Attacking the previous UPA Government, Modi said one more year to that Government would have “sunk” the country and that now there were no stories of a scam involving “son-in-law or a son” of a political leader happening. “Some people are very troubled these days. Their trouble is with the fact that ‘achche din’ has come to all people but ‘bure din’ for them. Those whose ‘bure din’ have come, they are troubled. They are shouting. Because for 60 years, in Delhi’s political corridors, only their voice was heard and the country was run as they wished… “I did not give guarantee of ‘achche din’ for those who looted the nation for years. We will run the country in a way that there will be more ‘bure din’ for them and their troubles will increase. Your money can’t be looted by anyone,” the Prime Minister said at a public rally here at the birth place of Deen Dayal Upadhyay, a BJP ideologue. BJP has planned nearly 200 public rallies by its main leaders across to mark the first year of the NDA Government. However, Modi, who made a very pro-farmer and pro-poor pitch during his hour-long speech, did not mention the contentious land acquisition bill, on which his Government is facing tough opposition even from NDA allies. Noting that thoughts of three leaders “shaped us in the last several years – those of Mahatma Gandhi ji, Lohia ji and Deendayal ji”, the Prime Minister said he See MODI on page 11 Militants strike twice in Kashmir; soldier among three killed SRINAGAR, May 25 Three persons, including a soldier and a militant, were killed and two people were injured today as ultras targeted an army patrol and a franchise of BSNL at two places in Kashmir, police said. Militants opened fire at an army patrol at Kanjikulla in Yaripora area of south Kashmir’s Kulgam district, about 80 kms from here, a police officer said. Sepoy Dharam Ram was injured in the firing and succumbed later, the officer said. Security forces immediately cordoned off the area and tracked down a militant to an orchard where he was killed in a brief gunfight, the police officer said. Earlier in the day, militants fired at a franchisee outlet of BSNL at Iqbal Market in Sopore in north Kashmir Baramulla district, 52 kms from here. The attack was apparently directed at telecom oper- ators who have been threatened earlier, a police officer said. "The status quo on Article 370 will be maintained. .... This is a constitutional matter and any kind of change in it cannot be brought in the Parliament," BJP's national spokesperson MJ Akbar told reporters here. Akbar said this while responding to a question on Prime Minister Narendra Modi's stand on Article 370 in the light of recent statements by some BJP leaders that it will be abrogated when the party gets two-third majority in the Parliament, during a media workshop for state spokespersons of his party. "The Chinese side holds a consistent and clear position on the eastern section of the China-India boundary," Foreign Ministry spokesperson Hua Chunying said, reaffirming Beijing's claims on Arunachal Pradesh, which it says is a part of 'Southern Tibet'. "The Chinese government does not recognise 'the McMahon Line', which is illegal," she said, reacting to National Security Advisor (NSA) Ajit Doval's remarks made at the K F Rustamji lecture in New Delhi recently. "The Chinese side is ready to work with the Indian side to resolve the boundary question through friendly consultation at an early date and create more favourable conditions for the development of the bilateral relations," she said in a written response to a PTI query. In his address on May 22, Doval said settlement of the border issue is "critical" for India-China ties and called for a "larger plan" for "tackling" that country to resolve all ticklish matters. Doval, also the Special Representative of the Sino-India boundary talks, said while ties with China are looking up, "we are particularly concerned about the Eastern sector where the claims have been made on Tawang (in Arunachal Pradesh) which is totally in contravention of accepted principles". He also expressed surprise that while McMahon Line was agreed till Burma (Myanmar) by China, it was not accepted beyond it. She said positive trend has been seen in the recent results as number of top positions has gone to government schools and all out efforts have to be made by the teaching fraternity to improve the performance of government schools. Over 35 positions have been from the govern- ment schools and this benchmark has to be improved in the coming years, she added. “Government schools have good human resource and infrastructure and need of the hour is to motivate and reorient the working so that these institutions become hub of good education,” she added. She said teacher has to play the role of mother and each student needs to be handled with proper care and attention so that Jammu, May 25: The Directorate of Health Services Kashmir has directed all its subordinate offices including Chief Medical Officers and Medical (CMO’s) Superintendents of District and Sub–District Hospitals to ensure that hospitals and various other health institutions are made ‘Tobacco free premises’. The move is aimed at strengthening the public health measure at the district and sub-district level to achieve the status of ‘Tobacco free Kashmir’. The order issued asks officials to–identify nodal officer from Health Institutions, Display ‘Tobacco Free premises’ board at the entrance of the boundary wall, display of nonsmoking signage’s along with the name and contact details of nodal officer within the building at entrance, reception, prominent places of every floor, staircase, lift and other important places. The order also directed officials for ensuring ban on the sale of tobacco products within 100 meters of all buildings or premises under health department to promote tobacco cessation services within the dispensary and hospitals and extend tobacco cessation services of neighbourhood community premises and to ensure no-smoking and tobacco free status within the premises. Pertinently, the Cigarettes and Other Tobacco Products Act (COTPA) enacted in the year 2003 and applicable to the entire country was aimed to discourage the consumption of tobacco products through progressive restrictions and to protect nonsmokers from passive smoking. Notably, the Jammu and Kashmir Police is already booking people who are found violating the provisions of COTPA. Many States have taken effective steps for implementing COTPA. He asked the teaching community to guide students to pursue career oriented vocational courses so that students after completing their degrees do not add to the number of unemployed, but become real entrepreneurs. This was stated by the Minister today during his visit to Government College for Women, Nawakadal, to review the functioning of the educational institution. He called for strengthening the infrastructure and rejuvenating the academic process in the institute. Stressing upon the need to tap human re- source into value assets of the State, Akhtar said with changing market needs the demand for skilled manpower has increased, adding that courses to be taught in educational institutions need to be technical and divergent enough to help students develop entrepreneurial skills. He asked the college authorities to formally introduce vocational course on Papier Machie from this session and asked the concerned to immediately arrange an expert for the same on academic arrangement basis. The Minister said that in order to develop entrepreneurial skills in the students and to provide them on the job training, a course on ‘Boutique Technology’ should be formalised and a boutique should be set up in the College. He said that a buy–back mechanism for the same could also be developed. He further said that such a set up will also help develop marketing skills and salesmanship among the students. Referring to courses under Home-Science stream, Akhtar said in order to prepare students gain hands on experience and to create a space for themselves in the market a ‘Diet Restaurant’ may also be started by the college students on similar lines. He said an arrangement with the Institute for Hotel Management (IHM), Rajbagh would also be made to provide help to students in such an initiative. The Minister appreciated the ‘Education Outreach Programme’ initiated by the College on his instructions, to provide academic help and guidance for all those students who do not have any academic guidance at home, through after-school extra classes. He said that such an initiative should be given wider publicity so that more and more people are aware of and could take benefit from such an initiative. The Minister also asked the Principal of the College to adopt one or two schools from the vicinity, in order to provide academic guidance and handholding to them. On the occasion, the Minister was also briefed on the repair and renovation work of damage occurred to the college infrastructure during September-2014 floods, and the status of the new academic block coming up in the college premises. The Minister said that the Enforcement Wing will start functioning immediately and launch a massive drive to remove all the illegal structures raised along the highways and roads. He said this is being done to facilitate smooth traffic move- ment as encroachments have become a major contributor to traffic congestion especially in Srinagar and other major towns on the State. The Minister also ordered that no work should be taken-up without inviting tenders and warned stern action against those found violating the instructions. “No road project should be taken up and framed without provisions of drainage system,” said the Minister, adding that concerned engineer will be penalized for negligence, if any, on this count. The Minister was reviewing the status of road projects of Inauguration of ATF Homshalibugh, Shangus and Pahalgam constituencies at an officers meeting here today. During her visit, the Minister was informed by the hospital authorities that the injured boy was operated by the specialists of the college successfully. Dr Jitendra Singh took this decision in response to a representation submitted by 11 MLAs from Arunachal Pradesh who alleged that the State Government of Arunachal Pradesh was responsible for misuse and misappropriation of Government of India funds released against projects sanctioned during 2011-12 to 2014-15. Accordingly, Dr Jitendra directed Secretary, Singh Ministry of Development of North-Eastern Region (DoNER) to immediately collect all the relevant information related to these projects and institute an inquiry into the status and progress of these projects. After compilation of the details and examination of the issues raised by the MLAs, comments may be sought from the State Government before deciding further course of action. Surveys say Modi government is still popular, though not as popular as A survey poll stated that nearly 20 percent of the respondents said that the government's performance has been 'very good'. But the number of those who said that the government's performance had been 'somewhat good' made up for almost half the responses. A total of 66 percent respondents were satisfied with the government's performance. However, the poll said that even though the number of respondents calling the Modi sarkar's performance 'somewhat good' had not changed since a similar poll done in Decemeber-end, the number of those calling it 'very good' had reduced from more than one-fourth to a little less than one-fifth now. Statements like those made by Sakshi Maharaj, Sadhvi Niranjan Jyoti and Giriraj Singh has clearly dented the government's image as the PM's inability to rein in loose-talking ministers was regarded as Modi's biggest blunder. This effect was compounded by the controversy over the land acquisition bill, the nameembossed bandhgala suit Modi wore during Obama's visit to India and the 'mishandling' of Parliament, according to the poll. Even though government's performance with respect to job creation had been rated the lowest, with only 43 percent satisfied with it, the IBN survey said that 62 percent of its respondents felt that jobs have either gone up or have remained the same. The IBN poll said that over 72 percent were satisfied with the Modi government's performance. 56 percent felt that Modi is effective as a Prime Minister. Over 60 percent respondents felt that India's economic situation has improved and 55 percent said that corruption has either reduced or remained the same. An overwhelming 85 percent of the respondents said that the Swachh Bharat Abhiyan was the government's best initiative while 76 percent felt Jan Dhan Yojana was the second best. Make in India and Digital India initiatives were also popular among the people, according to the poll. However, the poll added that while just 35 percent supported the land bill, an almost equal number was undecided on the bill while only 28 percent supported the bill. A surprising conclusion made by the poll was that despite PM Modi's regular tweeting and reaching out to the public through his rallies, only 20 percent felt that Modi effectively communicated through social media and a mere 17 percent felt Modi's rallies made a substantial impact. Modi's inability to make a mark on social media was also portrayed by the India Today Group-Cicero snap poll, which said that "the noise over online trends and hashtags notwithstanding, 72 percent do not follow him (Modi) on social media." 56 percent respondents had not even heard of Modi's 'Mann ki Baat' radio programme. Although 56 percent of the respondents in the India Today poll felt that the government's performance had been good, the poll added that 33 percent felt Modi should be the Prime Minister, down from 57 percent in August 2014. 43 percent of the respondents felt that Rahul Gandhi was right in calling the Modi government a "suit buit ki sarkar". 11 percent felt Rahul Gandhi should be the PM, up from 6 percent in August. Over 30 percent said Rahul was the best performing Opposition leader and the biggesst challenger to Modi. However, the poll also said that Modi's pro-poor image had improved, with 23 percent respondents saying he was working for the poor, compared to only 16 percent feeling this way during another poll conducted in March. The poll also said that the BJP's vote share had gone up. ABP News-Nielsen's latest opinion poll also said that NDA's vote share had risen to 41 percent from 39 percent in 2014. However, it also said that NDA would win 317 seats if general elections were held now, down from the 336 seats which NDA won during the Lok Sabha polls last year. Giving the Modi government 7 out of 10 for its first year's performance, Assocham on Sunday had said it still needs to cover some ground on tax issues and a lot more needs to be done on improving ease of doing business. The industry body had said the country's macro-economic situation has improved in the past one year with decline in inflation, stability in currency and attractive financial markets. "However, the NDA government has to cover some ground in terms of taxation issues, particularly with regard to FIIs' problems on retrospective liabilities and in taking big-ticket infrastructure projects off the ground," the chamber had said in a statement. A JAMMU TUESDAY MAY 26, 2015, PAGE 6 Pushing the envelope in foreign policy BY : SRINATH RAGHAVAN arendra Modi’s foreign policy has been continuous with that of his predecessors but he has also sought to push the boundaries of certain engagements much further. Foreign policy is all about securing permanent interests. As such, it may be best judged in the long run. Nevertheless, since foreign policy has been so prominent during the government’s first year in office, an interim assessment may be useful. What are the areas of continuity and change, the successes and blind spots? Since the early 1990s, the overarching goal of our foreign policy has been a stable and conducive external environment for India’s internal economic transformation and a larger international profile. Towards these ends, successive governments have sought simultaneously to preserve India’s key security interests and to deepen its ties with the global economy. From this standpoint, Prime Minister Modi’s foreign policy has been continuous with that of his predecessors. Yet, Mr. Modi has also sought to push the boundaries of certain engagements much further. This is not just a question giving a fresh vim to foreign policy, although the vigour is palpable. THE U.S. AND CHINA Consider his approach to dealing with the two most important powers: the United States and China. For over two decades now, every Indian government has tried to impart more substance to relations with these countries. Even as New Delhi has moved steadily to forge strategic ties with Washington, it has sought to place its relations with Beijing on an even keel. However, Mr. Modi has been exceptionally clear in articulating India’s interests and trying to leverage the relationship with the U.S. and China. Thus, during U.S. President Barack Obama’s visit to India in January 2015, India issued a separate joint statement on security in the Asia-Pacific and Indian Ocean. And on Mr. Modi’s trip to China this month, a separate joint statement N was issued on climate change in the light of the upcoming conference in Paris. In both cases, there may be a gap between rhetoric and reality. Still, Mr. Modi is clearly attempting to push the envelope and advance India’s interests without making binary choices in its engagement with these countries. IN SOUTH ASIA Closer home, he has consistently outlined a vision of shared prosperity for South Asia and has credibly projected Indian leadership in the region. His visits to Nepal, in August 2014, and Sri Lanka, in March 2015, have gone a long way in helping reset relations with both these countries. Similarly, his decision to abandon the Bharatiya Janata Party’s stance and ratify the Land Border Agreement with Bangladesh has given a shot in arm to the bilateral relationship. Yet, the real challenges lie ahead of him. The earthquake in Nepal will certainly delay and may even complicate the arduous task of drawing up an agreed constitution. India will not only have to prepare for longer-term assistance in reconstruction, but will also have to engage Nepalese parties more proactively to prevent the political process from drifting. In Sri Lanka, the present government has rolled back the worst features of the presidential system. It has also moved to return the land acquired by the security forces, including in the Tamil areas. But it remains to be seen if Sri Lankan President Maithripala Sirisena is open to a political settlement with the Tamils. After all, his own base includes a slice of the Sinhala chauvinists. In any event, the Tamil question remains a potentially thorny issue in bilateral relations. Colombo’s relationship with Beijing is another sensitive area. On campaign trail, Mr. Sirisena had spoken out against his predecessor, Mahinda Rajapaksa’s tilt towards China. In office, he has struck a more equivocal note. This is hardly surprising given China’s economic importance to Sri Lanka ties that will deepen further with China’s plans for a maritime silk route. During his forthcoming trip to Dhaka, in the first week of June, Mr. Modi will undoubtedly seek to capitalise on the boundary agreement. Bangladesh also seems open to improve transportation and transit links with India. So far, New Delhi’s inability to deliver on an agreement on Teesta river waters had led Dhaka to hold back on transit arrangements. It is unlikely that Bangladesh Prime Minister Sheikh Hasina will execute a complete volte-face and fall in with India’s requirements. Yet, growing international pressure on her government may make her more amenable to Indian interests. New Delhi has done well to stand by Ms. Hasina in the face of the ongoing onslaught by the Islamists. Yet India must also be mindful of the problem of being identified solely with the Awami League. A stable two-party democracy in Bangladesh is in India’s long-term interests. THE PAKISTAN QUESTION As ever, the sharpest challenge for India’s regional ambitions comes from Pakistan. Despite getting off to a good start with Prime Minister Nawaz Sharif, Mr. Modi has been unable to craft a coherent and consistent approach to dealing with Pakistan. Like his predecessors, he has swung from engagement to disengagement — only to be forced to pick up the diplomatic pieces and return to the table. There is something curious about India’s policy towards Pakistan, which consists of doing the same thing over and over again and expecting a different result. Mr. Modi has to break this mould. Diplomatic engagement should not be seen as a reward for Pakistan’s good behaviour. The symbolism of diplomacy should be reduced — even if substantive progress remains tough to achieve. The current impasse with Pakistan also impinges on our ties with Afghanistan. Here, Mr. Modi faces a situation that has turned rather unfavourable from New Delhi’s perspective. Afghanistan President Ashraf Ghani’s attempt to cosy up to Pakistan has led to an inevitable downgrading of ties with Year of hope after six decades of despair BY : BALBIR PUNJ n January 2014, at the most famous annual high table of global entrepreneurs in Davos, India could gain only a small table. “The India Story was over”, they said. Many Indian industrialists had sensed the mood earlier and did not turn up at the Swiss resort town. Between May 2014 and now, there has been a rush of world leaders to New Delhi — Prime Ministers, Presidents, Foreign and Defence Ministers et al. Every major country that counts has sought an appointment with India. What has made this difference? How did India move from despair to discernment within so short a time? The dramatic change in the situation has been brought about by an abroad that 1.2 billion people, with a two trillion dollar economy, a $350 billion foreign exchange reserve, and plans to invest a trillion dollar in the next five years in various infrastructure projects, are back in action. Also, instead of a dummy Prime Minister at the helm, the Government is now headed by a real leader, with a strong majority in Parliament. Globally, leaders of most Governments that count have already showed, with their enthusiastic visits and statements, that there is a new India that has emerged over the last 12 months. This is the result of a Government that is determined to get things done with lighting speed. For the first time, inflation, that was hovering near double digits for years, is decelerating. The Indian economy is finally in a recovery mode. Economic growth has improved from less than five per cent to more than seven per cent. The fiscal deficit is down to four per cent and revenue deficit rests at 2.8 per cent. Power output is up by 22,566 MW as against an uncertain addition of 17,830 MW the previous year. There is a large-scale thrust for solar power and a push for nuclear power reactors with a single complex alone pegged at near 10,000 MW. The infrastructure push is also remarkable by any standard. Look at the bold five-time jump in the target for solar energy: From 20,000 MW to 100,000 MW. Look at Indian Railways: From an enterprise that only 18 months ago had no money to pay for spare parts, it is now working for bullet trains, more freight corridors, new I Gujarat: a tale of two cities management institutions and large scale private investment in multiple commercial areas. A six lakh crore rupee investment is planned. No different is the story of the national highway programme. During the two terms of the previous Congress-led Government, the ‘progress’ was just two kilometers a day. Under the Modi Government, the National Highways Authority of India is doing 10km a day and plans are in place to move up to 30kms a day in the near future. In his election campaign, Prime Minister Narendra Modi had envisaged a new federal structure with the States as equal partners. It is the Union Government’s ability to establish this new federalism that is partly responsible for the States participating in the implementation of highway projects. The same new federalism has also been at the core of this Government’s success in bringing the goods and services tax. These successes expose the defeated and disoriented Congress’s efforts to delay the NDA’s fast track progress. The latter is using its strength in the Rajya Sabha to filibuster legislations and programmes. Filibuster is the Congress’s last resort to deny the people the Government that they had voted to power on the promise of fast tracking governance. The Congress is using its numbers in the Upper House to halt legislations on one pretext or the other. In some cases, the laws had actually been envisaged by the Congress itself. The Congress is also resorting to falsehoods to turn innocent farmers against the Government. It is instigating other sections, like industrial workers, to block much needed labour law reforms — many of which again have been under discussion for more than a decade, since the National Labour Commission envisaged these reforms. International organisations, like the International Monetary Fund and the World Bank, which had only 12 months ago repeatedly expressed doubts over India’s progress, given the state of policy paralysis it was in under the Manmohan Singh Government, are now boldly forecasting that the country will soon overtake China’s growth rate. The IMF and the World Bank are not the only ones to compliment a regime on the fast track. Industry has raised Rs56,801 crore in capital for new ventures and expansion compared to Rs29,381 crores in 2013-2014. Medium and small enterprises, which contribute about 45 per cent to the country’s export earnings, have new hope in the Micro Units Development and Refinance Agency bank. A Government determined to put the country on the road to high speed growth, must have the guts to take bold decisions and go against the culture of chalta hai attitudes within society and Government itself. The bureaucracy is on the alert with the Prime Minister taking regular updates and Secretaries getting the taste of his displeasure for lagging behind expectations. The same Prime Minister who is pushing the Government to be on the fast track, is also urging the bureaucracy not to hesitate in taking decisions. The recent effort to protect honest officers, from targeted attacks and primed accusations from those they may have displeased, in the discharge of their duties is a good example of a practical Prime Minister who expects the best from his officers and Ministers. Contrast that with the decision-making process under the UPA regime. There was no Government but every Ministry was a Government by itself. The weird arrangement led to multiple scams, resulting in huge losses to the exchequer. This has naturally led the Union Finance Minister, Mr Arun Jaitley, to underline that, “in one year, the Government under the leadership of Modi has erased the word corruption from the political dictionary of India”. The grime of the past 65 years, over 50 of which were under Congress rule, has put India behind a big country like China as well as a tiny city-state like Singapore. Why is India so far behind China that adopted free market policies while being run by a single party? Mr Modi’s one year in power has taken India to a discernment of hope after six decades of depression that the Nehru-Gandhis had bequeathed. confidant of Mr. Modi. “You will see, you will not even recognise the new India,” he said. (Kashmir is ours!)” Fireworks were set off throughout Ahmedabad that night but Juhapura was on police lockdown. In a recent study published by Charlotte Thomas of France’s Sciences Po University, she cites integration — both economic and social — as being one of the key challenges that Muslims in Gujarat face. Thomas spent six years visiting Juhapura and she has documented the struggles Muslims face in having loans sanctioned, getting school admissions, and even in filing complaints with the government. She concludes: “Although formally Muslim citizens have the same rights as their Hindu counterparts, in Ahmedabad and even more in Juhapura, their ethnicity disqualifies them from an effective form of citizenship.” (See: http://goo.gl/XZMR7u) J.S. Bandukwala, a retired physics professor and one of Gujarat’s most seasoned human rights activists from Vadodara, is not optimistic about the changes he has seen since Mr. Modi’s victory. In September last year, clashes between Muslims and Hindus erupted for nearly a week near his home, leading to two deaths and the arrest of over 150. He spoke about the growing influence of the Rashtriya Swayamsevak Sangh and the Vishwa Hindu Parishad (VHP) over Gujarati society. Ali Asgar Zaveri, a Muslim businessman, bought a house in an upperclass Hindu neighbourhood in Bhavnagar; in December, after his neighbours objected to his presence, Pravin Togadia of the VHP led a campaign and forced him to sell the house and move back to a Muslim area. The Gujarat Chief Minister’s attempt to distinguish herself from her predecessor by making women’s issues a priority hardly gets around the deep discrimination that Muslims in the State face in the form of communalism and a lack of housing. BY : ZAHIR JANMOHAMED n April 11, Gujarat Chief Minister Anandiben Patel visited Juhapura, a neighbourhood in the new west zone of Ahmedabad. The convoy of sports utility vehicles that was followed by police and media vehicles marked the first time that a Chief Minister was visiting the Muslim ghetto, whose population doubled after the 2002 riots. Two weeks prior to this, the Ahmedabad Municipal Corporation had announced its plans to demolish more than a hundred illegal buildings in what is the largest Muslim ghetto in the city. Demolitions and the consequent resistance by residents began in late March. Shabnam Sheikh, a 17-year-old girl living in Juhapura, sent a petition in the form of a single question to the Chief Minister. Her parents’ house was on the list of buildings to be demolished while her uncle’s house had been razed. Ms. Sheikh had heard rumours that Ms. Patel had planned to announce new projects to ensure the uplift of Muslim women and that she would reverse the Gujarat’s government earlier record of denying basic services like schools and roads to Juhapura. The girl wrote out her question on a sheet of paper and walked through a crowd of photographers and politicians, both from the ruling Bharatiya Janata Party and the Opposition Congress party, to reach Ms. Patel’s inner circle. Before she could speak to the Chief Minister, one of the staff members stopped Ms. Sheikh, grabbed the paper from her hand, and read it. It said: “If my father pays the ‘impact fee’, will you stop the demolition of our home?” He O tossed the sheet of paper aside and said, “No! No! The CM will not answer that. She is only here to talk about women’s issues.” After Ms. Patel went around Juhapura for about an hour and a half, she announced the government’s plans to build a school and a woman’s health centre, all of which left Ms. Sheikh unimpressed. “None of these promises will make a difference if we do not have a home,” she said. ‘IMPACT FEE’ AND JUHAPURA Weeks earlier, on a Saturday morning on March 28, Ms. Sheikh was watching television at home when bulldozers arrived. Being Ram Navami, the birthday of Ram, she was off from school. Her 14-year-old cousin, who lived a few buildings away, ran in frantically shouting about an “impact fee”, the first time Ms. Sheikh heard the phrase. Juhapura is an area with nearly five lakh residents, almost all of them Muslim. On the outskirts of Ahmedabad, it came under the city’s municipal government in 2007. Most of the area is still designated as prime agriculture land despite the fact that there is no farming done today within the boundaries of Ahmedabad. Juhapura is also the largest land area within city limits earmarked for sewage storage and treatment. Ms. Sheikh’s family moved to Ahmedabad from rural Gujarat five years ago. Unable to take a house on rent elsewhere in the city, they moved to Juhapura. Before the 2002 riots, Juhapura’s population was about half its size but has grown since. The Sheikhs knew that they could save money living in an illegal building, as the rent can be half of what it is for a legal building, an important consideration for a struggling carpenter like her father, Mansoor Sheikh. They hoped to gradually save and make their home legal. “The government is obliged to provide residents the option of paying the ‘impact fee’, a service which would start the legalisation process,” said Rizwan Kadri, an architect in Ahmedabad. This was not an option given to Juhapura residents like Ms. Sheikh’s relatives whose home was torn down. As the bulldozers began demolishing eight buildings in Juhapura, Mr. Sheikh had some questions for the city officials: “Why are you only doing this to Muslim buildings? Why are you making us pay taxes if you are not providing us with services?” HE GOT NO ANSWERS. Policemen carrying batons and tear gas canisters also surrounded Fatehawadi and arrested dozens of residents who resisted the demolitions. While Mr. Sheikh was in a mosque, his wife and children watched from their apartment. “They are breaking our backs,” he said. The controversial Fatehwadi site, across 84 acres, was acquired by the Ahmedabad Collector after the Ahmedabad Urban Development Authority (AUDA) planned a sewage treatment plant at the site. But after the 2002 riots, a number of Muslim families began migrating to the open plot from different areas of the city. In 2006, with the expansion of Municipal Corporation limits, the area came under its limits but the civic body saw that constructing a treatment plant would be impossible. On the day of Narendra Modi’s landslide victory as Prime Minister and leader of the Bharatiya Janata Party last May, I spoke with Bhushan Bhatt, a BJP legislator in Gujarat whose late father, Ashok Bhatt, was a India. Whether or not this yields results, India has to ensure that its interests in Afghanistan are not placed on the chopping block. China’s backing for reconciliation with the Taliban will further complicate India’s position on Afghanistan. Unless New Delhi adopts a clear strategy, Mr. Modi may well find himself presiding over a retrenchment in Indian engagement with Afghanistan. While the overall record in South Asia has been mixed, there has been a startling lack of focus on our extended neighbourhood to the west. Even as West Asia is roiled by a range of conflicts, the government has remained content with mounting rescue missions for Indians living in trouble spots. This policy will prove unsustainable if instability deepens and widens in West Asia: some seven million Indians live in the Gulf countries. India needs to position itself as a force for stability in the region, which in turn will require enormous diplomatic engagement. So far, the government has proved purblind on West Asia. Part of the problem is the persisting flaws in the institutional set-up on foreign policy and security. Despite considerable centralisation in the Prime Minister’s Office, the silos between various ministries seem intact. The lack of functional integration of expertise is evident in several areas. Think of the ill-considered decision to purchase 36 Rafale fighter jets. The Defence Minister is still unable to explain how the remaining 90 aircrafts will be procured — if at all. The inability to grasp the import of mega regional trade pacts being negotiated under American leadership is another case in point. The Ministry of Commerce has done little more than set up a company to invest in countries like Vietnam—hoping thereby to secure access to other markets if the TransPacific Partnership goes through. There is still no indication of a strategic response to attempts by leading industrial economies to change the rules of world trade. The government’s stance on Intellectual Property Rights in yet another example. A great opportunity lost BY : BHAMY V SHENOY uring its first year, the NDA government missed a golden opportunity to implement the much desired oil sector reform. Oil and gas sector is undoubtedly a critical sector of the economy. It has a huge impact on India’s sustainable development, energy security and on the country’s desired policy to contribute to solving climate change problem. Hopefully, even now it is not too late. International oil markets are relatively at a low level compared to the last four years. World benchmark Brent after staying above $100 per barrel during 2010-2013, fell below $50/b in the first quarter of 2015. That was the time when the NDA could have taken some hard decisions to reform the oil sector pricing. It is to the credit of the NDA that it totally liberalised diesel price from October 18, 2014. As in the case of petrol (liberalised from June, 2010), public sector oil companies now have the freedom to change it to reflect international oil market. As oil prices were falling, the NDA government boldly increased excise taxes to mop up additional revenues. One needs to admire the government for such bold steps. Unwisely, they had been reduced by the UPA when oil prices were high, purely for political reasons. For several sound reasons, excise taxes on diesel and petrol are kept high in most countries. They serve to reduce green house gases (GHG), and contribute to improving the financial position of the government to balance the budget. Petrol and diesel prices touched a low in the past 12 months owing to fall in international crude price. But they firmed up later. Since such unpopular decisions are made by the oil companies without the interference of the government, there has not been the usual protest by the opposition. Let us hope that unlike the UPA, when oil prices go up in the future, the NDA will not be tempted to control petrol and diesel again to the detriment of the economy. In December, 2014, the NDA announced a policy to scrap PDS kerosene to plug leakages and reduce corruption. It would have allowed kerosene to be sold at market prices. The poor would still be given subsidy through direct benefit transfer to reduce diversion. It is a mystery why the government backed down to take a historic step of liberalising kerosene, a commodity controlled since the World War II. Also at one stroke, the NDA would have eliminated the mother of all corruption. However, it is in the distribution of residential LPG where the NDA govt has completely failed to take a much desired decision of removing subsidy and liberalising LPG to reduce diversion, and to reduce subsidy burden. Studies have shown that the 20 per cent of the rich get 39 per cent subsidy and 50 per cent middle class get 47 per cent of LPG subsidy. In 201314, LPG subsidy burden was Rs 52,246 crore. Aware of this reality, the government had urged the well-to-do to voluntarily give up the subsidy. Only an insignificant number has so far done so. A bold policy of scrapping residential LPG would have showed the real desire of the NDA to reduce subsidy burden and to divert the resources generated for other sectors like education, health, water. The govt can still continue to assist those below the poverty line through DBT to plug the leakages. A BABY STEP In case of gas sector, the NDA government’s reform was at best a baby step. The gas formula suggested by the UPA was arbitrary, but it reflected the Indian market reality of LNG imports to meet the domestic demand. Criticising the UPA gas formula as generous, the NDA removed LNG prices and replaced them by unrelated Canadian and Russian gas prices. It looks as though the goal was only to reduce the resultant gas price. Instead of allowing the market place to discover the price, govt continued to control the price without realising how it will result in reduced exploration. At least one good thing they did was not to have multiple pricing or a postal stamp kind of pricing. The NDA also failed as a result of wrong gas pricing policy to promote shale gas exploration which has brought about dramatic changes in the US oil and gas sector, and is likely to do the same in China. The Vijay Kelkar committee submitted a report in September, 2014, outlining several recommendations to reduce oil and gas import dependency. If implemented in totality, India’s oil and gas import dependency would be only 39 per cent versus the 77 per cent under the business as usual scenario in 2030 and the current 62 per cent. Although officials were tight-lipped as to why the militants were targeting telecom installations, sources said the ultras were upset about “theft” of their communication equipment from mobile transmission towers in Sopore and surrounding areas earlier this month. The militants had allegedly installed communication equipment atop the towers of private and PSU companies. Later, police said the militant killed in the Kulgam encounter was identified as Ataullah Bhat alias ‘Khumani’ who was affiliated with Lashker-eToiba (LeT). Bhat was a resident of Chinigam village of Kulgam and was wanted in a number of militancy-related incidents, police said. Meanwhile, police in a statement said district commander of LeT was killed in an encounter in Yaripora area of South Kashmir’s Kulgam District. The militants fired upon an Army vehicle near Kanjikula, Yaripora, this afternoon resulting in injuries to an Army Jawan. During the search operation, the joint search party came under fire in an orchard, which was retaliated ensuing an encounter in which a militant was killed. Khoumaini was active since 2010 and was involved in various militant activities including killing of Sarpanch Gul Mohammad resident of Hawoora in 2012, killing and snatching of weapons from police and CRPF in Arwani and Awneera Shopian. As compared to this, Abetment to Suicide case Omar concerned about incidents of Pak flag waving New Delhi, May 25: Former Chief Minister Omar Abdullah has attacked the PDP-BJP coalition in Jammu and Kashmir expressing concern over the "regularity" with which Pakistani flag was being waved at separatist rallies and the "few nasty scraps" between the two parties which does not augur well. He describes the over two-month-old alliance between the two parties as "extremely uneasy" and says the gap between PDP and BJP on political positions will become "more glaring". "No, I don't think that things are as bad as that. We learnt some costly but very valuable lessons in 2010. Therefore, I don't perceive a summer of discomfort but it's not a comfortable situation where you have this sort of regularity with which Pakistani flags are being displayed," Omar told PTI here. "When these flags are waved, you end up with statements where BJP starts targeting the PDP and then the Chief Minister has to react and it is seen to have to react on the directions of the central government or the BJP....so this sort of regular display of Pakistani flags is troubling the state govern- ment and making difficult the life of the coalition and the understanding between the BJP and the PDP," he said. "Just like Ram Temple, BJP is befooling the people of this country on the issue of Article 370. Article 370 is the binding force between India and Jammu and Kashmir; it is a commit- ment that was signed between the Maharaja and the Indian government of that time," Congress spokesman Meem Afzal told reporters here today. He said that the abrogation of Article 370 was impossible and BJP would not be able to do it even if it secures two third majority in Parliament. BJP spokesman Sambit Patra had yesterday said that the issue of the abrogation of Article 370 continued to be part of the core ideology of BJP and the party would work towards its removal once it gets two third of majority in Parliament. "They will never get two third majority and even if they do they cannot be able to abrogate it. BJP sacrificed all its ideology and sat in the laps of PDP just to be in the power. "The party which once accused PDP of being sympathetic towards separatists has now joined hands with the same party to enjoy power," Afzal said. The former MP also said that Hurriyat Conference should fight elections to prove its relevance in Kashmir. Parliament Panel Urges Government to Provide Financial Assistance to JK CYM K SRINAGAR, May 25: Criticising the Union and the Jammu and Kashmir governments for "inadequate" relief to the last year's flood victims, a Parliamentary committee today said the Centre should give liberal financial assistance to the state to compensate the people. "We have discussed a number of issues, particularly the issue of relief of the people affected by the last year's floods. I must say that while the state government has informed us that it has done its best with the resources at its command, my own view, and that is the view of the members of the committee also, is that a lot more is required to be done. "The relief and compensation given so far is totally unacceptable, inadequate and it does not constitute the reasonable compensation... I and the committee are of the view that it is not enough," head of the 16- member Parliamentary Standing Committee on Science and Technology, Environment and Forests, Ashwani Kumar, told reporters here. Kumar said the central government should give liberal financial assistance as per the plans submitted by the state government to the Union government. "In our report, we intend to make a strong case for liberal financial assistance to the state of Jammu and Kashmir for the purpose of relief and rehabilitation and compensation to the commercial establishments and also for reconstruction of the houses. "There has been a suggestion that the business community, in order to kick-start their business, could be given loans on easy interest rates. "The other issue that we feel deserves immediate attention is deforestation. We have given specific examples in Ramban area of the scale at which the encroachments have taken place. "And the state government has confirmed that 13,300 hectares of land has been encroached upon in the state," he said. Kumar said the state government had informed the committee that they have succeeded in reclaiming some part of the encroached land. "That however is very minimum. I have asked them to give within one week an action plan on how they would prevent further encroachments," he said. He said the solid waste management in Srinagar and Jammu cities was an issue. "The discharge of sewage continues unabated into the lakes. Large scale constructions that block the water in chan- nels is an issue. They (government) said they have given a plan to have another flood channel, but that is a long-term plan. I have insisted for short-term measures which are absolutely imperative and cannot wait any longer. The de-silting and dredging of Jhelum has to continue on a war-footing," he said. He said the committee would submit its report to Prime Minister Narendra Modi for his immediate personal intervention. "We plan to submit our report within four weeks of our visit. We will send this report to Prime Minister for his immediate personal intervention. We believe that the state of Jammu and Kashmir, because of its unique geographical position, the political situation and its state of economic development, needs massive dose of financial assistance by the central government and the sooner that happens the better it would be," Kumar said. Justice Janak Raj Kotwal of J&K High Court Jammu Wing after hearing Sr. Adv BS Salathia for the petitioner whereas Adv Asee Sawheny for the private respondents observed that A ground for cancellation of Bail granted to respondent certainly is not made out and it can be said that no such ground even has been alleged. To say that one of the respondents being a judicial employee is influencing investigation, without explaining in what manner and how she exercised her influence, is too scanty to make out a ground for cancellation bail. Such a ground or any other ground sufficient to seek cancellation of the bail can well be raised by the investigating officer of the case. No case for cancellation of the bail, therefore, is made out. Court further observed that in regard to the legality and correctness of granting bail at initial stage, this Court having regard to the nature of allegations, am not persuaded to take a view that granting of bail was improper exercise of discretion by the learned Magistrate or that bail was against general public interest. Given the nature of allegations, ends of justice would be served by properly investigating the case and arriving at a wellconsidered conclusion by the investigating officer and not by keeping the respondents in custody during investigation. With these observations Court dismissed the petition. JNF DB held downgrading of ACR of an employee is illegal and cannot be acted upon Jammu, May 25: A Division Bench of State High Court Comprising Justice Mohammad Yaqoob Mir and Justice BS Walia after hearing Sr. Adv SS Lehar with Advs Meharban Singh and Aditya Sharma in a landmark judgment while allowing a petition filed by Ramesh Tiwari and Ors, held that downgrading of ACR (Annual Confidential Report) of an employee from Good to Average that too without giving any reason is illegal and such ACR cannot be acted upon. This landmark judgment has been passed in a petition challenging the order of Central Administrative Tribunal on the ground that the Central Administrative Tribunal instead of deciding the matter itself, directed the petitioner to file a representation. According to the case of the petitioner was that Reporting Officer has reported Good grading for the year 2002, 2003 and 2004 but the reviewing officer, while agreeing with the remarks of reporting officer reviewed the same to be Average but never communicate to the petitioner. Sr. Adv SS Lehar assisted by Advocates Advs Meharban Singh and Aditya Sharma submitted before the Court that the petitioner, whoc was working as Marketing Officer was given the benefit of ACP with effect from August 28, 2005 but he could not be given the same as his ACRs were reduced from Good to Average without assigning any reason. He further submitted that this was done t the back of the petitioner who was not given any opportunity of being heard. According to the ACP scheme, the employee must have three Good ACRs in the five preceding years and these two ACRs were reduced from Good to Average, so they have toe be treated as Good and the petitioner has to be given benefit of ACP. Division Bench while allowing the petition held that downgrading of ACRs, that too after agreeing with the report of reporting officer, is illegal and such ACRs cannot be acted upon and Division Bench further directed that such ACRs are treated to be Good and the petitioner is entitled for all the benefits including the arrears and other consequential benefits.
