2. The Officer A d m i n i s t e r i n g the Government hereby sanctions—
( a ) any assignment of a t h i n g i n action,

( i i ) a n account of* a person resident i n any t e r r i t o r y specified i n
the Second Schedule to this Order, being a transfer to another
account of a person resident i n the same t e r r i t o r y ;
( i i i ) an account (not being a special account or a s t e r l i n g area account) of a person resident i n any t e r r i t o r y specified i n the F i r s t
Schedule to this O r d e r being a transfer to another such account
of a person resident i n the name t e r r i t o r y or a transfer to the account of a person resident both outside the s t e r l i n g area a n d outside
any of the t e r r i t o r i e s specified i n the F i r s t or Second Schedules to

4. The L o c a l C o u n c i l may by w r i t t e n notice require the owner of any
p r o p e r t y a b u t t i n g on one or more streets w i t h i n the L o c a l C o u n c i l area
to pave, enlarge, or complete the pavement of any footway a b u t t i n g on
such p r o p e r t y w i t h i n a p e r i o d of one m o n t h from the date of such
notice. The owner s h a l l bear a n d i n c u r a l l the costs of such construct i o n , but s h a l l be e n t i t l e d u p o n o b t a i n i n g a certificate i n accordance
w i t h by-law 7 to c l a i m from the L o c a l C o u n c i l the refund of twenty five
per centum of the costs of construction as may be assessed a n d determ i n e d by the L o c a l C o u n c i l .
Specification.
5. The p a v i n g of any footway w i t h i n the L o c a l C o u n c i l area m a y
i n c l u d e the construction of a kerb, a p p r o v e d p a v i n g a n d r e t a i n i n g
w a l l , i n c l u d i n g protective fence or r a i l i n g where necessary, a n d s h a l l
be of such construction, m a t e r i a l , f o r m , level, grade, size a n d w i d t h
as m a y be decided u p o n by the L o c a l C o u n c i l .
Construction of

L o c a l Council.
6. I f any owner f a i l s to construct, enlarge or complete the construct i o n of a footway i n accordance w i t h a notice issued to h i m under bylaw 4, or i f he fails to c a r r y out the construction i n accordance w i t h
the specifications decided u p o n by the L o c a l C o u n c i l under by-law 5,
the L o c a l C o u n c i l may c a r r y out the construction of the footway or the
necessary alterations, and seventy five per centum of a l l the costs of
such construction or alterations s h a l l be recoverable by the L o c a l C o u n c i l i n the same manner as a debt due to the L o c a l C o u n c i l a n d the L o c a l
C o u n c i l s h a l l be at l i b e r t y to determine a n d fix the date of payment
of such costs.
Certificate re

7; A s soon as the owner s h a l l have paved a footway i n accordance
w i t h the provisions of these by-laws, he s h a l l be e n t i t l e d to receive from
the L o c a l C o u n c i l a certificate stating that he has fulfilled his obligations undur these by-laws.
Maintenance
of footways.
8. E v e r y owner s h a l l be liable to m a i n t a i n a n d r e p a i r at his own
cost any footway a b u t t i n g on his property, whether such footway was
constructed by h i m or by the L o c a l C o u n c i l , for a p e r i o d of five years
from the date of construction of such footway, a n d thereafter the
footway shall be m a i n t a i n e d by .the L o c a l C o u n c i l .
Penalties.
9. A n y p e i s o n constructing a footway w i t h o u t or i n contravention
of the terms of a p e r m i t or a notice issued by the L o c a l C o u n c i l s h a l l
be liable, u p o n conviction, to a fine not exceeding twenty pounds, a n d ,
i n a d d i t i o n , shall be required to deposit the costs of m a k i n g u p •such
footway i n accordance w i t h the s t a n d a r d specifications a n d requirements of the L o c a l C o u n c i l .

IV.—ROADS.
1. I n this P a r t , unless the context otherwise r e q u i r e s :

3. N o b u i l d i n g may be erected and no work may be done u p o n any

and obstructions
7. The L o c a l Commission may delegate their powers by p e r m i t to
any person or persons desirous of constructing or w i d e n i n g any road,
p r o v i d e d that such person or persons take over a l l l i a b i l i t i e s a n d responsibilities which would f a l l by law on the L o c a l Commission were
they responsible for such construction or w i d e n i n g . The L o c a l Commission i n delegating their powers by such p e r m i t shall impose such
conditions as •they may doom fit i n order to ensure the proper execution
of the works.

8. —(1) The L o c a l Commission shall have power to order the owners
of lands a b u t t i n g on a constructed r o a d to undertake the p l a n t i n g or
t r i m m i n g of hedges, trees and shrubs, and the removal of any obs t r u c t i o n between the b u i l d i n g line a n d road line. .
( 2 ) A n y owner on whom a n order under this p a r a g r a p h is served
shall, w i t h i n the p e r i o d prescribed i n such order, p l a n t or t r i m such
hedge, tree or shrub, or remove such obstruction, a n d otherwise comply

9. The L o c a l C o m m i s s i o n s h a l l have power, a t any t i m e after this
scheme has come i n t o force a n d after g i v i n g one month's notice to the
owners, to enter on, a n d take possession of, a n y lands f o r m i n g the
sites of roads, w i d e n i n g of e x i s t i n g roads, for the purpose of ‫ ׳‬con­
struction.

conditions at his own expense.

the recommendation of the L o c a l Commission, p e r m i t the e x t e r n a l
walls or columns of any a d d i t i o n to, or a l t e r a t i o n of, such house to be
faced w i t h the same m a t e r i a l as t h a t w i t h w h i c h the s a i d external
walls or columns are faced at the date of the coming i n t o force of
this scheme.

15. I n the O l d T o w n , balconies may project over the pavement to
a m a x i m u m of 60 cms. The length of the balcony s h a l l not exceed one
fifth of the o v e r a l l length of the f r o n t elevation a n d a m i n i m u m
distance of 50 cms. must be m a i n t a i n e d between balconies. A l l balconies
must be c a r r i e d out i n stone w o r k a n d s h a l l be supported on stone
corbels. The balustrades of a l l balconies• s h a l l be c a r r i e d out i n
w r o u g h t i r o n or stone.
I n r e s i d e n t i a l zones A and B balconies may be permitted p r o v i d e d
t h a t they are supported on stone columns or recessed i n t o the m a i n

16! O r i e l s m a y be permitted i n the upper storey o n l y . I n the O l d

I n a l l cases where a p p r o v a l is given for the construction of oriels,
they s h a l l conform to the f o l l o w i n g d i m e n s i o n s : —
(a) the projection s h a l l not exceed 80 cms.;
( b ) the outside height s h a l l not exceed the height of the
room plus floor a n d c e i l i n g ;

w i n d o w space equal to not less than one tenth of the floor a r e a g i v i n g

PART VII.—SPECIAL
POWERS.
1. The L o c a l Commission, w i t h the consent of the D i s t r i c t Commission, s h a l l have power to g r a n t a r e l a x a t i o n of any r e s t r i c t i o n imposed
by this scheme on the use of any l a n d or b u i l d i n g or a n y other restrict i o n contained i n this scheme, after c o n s i d e r i n g the effects of such
r e l a x a t i o n on the a d j o i n i n g properties.
Eelaxations.
2. —(1) The L o c a l Commission s h a l l have power to renew a n y b u i l d i n g p e r m i t issued before the coming i n t o force of this scheme w i t h
such changes i n the p e r m i t as are necessary i n order t h a t its p r o v i sions m a y comply w i t h , the provisions of this scheme.

(2) A n y b u i l d i n g or structure for w h i c h a p e r m i t has been issued
p r i o r to the p u b l i c a t i o n of this scheme s h a l l be exempt from the operat i o n of this scheme, u n t i l such time as the s a i d b u i l d i n g or structure
is r e b u i l t or altered, p r o v i d e d t h a t .such b u i l d i n g s or structures were
c a r r i e d out i n accordance w i t h any relevant O r d i n a n c e , regulations
or by-laws which were i n force when the s a i d p e r m i t was issued.
3. The L o c a l Commission m a y require a l l owners s u b m i t t i n g p a n e l l a t i o n schemes to make adequate p r o v i s i o n for p u b l i c recreation
grounds.

4. —(1) O n the completion of a house for w h i c h a p e r m i t has been
granted, the L o c a l Commission shall issue a certificate of occupancy
i n ! espect of such house :
P r o v i d e d that the L o c a l Commission m a y refuse to issue a certificate
of occupancy i f the house is not i n c o n f o r m i t y w i t h the b u i l d i n g p e r m i t
or any of the. requirements of this scheme or any by-laws.

of occupancy i n respect thereof has been obtained f r o m the L o c a l
Commission.
5. Subject to the provisions of the O r d i n a n c e , the D i s t r i c t C o m mission a n d the L o c a l C o m m i s s i o n m a y delegate any of the powers
conferred u p o n them by this scheme to the C h a i r m a n of the respective
C o m m i s s i o n or to the M u n i c i p a l E n g i n e e r , or to both, or to a Committee, for the purpose of c a r r y i n g out the objects of this scheme.

6. A n y person aggrieved by the refusal of the L o c a l Commission to
g r a n t t h e i r a p p r o v a l or make a recommendation for any matter for
w h i c h t h e i r a p p r o v a l or recommendation is r e q u i r e d may, w i t h i n two
months of notification to h i m of such refusal, appeal to the D i s t r i c t
Commission a n d the decision of the D i s t r i c t Commission on such appeal shall be final.

7. N o t w i t h s t a n d i n g any p r o v i s i o n i n this scheme r e l a t i n g to height

1• A n y notice, order or other document r e q u i r e d or authorised to be
served under this scheme shall be considered to have been d u l y served,
i f i t has been delivered at the last k n o w n address of the person to
whom i t is addressed, or where addressed to the owner or occupier
of any l a n d or b u i l d i n g , i f such notice, order or other document, or
a true copy thereof, has been delivered to some person on the l a n d
