Melendres called the meeting to order at 1:50 p.m. ******* ADOPTION OF AGENDA University President Richard E. Peck said he would like to present a Resolution for consideration by the Regents requesting the Commission on Higher Education (CHE) to modify its policies to allow all students to obtain residence status under the CHE's residence rules and regulations that currently apply to the general student enrollment. • ' Regent Penny Taylor Rembe moved to add the Resolution as Item IX on the agenda and moved adoption of the agenda as revised. Motion carried. ******* • PUBLIC INPUT REGARDING ITEMS ON THE AGENDA There was no public input at the meeting. ******* ApPROVAL OF SUMMARIZED MINUTES OF THE NOVEMBER 9.1995 MEETING Regent Barbara G. Brazil moved approval of the summarized minutes of the November 9, 1995, meeting. Regent Thomas seconded the motion. Voice vote was taken and Board members unanimously approved. Motion carried. ******* ADMINISTRATIVE REpORT --UNM PRESIDENT RICHARD E. PECK University Richard E. Peck presented the administrative report as follows: Introduction of New Provost • President Peck introduced the new provost, Dr. William Gordon, the former dean of Arts & Sciences, effective January 1, 1996. Dean Gordon, who has been at UNM for 18 years, replaces Dr. Mary Sue Coleman, who has accepted the presidency at the University ofIowa. December 13 Legislative Finance Committee (LFC) Meeting UNM and other higher education officials met with the Legislative Finance Committee (LFC) in Santa Fe to present the higher education budget request. The University's request includes a 6% salary increase, but President Peck said he believes the Legislative Finance Committee is considering a 2.9% salary increase. President Peck said it is difficult to know what will happen, but the University will know more when the Governor and LFC both make their recommendations':' The general topics that were of most concern to the legislators who asked questions were about scholarships, books and student issues. Arid Lands Institute On Monday, December 11, President Peck joined Mayor Martin Chavez at Nine-Mile Hill for a news conference to discuss a new Arid Lands Institute. The Mayor would like to see Albuquerque become an international center for studies and information on arid lands activities. Mr. Ray Powell, from the New 2 • n·, n ,.• ," 'u',,' U ",: • i Mexico State Land Office, faxed a letter to President Peck congratulating and commending UNM for its participation in this project and offering the State Land's Office assistance in making this a reality. Mr. Powell said Mesa del Sol would be a natural place to site the Institute and potential research stations. President Peck said that New Mexico State University already has a project in arid lands agriculture and should also be a part of this. For the moment, only UNM and the City of Albuquerque are involved, but he believes that soon there will be a number of participants from across the country and internationally who would want to participate. Dean of the School of Architecture and Planning Richard Eribes is already at work on this, and University needs to help in making this the center of the Arid Lands Institute. Dean Eribes has met with the School's advisory board to talk about a location for the institute. Dean Eribes said this is an effort the School has been engaged in for about two years. He said it seems like a natural interest for New Mexico, and a lot of people are interested in this venture. A conference is being planned next year in Albuquerque for people who are interested in the issues of arid land management and habitability. City Councillor Perea will be submitting legislation that would help fund the beginning of this institute. Provost's Report • Provost Mary Sue Coleman summarized the accomplishments of the Provost's office during her 2 Y2 year tenure at the University. Her hires included two deans, two Branch directors, director of Institutional Research, Faculty Contracts Officer, the general manager at KUNM, and a new University Secretary. She has overseen the growth of the Taos Education Center and has completely reorganized University College. The Maui High Performance Computing Center was created. She's initiated Project Progress, a degree audit program, the Library Campaign, the BBA Program as a pilot project to address the needs of the business community. At the behest of the Regents, Academic Affairs has taken a serious look at its core curriculum and has made major advances with the articulation agreements with all state institutions so that UNM can accept a common core of courses from students in any public post-secondary institution in the state into UNM. She has been working with the Faculty Senate on post tenure review and with the Academic Freedom and Tenure Committee on re-doing a part of the Faculty/Handbook. On behalf ofthe Regents, Regent President Melendres thanked Provost Coleman for everything she has done at the University and presented her with a plaque. Implementation of Measures for the UNM Strategic Plan The UNM Strategic Plan (UNM 2000) lists 21 possible measures to be reported annually in the area of Scholarship and Academic Excellence. Provost Coleman presented a brief report on some ofthese measures: • • Increase retention and graduation rates: Institutional tracking systems are in place. Graduation rates after four, five and six years increased steadily for the fall 1983 through fall 1988 classes, but they have leveled off or declined slightly since then. As an institution that serves a non-traditional student population, UNM will always have graduation rates that are lower than other institutions. • Increase faculty compensation relative to peers: Progress was made for faculty in 1994-95, but this progress needs to be maintained, and the compensation rate is still below that for peer institutions. 3 ~ 'J V'x • Increase extramural funding: There has been a remarkable increase in UNM's contract and grant awards since 1989, over $100 million, from about $83 million to over $184 million, a 122% increase. Federal support is up to almost $119 million in 1995 from $53 million in 1989. • Increase ranking of UNM libraries: UNM has frequently stated a desire to be in the top 50 of research libraries. Progress has been made toward this goal, from 60 in 1990-91 to 53 in the most recent year available, 1993-94. This measure will continue to be reported annually to monitor progress toward the goal. • President Peck concluded his report. ******* COMMENTS FROM REGENTS' ADVISORS Harty LlulL President. Faculty Senate Professor Llull said the support from the faculty is very genuine and very broad for Dean Gordon. He also said he is hearing a lot of positive things about the new directors at the Branches, and believes there is more of an awareness for the UNM branches. Professor Llull presented two charts from a study based on three major indexes in the field of Arts in Humanities, Scienge and Technology and Social Sciences of high-impact journals and serials. One chart showed the number of total publications created by each institution--UNM ranks 68 in that chart. However, in the chart that takes into account the number of faculty, and therefore presents this data in terms of productivity of faculty, UNM moved from 68 up to 45. • Don Burge. Staff Council Mr. Burge said that Staff Council President Velma Morgan was unable to attend the meeting due to a family emergency, but asked him to pass on her warmest holiday wishes to the Board. Alberto Solis. President. Associated Students ofUNM Mr. Solis said ASUNM will be conducting a voter registration drive in January and is getting prepared to lobby at the national level for federal financial aid. Mr. Solis expressed his concerns about the distribution of racist flyers on campus. He said that students have expressed a concern that the University's policies concerning these kinds of issues are more reactive than preventive. He said he would like to see the University try to prevent these things from reaching a scale that are violent. Mr. Solis said that in October he attended a conference sponsored by New Mexico First, a non-profit organization that deals with public policy issues. The participants met in small panels and recommended policies that they will try to have implemented. Mr. Solis said he is co-chair of the Implementation Team, and they hope to make a presentation to the Board in the future. Graduate and Professional Students Association Mr. Sharbutt said that GPSA recently completed a mid-year review. GPSA has representatives credentialed I to attend GPSA meetings from 39 different departments, but there are. 22 departments that are not represented at this point. Mr. Sharbutt said that GPSA is making contact with these departments and is making an effort to have 100% participation by the end ofthe year. Currently, there are 51 primary delegates and 77 alternate credential members of the GPSA Counsel. ) The annual GPSA Legislative reception is scheduled on December 15, 1995 and Mr. Sharbutt encouraged the Regents to attend. Michelle Polk, President. Alumni Association Ms. Polk said the Alumni Association hosted a community outreach program for the alumni representatives . who were selected for the six new communities. Of those, five have volunteered to organize legislative receptions the first week of January. The Alumni Association is currently setting up focus groups to find out what things alumni would like more from the Alumni Association in return for what they would give back to the University. • Ms. Polk said that there was an article in the Albuquerque Journal recently concerning the issues of whether UNM alumni will pay dues in the future. She said that the Alumni Association had a very lengthy interview with the reporter and the dues part was approximately 10-15% of the interview, but that was what chosen to be written about. In response to this story, Ms. Polk said the Alumni Association is considering this and the Finance Committee is working on it. ******* RA TIFICATION OF CANDIDATES FOR DEGREES, SEMESTER I, 1995-96 Regent Brazil said that the Faculty Senate and the Academic/Student Affairs Committee approved ratification of the Fall 1995-96 Candidates for Degrees and moved approval. Regent Thomas seconded the motion. Voice vote was taken and Board members unanimously approved. Motion carried. A copy ofthe Candidates for Degrees, Semester I, 1995-96 is hereby made a part ofthese minutes as Exhibit A. ******* FACULTY RETIREMENT INCENTIVE PROGRAM • The Voluntary Retirement Incentive for tenured faculty has been iIi place since 1992 and was renewed by 5 the Regents through 1997. However, the possibility of an added incentive in the Spring Semester 1996 would encourage more faculty to take advantage ofthe program sooner, and would provide greater flexibility for the Deans in their budget reduction decisions, which are currently underway. • Regent Brazil said this recommendation comes before the Board without recommendation from the Academic/Student Affairs Committee because there are several questions the members wanted to have addressed before voting. Provost Coleman explained that for Spring Semester 1996 only, incentives would be increased from a maximum of $24,000 to a maximum $35,000 or from 40% of current contract salary to 60% of current contract salary, whichever is less. The program would revert to the original $24,000/40% maximum on July 1, 1996, up through the December 31, 1977 deadline. At the request of the Academic/Student Affairs Committee, Provost Coleman went back and polled every dean on the concerns of the Committee--(l) what would be the financial implications of this program? and (2) would the University lose any people that it did not want to lose as a result of this program? She said that everybody reported to her that first of all, they would not lose anybody that they didn't want to lose. Secondly, Provost Coleman said no one believes this is going to be a financial hardship. She said she believes that UNM will get approximately 8 to 10 additional retirements during this period. Provost Coleman said that all deans reported that they are in favor of the program, because they believe it will give them additional flexibility, and even though they will not save money immediately, they can save money in the long-term. This may also 'give them the opportunity to bring in some new, young faculty in areas where they would like to do this. University Counsel Nick Estes added that there is no legal barrier to the added incentive. Regent Brazil moved approval forthe increased incentive for the Faculty Retirement Incentive Program. Regent Rembe seconded the motion. • Voice vote was taken and Board members unanimously approved. Motion carried. ******* EXECUTIVE SESSION -- POTENTIAL LITIGATION (PURSUANT TO SECTION 10-15-1-H.(2). NMSA. 1978. AND LIMITED PERSONNEL MATTER (PURSUANT TO SECTION 10-15-1-H.(7). NMSA. 1978) -- NOVEMBER 9. 1995 At the adjournment ofthe open meeting on November 9, 1995, Regent Gallegos moved for a closed meeting to discuss potential litigation (pursuant to Section 1O-15-1-H.(7), NMSA, 1978) and personnel matters (pursuant to Section 10-15-1-H.(2), NMSA, 1978). Regent Thomas seconded the motion. All ofthe Regents attended the Executive Session. The Regents attested that they attended the Executive Session on December 4, 1995, from 10 a.m. to 2 p.m., and that the only items discussed at the meeting were limited personnel matters as noticed. ******* ACTION ON ApPEAL OF DR. STANLEY lIANDMAKER Regent J.E. (Gene) Gallegos said the matter on December 4 concerned the appeal regarding Dr. Stanley Handmaker from the decision ofthe Academic Freedom and Tenure (AF&T) Committee, which was entered on February 15, 1995. On December 4, 1995, the Regents heard arguments and presentation of counsel and the parties, and it has also been confirmed by University Counsel that there is no other information that would be material to the Board's decision. He said there were five issues that were before the AF&T Committee. Issues 4 and 5 were not pursued on appeal. • Regent Gallegos moved that the Board adopt a decision as follows: (1) to affirm on issue number one, which was removal ofDr. Handmaker as director ofthe University Affiliated Programs; and (2) to remand on issues 2 and 3. On issues number two and three, removal of Dr. Handmaker as Principal Investigator and change in office and assignment to Los Lunas project, respectively, the motion was for the Board to remand those to the AF&T Committee with instructions to dismiss those two issues as not being violations of academic freedom and being beyond the jurisdiction of the Committee. The Board will enter a written decision accordingly. Regent Thomas seconded the motion. Voice vote was taken and Board members unanimously approved. Regent Gallegos moved approval of the minutes of the August 9, 1994, meeting. Regent Rembe seconded the motion. Voice vote was taken and the motion was passed by a vote of 6-1 with Regent Tang abstaining. Motion carried. ******* • 7 MEETING OF THE REGENTS OF THE UNIVERSITY OF NEW MEXICO AS THE MEMBER OF THE SCIENCE & TECHNOLOGY CORPORATION@ UNM (FORMERLY UNM TECHNOLOGY DEVELOPMENT CORPORATION -ApPROVAL OF AUDIT REpORT • Mr. Charles Wellborn, president of Science & Technology Corporation @ UNM, presented the Independent Auditors' Report for Science & Technology Corporation @ UNM. Mr. Wellborn explained that the audit stated that the bookkeeping needs to be improved. He said STC has recently hired a professional bookkeeper to correct the deficiencies that are mentioned in the audit report. Mr. Wellborn explained that 80% of the money on the balance sheet was related to new construction. The multi-tenant building, the Manufacturing Technology building and BDM will also help provide for STC salaries. Regent Gallegos moved approval of the audit report. Regent Larry D. Willard seconded the motion. Responding to an inquiry by Regent Tang, Regent Gallegos explained that detailed schedule~ were presented at the Finance and Facilities Committee as to the sources of the various revenues. Regent Gallegos suggested that perhaps a complete overview of STC can be presented to the Board. Voice vote was taken and the motion was passed by a vote of 6-1 with Regent Tang abstaining. Motion carried. ******* RESOLUTION President Peck said that currently, by Commission on Higher Education (CRE) rules not statute, a student who comes from out-of-state on any kind of scholarship, remains an out-of-state student for as long as he/she is here. A student who graduated as a Regents' Scholar last year was always counted as an out-of-state student. UNM payed $6,000 for the student's tuition, rather than the $2,000 had this been an in-state student. The argument has been that these students do not become residents because they do not pay taxes, get a driver's license and do not declare independence from their parents, which are the ways that someone may achieve in-state residence. Vice President Mc Kinney and some legislators have argued that if a student on scholarship were to meet the same tests that any other student who is not on scholarship meets, that student should be granted residency. President Peck said that he believes Senator Manny Aragon will be presenting a Memorial at the legislative session about this. In order to show support for a change, President Peck presented a Resolution in which the Regents would request that the CRE modify its policies to allow all students to obtain residency status under the CRE's residency rules and regulations that currently apply to the general student enrollment. • Regent Gallegos moved approval of the Resolution. Regent Brazil seconded the motion. Voice vote was taken and Board members unanimously approved. Motion carried. Over the past century, the ceremonies have occurred in a number of locales, including the original Rodey Hall, Tight Grove, the Art Building Quadrangle, Zimmerman Stadium, Carlisle Gym, University Arena and University Stadium. Today, UNM's Commencement returns to Johnson Center. This facility was built in 1957 as the main athletic and recreational arena for the University. That year, UNM's Board of Regents shattered precedent by naming the gym for a man still actively serving on the faculty. Professor Roy W Johnson initiated the Departments of Physical Education and Athletics and served them devotedly from 1920 until his retirement in 1959. At the University of New Mexico's first commencement, six graduates of the Normal Department received the degree of bachelor of pedagogy. (The Territory of New Mexico had no public high schools when it created its university in 1889, so UNM's first students were teenagers in high school-equivalent courses and young people, mostly women, studying to become teachers. The first graduation of the College Department was not until several years later.) . The University of New Mexico has grown from 108 students to nearly 25,000 on the main campus. That number swells to 31,000 with the addition of the student populations from the branch campuses in Los Alamos, Gallup and Valencia County; graduate centers in Santa Fe and Los Alamos; and .the Taos Education Center. UNM has the state's only schools of law, medicine, pharmacy and architecture. Its twelve units offer 140 degrees and award 80 percent of the state's doctoral and profeSSional degrees. In 1892 there were seven faculty members; in 1994 there were some 1,507 full-time and 1,092 part-time faculty. They received more than $183 million in contracts and grants for research, public service and sponsored instruction in FY 1995. Faculty also published more than 2,300 books, chapters and scholarly articles last year, and they continue to bring UNM more Fulbright grants than all but a handful of top American universities. The first Board of Regents was appointed on September 2, 1889, and consisted of five members. Regents of the University are appointed by the Governor for terms of six years; the Governor and the State Superintendent of Public Instruction are ex-officio members of the Board. The present Board members are: Arthur Melendres, president; Penny Rembe, vice president; Barbara Brazil, secretary-treas)lrer; J. E. Gallegos, Mary A. Tang, Larry D. Willard and Eric Thomas. The colorful academic procession is formed under the direction of eight faculty marshals, who wear da Vinci caps which display the colors of the University of New Mexico. Academic dress has its beginnings in the Middle Ages. When the English universities were taking form in the twelfth and thirteenth centuries, the scholars were also clerics and adopted obes similar to those of their monastic orders. Caps were a ecessity in the drafty buildings, and copes or capes with hoods attached were needed for warmth. The hood was selected by these early scholars as the article to be made. distinctive for the various degrees by its color, trimming, and binding. As the universities gradually passed from the control of the ecclesiastics, costumes took on brighter hues, and even today the robes of Oxford and Cambridge remain among the most colorful of all. The use of academic costume in the United States has been continuous since Colonial times. The idea of a well-defined system, however, did not arise until about 1893 when an intercollegiate commission was formed which prepared a uniform. code for caps, gowns and hoods designed to show not only the various degrees but the sources of the degrees as well. The commission offered its code to all institutions of higher learning and it was soon adopted. The cap, Originally round, is now a square mortarboard and is the same for all degrees. Gowns and hoods, however, are markedly different for the respective degrees. The hood not only varies in length and design for the various degrees, but the color and width of the velvet binding or edging of the hood indicate the degree it represents: apricot-nursing; blue-philosophy; light blue-education; brown-fine arts; blue violet-architecture; drab-business administration; lilac-dentistry; green-medicine; sage green-physical education; olive-pharmacy; orange-engineering; pink-music; purple-law; white~arts,letters, humanities; golden yellowscience; peacock blue-public administration. The hood not only indicates the type of degree but is lined with the official color or colors of the university conferring the degree, this to be charged with a chevron or chevrons when the institution uses more than one color: For example, the official University of New Mexico colors are cherry and silver, so the hood is lined \vith silver gray with a chevron of cherry red. In the case of today's candidates for Bachelor's degrees, hoods are not worn, but the color of the cap tassel serves the same purpose in identifying the wearer's degree. Candidates for Master's degrees are hooded and have black cap tassels. Doctors are hooded and have gold cap tassels. General Honors students are identified by a silver tasseled cord worn over the academic robe. The procession is led by the President of the Faculty Senate who carries the University Mace. The mace, Originally a medieval weapon and later carried by sergeants at arms guarding kings and high church officials, gradually assumed a purely ceremonial character symbolizing authority. When used in academic processions, the mace usually precedes the entire procession. The University of New Mexico Mace was designed and crafted for presentation at the Centennial Convocation in 1989 by Ralph Lewis, professor emeritus of art. The cherry wood staff is crowned by a sih:er stylized yucca blossom connected by bronze casting to a silver replica of the University seal. Views of six campus sites are etched in a silver band at the top of the wooden shaft. The foot of the mace is silver with a turquoise accent. 3 REGENTS' MEDAL RECIPIENTS The Recents' Meritorious Seroice Medal is awarded to members of the faculty or staffofthe University of New Mexico in recognition of distinguished seroice to the university. STUDENT SPEAKERS Even) school and college ofthe University nominates outstanding undergraduate and graduate students to speak at Commencement. The final choice of OIie undergraduate and one graduate student speaker is made by the President o f e the University. . ' DR. ALICE CUSHING STELLA SAINDON The first female faculty member of the University of New Mexico School of Medicine, Dr. Alice Cushing's service to the University. goes back to the birth of that school. Over the past thirty years, this Professor Emeritus in Pediatrics has helped the School of Medicine grow from its roots in an old bottling plant and former mOltuary to one of the top medical schools in the United States. Dr. Cushing's first love has always been 'the youngest in our state. A native New Mexican, she has dedicated her career to the care and health of our children. She was instrumental in setting up what is now the Infectious Disease Unit in the Department of Pediatrics. She has also served as interim Chair of Pediatrics and on numerous School of Medicine committees. Dr. Cushing enjoys the support of her peers and colleagues and the affection and love of all her patients over the years. The University .of Mexico proudly honors her with the Regents' Meritorious Service Medal. The undergraduate speaker is Stella Saindon who is receiving her Bachelor of Business Administration degree with an emphasis in Accounting. Saindon's academic credentials are outstanding. She's made the Dean's list at the Anderson Schools every semester since her arc rival in the fall of 1993 and has not received a grade lower than an "A". Saindon has been awarded two Anderson Schools scholarships, including the Clinton P. Anderson Memorial Scholarship and the Philip Morris Undergraduate Scholarship. She is also a Ford Motor Company Hispanic Scholar. Stella is past president of the Association for Accounting Students, a member of the Honorary Associac tion for Accounting Students Beta Alpha Psi, and a member of the Dean's Student Advisory Council. RICHARD MARTIN WHEELOCK THEO R. CREVENNA Tactful diplomat, tenacious negotiator, dedicated administrator and ardent advocate for the University of New Mexico in this hemisphere and throughout the world, Theo R.Crevenna has made himself an essential element of the University's Latin American programs. In 1945, he became the first recipient of what was then UNM's Master of Arts Degree in Inter-American Affairs. He became Deputy Di- _ rector of UNM's Latin American Institute in 1979 following a distinguished career in the Organization of American States. Here, he has been involved in an impressive array of activities involving UNM's ties to Latin America-negotiating programs between various UNM units and their counterparts in Mexico's universities; serving as liaison behyeen the institute and the University's academic units that offer hemispheric initiative programs; and developing new programs and securing funding for them. In the wider community, he has played prominent roles with the Governor's Camino Real project, the Albuquerque Coordinating Council on International Friendship, the Mexican Consulate, Partners of the Americas, the Pan-American Roundtables, the cultural affairs offices of both the city and the state and others. Mr. Crevenna gives unselfishly of his time, imagination and energy. The University of New Mexico proudly honors him as a recipient of the Regent's Meritorious Service Medal. The graduate speaker is Richard Wheelock who has completed his Ph.D. in American Studies this semester. A member of the Oneida Tribe ofWisconsin, Wheelock has spent most of the last twenty years working in Indian education in the West. He also worked as the editor of Knlihwisaks, the Oneida tribal newspaper. Wheelock's workin journalism led to his dissertation topic, "Indian Self-Determination: Implications for Tribal Communications Policies." While completing his doctorate, Wheelock continued his work irt Indian education, holding a teaching position as an Assistant Professor of Southwest Studies at Fort Le\vis College. Deeply committed to increasing the opportunities for Indians to successfully complete,. higher education degrees, Wheelock has worked hard to develop a pedagogy and a curriculum at Fort Lewis College that meets this goal in a culturally respectful manner. The Regents' Recognition Medal is awarded to persons teho have performed outstanding seroice to the University of New Mexico. ERNEST S. ROMERO As a banker, a town manager, a consultant in technology commercialization, and an operations consultant to small business, local governments and institutions, Ernest S. Romero has served New Mexico and its surrounding regions with distinction. As a proven friend of the University of New Mexico, this long-time resident of Taos has given his time and considerable talents to University Hospital, serving on its Board of Trustees from 1988 through 1995, the lasthvo years as Board Chairman. During this time, Mr. Romero has helped define the role of the hospital trustees within the organization of the Health Sciences Center. He has also seen the hospital achieve remarkable security, both finanCially and within the rapidly changing world of the health care industry. Presidential Scholarships are funded by contributions ofindividuals, cOlporations, alumni, faculty, staff, and the University's Hugh Woodwdrd Trust Fund. The award is renewable for three years iftIle student meets specific renewal criteria each year. Regents' Scholars are each assigned one ofUNM's outstanding faculty to serve as a mentor. Merino • 25 •• RESOLUTION WHEREAS, the Commission on Higher Education (CHE) has established rules and regulations for post-secondary institutions to follow in determining residency status of students enrolled at the institution; and WHEREAS, the University of New Mexico Board of Regents (Regents) is aware of and support the CHE's residency rules as they apply to the general student population; and WHEREAS, the Regents have recently been made aware that the CHE's general residency rules do not apply to nonresident students who receive certain scholarship support at the institution; and WHEREAS, the Regents believe that the CHE's restriction on its residency policies as these restrictions relate to Regents' Scholars, student-athlete scholars, and other similar scholarship students is discriminatory and not defensible. • NOW, THEREFORE, BE IT RESOLVED, that the Regents request that the CHE modify its polices to allow all students to obtain residency status under the CHE's residency rules and regulations that currently apply to the general student enrollment.
