Ammonia supply systems, individual planning and construction
Ammonia supply systems are used to supply ammonia to a consumer. The ammonia can be
withdrawn in liquid or gaseous form. We will plan and construct your ammonia supply system
together with you to realise the system you need.
You tell us the consumption rate, the pressure and the material specifications - and we’ll do the
rest! If you do not want to or are unable to erect an enclosure on your premises yourself, we’ll
deliver the supply system completely assembled and installed in a room container. This room
container contains the necessary collecting trough as well as heating and lighting in accordance
with TRG280, TRR100, the German water management act, VAwS (German ordinance regarding
installations for handling substances hazardous to water and regarding specialised companies),
DIN, ATEX and German accident prevention regulations.
The scope of supply includes documentation comprising:
- works certificate according to EN 10204-3.1/2.2
- pressure test reports
- operating instructions
- spare part lists
- layout plan
- P&I diagram
- circuit diagram
- declarations of conformity.

Standard ammonia supply systems from Schick!
As an alternative to individual planning and construction of withdrawal concepts, we also offer standard systems. Compared to customised
concepts, they have the advantage that we can calculate their prices more quickly, you save costs with them and their delivery periods are
shorter.
These supply stations are designed for withdrawal from cylinders. You can put together the system you need individually from six basic
versions and various options. We will naturally be glad to advise you in this regard and will help you choose the system best-suited to your
needs.
The basis for both our standard and our customised concepts is formed by our proven quality and choice of suitable materials. The scope
of supply for the standard systems includes operating instructions and documentation in German.

Corrugated hoses are used where there is a need for a flexible connection method. Refer to the table for the standard
versions. If required, we can supply corrugated hoses in other nominal diameters, special lengths and with your
choice of connections.

§ 1 Vertragsschluss
(1) Unsere Verkäufe und Lieferungen erfolgen ausschließlich aufgrund dieser Verkaufsund Lieferbedingungen. Allgemeine Geschäftsbedingungen des Bestellers gelten auch
dann nicht, wenn wir ihnen nicht ausdrücklich widersprechen.
(2) Unsere Angebote sind freibleibend. Verträge kommen erst mit der schriftlichen
Bestätigung einer Bestellung durch uns zustande.
§ 2 Umfang der Leistungspflicht
(1) Für den Umfang der Leistungspflicht ist unsere Auftragsbestätigung maßgeblich.
(2) Die in Katalogen, Prospekten, Rundschreiben, Anzeigen, Abbildungen und Preislisten enthaltenen Angaben bestimmen die Beschaffenheit des Liefergegenstandes
nicht, es sei denn, dass diese ausdrücklich in die Auftragsbestätigung einbezogen
werden. Die in schriftlichen Unterlagen wie z.B. technischen Zeichnungen, Entwürfen
und Vorschlägen enthaltenen technischen Daten sind vom Besteller vor Übernahme
und Anwendung zu prüfen. Dasselbe gilt für mündlich gemachte Vorschläge, die
mündliche Beratung und zur Verfügung gestellte Software.
(3) Änderungen des Leistungsumfangs und Abweichungen vom Inhalt technischer
Unterlagen bleiben uns vorbehalten, soweit sie den Besteller nicht benachteiligen.
§ 3 Preise
(1) Die Preise gelten netto ab Werk oder ab Niederlassung zzgl. Mehrwertsteuer ohne
Verpackung, Fracht, Zoll und Versicherung.
(2) Erhöhen sich für Lieferungen und Leistungen mit einer vereinbarten Lieferfrist von
mehr als sechs Wochen nach Abschluss des Vertrages Anschaffungs- oder Herstellungskosten (insbesondere infolge einer Erhöhung der Lohn- oder Materialkosten),
sind wir berechtigt, eine Preiserhöhung vorzunehmen, soweit hierdurch eine Erhöhung
unserer Selbstkosten für den Liefergegenstand eintritt.
§ 4 Zahlungen
(1) Zahlungen sind innerhalb von 30 Tagen ab dem jeweiligen Rechnungsdatum zu
leisten.
(2) Eine Aufrechnung oder die Geltendmachung eines Zurückbehaltungsrechts ist dem
Besteller nur mit einer unbestrittenen oder rechtskräftig festgestellten Forderung
möglich.
§ 5 Lieferzeit, Lieferverzug
(1) Für die Lieferzeit ist maßgeblich der in der Auftragsbestätigung genannte
Liefertermin.
(2) Lieferfristen verlängern sich angemessen, wenn der Besteller ihm obliegende Mitwirkungspflichten nicht rechtzeitig erfüllt oder wir infolge höherer Gewalt oder sonstiger Ereignisse, die wir nicht zu vertreten haben, vorübergehend außerstande sind, den
vereinbarten Termin einzuhalten.
(3) Wir sind zu Teillieferungen berechtigt.
(4) Die Lieferfrist ist eingehalten, wenn bis zu ihrem Ablauf der Liefergegenstand unser
Werk/unserer Lager verlassen hat oder bei Abholung unsere Lieferbereitschaft dem
Besteller mitgeteilt worden ist.
(5) Geraten wir mit der Erbringung unserer Lieferung in Verzug, so kann uns der
Besteller schriftlich eine angemessene Nachfrist, mindestens aber eine Frist von vier
Wochen, mit der Erklärung setzen, dass er nach Ablauf dieser Frist unsere Lieferung
ablehnt. Nach erfolglosem Ablauf der Nachfrist ist der Besteller berechtigt, vom Vertrag zurückzutreten oder Schadensersatz zu verlangen. Verlangt der Besteller Schadensersatz, ist dieser beschränkt auf den typischerweise vorhersehbaren Schaden, es
sei denn, uns fällt Vorsatz oder grobe Fahrlässigkeit zur Last.
§ 6 Gefahrtragung/Versand
(1) Wird der Liefergegenstand dem Besteller zugeschickt, oder erfolgt die Lieferung ab
Werk, so geht mit ihrer Auslieferung an den Versandbeauftragten, spätestens jedoch
mit Verlassen des Werks oder des Lagers die Gefahr des zufälligen Untergangs und der
zufälligen Verschlechterung des Liefergegenstandes auf den Besteller über unabhängig davon, ob die Versendung vom Erfüllungsort aus erfolgt und wer die Frachtkosten
trägt. Ist der Liefergegenstand versandbereit und verzögert sich die Versendung oder
Abnahme aus Gründen, die wir nicht zu vertreten haben, so geht die Gefahr mit dem
Zugang der Anzeige der Versandbereitschaft auf den Besteller über. Die Versicherung
des Liefergegenstandes durch uns erfolgt nur aufgrund schriftlicher Vereinbarung.
(2) Soweit der Besteller nichts anderes bestimmt, steht die Versandart in unserem
Ermessen. Wir sind nicht verpflichtet, die günstigste Versandart zu wählen.
(3) Technische Gase liefern wir auf Wunsch in Leihgebinden. Diese bleiben unser
Eigentum, sie werden dem Besteller lediglich zur Entleerung des Füllgutes zur Verfügung gestellt. Jede andere Verwendung ist dem Besteller untersagt. Der Besteller haftet für die Beschädigung oder den Verlust sowie die bestimmungswidrige Verwendung
dieser Gebinde. Der Besteller hat die Gebinde schnellstmöglich zu entleeren und innerhalb der vereinbarten mietfreien Zeit, fracht- und spesenfrei an den Ort unserer Auslieferung zurückzugeben. Für jeden weiteren Tag wird Miete gemäß unserer jeweils
gültigen Preisliste berechnet. Nach Ablauf von 12 Monaten werden die Gebinde von
uns nicht mehr zurückgenommen. In diesem Fall ist der Neupreis zu erstatten. Restinhalte bei Rückgabe der Leihgebinde werden nicht vergütet.
(4) Maßgeblich für den Transport sind die gesetzlichen Transportbestimmungen, insbesondere ADR und RID in der jeweils aktuellen Fassung.
§ 7 Gewährleistung
(1) Weist der Liefergegenstand einen Mangel auf, so haben wir nach unserer Wahl
diesen zu beseitigen oder eine mangelfreie Sache zu liefern.
(2) Die Verjährungsfrist für Mängelansprüche für Liefergegenstände, die üblicherweise
nicht für Bauwerke verwendet werden, beträgt 1 Jahr ab Eingang des Liefergegenstandes beim Besteller.
(3) Für gebrauchte Gegenstände übernehmen wir keine Sachmängelhaftung. Dieser
Haftungsausschluss findet keine Anwendung auf Schadensersatzansprüche verursacht durch Vorsatz oder grobe Fahrlässigkeit sowie eine von uns zu vertretende Verletzung von Leben, Körper und Gesundheit.
(4) Die Untersuchungs- und Rügepflichten des Bestellers bestimmen sich nach
§ 377 HGB.
§ 8 Eigentumsvorbehalt
(1) Die gelieferte Ware bleibt bis zur vollständigen Bezahlung sämtlicher Forderungen
aus der Geschäftsverbindung mit dem Besteller unser Eigentum. Der Besteller ist
befugt, über den Liefergegenstand im ordentlichen Geschäftsverkehr zu verfügen.
(2) Der Eigentumsvorbehalt erstreckt sich auch auf die durch jegliche Weiterverarbeitung entstehenden Erzeugnisse zu deren vollem Wert, wobei wir als Hersteller gelten.
Bleibt bei einer Weiterverarbeitung mit Waren Dritter deren Eigentumsrecht bestehen,
so erwerben wir Miteigentum im Verhältnis der Rechnungswerte an diesen Waren.
(3) Die aus dem Weiterverkauf entstehenden Forderungen gegen Dritte tritt der Besteller schon jetzt insgesamt, bzw. in Höhe unseres Miteigentumsanteils (Abs. 2) zur
Sicherung an uns ab. Wir nehmen die Abtretung an. Der Besteller ist ermächtigt, diese bis zum Widerruf oder zur Einstellung seiner Zahlungen an uns für uns einzuziehen.
(4) Sofern der Wert der uns zustehenden Sicherungsrechte die offenen Forderungen
gegenüber dem Besteller um mehr als 10 % übersteigt, werden wir auf Verlangen des
Bestellers Sicherungsrechte nach unserer Wahl freigeben.
§ 9 Produktüberwachungs- und Produktwarnpflicht
(1) Um den Endverbraucher vor Gefahren, die eventuell von unseren Produkten ausgehen, zu schützen, hat der Besteller die Produkte in sicherheitstechnischer Hinsicht zu
beobachten. Wird erkennbar, dass von dem Produkt Gefahren ausgehen, so ist der
Besteller verpflichtet, uns unverzüglich hiervon in Kenntnis zu setzen.
§ 10 Warenrücknahmen
Sofern nicht anders vereinbart nehmen wir gelieferte Handelswaren, technische Gase
oder Kälteträger binnen 3 Monaten ab Lieferung gegen Warengutschrift zurück, sofern
der Liefergegenstand originalverpackt ist. Dies gilt nicht für Sonderanfertigungen. Wir
behalten uns vor, für unsere Aufwendungen im Zusammenhang mit der Rücknahme
eine angemessene Bearbeitungsgebühr zu berechnen.
§ 11 Reparaturen
Für Reparaturen übernehmen wir eine Gewährleistung für die Dauer von 3 Monaten ab
Auslieferung an den Besteller.
§ 12 Geschäftsgeheimnisse
Pläne, Zeichnungen und andere technische Unterlagen, die dem Besteller übergeben
werden, bleiben auch nach Beendigung der Vertragsbeziehungen unser Eigentum.
Ohne unsere schriftliche Zustimmung dürfen diese Unterlagen nicht genutzt, vervielfältigt oder Dritten zugänglich gemacht werden.
§ 13 Export unserer Waren
Die für den Export gekauften Waren dürfen nur in das uns namhaft gemachte Land
geliefert und nicht im Inland verwendet werden. Der Export unserer Waren ist nur mit
unserer schriftlichen Zustimmung zulässig.
§ 14 Erfüllungsort, Anwendbares Recht, Gerichtsstand, Salvatorische Klausel
(1) Erfüllungsort ist Stuttgart.
(2) Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts (CISG).
(3) Gerichtsstand ist Stuttgart. Wir können den Käufer auch an dessen Geschäftssitz in
Anspruch nehmen.
(4) Sollte eine der obigen Bestimmungen unwirksam sein oder werden, so wird die
Wirksamkeit der übrigen Bestimmungen hiervon nicht berührt. Die Parteien werden an
die unwirksame Klausel durch eine wirksame Regelung ersetzen, die dem angestrebten wirtschaftlichen Zweck möglichst nahe kommt.
