Independent Electoral Commission Decision upon Kayode Fatoba KF05 Complainant : Tejdeep Grewal, Marija Jovanovic, Blossom Malhan Respondent : Kayode Fatoba Issues : Postering in the Starbucks Patio, Outside Shell House. Decision : $10 fine payable to the SFSS foodbank Appeal outcome : Reduction of fine to $7.50 Reasons [1] On March 13th, and 14th, the IEC received complaints about Kayode Fatoba Posters being placed outside the Starbucks, in the area utilized as a patio. Another poster was also reported outside Shell House in the Student Residences. [2] As per the Candidate Handbook Page 12, Permissible Locations Campaign Materials may not be posted anywhere that is exposed to rain. Campaign Materials may not be posted in Private Businesses. Campaign Materials may not be posted in the Student Residences. [3] The IEC decided that a 10$ fine payable to the SFSS food bank would be appropriate. [4] On March 19, Kayode requested a hearing which was held on March 20 at 11:30 a.m. [5] Kayode was in full agreement about the Shell house poster. He objected to the Starbucks infraction on the basis that he had intentionally placed the poster where the tree would provide some cover from the rain. Moreover, he had asked Starbucks if they considered the planter part of their private property. [6] CEO Sanchez felt that the tree was an inadequate excuse to provide cover from rain as it provided inadequate cover and was permeable. [7] After the hearing, Commissioners Chu, Shepherd, and Turdeanu deliberated on the matter, while CEO Sanchez recorded minutes of the proceeding. The three commissioners agreed that as the planter was not part of Starbucks the fine could be proportionally reduced by $2.50.
