departing 10:00 a.m. Sunday). Off-Peak Season (September 1 through November 30) – $1,375/week; $2,950/month; $775 Weekend Getaway (arriving 3:00 p.m. Friday and departing 10:00 a.m. Sunday). We require a small security deposit, refundable after your stay(*) or you can roll the deposit towards a future rental(‡). Rates do not include taxes that total 12%. We look forward to welcoming you to Casa del Sol-mates! Rental Agreement, Terms, and Conditions 1. Hear us now, believe us later. (There’s a reason this has become #1, folks.) Flushing paper towels, large wads of toilet paper, feminine hygiene-related products, condoms, baby wipes, diapers, non-biological solids, and the like down the toilets MAY RESULT in the IMMEDIATE backing-up of the septic system and in the VERY UNWANTED overflow of waste and what-not into the house. For sure, it’ll be a vacation you’ll never forget. Use the trashcans for such items instead, okay? We will hold you and you agree to be held responsible for all costs associated with any plumbing problems that occur as a result of your stay. 2. 3. 4. 5. 6. 7. 8. 9. 10. 11. 12. 13. Check-in is at 3:00 p.m. Check-out is at 10:00 a.m. Maximum comfortable occupancy is six (6) people. Maximum occupancy otherwise is eight (8) people. Pets are prohibited without prior approval of the property owner(s). Smoking is strictly prohibited in Casa del Sol-mates. We do not rent to vacationing students or to persons under the age of twenty-five (25) that are not accompanied by an adult parent or guardian. A Deposit to hold your reservation is due within ten (10) days of your making it. Full payment is due within twenty (20) days of your arrival date. If your payment is not received within this timeframe, we reserve the right to cancel your rental and rent your reserved dates to someone else. If, however, there are less than twenty (20) days before your arrival date, you must contact us and make arrangements for us to hold your reservation. If, for any reason, you cancel your reservation within forty-five (45) days of your arrival date, we cannot return any deposit(s) (security or otherwise) you have made unless we are able to re-rent Casa del Sol-mates under the same (or better) terms of your reservation and for the full Term reserved. If we are successful in re-renting Casa del Sol-mates, we will refund your payment(s) (less any amount incurred for bank or credit card processing-related charges if you paid by credit card) within thirty (30) days. Cancellations made more than twenty (20) days prior to check-in are subject to an additional cancellation fee of $50.00. Cancellations made less than twenty (20) days before check-in are subject to an additional cancellation fee of $150. No refund is due (or will be made) for inclement weather; travel or vacation insurance is therefore recommended. We charge $175 or the maximum allowed by law for any checks returned for insufficient funds. If your payment is returned by the bank for insufficient funds, or for any other reason(s), in order to avoid the cancellation of your reservation you agree to make payment, including any fees and penalties, by credit card (add 4%), cash, or certified check within five (5) days. Any reservation obtained under false pretense will be subject to forfeiture of Reservation Deposit and Final Balance, if paid, and such party will not be permitted to check in and/or will be subject to immediate eviction with the forfeiture of all amounts paid. We require a valid Visa, MasterCard, American Express, or Discover Card number on file to be held in the event there is intentional damage, theft, unauthorized entry into the owner’s supply closet, unauthorized pets, check-out after 10:00 a.m. on your departure day, check-in before 3:00 p.m. on your arrival day, extensive cleaning required at check-out, smoking, exceeding occupancy limits, failure to follow these Terms and Conditions, and so forth (collectively, the “Excess Damage Costs”). We will notify you of any Excess Damage Costs in writing that we shall then charge immediately to your credit card. By signing below, you assume full responsibility for any items found to be missing and any damage due to misuse, negligence, or other action on your or your guests’ part. Repair and maintenance issues must be brought to the Owners’ attention within twenty-four (24) hours of occupancy or occurrence, or you will be held liable for all such damages or repairs. Owners are not be responsible for any unauthorized expenses incurred by you or your guests. 14. 15. 16. 17. (^)In the event you make more than one reservation, we will apply the remaining deposit from your first stay towards your subsequent stay(s). If, however, we are required to apply all or a part of your deposit prior to your subsequent stay(s), (a) we may request you replenish your deposit prior to your subsequent stay(s), and (b) depending on the reason(s) for the forfeiture of all or a part of your deposit, we reserve the right to cancel your subsequent stay(s) in our discretion. We will return your deposit (* less any amount incurred for bank or credit card processing-related charges if you paid by credit card), within thirty (30) days of your departure, provided that: a. You follow #1 above. b. No damage is done to Casa del Sol-mates or its contents, beyond normal wear and tear. Any items abused, taken, or broken as a result of your visit will be deducted from your security deposit. c. You have not used more than the available allotment on the WiFi system (if you selected to have WiFi service during your stay). d. No towels, sheets, pillows, linens, etc. are removed from Casa del Sol-mates–our housekeeping staff keeps an accurate count. e. No charges, including attorney’s fees, are incurred due to contraband, pets, or collection of rents or services rendered during your stay. f. You remove all debris, trash, and rubbish from Casa del Sol-mates and deposit same into the dumpster located at Eldred’s Marina. g. You have washed and put away the dishes, cups, pots, etc. used during your stay. h. There is a full set of keys in the lockbox upon your departure. i. All beach chairs and other items provided for your use and enjoyment are returned and stowed under the house. j. There is no evidence of smoking in or near Casa del Sol-mates. (‡) As an alternative to the return of your deposit, you may elect to “roll it over” towards a future rental reservation of a week or more. You must notify us in writing of your election to roll over your deposit within twenty (20) days of your departure. Your future reservation can be for any available dates, however. The only permissible place to barbeque or light a fire is the barbeque grill provided for your use and enjoyment. No other fires are permissible anywhere on the property or grounds of Casa del Sol-mates. 18. Check-out Procedures: We will return your deposit, (* less any amount incurred for bank or credit card processing-related charges if you paid by credit card), within thirty (30) days of your departure, provided that: a. Dishes, pots, pans, and utensils are washed, dried, and put away. b. The stove/oven has been left in a clean condition. c. The refrigerator and freezer should be left clean and free of leftovers, fruits and vegetables, perishable items, and the like. If there are unopened items, these can be left for the housekeeper. d. ALL TRASH must be bagged and removed, taken with you on the water taxi ride back to Eldred’s, and disposed of in Eldred’s dumpster. e. The front door and sliding glass door must be locked and all air conditioning units and ceiling fans must be turned off. f. The key to the House has been returned in the lockbox. g. You have complied with Paragraph 15, above. h. In other words, we ask our guests to leave the House in the same (or better) condition as it was in when they arrived. 19. You, your heirs, guests, representatives, agents, and assigns hereby indemnify and hold the owners of Casa del Sol-mates, as well as their respective heirs, agents, representatives, and assigns (collectively, the “Owners”), harmless from and against any loss, damage, or expense, including reasonable attorney's fees, incurred or suffered by or threatened against the Owners in connection with or as a result of any claim for personal injury or property damage or otherwise brought by or on behalf of any third party person, firm, or corporation as a result of or in connection with the rental, which claim does not result from the active and intentional negligence of the Owners. You agree that at the time of your arrival at Casa del Sol-mates the dwelling and property were in a reasonably safe condition and that no unreasonable risk of harm existed therein. You further agree that upon your arrival you have accepted the condition of the dwelling and the property with full knowledge and 20. 21. 22. 23. assumption of any risks that may be attendant to any unsafe or dangerous condition(s) in existence or later discovered. It is expressly understood and agreed that this is a short-term vacation rental under the provisions of Chapter 509, Florida Statutes, and is not a lease or other long-term residential tenancy agreement. This Agreement is only for the licensed use of Casa del Sol-mates for the stated term. It creates no property rights in Guest and no rights to renewal or for recurring usage. This Agreement is also neither a time-share sale, nor a plan of time-share development, nor a vacation club. We reserve the right to seek reimbursement, contribution, and/or indemnification from you, including attorneys’ fees, suit money, and costs, whether through lawsuit or otherwise, for all damage to the septic system, to Casa del Sol-mates, or to the surrounding property(ies) connected in any way to your failure to follow the Terms and Conditions as set forth herein and above. You further agree that you shall be subject to the jurisdiction of the Courts in and for Orange County, Florida, and that the exclusive venue for any legal action that follows from your failure to adhere to the Terms and Conditions shall be in Orange County, Florida, to the exclusion of all other venues. This Agreement contains the sole and complete understanding of the parties hereto and may not be amended, supplemented, varied, discharged, except by an instrument in writing by both involved parties. The person executing this agreement warrants his/her authority to do so and such person hereby personally assumes liability for the payment of said price in full. The laws of the State of Florida shall govern the validity, construction, and effect of this Agreement. I/We understand and accept the terms and conditions on all three (3) pages of this Agreement.
