For other associations, like UPSTAR, the new Core Standards affirmed our organizational structure and financial solvency, as well as, the quality programs and services we were already providing. Dave Mervar The purpose behind the new standards is to ensure that REALTOR® associations are providing key services and representing the REALTOR® brand correctly. NAR has raised the bar and UPSTAR is prepared to meet it each year with your support. As your President, I am proud to say that UPSTAR’s Core Standards submission was approved by the national and state associations in 2015. Many smaller associations, also approved by NAR and IAR for excellent service, felt the impact of the new, more rigorous, standards differently. The new standard caused many of them to take a realistic look at how they might leverage economies of scale going forward while maintaining all the advantages of servicing members in their local communities. UPSTAR has a history of collaboration with community organizations and associations, which is why we were pleased to sign a shared services agreement in November 2015 to provide MLS support, technology training and website maintenance for our neighbor, the Northeastern Indiana Association of REALTORS® . We look forward to a fruitful and prosperous relationship with NEIAOR in 2016. Dave Mervar, 2015 UPSTAR President Executive Officer’s Letter M any of you have expressed that 2015 was a good year in terms of your real estate business. I’m delighted to hear that because your association is here to support your business interests and to promote the REALTOR® brand in the local community. That’s why the UPSTAR team invests time and energy to provide opportunities for our members to give back. We want the residents to see the REALTOR® investment, so we partner with community organizations that are doing good work and provide opportunities for you to support them in a coordinated effort. Katrina Kay In 2015, we launched the UPSTAR Young Professionals Network or YPN for “young-at-heart” REALTOR® and Affiliate members who want to network, grow and reach out to the community through volunteerism and fundraising projects that contribute to the vitality of Northeastern Indiana. We are proud that UPSTAR, including our new YPN, contributed a combined total of over $8,000 to the Redemption House, Fort Wayne Rescue Mission, Vincent Village and Community Harvest Food Bank in 2015. Not only that, UPSTAR partnered with Fort Wayne’s Metropolitan Human Relations Commission during Fair Housing Month and with Arts United— specifically the Civic Theatre’s “A Christmas Story” sponsorship, where UPSTAR hosted a “Meet the Legislators Night”. Thanks to all of you, we are making an impact in this great community. I consider it a privilege to work with such a dynamic group of people. Katrina Kay, UPSTAR Executive Officer COMMUNITY OUTREACH New UPSTAR YPN Takes Off S eeing the need to empower the next generation for leadership and community service, UPSTAR launched a new Young Professionals Network or “YPN” to develop young-at-heart professionals in the REALTOR® family through association involvement, advocacy, peer networking and community outreach. On Jan. 14, 2015, UPSTAR YPN held its first membership meeting. By the end of the year, the group had successfully conducted two educational seminars, a networking event and raised $4,100 for the Community Harvest Food Bank’s (CHFB) holiday food drives. UPSTAR YPN also had a strong presence at the association’s annual events including the Mardi Gras Golf Outing, Porkfest Cook-off and Civic Theatre sponsorship. COMMUNITY OUTREACH UPSTAR Events Supporting the Community U PSTAR designated a portion of the proceeds totaling approximately $4,000 from the annual events including the Pancake Breakfast, the Porkfest Cookoff and the Golf Outing to support the Association’s 2015 designated charities—Redemption House, The Fort Wayne Rescue Mission, Vincent Village and the Moeller Home Build. The community campaign for the Moeller Home Build was a 2014-15 initiative that culminated in the spring of 2015 with the home build dedication. UPSTAR supported the community in other tangible ways such as sponsoring a private performance of the Civic Theatre’s A Christmas Story: the Musical, where the association hosted a “Meet the Legislators Night”. UPSTAR could not touch the community to the extent that we do without the dedication and support of the Affiliate members who are engaged in the community outreach process through planning, volunteering and fundraising. In the fall of 2015 that all came to an end when the IRMLS worked with Supra to establish reciprocity for IRMLS SentriLock users. Now, any IRMLS subscriber can request Supra service. The user must have an approved smart phone and the ability to download the appropriate app. Users pay a one-time activation fee, as well as an annual fee for Supra access. The new rule was a hot topic for CE classes and Lunch n’ Learn presentations throughout the year. The change came about from 2013 legislation, where the Consumer Financial Protection Bureau (CFPB) integrated the Real Estate Settlement Procedures Act (RESPA) and Truth in Lending Act (TILA) disclosures and regulations. After Oct. 3, any transaction involving a mortgage used the new CFPB disclosure forms. The year 2015 also marked the ending of the first year of the new three-year license renewal cycle (July 1, 2014 through June 30, 2017), as well as the new CE requirements, which mandated that all brokers take 12 hours of CE by June 30th each year. Additionally, UPSTAR launched an Online CE program through its affiliation partner CBT real estate in June 2015. The association also works in concert with the Indiana and National Associations of REALTORS® to support their advocacy efforts on a state and federal level. LOCAL HIGHLIGHTS Local Appointments Gain appointments to the Downtown Improvement District and Downtown Development Group. Retained representation on the Housing and Neighborhood Services Board, Safe Housing Advisory Board and Utility Advisory Group. Zoning & Subdivision Ordinances Worked with Allen County to clarify language in the zoning and subdivision ordinances that were adopted two years ago. Columbia City Comprehensive Plan Supported Columbia City in updating its comprehensive plan and custom owner-occupied rehab initiative. REGIONAL ECONOMIC DEVELOPMENT HIGHLIGHTS Greater Fort Wayne Inc and Northeast Indiana Regional Partnership worked collaboratively to create a portfolio of projects to present to the Indiana Economic Development Authority. The region was approved to receive funding from the state. Other Regional Legislative Successes Impacting Economic Development include: • Extension of the venture capital tax credit sunset date • Increased funding for IPFW and support for a new classification • Expansion of economic development opportunities downtown with the support of the 200 foot waiver and dining district • Adoption of the dining district (locally) STATE HIGHLIGHTS HB 1403: Regional Cities This bill creates the Indiana regional city fund to provide grants and loans to regional development authorities for regional economic development projects. SB 408: Real Estate Brokers and Broker Companies This bill clears up the definition of a broker company and a managing broker. It allows brokers to take eight hours of continuing education credit a year, as long as they complete at least 36 hours in a three-year cycle. SB415: Vacant and abandoned housing Allows municipal governments to adopt an ordinance to establish a tax deduction period for abandoned and vacant property. • Attaches a delinquent property tax or special assessment to a property before it can be sold by the county treasurer. • Eliminates the concept of redemption after sale if the property is deemed vacant or abandoned. • Transfers ownership of property to the treasurer or executive If a minimum bid is not reached. • Barrs owners of properties found to be vacant or abandon from buying additional property at a tax sale and requires that the attorney general keep the owners names on a tax sale blight registry. • Requires a redemption period of 120 days on other properties and properties removed from tax sales. NATIONAL HIGHLIGHTS National Flood Insurance Program: Maintains funding levels for the National Flood Insurance Program and homeowner’s advocate, with small increases for flood mapping and mitigation activities. Mortgage Debt Forgiveness: Authority extended for two years (2015 & 2016) Mortgage Insurance Premium Deductibility: Provisions allowing the deductibility of mortgage insurance premiums were extended for two years Housing Finance Reform: Explicitly prohibits the sale, transfer and liquidation of the Treasury Department’s senior preferred stock holdings in the GSEs without legislative action; provision sunsets January 1, 2018. For his commitment in these areas, J. Kyle Ness, of Real Living Ness Bros., was named REALTOR® of the Year, not only for what people see, but also for what they don’t see. He volunteers for the Real Men Read Program, an organization focused on reading to low income children, and he is also a volunteer for Big Brothers/Big Sisters. Recently, Kyle spent a holiday season on a mission trip helping to build a health clinic in Mexico. Kyle is a graduate of Leadership Fort Wayne and the Indiana REALTORS® Leadership Academy, where he chaired the class project. He frequently represents the industry in the media as “the voice of real estate” with knowledge and professionalism. As a third generation REALTOR®, Kyle literally has real estate in his blood. He has served on the UPSTAR Board of Directors for multiple years, serving as President in 2014 and MLS President in 2015.
