New York City OTB shutdown
puts racing industry in jeopardy

Five current New York Thoroughbred Breeders Inc. directors have been elected to new two-year terms on the 11person board. Voting concluded on December 3, and results
were announced on December 6.
Re-elected to the board of directors for terms ending December 31, 2012, were:
• Lois Engel of Lattingtown, owner of Pucker Ridge Farm
in Warrensburg;
• Thomas J. Gallo III, founder and managing owner of Parting Glass Racing and Thomas J. Gallo III Sales Agency, and
owner of Blue Stone Farm in Cambridge;
• Vivien Malloy, owner of Edition Farm in Waccabuc;
• John McMahon, owner and manager of Old Saratoga
Thoroughbreds near Saratoga Springs; and
• Chris Purdy, D.D.S., owner of Ivy League Farm in Ithaca.

Track closures, fewer race days, and lower purses are possible following New York City Off-Track Betting Corp.’s shutdown,
the state’s chief racing regulator said on December 8.
New York City OTB closed at midnight on December 7 after
the state Senate failed to approve legislation that would have kept the
bankrupt organization open. New
York City OTB was on track to handle $750-million this year.
Trying to keep money from leaving New York, the New York State
Racing and Wagering Board on December 8 took emergency measures
that allowed people to register online for betting accounts with the
New York Racing Association, Yonkers
Raceway, and both Catskill and Nassau OTBs. Previously, bettors had to

“There’s a consequence to what happened yesterday,” board

handle. The size of the hole, we don’t know yet. But there will
likely be less of a racing product. I think you’ll see fewer race
dates and you may even see a track or two close.”

After 39 years, New York City OTB was shuttered when it
was unable to emerge from bankruptcy
NYRA, Yonkers Raceway, and Monticello Raceway are the
tracks that relied most heavily upon New York City’s OTB’s revenue stream. Monticello is the track most vulnerable to a potential closing, according to observers.
NYRA also met on December 8 and discussed repercussions
about the New York City OTB closure, but has no definitive plans
for altering race dates in 2011. Such action would require approval of a state Racing Franchise Oversight Board that monitors NYRA’s business matters. The Racing and Wagering Board
would not have to act.
“If anybody thinks there’s not going to be considerable change
to the racing product, they’re kidding themselves,” Sabini said.
“Now, not only New York City OTB workers lose their jobs, but
every segment of the racing industry—from feed store owners
to horsemen to those who board the equine athletes—will feel
negative consequences.”
New York Assembly Speaker Sheldon Silver’s office confirmed
that an 11 a.m. EST hearing was scheduled for December 15 in
Albany to consider consolidation of the five remaining regional
off-track betting organizations.

But the Senate’s Republican leadership
said the same benefits and provisions
given New York City OTB should be extended to the state’s five other regional
off-track betting firms as well—Nassau
and Suffolk on Long Island; and Catskill,
Capital, and Western in upstate New York.
“They’ve been doing the right thing; all
they want is to be treated fairly,” said Dean
Skelos (R-Nassau County), who is slated
to become the new majority leader on January 1. “Most of our members understand
that this is the time for a global solution
to the OTB problem, not just New York
City.”

breeding industry and will cost the state an enormous number
of jobs—not only lost DC 37 union [OTB] workers, but the jobs
of people in the breeding industry. This action will adversely af-

NYRA by more than $11-million. Overall, NYRA
would take a $20-million hit because of money

“NYRA cannot sustain a revenue reduction of
$20-million and continue to operate the three
racetracks,” NYRA President and Chief Executive Officer Charles Hayward said on December
7. “The consequence of the legislation being
advocated by the regional OTBs is that NYRA
would be forced to close.
“No regional OTB can survive long without the
NYRA product,” he added. “The net result of the
legislation being sought by the regional OTBs
would be the eventual closure of their own corporations and the elimination of Thoroughbred

morning radio show, said, “This is going to have a tremendous
impact on the racing industry. I believe upstate tracks will close.
Horse farms will shut down, breeders will be moving out of state.
Many small businesses that support racing will have to lay off
people or shut down their operations. With a 9% unemployment rate in the state of New York, the Senate had a chance not
to add to those figures by passing a restructuring plan that the
Assembly approved.”
The Senate’s Republican leadership favored a bill that would
have dealt with New York’s five other regional OTBs, not just
New York City alone. State Republican leader Dean Skelos (RNassau County) said New York City OTB could have remained
open while negotiations continued.
But Schwartz said New York City OTB has no cash and could
not cover rent payments the past few days before closing.
“New York City OTB is shut down,” he said. “There is no plan
to reopen it. This is not a light switch. You can’t flick it on and

Another sign
of New York optimism
Vinery joins Adena in establishing a strong stallion presence in the Empire State
One unmistakable sign of optimism in a state’s breeding program is when established, indigenous farms and operations announce plans to stand new stallions. Another sign—and perhaps
just as important—occurs when large operations from other
breeding regions decide to establish operations in the state.
Twice in two months, major commercial breeding operations
have announced that they are setting up shop in New York. The
first was Frank Stronach’s Adena Springs, which formed Adena
Springs New York and will stand five stallions at McMahon of
Saratoga Thoroughbreds for 2011.
In mid-November, another major player in the commercial
breeding industry, Vinery, announced plans to expand its presence in New York and to take over management of Empire Stud
in Hudson.
The renamed operation will be known as Vinery New York.
Jamie LaMonica, who served as Empire Stud’s president, will
be involved in the new venture.
For both Vinery and Adena Springs, the prospect of video lottery terminals boosting race purses and breeder awards played
a significant role in the decisions to set up shop in New York.
The first VLTs are expected to be in operation at Resorts World
New York at Aqueduct in the spring.
Vinery took its first steps into New York last year, when the
Kentucky-based commercial breeder and stallion manager relocated Posse and Repent to Empire Stud for the 2010 season. Joining them for the 2011 season will be Purge, who has stood at
Vinery’s Lexington farm since 2006, and Darley Stable’s recently
retired Justenuffhumor.
Remaining on the roster at Vinery New York will be Silver
Wagon, Frost Giant, Maybry’s Boy, and Midas Eyes.
‘Lucrative market’
“We’re excited about this expansion,” Vinery President Tom
Ludt said in announcing the changes. “Vinery stallions Posse
and Repent were relocated to New York, and they have been
very well received by the New York breeders. We have seen benefits from operating in a regional market, and with casinos boosting the New York program, we think that there will be a more
lucrative market for New York-breds.”
According to Jockey Club statistics, Posse was bred to 86 mares
in 2010 and Repent was bred to 75. Ludt said all the stallions
will be supported with Vinery-owned mares that will be shipped
to New York to be bred, and they will foal in New York.
Through December 1, Posse was New York’s top-ranked stallion by progeny earnings, and Repent was fourth. Posse will
stand the 2011 season for $10,000 live foal, and Repent will carry
a $5,000 fee.
Purge, who transfers to New York for the 2011 breeding season, is by the prominent sire Pulpit and out of Copelan’s Bid
Gal, by Copelan. A $180,000 Keeneland September yearling, he
collected three graded stakes victories for trainer Todd Pletcher

while racing for Starlight Stables, Paul Saylor, and Johns Martin.
He won his only start at two in 2003 and then scored in Belmont Park’s Peter Pan Stakes (G2) and Saratoga Race Course’s
Jim Dandy Stakes (G2) at three. He concluded his racing career
with a 33⁄4-length victory in the 2005 Hill ‘n’ Dale Cigar Mile
Handicap (G1).
Purge had more than $2.1-million in 2010 progeny earnings,
and his top horse overall is Macias, a three-time stakes winner
at Santa Anita Park.
“We think Purge will be well received with New York breeders,”
Ludt said. “He’s in the top of his crop in every category, is a son
of emerging sire of sires Pulpit, and on top of that he’s a very
attractive individual.”
Purge’s 2011 fee is $5,000 live foal.
Justenuffhumor
Justenuffhumor, a two-time Grade 2 winner, brings to New
York a highly desirable pedigree to complement his racing record.
He is by Distorted Humor, who again was among the leading
sires in 2010, and he is out of Justenuffheart, by Broad Brush.
Justenuffheart was the dam of 2006 champion two-year-old
filly Dreaming of Anna and two-time Grade 2 winner Lewis
Michael. Justenuffhumor’s second dam is Kitten’s First, by Lear
Fan, who produced 2004 champion turf male Kitten’s Joy, now
a successful stallion in Kentucky, and three-time Grade 1 winner Precious Kitten.
Purchased for $550,000 during the 2006 Keeneland September yearling sale, Justenuffhumor prospered in the silks of Godolphin Racing.

the racetrack, and will provide New York breeders with a much
sought-after sire line,” LaMonica said. “He is an outstanding
physical specimen, and we look forward to breeders coming to

Justenuffhumor will stand his initial season at stud for $5,000.
Adena Springs also established stud fees for its 2011 New York
roster. Heading the list is veteran Touch Gold, who stands for
$10,000, and 1996 Breeders’ Cup Classic (G1) winner Alphabet
Soup, who has a $6,000 fee. Tiago and Silent Name (Jpn) each
will stand for $5,000, and Harlem Rocker will be at $3,500.

and Breeders’ Cup. An introductory stud fee of $2,000, payable
when foal stands and nurses, is being offered to the first 50 mares
booked to Marsh Side.

At Saratoga in 2009, he pulled off successive victories in the
Fourstardave (G2) and Bernard Baruch (G2) Handicaps to cap
a six-race winning streak. At Santa Anita Park that fall, he finished third to Goldikova (Ire) in the TVG Breeders’ Cup Mile
(G1).
“We think Justenuffhumor will be well received by New York
breeders given his race record and world-class pedigree,” said
Charlie Boden, Darley’s head of sales. “The New York breeding
program is poised to become one of the most lucrative places in
the country to raise a horse.”
LaMonica noted that Justenuffhumor has attributes that will
be attractive to New York breeders.
Another new arrival at McMahon, Coal Play, will have a $4,000
fee for 2011.

A Shin Forward became one of New York’s all-time leading
state-breds when he bravely turned back a late cavalry charge
to win the Mile Championship (Jpn-G1) on November 21 at Kyoto
Race Course.
Bred by Edition Farm, the five-year-old Forest Wildcat horse
raised his career earnings to $3,302,052, placing him right behind New York’s Horse of the Decade, Funny Cide, who earned
$3,529,412.
To be sure, A Shin Forward toils in Japan, where the purses
are just shy of astronomical. His victory in the Mile Championship earned him $1,246,199, which is more than all but
two Breeders’ Cup races pay to their winners. Still, it is all too
easy to dismiss his riches as merely the result of Japan’s lofty
purses.
Deep in his pedigree is an undistinguished racemare who
helped to shape Florida’s breeding industry. And behind her productivity is a name that often pops up in connection with the
flowering of the Florida industry: Racing Hall of Fame trainer
and New York breeder John Nerud.
Tartan Farms and its owner, William McKnight, certainly reaped
the benefits of Nerud’s horsemanship and the riches produced
by Cequillo, a *Princequillo mare out of Boldness, by *Mahmoud.
She never finished better than third in a brief racing career
and earned all of $350, but she was pure gold as a broodmare.
Her first foal, Hot Dust, by Jet Action, was a multiple stakes
winner for McKnight. And, the hits kept coming. Her second
foal, Three Up, by Decathlon, was the grandam of several stakes
winners.

Quiet Charm’s daughter Partygoer, by Secretariat, produced
Dare and Go, a two-time Grade 1 winner by Alydar who always
will be best known for stopping two-time Horse of the Year
Cigar’s 16-race winning streak in the 1996 Pacific Classic Stakes
(G1). His half brother Go Deputy, by Deputy Minister, also was
a Grade 1 winner.
Quiet Charm’s daughter Demure, by Dr. Fager, produced
Tartan-bred Quiet American, by Fappiano, a Grade 1 winner and
a prominent sire.
Her 1982 daughter, Charming Smile, by Mac Diarmida, did
not race, but she produced stakes winner No Mecourtney, by Jeblar, and Grade 2-placed Good Morning Smile, by Morning Bob.
Both racemares were durable, especially Good Morning Smile,
who made 76 career starts over six racing seasons.
At stud, Good Morning Smile’s best was Wake Up Kiss, who
transformed a Florida family into a New York family. By six-time
leading New York sire Cure the Blues, Wake Up Kiss was bred
by John Hettinger and consigned by Hettinger’s Akindale Farm
to the 1999 Fasig-Tipton Kentucky July sale of selected yearlings, where Equix Biomechanics bought her for $150,000.
Raced by Rudlein Stable and William L. Clifton Jr., Wake Up
Kiss was unraced at two and woke up after she was put on the
grass in her three-year-old season. She won three consecutive
starts and concluded that streak with a victory in the New York
Stallion Perfect Arc Stakes.
At four, she finished fourth in three races for New York run-
ners. Wake Up Kiss returned at five to win her final two starts
and went out with a 41⁄2-length victory in the restricted Yaddo
Handicap at Saratoga Race Course.
In foal to Forest Wildcat, Wake Up Kiss went into the 2004
Keeneland November breeding stock sale, where she caught the
attention of Vivien and Harry Malloy, owners of Edition Farm,
who bought her for $380,000.
The resulting foal was A Shin Forward. Through agent Denali
Stud, Edition consigned the colt to the 2006 Fasig-Tipton Saratoga preferred sale of New York-breds, and Rayzin the Bar Stable bought him for $125,000. Pinhooked into the Fasig-Tipton
Calder sale of selected two-year-olds in training the following
March, A Shin Forward began his Japanese odyssey when purchased for $290,000 by Hirotsugu Hirai.
He won his first two starts that fall and has matured into a
high-quality miler. Early in 2010, he won his first group stakes,
the Hankyu Hai (Jpn-G3), and then finished third in his first
Group 1 race, the Takamatsunomiya Kinen, in which he was
beaten only a neck.
He tailed off over the summer and finally put everything together for the Mile Championship. He went off at 51.40-to-1 in
a field of 18 and always was well placed under jockey Yasunari
Iwata, who kept him near the inside rail on the right-handed
course.
A Shin Forward burst clear of the pack in the final 200 meters
and then withstood a late charge by three horses outside him to
win by a neck over 2.70-to-1 favorite Danon Yoyo. A Shin Forward ran the 1,600-meter (7.95-furlong) distance in a stakes
record 1:31.80.

Endless Circle breaks out
Former claimer takes Fall Highweight;
Stormy’s Majesty storms to Discovery victory
For a while this past spring, Endless Circle appeared to
be trapped in a purgatory of lower-level claiming races. He
was claimed for $14,000 from a victory at Aqueduct in
March, missed hitting the board in an optional claiming
race, and then was claimed again for $14,000 after winning
on April 16 at Aqueduct.
The pattern of win, claim, defeat did not continue, however. In the hands of trainer Rudy R. Rodriguez, the New
York-bred son of Precise End rose steadily to higher circles
of New York racing through the remainder of the year and
capped his six-year-old season with a two-length victory
in the $100,000 Fall Highweight Handicap (G3) on November 25 at the Jamaica, New York, track.
Endless Circle’s first graded stakes victory in his first shot
at that level wrapped up another outstanding month for
New York-breds in a year of racetrack milestones.
After three New York-breds won Grade 1 races at New
York Racing Association tracks in 2010, a fourth, A Shin
Forward, broke through at the highest level in Japan on
November 21. (See pedigree profile on page 14.)
Also collecting a graded stakes victory during the month
was Stormy’s Majesty, who came back from an uncharacEndless Circle recorded the fourth stakes win of his career when

Stormy’s Discovery
Like Endless Circle, Stormy’s Majesty had a stormy
outing on New York Showcase Day. Bumped at the start
of the Empire Classic, the Majesty Stud homebred was
done after six furlongs and finished tenth, 18 lengths
behind winner Friend Or Foe.
Prado, the three-year-old Stormy Atlantic colt’s regular rider, was available for the Discovery, and he and
trainer Dominic Galluscio plotted a different strategy.
“Edgar and I decided to let him run a little bit,” Galluscio said. “In the Empire Classic, he got behind and
didn’t seem to catch his stride or breathe as well.”
Stormy’s Majesty went off as the 3.55-to-1 second
betting choice for the 11⁄8-mile Discovery behind 2.65to-1 Golden Moka, and Prado broke him sharply from
the second starting stall in a field of seven.
The two favorites alternated on the lead, with Stormy’s
Majesty leading through a quarter-mile in :23.77 and
Golden Moka on top by a head through a half in :47.93.

by 2010 earnings
The accompanying sire list reports racing in the current year, plus lifetime statistics for
all foals of racing age for each sire. The list reports sires that stand in New York regardless of where runners were foaled. To be considered for inclusion is any sire who is
currently standing in New York or had last stood in that state if the sire has been pensioned or is dead. (If pensioned or is dead, the sire will be included if his youngest foals
are age three or younger in 2010.)
Freshman sires of 2010 are denoted by a diamond (◆) preceding their name.
The statistics are inclusive of all racing in the U.S. and Canada, Argentina, Australia,
Brazil, Chile, England, France, Germany, Hong Kong, Ireland, Italy, Jamaica, Japan, Malaysia,
Mexico, New Zealand, Peru, Puerto Rico, Saudi Arabia, Singapore, South Africa, United
Arab Emirates, Uruguay, and Zimbabwe. North American statistics are complete through
December 13, 2010.

Breeding Rules
To qualify for registration as a New York-bred, the mare must foal in New York state and meet the following
domicile requirements:
Resident Mares: Must be continuously in residence in New York state from within 90 days after last cover in
the year of conception and thereafter remain in residence until foaling the following year, with no breed-back
required.
Non-Resident Mares: Must foal in New York state and be bred back to a registered New York-based stallion
and remain for a continuous period of 90 days after foaling.

NY-Breds Award Program
Breeder, owner, and stallion owner awards are based
on purse money earned (1st through 3rd) while
competing in pari-mutuel races run in New York state.
BREEDER AWARDS
In 2009, the New York State Thoroughbred Breeding and Development Fund paid $6,300,452 to breeders of
registered New York-breds. A breeder is the owner of the mare at the time the mare foals in the state of New
York. Breeder awards are determined by covering stallion. If the New York-bred is by a registered New York-based
stallion, the award is up to 20% of the purse earned for a first-place finish and up to 10% for a second- or thirdplace finish.
If the New York-bred is by an out-of-state stallion or non-registered stallion, the award is up to 10% for a firstplace finish and up to 5% for a second- or third-place finish. All breeder awards are capped at $10,000 per horse
per race.
STALLION OWNER AWARDS
In 2009, the New York State Thoroughbred Breeding and Development Fund distributed $2,370,035 in stallion
owner awards. Stallion owner awards are paid to owners of registered New York-based covering stallions (at time
of conception) at up to 7% of earned purses from 1st through 3rd positions. All stallion owner awards are capped
at $10,000 per horse per race.
OPEN OWNER AWARDS
In 2009, the New York State Thoroughbred Breeding and Development Fund paid $1,107,667 to owners of
registered New York-breds who earned purse money in open-company races. Owner awards for registered New
York-breds sired by a registered New York-based stallion is up to 20% of purses earned from 1st through 3rd
positions in races run for a claiming price of $30,000 and upward, with a cap of $20,000 per horse per race.
If the New York-bred is by an out-of-state stallion or non-registered stallion, the award is up to 10% of purses
earned from 1st through 3rd positions in races run for a claiming price of $30,000 and upward with a cap of
$20,000 per horse per race.
NEW YORK-BRED RACES
More than 52 stakes races exclusively for registered New York-breds are run at New York Racing Association
racetracks (Aqueduct, Belmont Park, and Saratoga Race Course) and Finger Lakes racetrack with total purses
worth nearly $5-million. In 2009, more than 900 overnight races exclusively for registered New York-breds were
held at the four New York racetracks.
