WHAT IS MESOTHELIOMA AND HOW CAN IT AFFECT ME OR MY FAMILY?
Submitted by Curtis Osborne
You’ve probably seen law firm commercials on t.v. talking about
mesothelioma. What is it, and is it something that you need to
be concerned about? Mesothelioma is a malignant cancer of the
mesothelial lining of the lungs and chest cavity, the abdominal cavity,
the pericardium sac surrounding the heart, or the tunica vaginalis
sac surrounding the testes. It was first diagnosed in the 1940’s and is
positively associated with asbestos exposure. Most patients diagnosed
with mesothelioma die within a year of diagnosis. The latency period,
or the time it takes for mesothelioma to develop, may be as long as
20 to 60 years after exposure to asbestos. Cases of mesothelioma have
been seen in people who were only exposed to asbestos for a month or
two of their lifetime.
So who is most likely to have been exposed to asbestos, and is,
therefore, most at risk for developing mesothelioma? People who have
been or are employed in industrial-type jobs, construction (including
remodeling and renovation), automotive brake and clutch repair, or
ship building are at the highest risk for asbestos exposure. Not only are
workers at risk, but their families are as well, because asbestos fibers,
which may be too small to be seen by the naked eye, can be brought
home on clothing, skin, and hair. And those who wash the asbestosexposed clothing are also put at risk.
In the U.S., 10,000 people die every year from asbestos-related
diseases. Astoundingly, that is one out of every 125 men who die
over the age of 50. Other diseases associated with asbestos exposure
include asbestosis and cancer of the lungs, kidneys, larynx, esophagus,
stomach, colon, and rectum. Between 1940 and 1979, approximately
27.5 million people in the U.S. had been exposed to asbestos through
their workplace. Today, approximately 2,000 to 3,000 people each year
are diagnosed with mesothelioma, and trends indicate that the rate at
which people are diagnosed with one of the diseases caused by asbestos
exposure will likely increase through the next decade.
to asbestos. Some of the more popular uses for asbestos include textiles,
friction products, insulation, and building materials.
Manufacturers in the U.S. have known about the dangers of asbestos
use since the 1920’s, but continued to use the product because of
its sound absorption and resistance to heat, electrical, and chemical
damage. As a result, lawsuits have been filed by its victims. The first
lawsuit was filed in 1929. Since then, because of the large numbers of
products that contain asbestos and the large number of people affected
by exposure to asbestos, lawsuits against asbestos manufacturers and
employers for neglecting to implement safety standards have made
asbestos litigation the longest, most expensive mass tort in U.S.
history. With more than 6,000 defendants and 600,000 claimants,
compensation awarded to victims has reached billions of dollars.
Analysts have estimated that the total costs of asbestos litigation will
reach $200 billion in the U.S. alone.
Some of the more prominent deaths that were a result of mesothelioma
and its complications include: Paul Gleason, actor, best known
for his role as Prinicpal Vernon in the 1985 film, The Breakfast
Club; Hamilton Jordan, Chief of Staff for President Jimmy Carter
and lifelong cancer activist; Bernie Banton, Australian workers’
rights activist, who contracted mesothelioma after working for the
James Hardie Company; Steve McQueen, actor; Bruce Vento, U.S.
congressman; Terrence McCann, Olympic gold medalist; and Merlin
Olsen, football player and actor.
For more information on asbestos, its regulation, its presence in homes
and schools, and its affect on your health, go to the U.S. Environmental
Protection Agency’s website at http://www.epa.gov/asbestos/pubs/
help.html
You may be wondering if people are still exposed to asbestos today,
considering how dangerous the substance is. At one point, asbestos
was used in over 5, 000 products including hair dryers, concrete,
bricks, pipes and pipe insulation, fireplace cement, gaskets, drywall
and drywall compound, flooring, roofing, lawn furniture, WWII ships,
brake pads, cigarette filters, artificial Christmas snow, crayons, and
potting soil. Asbestos-containing products have been used extensively
in our homes and schools. Although several countries have regulated
or banned the use of asbestos, asbestos use in the U.S. has not been
entirely banned. Today, more than 3 million workers are still exposed

THE GOLDEN GIRLS
WOMEN’S DINNER GROUP
JUST A FEW THOUGHTS ABOUT LIFE....
Life is not a race but a journey. Be honest - work hard - be choosy,
be fair. Say “Thank You”, “I Love You”, and “Great Job” to someone
each day. Take time for prayer. Let your handshake mean more
than a written contract. Love your life and be thankful for what
you have been given - it is not accidental. Search for your purpose
and fulfill it as best you can. Laugh often - it heals the body. Be
forgiving - it heals the soul. Appreciate the little things in life.
Some of the best things in life really are free - a golden sunset, a
baby’s laughter, a double rainbow, a smile from a friend.
Worry less and smile more. Be open to new adventure - it awakens
the spirit. Recognize the special people you have been blessed to
know - it is not accidental. Be grateful - it calms the mind. Live
for today and enjoy the moment but also plan for tomorrow.
If you live in Highland Creek and are 60 or better, why not join us
and see what we’re about. We will help you laugh, think and enjoy
life. We go to movies, lunches, plays, dinners and other interesting
places.

FINANCIAL MOVES FOR NON-RETIRING BABY BOOMERS...submitted by Alan Thornton
If you’re in one of the early waves of baby boomers, you may know some retirees who are now enjoying a wide variety of activities-possibly even
including a new career. And you, too, may now have some choices about how to spend your time. Should you stay at your current job? Should
you retire altogether and travel or pursue hobbies? Or should you “retire” and then start a new job, do some consulting or even open your own
business? While you may have choices on how to draw an income, you’ll also have some key issues to consider.
For starters, think about how your earnings might affect one source of retirement income: Social Security. As an early wave baby boomer, your
“full retirement age,” from a Social Security standpoint, will be around 66. If you are younger than full retirement age during all of 2010, you
will lose $1 from your benefits for each $2 you earn above $14,160. But if you reach your full retirement age during 2010, you’ll lose $1 from
your benefits for each $3 you earn above $37,680 until the month you reach that age. (Keep in mind that these figures are for 2010 only; for
changes in 2011 and succeeding years, you’ll want to check with the Social Security Administration.) Once you reach full retirement age, you
can keep all your benefits, no matter how much you earn.
Deciding what to do about Social Security isn’t the only move you need to make if you work during your “normal” retirement years. You’ll
also want to contribute as much as possible to your IRA, 401(k) or other employer-sponsored retirement plan. During these years, with your
children grown and your mortgage possibly paid, you may have more investable income available - so take advantage of the opportunity.
You’ll also need to carefully review your portfolio to help ensure your investment mix is appropriate for your needs. To stay ahead of inflation,
you’ll still need to invest for growth, but since you’re not that far from retirement, you’ll also want to control risk and volatility as much as
possible.
Furthermore, you’re at the time of life when you may want to consider consolidating your investment and retirement accounts. If you have an
IRA here, a 401(k) there and another account someplace else, you have a lot of paperwork to keep trak of, both during the year and, especially,
at tax time. But even more importantly, with all your accounts scattered, you might not be following one central, unifying investment approach
- an approach that could help make it easier for you to pursue your long-term goals, including a comfortable retirement. By consolidating
your accounts with one company, you can save time and possibly reduce
administrative fees - while your accounts can work in harmony on your
behalf.
This may be a good time to consult with a professional financial advisor someone who can help you make those choices that can help provide you
with the freedom to spend this next phase of your life doing as you please.
After all, you’ve earned it.

MANAGER’S CORNER
We hope you and your families are enjoying
all the “summer fun” Highland Creek has
to offer… four pools, six tennis courts, eight
parks, walking trails, play grounds, etc. Below,
we have included a few items of interest and
information for you.
Brick Wall Project
By the time you receive this newsletter, the
brick wall repairs should be very close to
completion. The following paragraph is a
message from the Chairman of the Brick Wall
Project to the Owners in the community:
Please understand the work that was
performed was a mixture of partial rebuilding,
tuck pointing, brick replacement and a limited
amount of wall panel and pier replacement.
We were addressing structural issues as well
as a few original design issues. In the original
design there was often 50% or less of overlap
in bricks which led to weaknesses in the
wall and headers, and the original walls and
headers did not have expansion joints. The
original headers were not of consistent size
and numbers of bricks in each course. As we
went along, if the contractors were completely
rebuilding the pier and/or pier header, then
a consistent design was applied. The newer
design has less overhang and a consistent
number of bricks in each course, which should
provide a stronger construction and hopefully
a longer life. This approach to decrease the
brick overlap was recommended by the
engineer. Will this lead to inconsistencies in
certain sections where you have a mix of old
headers, headers where only tuck pointing,
and/or one or more bricks were patched in?
Yes. However this was a known issue that will
be barely noticeable once the power washing
is completed. The Board of Directors felt
that it was financially irresponsible to rebuild
every pier, header, and panel.
Lawn Maintenance Expectations
The Association realizes that each resident
may not have a lawn of lush, green, thick
grass. However, there are certain expectations
of lawn maintenance. At a minimum:

Apply weed killer to rid your yard of
unsightly, uncontrollable weeds
Mow your grass (and/or weeds) to a
maximum of approximately 4”
Remove dead plant material from your
property
Mow the strip of grass between the
curb and the sidewalk adjacent to your
property
Edge your grass to keep it from growing
over the sidewalk, curb and driveway
Residents who do not maintain their yards
at an acceptable standard will now receive
two letters via US Mail before being called
to a violation hearing. Overall, the level of
www.highlandcreek.com
yard maintenance has deteriorated in the
community which lowers the overall aesthetics
and is unfair to those who work hard to keep
a neat, trimmed yard.
You May Report Unkempt Yards
If you live in Charlotte and wish to report a
yard with grass over 6”-7” tall, you may call
311 and report this unkempt property by
street address. The city will send an inspector
out to validate the report. If the grass is
indeed taller than 7”, the city will mow the
yard and add the cost of mowing to the
property tax invoice for that property. If you
live in Concord, call 704-920-5555 to report
the same situation.
Pool Improvements
By this time, we are sure you are enjoying
the added deck space and pool furniture at
Christenbury Pool. Prosperity Pool now has
a gazebo-like shade structure in the summer
which doubles as a storage building in the
winter.
Nominees for Board of Directors
The Highland Creek Board of Directors
consists of nine members that work closely
with Hawthorne Management Company
to oversee and manage all aspects of the
Highland Creek Community Association. In
September, three positions on the Board will
be open for election by the Voting Members
representing each Village. If you have a
desire to serve on the Board of Directors
and volunteer your time and expertise, please
contact Dollye Walters or Leah Singleton at
Hawthorne Management at 704-377-0114.
Your name and contact information will be
forwarded to the Nominating Committee.
A member of the committee will call each
nominee to discuss the role of a director and
answer any questions the nominee may have
regarding this position. Please be prepared
to submit a brief personal biography and
willing to commit a minimum of ten hours
per month to your role as a Director of the
Association.
If you walk to the parks, playing fields/courts
or pools, please do not trespass on other
owners’ property in order to “shortcut” your
distance. Foot traffic on others’ property
damages the turf, violates privacy rights and
trespassing laws, and causes litter problems.
Plan ahead and follow walking paths and
sidewalks.
Exterior Maintenance of House
The governing documents for Highland Creek
hold the Owner responsible for maintenance
of the exterior of his/her house. Article XII,
Section 6 of the Declaration states that each
Owner shall prevent the development of any
unclean, unsightly, or unkempt condition
on his or her Unit. Over the past couple of
years, mildew/mold and rotten wood have
become widespread maintenance issues,
particularly in the older neighborhoods of
the community. Both are unattractive and, if
not addressed, can lead to major exterior and
interior problems. Please take the necessary
steps to replace any rotten wood and pressure
wash the mildew/mold early on.
Vandalism
Unfortunately, we often experience an increase
in vandalism during the summer months.
Vandalism is very costly to the Association,
and therefore, each of you. Please help us hold
the perpetrators responsible for their actions
and the losses incurred by the Association
by reporting any hint of suspicious behavior
to Securitas (704-609-0569) and/or the
appropriate law enforcement department.
The staff of Hawthorne Management
Company appreciates the opportunity to
serve as your management company for the
Association. Please do not hesitate to call
our office at 704-377-0114 if you have an
Association related question, comment or
concern.
