BIM – The Legal Landscape
The potential of building information modeling (BIM) is now being realised in the
Australian construction, infrastructure and mining industries. BIM is now regularly
deployed on projects throughout Australia and it may only be a matter of time
before Australia follows the UK and the US and its use is mandated on government
projects. While there are compelling advantages to the use of BIM, it also comes with
significant legal and regulatory risks.
The use of BIM can alter the legal landscape at all levels of project participation. This
seminar will cover a broad range of areas that are affected in a BIM driven project,
with particular reference to;



the legal risks associated with implementing a BIM including indemnities,
intellectual property, insurance and confidentiality;
procurement methods and BIM;
the need for protocols, definitions and standards for the implementation of
BIM, amongst other topics.
Our speakers:
Nick Crennan, CBP, is a partner in the construction and engineering group.
He advises and acts for businesses and professionals involved in projects. His
expertise is in helping clients prevent or manage difficult issues arising in
their businesses and practices, and, if they do arise, developing and
executing strategies to resolve them.
Lindsay Prehn, CBP, is a senior associate in the construction and engineering
team. She has experience in the construction, engineering, infrastructure
and mining industries. Lindsay assists her clients in all forms of dispute
resolution including arbitration, expert determination, mediation and
litigation. She also provides advice on contractual interpretation issues,
contractual compliance, matters of contract administration and preparation
of construction documentation and related commercial agreements.
Lindsay was admitted as a solicitor in NSW in 2002.
Andrew Miller, AECOM, is an Engineer with over 15 years’ experience in
both the digital creation and physical construction of engineering
information. His experience has been gained from the full range of projectlifecycle phases and at major projects in both Europe and Australia.
Almost 9 years of Andrew’s career was spent working for the Leighton Group
company Thiess in managing digital design data in the pursuit of improved
utilisation for construction project stakeholders. His key achievements in this
regard were realised at the Victorian Desalination, Airport Link Tunnel,
Westgate Freeway Upgrade and 400 George St projects.
