The award was recently announced at the Global Water Summit in Abu Dhabi. It highlighted the plant for its technological and environmental achievement. The Carlsbad plant is the result of a 30-year Water Purchase Agreement between the plant’s developer and owner, Poseidon Water, and the San Diego County Water Authority for the production of up to 56,000 acre-feet of water per year. As the largest seawater desalination plant in the nation, it started commercial operations in December 2015 and is providing the San Diego region with a drought-proof water supply during one of the most severe droughts in California’s recorded history. It utilizes reverse osmosis membrane technology to produce approximately 10 percent of the region’s water supply; it is a core supply regardless of weather conditions, and it is blended with water from other sources for regional distribution. We often work side-by-side to preserve jobs. Thus, we want to encourage our members to spend a little time reading these bills to make sure they know what can hurt them and relaying that information to their elected representatives in the state legislature. HERE ARE SOME 2016 JOB KILLER BILLS Arbitration Discrimination AB 2667 (Thurmond; D-Richmond) Arbitration Agreements Discrimination — Prohibits arbitration of Unruh Civil Rights violations made as a condition of a contract for goods or services. AB 2879 (M. Stone; D-Scotts Valley) Employment Arbitration Agreements Discrimination — Prohibits an employer from requiring an individual who is a member of the military to sign a mandatory arbitration agreement as a condition of employment. Increased Labor Costs SB 1166 (Jackson; D-Santa Barbara) Imposes New Maternity and Paternity Leave Mandate — Unduly burdens and increases costs of small employers, as well as large employers, by requiring 12 weeks of protected employee leave for maternity or paternity leave, in addition to up to four months of existing pregnancy disability leave, for employees who have worked for the employer one day, as well as exposing employers with 50 or more employees to potentially provide 24 weeks of protected leave in a 12-month period, and all employers of 5 or more to the threat of costly litigation. Meritless Litigation SB 899 (Hueso; D-Logan Heights) Increased Meritless Litigation Costs — Drives up consumer costs and increases GOVERNMENT AFFAIRS Tax Increase TED OWEN President & CEO CARLSBAD CHAMBER OF COMMERCE frivolous litigation similar to the disability access lawsuits in California, by prohibiting a retailer or grocery store from discriminating against a person on the basis of gender with the price of goods and subjecting them to a minimum $4,000 of damages for each violation. Tax Increase ACA 8 (Bloom; D-Santa Monica) Lowers Vote Requirement for Tax Increases — Adds complexity and uncertainty to the current tax structure and pressure to increase taxes on commercial, industrial and residential property owners by giving local governments new authority to enact special taxes for storm and wastewater infrastructure, including parcel taxes, by lowering the vote threshold from two-thirds to fifty-five percent. AB 2782 (Bloom; D-Santa Monica) Targeted Tax — Threatens jobs in beverage, retail and restaurant industries by arbitrarily and unfairly targeting certain beverages for a new tax in order to fund health programs. 2015 JOB KILLER CARRY-OVER BILLS Burdensome Environmental Regulation SCA 5 (Hancock; D-Berkeley) Split Roll — Undermines the protections of Proposition 13 by unfairly targeting commercial property owners and increasing their property taxes by assessing their property based upon current fair market value instead of acquired value. Such costs will ultimately be passed on to consumers and tenants through higher prices and will result in job loss as businesses struggle to absorb such a dramatic tax increase. The Carlsbad Chamber of Commerce has taken a stand on the following bills: Public Utilities Commission SB 512 Hill (D) – This bill proposes a suite of reforms of the operations and governance of the California Public Utilities Commission (CPUC), including requiring the CPUC to hold no less than six sessions per year in Sacramento, expand the information required of the CPUC in its annual report and workplan to the Legislature and Governor, require specific information on its website, apply the Code of Ethics from the Administrative Procedures Act (APA) to administrative law judges (ALJs), and others. Carlsbad Chamber supports Increased Labor Costs SB 32 (Pavley; D-Agoura Hills) Slows Economic Growth — Increases costs for California businesses, makes them less competitive and discourages economic growth by adopting further greenhouse gas emission reductions for 2030 without regard to the impact on individuals, jobs and the economy. SB 654 (de León; D-Los Angeles) Creates Unworkable Hazardous Waste Permitting Process — Discourages investment in upgrading and improving hazardous waste facilities by shutting down JULY ADVERTISING SPOTLIGHT hazardous waste facilities if the Department of Toxic Substances Control (DTSC) fails to take final action on the permit renewal application within a specified timeframe. SB 878 (Leyva; D-Chino) Mandated Scheduling Requirement — Eliminates worker flexibility and exposes employers to costly penalties, litigation, and government enforcement, by mandating employers in the retail, grocery, or restaurant workplace, including employers who have hybrid operations that include a retail or restaurant section, to provide a 21-day work schedule and then face penalties and litigation if the employer changes the schedule with less than 7 days notice, even when the change is at the request of the employee. The Carlsbad Chamber of Commerce is not only aware of that importance, but has a desire and a responsibility to play a role in the initiatives that affect the quality of life in Carlsbad over the long term. We have been listening to the needs of various businesses and are aware of many issues that we need to be involved: •The future of the McClellanPalomar Airport; •The modification of the city’s Proposition H which forces capital projects exceeding a cost of $1 million to go to the voters; •The council seats that are up for re-election this fall, and the leadership of our government in general; •The construction of the NRG power plant; •The expansion of the Carlsbad Desalination Plant; •The development of Ponto Beach; •The build out of Bressi Ranch; •Completing the projects zoned in Proposition D; •Trenching the railroad tracks through the Village; •Attracting new business to Carlsbad (higher education institutions, clean technology companies, and corporate headquarter relocations for example); •Retaining Carlsbad’s largest employers (ViaSat, Callaway Golf, and Thermo Fisher for example). The Carlsbad Chamber of Commerce is taking every step to stay involved at the forefront of these issues and the Quality of Life Task Force is starting with a lot of positive elements out the gate. It is comprised of a good balance of small, medium, and large employers who are not afraid to speak their mind and get things done. The excellent relationship the Chamber has with the city staff and elected officials will allow us all to work together toward the common good. The employers who are on the task force understand that the welfare of their employees is equally as important as the welfare of their business. The businesses on the task force are motivated to stay and grow in Carlsbad, and can effectively communicate how their needs align with the local economy, environment, and overall quality of life. As my primary focus this year is geared toward “listening to our members” I am very excited that this Quality of Life Task Force is doing just that, with a view toward the future. Visit Us Nordson Corp. cut the ribbon on a new 93,000-square-foot manufacturing facility in the City of Carlsbad in March, indicating that they plan to retain and expand operations in the city and region. The new Nordson facility will employ more than 500 people in advanced manufacturing systems, building upon the company’s presence in Vista and Carlsbad. Nordson’s Carlsbad campus is home to several businesses in the company’s Advanced Technology group, including Nordson ASYMTEK, DAGE, YESTECH, Matrix and MARCH. The new facility on Loker Avenue will house manufacturing, demonstration labs and factory support staff. Nordson is a global company that designs and makes a full line of equipment used to manufacture many devices that people use every day, such as computers, mobile phones, game systems, medical instruments, automotive electronics and aerospace products. The firm operates in more than 30 countries and employs 6,000 people around the world. It is a high priority for the City of Carlsbad to retain firms like Nordson, which provide quality, high-paying jobs in the increasing industry of advanced manufacturing. The city helped to uncover specific site issues, talent programs, Nordson provides high-paying jobs in Carlsbad’s increasing advanced manufacturing industry. Its new location employs more than 500 local residents along the 78 Corridor. Nordson was one of the firms that the City of Carlsbad had in mind when it joined MiraCosta College to bring the school’s Technology Career Institute to a city-owned building in the Carlsbad Research Center. Several firms expressed to the city’s economic development team that they need highly skilled technical workers to help them stay and expand in the region. Business retention is one of the city’s goals, so the city worked with MiraCosta to provide a building at below market rate where the college could expand its Technology Career Institute. The building also houses the San Diego North Small Business Development Center, which provides programs for small businesses “Nordson was one of the many companies expressing support for Carlsbad’s MiraCosta Technology Career Institute for accelerated certificate programs for machinists and technicians,” said Carlsbad Mayor Matt Hall at the ribbon cutting ceremony on March 22. “MiraCosta trains skilled workers for industries like Nordson in high-tech manufacturing, maritime technology and biotech manufacturing. This provides a pipeline of talent to our businesses and assists business expansion programs.” Carlsbad’s industry clusters, which include action sports manufacturing, life sciences, information and communications technology, and cleantech, need skilled engineers. To fill that need, the city has a goal of attracting an institute of higher learning that would offer a master’s program in engineering. The city is in regular conversations with representatives of higher education institutions to achieve that goal. Building partnerships for talent development is a key to keep our economy thriving. We have to consider the impact beyond Carlsbad and leverage partnerships that enable the region’s success. Two years ago, Carlsbad joined neighbor cities along state Route 78 — Escondido, Oceanside, San Marcos and Vista — in a collaborative effort to retain businesses along the 78 Corridor, rather than risk losing them. This effort, called Innovate78, was instrumental in helping Nordson expand in Carlsbad. In addition, the San Diego Regional Economic Development Corp. was instrumental in leveraging regional assets to ensure Nordson was connected to local and state resources. The EDC is also the organization that is contracted to manage Innovate78, so the synergies were consistent throughout all efforts from a local, regional and state level. But you might not realize that some of the lessons you learn on the links can carry over to other areas of your life – such as retirement planning. So whether you’re already retired or are planning to retire in the next few years, consider the following suggestions: Try to overcome the “yips” When you miss those short puts – the ones you know you should be making – you might be in the grip of your old friend, the “yips.” As you know, it’s not always easy to shake this problem, but many golfers have benefited by working to improve their concentration, especially by adhering to a strict pre-shot and in-shot step-by-step routine. The answer for well-over 95% of those reading this is ‘no’ (and I’m being generous). I challenge you to change that and create and maintain a written strategy with a professional financial advisor. Partnership to establish binational hospital Scripps Health and Sistemas Medicos Nacionales S.A. de C.V. (SIMNSA) recently announced they are partnering to build a hospital in Tijuana aimed at serving the health care needs of the growing binational community along the U.S. - Mexico border. Scripps will provide consultative services to SIMNSA for the hospital’s planning, construction and operation, which SIMNSA will design, build and manage to achieve the standards of the Joint Commission International Accreditation (JCI). The JCIaccredited hospital will be co-branded as an affiliate of the Scripps Health Network as part of the arrangement. This marks the first binational collaboration on a hospital built to serve patients from both sides of the border. “We live in a binational region where thousands of people cross the border between San Diego and Tijuana daily for work. Technical education courses can boost wages Some people come to MiraCosta College to earn a degree. Others come here because of our success in sending students to top four-year colleges and universities throughout the nation. And today, more and more people are enrolling at MiraCosta College for yet another reason: state-of-the-art career and technical courses that can help them embark into a new profession or build the skills needed to stay current on advances at their current jobs. In fact, a new state study shows that students who take career technical education courses at a community college to add to their job skills will see a median gain of 13.6 percent in their pay – or $4,300 annually. Yet, for too long, students who attend community colleges for classes to improve their professional skills have not been counted as successes in state and federal accountability systems because they did not earn a certificate or transfer to a four-year university. Thanks in large part to the California Community College’s Strong Workforce Task Force, which I was honored to chair, that outdated view is changing. A new category to define these students, who are dubbed ‘skills builders’, is being added to the California Community Colleges’ Student Success Scorecard, HIGHER LEARNING DR. SUNITA (“SUNNY”) COOKE Superintendent/President MIRACOSTA COLLEGE an online tool allowing anyone to track the effectiveness of all 113 community colleges in the state. Skills builders include students who tend to be older and take just one or two career technical education courses. Many of these students have already earned degrees or certificates. And in 2012-13, some 86,000 students falling into the skills builders cohort saw a median wage gain of nearly 14 percent, of $4,300, from the period one year prior to taking a career educational course and one year after finishing the course. At MiraCosta College, those taking skills building courses in child development administration and management realized a median gain of 32.6 percent in pay. Those taking skills building courses in hospitality saw a median gain of 18.2 percent in pay. And those taking skills building courses in medical office technology saw a median gain of 12.5 percent in pay. Altogether, skills builders realized a $500 million boost in wages statewide. “These students come to us seeking to keep their skills current or move ahead in their careers and after finishing a few courses reap significant rewards,” said California Community Colleges Chancellor Brice Harris. “We finally have a way to measure these successes and demonstrate the tremendous return on investment that these courses provide.” California Community Colleges lead the nation in providing postsecondary career technical education and training. And at MiraCosta College, where we celebrated the opening last spring of a new Technology Career Institute in a city-owned building in Carlsbad, we are helping growing numbers of displaced workers to get training in areas ranging from high-tech manufacturing to maritime technology. Jesus, who participated in the CHS Virtual Enterprise program and plans to study Business Logistics in college, says, “Yes, that would be a good fit for me. I could raise a family.” Davina, another CHS student, had a “future identity” as a marketing account manager, making $3,400 per month. “Oh no, I have to rebudget. I spent too much!” she reports. Jesus and Davina are two of over 200 students in AVID (Advancement Through Individual Determination) programs from Carlsbad High School and Sage Creek High School, and Financial Algebra students from Carlsbad Village Academy who participated in the JA Finance Park program in March. AVID teachers Lauri Britton, Jeff Spanier, Rachel Newman, Aida Salah, and Linda Payne organized the experience which was generously funded by the Carlsbad Educational Foundation. The students begin with classroom lessons on income, savings, investing, risk management, debit and credit cards, and budgeting. Then they attended an all-day field trip to the JA Finance Park. Arriving in the JA Situation Room, they are handed a tablet and assigned their new “future identity” age, family situation, salary, and job. JA staff provide an overview on how to build successful careers by getting the necessary education and training, and by developing the character, work ethic, and out-of-thebox thinking skills needed in every industry. Next, the students are turned loose in the simulation rooms to build a budget for their “future identity” by exploring and interacting with information stations for a multitude of real-life necessities such as housing, utilities, and insurance. They might buy a car, deal with unforeseen health costs, and pay educational expenses. At the end of the day, the students have a balanced spending plan in each of 19 categories so their expenses do not exceed their income. There is a one year implementation delay for companies employing 25 or fewer people. Fourteen states and several cities began 2016 with minimum wage increases, typically phasing in raises that will ultimately take them to between $10 and $15 an hour. The Carlsbad Chamber of Commerce strongly opposed SB 3. One of our underlying missions is to examine the impact legislation such as SB 3 would have on business in our community. In order to comply with the legislation, many small businesses will be forced to consider cutting their employee’s hours, letting them go or some may even have to shut their doors. SB 3 was rushed through the legislative process to undercut the ability for small businesses to voice their strong opposition. The Carlsbad Chamber of Commerce wants to thank the many businesses that answered our call to advocacy. We would also like to thank the legislators representing Carlsbad including: Assemblyman Rocky Chávez and Senator Patricia Bates. CHANGES TO SALARY REQUIREMENTS Under California law, an employee cannot meet the commonly used administrative, executive or professional exemptions from overtime unless the employee earns a minimum monthly salary of no less than two times the state minimum wage for full-time employment, in addition to meeting all other legal requirements for the exemption. Under SB 3, that amount in January 2022 will rise from the current annual salary of $41,600 to at least $62,400, which is an increased cost to employers of $20,800 per exempt employee. Employers should be mindful of the effect of the minimum wage increase on exempt/ nonexempt classifications and ensure that employees meet the salary basis test for the particular exemption claimed. Dove Library closes for $6.3M renovation Construction is underway at Carlsbad’s Dove Library which is currently closed to allow for the remaining renovation work to be finished on the 16-year-old complex. The library is scheduled to reopen at the end of June. The full closure of the library comes after it partially closed in February to begin preliminary construction work. The Ruby G. Schulman Auditorium will be remodeled to improve accessibility and enhance visibility of the stage. The auditorium’s video production and other audio-visual equipment will be upgraded to digital technology.
