EMD & Processing Fee :- The bid shall be accompanied with non-refundable
processing fee of Rs.10,000 ( Rupees ten thousand only) and 10% of the quoted basic
bid value (excluding taxes and other duties, as applicable) as EMD in the form of
Demand Draft drawn in favour of Municipal Commissioner, Bhubaneswar Municipal
Corporation payable at Bhubaneswar

The asset will be sold on “as is where is” basis to the highest bidder selected
through the process.
HOW TO APPLY
Interested bidders may download the application form from BMC web site
www.bmc.gov.in and submit to BMC Office duly filled in along with non refundable
application fee of Rs. 1000+50 (VAT), (Rupees one thousand fifty only) in shape of
Demand Draft drawn in favour of Municipal Commissioner, Bhubaneswar Municipal
Corporation payable at Bhubaneswar. This amount is in addition to the processing fee
of Rs. 10,000 (Rupees ten thousand only) as mentioned above. Without cost of the
application form, processing fee and EMD, the bid shall not be taken into
consideration.
ACCEPTANCE OF TENDER
 Sealed envelope containing the filled in and signed (authorised signature) application
form, Processing Fees and EMD should be superscribed as “APPLICATION FOR
PURCHASE OF SPACE IN BMC-BHAWANI SAHEEDNAGAR COMPLEX”.
The application forms shall be available on BMC website from dt. 13-06-2013 to
dt. 14-07-2013 (05.00 PM). Any application received without being superscribed
shall be rejected out rightly. The EMD, processing Fees and Cost of Application form
should be prepared separately and attached with the application form. It should reach
BMC Office latest by dt. 15-07-2013 (04.00 PM) through Registered Post/Speed Post
Only. BMC will not be responsible for any postal delay and loss or damage to the
sealed envelope and/or its contents during postal transit. Application received after
due date will not be entertained. The bids received shall be opened on dt.15-07-2013
(05.00 PM) in presence of the bidders or their authorised representative(s) who may
want to witness the same. The bids shall be opened in the Conference Hall of BMC.
GENERAL CONDITIONS:
 The highest offer will normally be accepted.
 Tender incomplete in any respect shall be liable for rejection.
 Applicant cannot withdraw the offer once made.
 The Authority reserves the right to accept/reject any/all the offer without assigning
any reason thereon subject to the limitations of CVC.
 The successful bidder will be required to deposit the total bid amount for the bid
complex unit within 60(sixty) days from the date of issue of Provisional Allotment
letter. The EMD deposited by the successful bidder shall be adjusted (without any
interest accrued on it) towards the accepted bid value.
 The successful bidder has to execute a lease deed which needs to be registered and the
fees/stamp duty payable on this score as determined by Government of Odisha to be
borne by the successful bidder.
 All payment shall have to be made through Demand Drafts drawn in favour
Municipal Commissioner, Bhubaneswar Municipal Corporation, Payable at
Bhubaneswar.
 Extension of time for deposit of accepted bid amount shall not be allowed under
normal circumstances. All payment should be remitted by due date. In exceptional
circumstances and on request, the authority may extend the last date of payment for a
reasonable period, subject to maximum six months with an interest @ 15% p.a
compounded monthly on the outstanding amount for such extended period, if any.
 In case of default, the allotment will be liable for cancellation without any further
notice and the EMD deposited shall be forfeited.
 The Demand Draft deposited towards EMD will be returned in Original to unsuccessful bidder(s) after completion of Tender Process. However, the processing fee
shall not be refunded.
 Any dispute in between the Authority and lessee shall be subject to territorial
jurisdiction of Civil Court having Jurisdiction over Bhubaneswar.
 The detailed schedule of the proposed Auction Property is enclosed in the Annexure.
Further details regarding the building Project, its history and other relevant
information are also attached in the same Annexure.
 Separate applications and bidding should be made for floor wise space/Unit and
evaluation of the bids shall be made on the merit of the bids to be received for each
Floor/Unit.
 The details terms and conditions, notice inviting the bid, application form forms the
bid document. The bidder or his authorised representative must sign in each page
failing which his application will not be considered for the bid.
 Auction will be for the entire space in each floor. No break up of space for auctioning
will be entertained. The upset price per sqft is fixed at Rs. 8,550/-( Rupees eight
thousand five hundred fifty only). The roof top parking space with a provision for
50(fifty) vehicles is distributed floor wise: 12 each in 2nd & 3rd floor: 13 each in 4th &
5th floor. The upset value per unit car parking is Rs. 2.40 lakhs. The bid price should
be inclusive of both floor space and parking space.
 However, the space available as BMC share in Bhawani block i.e. No.F-3 (1006 Sqft
SBA) and No.F-4 (1975 Sqft SBA) are to be considered as independent units for
auction without being considered as inclusive of floor space for auction as indicated
above. These two units are not linked to any parking space but the upset price for
these units remains Rs- 8,550/ per sqft.
LEASE TERMS AND CONDITIONS:
I.
These assets/Properties are sold on lease (as is where basis is for a period of 90
years).
II.
THE LESSEE shall be responsible for obtaining water supply and electricity
connection from concerned department at their own cost and pay holding tax, ground
rent and other statutory dues to the concerned authorities.
III.
THE LESSEE shall not undertake any development work (external) violative of the
norms of Building Planning Authority.
IV.
Any further sub-lease or sale of leased properties by the Lessee shall require
necessary permission from BMC (LESSOR).
V.
THAT THE LESSEE is responsible and liable to pay and discharge all taxes, rates,
charges and other outgoing payable to Revenue, Municipality, Urban, CESU,PHD,
Government and other authorities levied in respect of the property.
VI.
THAT THE LESSEE shall peacefully and equitably possess the common areas
along with other LEESEE and enter into, retain, hold, use and enjoy the same without
any binding or interruption, claim or demand by or from the LESSOR or any of his
heirs, successors, assigns and representatives or any other person.
VII.
THAT THE LESSEE is at liberty to use and enjoy the common areas and all other
facilities provided therein the said complex namely “BMC-BHAWANI SAHEED
NAGAR ENCLAVE”, Saheed Nagar, Bhubaneswar like overhead tank, U/G water
tank, lift, common passage, staircase, etc along with the other purchasers and the
LESSEE will not create any sort of obstruction whatsoever in any manner and remain
abide by the terms and conditions.
VIII.
THE LESSEE, his/her heirs, successors, assigns and representatives shall use and
enjoy the said property along with other co-owners with the undivided proportionate
share and interest peacefully without doing any harm or obstruction to other coowners.
IX.
THE LESSEE is also at liberty to get his/her name mutated in the Government,
Municipal Corporation, GRIDCO, Revenue Department etc and all other records and
pay the taxes, rents and charges in their name and obtain receipts thereof.
X.
THE LESSEE shall not have any right to make any structural change/alteration in
the said building and shall not use in such a manner which may impair the safety of
the building or cause any danger to the beauty and safety of the building or which
may affect the right of other property owners in the said complex.
THE LESSEE Shall not use the unit for any unlawful acts and shall not store
inflammable/explosives, hazardous goods without proper license from competent
authority.

.THE LESSEE is responsible to keep the complex compliant to environment
standards of Odisha State Pollution Control Board.
XIII.
THE LEESEE shall Pay Electricity Charges, water charges, sewerage charges etc
for electricity, water & sewerage connection and its consumption charges etc in/or
relating to the assets be paid directly to the concerned service provider as the case
may be.
XIV.
THE LESSEE shall share and bear the common expenses for maintenance of
common passage, cleaning, scavenging, and lighting along with other co-owners of
properties in the complex.
XV.
THE LESSEE shall not carry on or cause to be carried on any obnoxious, injurious,
noisy, dangerous, hazardous, illegal or immoral trade or activity in or through the
designated units.
XVI.
THE LESSEE shall bear the required charges and expenses for backup power
provided in the complex, if availed.
XVII.
THE LESSOR reserves right to add condition/conditions as would be necessary
while executing the required lease deed.

VALUATION OF BMC SHARE IN BMC-BHAWANI ENCLAVE
1.1
Shahid Nagar area of Bhubaneswar, where the scheduled property is located is a very
peaceful and posh locality having branches of leading public sector banks, showrooms
of leading brands etc. One of the trends in this area is to use residential premises for
office purpose and therefore most of the public sector banks are paying very minimum
rent as compared to approved commercial buildings. One of the reasons for paying
less rent is also because of the fact that banks are in the possession of the property
for about 10 to 15 years. Further banks being public sector entity, security and
regularity of income is one of the most important factors for owners to accept less rent
from them. Some of the builders are also in the business of constructing very good
complex which could be used as office as well as for residential purpose by providing
large space without walls and columns. Most of the approved commercial buildings
located in this locality are generally given on rent by the purchaser of the space as an
investment option.
1.2
The Scheduled property is first building in the state of Odisha with multiplex cinema
and terrace parking space. This is a unique concept building developed by the
Corporation in collaboration with M/s Bhawani Construction Private Limited as a Joint
Venture. The Corporation owns about 30% of super built up space located in
basement, second floor to fifth floor and terrace. The super area of the super built up
space is indicated in possession letter of BMC Bhawani Commercial Enclave given at
page D1 Annexure D. Super built up area considered is 76,796 sft of office space and
about 14,000 sft of terrace parking space.
1.3
As requested by the Corporation, market value of scheduled property consisting of
super built up area of 76,796 sft office space and about 50 car parking space located
in BMC Bhawani Commercial Enclave is estimated for the purpose of sale.
Fundamental/basic premise of this valuation exercise based on Hon’ble Supreme Court
and Hon’ble High Court judgments. Assumption and limiting conditions for market
value estimate of the scheduled property is as per norm.
Comparative location of the scheduled property and property under sale instance is
shown on the copy of revised layout of Shahid Nagar area (Annexure A), and on
wikimapia satellite map (Annexure F). Photographs of scheduled property, sale
instance and surrounding areas are shown at Annexure E.
2.0
CONCLUSION
The Market Value for the scheduled property (i.e. Super built up area of
76,796 sft owned by Bhubaneswar Municipal Corporation) located in
Bhubaneswar, Odisha in its present state as on 20th December 2012 @ Rs.
8550/- per sft is Rs. 65,66,05,800/- (Sixty Five Crores Sixty Sixty Lakhs Five
Thousand and Eight Hundred only) and of 50 cars located on terrace @ Rs.
2,40,000/- per car park is Rs 1,20,00,000/- (One Crores and Twenty Lakhs
only). Total market value estimated is Rs. 66,86,05,800/- (Sixty Six Crores
Eighty Six Lakhs Five Thousand and Eight Hundred only).
