Da wir Ihnen gerne turniererfahrene Pferde auf unserer
IV. Springpferde-Auktion anbieten möchten, werden die
Auktionspferde mehrfach an Turnieren teilnehmen, wie
den Youngsterprüfungen auf den CSI* und CSI** in Eschweiler
und Lanaken. Eine zusätzliche Präsentation der Auktionspferde
findet zum Wohl der jungen Pferde nicht statt.

Jumpinghorse-Auction, the auctionhorses will go to numerous shows,
and participate in competitions like the Youngstertests at the CSI* and
CSI** in Eschweiler and Lanaken. An additional presentation of the
auctionhorses will not take place for the benefit of the young horses.

Masterplan – Der Erfolg gibt uns Recht.
Zielgerichtete Ausbildung für Reiter und Pferd.
2014 war für uns ein überaus erfolgreiches
Jahr. So haben sich unsere Pferde sehr positiv entwickelt und sind nun top-ausgebildet
für den großen Sport. Auch haben wir junge,
talentierte Reiter gefördert, die mit unseren
Pferden Erfolge auf internationalen Turnieren
bis zum CSI**** sammelten. Mit viel Zeit, Geduld und Erfahrung konnten die Paare zusammenwachsen und zahlreiche Erfolge feiern.
Dieser Plan ging auch für unsere Kunden auf.
Sie investierten in Rahmannshof-Pferde von
Rahmannshof`s Seraphina
4 Gestüt Rahmannshof
5- bis 7-jährig, mit altersentsprechenden Erfolgen, bildeten sie weiter aus und wuchsen
schließlich zu einem Team zusammen. Viele
dieser Springpferde kommen von einer unserer
Gestütsauktionen. So konnte sich Laurien Dietrich mit Colmetta in ihrem ersten S-Springen
auf Anhieb platzieren. Eine tolle Leistung für
Reiter und Pferd.
Auch Rahmannshof`s Davina, ebenso ein ehemaliges Auktionspferd, ist mit Kathrin Müller
bis zur Kl. S** erfolgreich. Ebenfalls internationale Siege und Erfolge konnte der bayerische Nationenpreisreiter Lawrence Greene mit
Rahmannshof Tic Tac u.a. in Arezzo erreichen.
Rahmannshof`s Before, die 2013 als 7-Jährige
das Youngster Finale in München gewann, erreichte den 5. Platz beim CSI***** in La Coruna
mit Sergio Lambre.
Vor allem meine Tochter Ina von Bormann ist
mit Rahmannshof Stagoldina hoch erfolgreich.
So ist sie aktuelle Bayerische Meisterin bei den
Senioren, gewann mehrere schwere Springen
von S* bis S*** und wurde schließlich 3. auf
dem CSI**** Salzburg.
Die Stakkato-Gold Stute haben wir selbst
ausgebildet. Zuerst hat meine Frau Ulla sie in
Springpferdeprüfungen vorgestellt, später hat
Ina sie dann weiter gefördert und aufgebaut.
Auch Felix Schneider ist ein tolles Beispiel für
die erfolgreiche Förderung junger, talentierter Reiter. Felix reitet unter anderem den von
uns selbst gezogenen Hengst Rahmannshof`s
Bamiro von Baloubet du Rouet, mit dem er
aktuell Rheinischer Vizemeister ist, sowie zahlreiche Erfolge in Springen bis S*** erreichte
und schließlich 5. im Großen Preis beim CSI***
Zandhoven wurde.
Mit Rahmannshof`s Baluga gewann Felix bereits sechs schwere Springen der Kl. S* - S***
und erreichte mit diesem Hengst zahlreiche internationale Erfolge wie den Sieg beim CSI***

2014 was an outstandingly successful year. Our
horses have developed positively and they are
now trained adequately for international competitions.
We also supported young and talented riders
who were internationally successful with our
horses up to class S****. Investing time and
patience as well as gaining experiences, the
pairs have grown together and have become
successful.
In the same way, our customers were successful. They invested in five- to seven-year-olds
with adequate placings. These horses were
trained further and they became a team with
their riders. Many of these successful jumpers
have been sold at our prior auctions. That
is how Laurien Dietrich and Colmetta were
placed in their very first S-class competition,
which was an outstanding performance.
Also Rahmannshof`s Davina, a former auction-
horse as well, is successful up to class S** with
her rider Kathrin Müller.
In addition, the Bavarian nation cup rider Lawrence Greene reached high international placings with Rahmannshof Tic Tac, for instance,
in Arezzo. Rahmannshof‘s Before, who won the
Youngster Final in Munich 2013 at the age of
seven, reached the fifth place at the CSI*****
in La Coruna with her rider Sergio Lambre.

Stagoldina. She is the current Bavarian Champion of riders over 21 years and won several
advanced tests from class S* to class S*** and
finally placed third at the CSI**** in Salzburg.
The Stakkato Gold daughter is self-trained.
Firstly, my wife Ulla presented Rahmannshof
Stagoldina in competitions for young horses.
Secondly, Ina supported the mare further.
Horses as capital investment –
that is for sure.
Felix Schneider is another great example for
our support of young and talented riders.
Among others, Felix rides our self-bred
stallions Rahmannshof‘s Bamiro by Baloubet
du Rouet. Felix and Rahmannshof‘s Bamiro
are the current Rhenish Vice-Champions and
reached many more placings in show jumping
competitions up to class S*** like the 5th place
in the Grand Prix of Zandhoven, CSI***.
The demand of perfectly trained jumpers with
much scope is constantly increasing. Discover
your favourite horse and support it for yourself
or for your future customers. 22 youngsters –
placed in competitions for young horses, from
novice tests, class A, to medium tests, class M.
With Rahmannshof‘s Baluga, Felix has already
won six competitions of the advanced class
from S* to S***. They reached many international successes, for example, the victory in
the CSI*** of Drachten 2015, a jumping class
with Longines Ranking points.
Such outstandingly talented horses are for sale
at this year‘s auction as well.

Bamiro hat aktuell ca. 55 Erfolge in S*-S***Springen und ist Rheinischer Vizemeister 2014. Er
gewann beim CSI** in Rosendaal und wurde 5. im
GP von Zandhoven CSI*** mit seinem Reiter Felix
Schneider.
Decktaxe: 1.000 € zzgl. MwSt.

Bamiro has 55 current placings from class S* to
class S*** competitions. He is the current Rhenish
Vice-Champion 2014. Bamiro won the CSI** of

CSI*** in Drachten mit Weltranglistenpunkten mit
seinem Reiter Felix Schneider.

placings in the advvanced class S*-S***. In 2014 he
won five jumping-competitions class S*-S***. In
2015 he was the winner of the finale of the medium

Kinder haben (k)eine Lobby!
Der Verein „Wundertüte e.V.“ Essen unterstützt
hilfsbedürftige Kinder im In- und Ausland
durch direkte finanzielle oder materielle Unterstützung. Er stellt sicher, dass Sach- und
Geldspenden den Kindern und Familien unmittelbar bzw. in voller Höhe zugutekommen. Alle
Vereinsmitglieder arbeiten ehrenamtlich und
ohne Aufwandsentschädigung. Seit Mai 2012
gehört der Verein zu den Unterzeichnern der
„Initiative Transparente Zivilgesellschaft“ von
„Transparency Deutschland e.V.“.
Im Ruhrgebiet unterstützt der Verein die Arbeit für Straßenkinder durch Finanzierung
von Anti-Aggressions-Trainings, heilpädagogischem Voltigieren, kleinen Geburtstagsgeschenken und Kinobesuchen. Diese Kosten
werden von keinem Träger übernommen, sind
aber wesentlich für den Therapieerfolg bzw.
tragen dazu bei, die ohnehin schwere Situation
der Kinder und Jugendlichen ein wenig zu verbessern. Ergänzend unterstützt der Verein die
Essener Notschlafstelle „RAUM_58“. Diese
bietet jungen Menschen, die ganz oder teilweise auf der Straße leben, für eine Nacht ein
Dach über dem Kopf und sozialpädagogische
Betreuung.
Die Essener Flizmobile bitten an verschiedenen Standorten wöchentlich zum „KinderTISCH“, an dem auch Essenswünsche der
Kinder aufgegriffen und in eine ausgewogene
Ernährung eingebettet werden. In das gemeinsame Kochen werden auch die Eltern der Kinder
einbezogen, um die Ernährungsgewohnheiten
insbesondere sog. bildungsferner Familien
nachhaltig positiv zu verändern. 2015 finanziert der Verein das Projekt in Essen-Kray.
Im Bereich der Familienhilfe unterstützt der
Verein einzelfallbezogen überwiegend arbeitslose Mütter und ihre Kinder durch „Akuthilfemaßnahmen“, z. B. wenn die Ernährung eines
Kindes aufgrund fehlender finanzieller Mittel
nicht möglich ist oder wenn es an dringend
benötigter Bekleidung fehlt.
Die Arbeit des KinderPalliativNetzwerk
Essen (KPN), einem ambulanten Netzwerk zur
Hilfe für Familien mit schwerst- und chronisch
kranken Kindern, die an einer zum Tode führenden Krankheit leiden, unterstützt der Verein
durch Finanzierung des Geschwistertreffs und
anlassbezogene Einzelfallhilfen (Hilfsmittel,
die weder von den gesetzlichen Kranken- und
Pflegeversicherungen gezahlt werden).

Kids (do not) have a Lobby!
The association „Wundertüte e.V.“ Essen
supports needy kids home and abroad
through direct financial and material support.
Wundertüte e.V. assures that donations in
cash and kind are directly and completely
beneficial for the kids and their families. All
members of the association work voluntarily
and without compensation. Since May 2012
the association belongs to the subscribers
of „Initiative Transparente Zivilgesellschaft“
of „Transparency Deutschland e.V.“.
In the Ruhr Area, the association supports
the work for street kids by financing anti-aggression-trainings, therapeutic volting, small
birthday presents and visits of the movies.
These costs are not taken over by any sponsor
but they are substantial for the success of the
childrens‘ therapies and they basically help to
improve the already difficult situation of the
kids and teens a little. Additionally, the association supports the Essen emergency shelter
In 2015 the association will finance this project in Essen-Kray.
In the field of family assistance, the association mostly supports unemployed mothers
and their kids by providing „urgent-helpactions“, for example, if the feeding of a child
is not possible due to a lack of financial means
or if urgently needed clothing is missing.
„Raum_58“. This shelter offers young people
who live on the streets fulltime or parttime a
roof over their heads, at least for a night, as
well as social educational care.
The „Essen Filzmobile“ offer a weekly
„KinderTISCH“ at different locations where
kids can get warm meals. We also consider
food wishes of the kids and embed them
into a balanced diet. In addition, we involve
the parents in cooking the meals in order to
improve the habits of their diets sustainably.
Wundertüte e.V.also supports the work of
the „KinderPalliativNetzwerk Essen“ (KPN),
an ambulant network to help families with
severly and chronically ill kids who suffer
from diseases that will lead to death. Here the
association helps by financing sibling-meetings and other aids that are not provided by
insurances.

Geschichte des Gestüts Rahmannshof
Ein Denkmal geschützter Hof von 1799 nur
durch Zufall entdeckt bei einer Rundreise
durch das Ruhrgebiet. Idyllisch gelegen, am
Stadtrand von Essen/ NRW mit dem Flair eines
irischen Gutshofes.
Da Thomas Blass und Ulla von Bormann seit
längerem auf der Suche waren und die Atmosphäre sie überzeugte sind sie letztlich auf diesem Hof gelandet. Den Namen hat er von den
Vorbesitzern, den Geschwistern „Rahmann“.
„Meine Frau und ich waren total begeistert
von der Lage, 4km zum Zentrum und eine gute
Autobahnanbindung. Ein traumhaftes Areal
um unseren Traum: Pferdezucht, Ausbildung
und die Vermarktung von Sportpferden, zu
verwirklichen“, so Thomas Blass. Nach vielen
Renovierungsarbeiten war es 1998 so weit, es
konnte eingezogen werden.
Es begann mit einer Reithalle und 40 Boxen.
Mit zunehmender Arbeit wuchs das Gestüt bis
heute zu einer renommierten Zucht und Vermarktungsstätte von Sportpferden mit dem
Schwerpunkt Springen.
Heute stehen hier fast 75 Pferde, es gibt
2 Hallen, große geräumige Boxen und einen
großen modernen Springplatz.
Pferdefreunde und Kunden fühlen sich hier
wohl, so wie es sich die Familie erhofft hatte.
Blass: „Unsere Kinder haben Spaß am Sport
und an der Zucht, es ist ein Familienbetrieb
wie man es sich wünscht. Auch für die Auktion
packen unsere Kinder Felix (29), Ina (26) und
Justus (16) voll mit an.“
Unsere Hoffnungen für die Zukunft liegen
auf Ina von Bormann und Felix Schneider mit
unseren selbst ausgebildeten Pferden Rahmannshof Stagoldina, Rahmannshof`s Baluga
und Rahmannshof`s Bamiro.

in 2014 sowohl Bayerischer Meister, als auch
Rheinischer Vizemeister wurden und die ersten Siege und Platzierungen in internationalen CSI*** und CSI****-Prüfungen erreichen
konnten.
History of Gestüt Rahmannshof
A landmarked farmyard from 1799 was accidentally discovered on a roundtrip through
the Ruhr area. It is located idyllically at the
periphery of Essen/NRW with the flair of an
Irish estate.
As Thomas Blass and Ulla von Bormann have
already been searching for a suitable place for
some time, it was the atmosphere that convinced them to settle down on this farmyard.
Its name originates from its former owners,
the “ Rahmann” siblings. “My wife and I were
totally enamoured with the location which is
situated four kilometers away from the city
center and also closely connected to the freeway. “A wonderful area to make our dream of
breeding, training and marketing of sporthorses come true”, said Thomas Blass. After lots of
restoration it was finished in 1998.
Initially there was a riding hall and 40 boxes.
With the increasing work, the stud grew an
turned out to be a well-respected breeding
and marketing spot of sportshorses with the
main focus on jumping.
Today almost 95 horses are living here. There
are two indoor riding arenas, spacious stables
and a modern outside jumping arena.
It is a place where horse enthusiasts and clients feel comfortable, just like the family was
expecting it.
We are proud of our horses and riders, who became Bavarian Champion as well as Rhenish
Vizechampion in 2014 and reached their first
placings and victorys in international CSI***
and CSI**** competitions.
Our hopes for the future are on Ina von Bormann and Felix Schneider with our selftrained horses Rahmannshof Stagoldina,
Rahmannshof`s Baluga and Rahmannshof`s

guten Zweck. Dieses Jahr geht der Erlös in Höhe des kompletten
Zuschlagspreises an den Verein Wundertüte e.V. aus Essen (siehe
S. 18). Wie bereits in den letzten Jahren, handelt es sich um ein
hoffnungsvolles Nachwuchstalent mit einem vielversprechenden

A.Allgemeines
I.Veranstalter

Veranstaltungsort ist Gestüt Rahmannshof, Schaffelhofer Weg 67, D 45277 Essen
II. Leistungsumfang des Veranstalters
Der Veranstalter veräußert das Versteigerungsgut (Pferd oder Anteil) im Namen und für
Rechnung des Anbieters durch Zuschlag. Das durch Erwerb des Versteigerungsgutes eintretende Rechtsverhältnis entsteht und besteht damit ausschließlich zwischen Anbieter
und Ersteigerer. Der Inhalt des Rechtsverhältnisses ergibt sich nachfolgend insbesondere
aus B II.
III. Haftung des Veranstalters
1. Allgemeines
Der Veranstalter haftet ausschließlich fiir die ordnungsgemäße Durchführung der Versteigerung nach diesen Bedingungen. Im Übrigen ist Haftung des Veranstalters wie seiner
Erfüllungsgehilfen beschränkt auf Vorsatz und grobe Fahrlässigkeit, auch, soweit ihn ein
Auswahlverschulden trifft. Dieser Ausschluss betrifft nicht solche Schadensersatzansprüche
wegen vorsätzlicher oder grob fahrlässig verursachter Schäden und wegen Schäden aus der
Verletzung des Lebens, des Körpers oder der Gesundheit, die auf fahrlässigen Pflichtverletzungen beruhen. Einer vorsätzlichen oder fahrlässigen Pflichtverletzung steht diejenige
eines gesetzlichen Vertreters oder Erfüllungsgehilfen gleich.
2. Verhältnis zum Ersteigerer
Der Veranstalter haftet ausdrücklich nicht für Mängel des Versteigerungsgutes. Die im
Laufe der Versteigerung, im Katalog oder in den Einlieferungsunterlagen mitgeteilten
Beschreibungen und Angaben beruhen auf Informationen des Anbieters; der Veranstalter
hat diese nicht auf ihre inhaltliche Vollständigkeit und Richtigkeit überprüft.
3. Verhältnis zum Anbieter
Der Veranstalter haftet nicht für Katalogbeschreibungen und die im Laufe der Versteigerung
geäußerten Angaben über das Versteigerungsgut, soweit diese auf Informationen des Anbieters beruhen. Unrichtige oder unvollständige Angaben sind vom Anbieter unverzüglich
– notfalls noch während der laufenden Auktion – richtig zu stellen beziehungsweise zu
ergänzen. Der Veranstalter steht nicht für die Bonität des Ersteigerers ein.
IV. Rechte des Veranstalters
1. Der Veranstalter ist berechtigt, für ausstehende Zahlungen Zinsen in Höhe von 5 % über
dem Basiszinssatz nach § 247 Abs. I BGB zu verlangen.
2. a) Der Veranstalter ist berechtigt, aus begründetem Anlass das Datum der Auktion zu
ändern, den Zeitpunkt für den Beginn der Auktion zu verschieben, für die Auktion einen
anderen Ort zu bestimmen, eine Unterbrechung der Auktion anzuordnen, die Auktion ohne
vollständige Durchführung abzubrechen oder ähnliche Maßnahmen zu ergreifen,
b) einzelne Personen in begründeten Fällen von der Teilnahme an der Auktion, deren Besuch
sowie vom Betreten des Auktionsgeländes oder des Boxenbereichs auszuschließen,
c) Bieteverbot für einzelne Personen anzuordnen,
d) eine Haftpflichtversicherung für die Dauer der Auktion für ein Pferd abzuschließen, für
das eine Haftpflichtversicherung nicht nachgewiesen wird; Pferde auch dann, wenn sie
das Auktionsgelände betreten haben oder dort eingestallt sind, zurückzuweisen, sofern
sich herausstellt, dass diese nicht ordnungsgemäß geimpft sind oder ansonsten an einer
übertragbaren oder ansteckenden Krankheit leiden, oder solche Pferde zu isolieren, Pferde
von der Auktion auszuschließen, auch z. B. bei Verletzung, unbefriedigendem und/oder
mangelhaftem Futter- und/oder Pferdezustand, . alle sonst im Interesse der Auktion und
deren Durchführung notwendigen oder zweckdienlichen Maßnahmen zu ergreifen.
3. Der Veranstalter ist berechtigt, Pferde schon bei der Einlieferung zurückzuweisen und deren
Unterstellung im Boxenbereich zu verweigern, wenn diesbezügliche in den Anmeldbedingungen verlangte Unterlagen unvollständig oder sonstige Aufzeichnungen lückenhaft sind.
Der Verkäufer bleibt auch im Falle dieser Zurückweisung dem Veranstalter verpflichtet, die
diesem nach diesen Versteigerungs- oder den Anmeldebedingungen geschuldeten Gebühren abzüglich eventuell ersparter Eigenkosten des Veranstalters auf erstes Anfordern
unbeschadet weiterer Rechte des Veranstalters zu zahlen. Dem Verkäufer bleibt der Nachweis
vorbehalten, dass dem Veranstalter ein geringerer Schaden entstanden ist. Sonstige Rechte stehen dem Verkäufer nicht zu. Insbesondere stehen ihm Zurückbehaltungsrechte oder
eventuell zur Aufrechnung berechtigende Ansprüche nur im Falle rechtskräftiger Feststellung
oder im Falle des Anerkenntnisses durch den Veranstalter zu.
B. Die Versteigerung

I. Charakter der Versteigerung
1. Der Veranstalter wendet sich mit der Auktion an die Öffentlichkeit. Die Versteigerung wird am
Auktionstag öffentlich durchgeführt und ist für jedermann zwecks Teilnahme frei zugänglich.
Die Versteigerung ist eine öffentliche Versteigerung gemäß § 383 Abs.3 BGB.
2. Das Versteigerungsgut wird während der Versteigerung vorgeführt. Es steht im Übrigen
während der im Einzelnen aus dem Auktionskatalog ersichtlichen Besichtigungszeiten am
Versteigerungstag den Interessenten zur näheren Besichtigung zur Verfügung.

II. Inhalt und Gegenstand des Kaufvertrages
1. Die in der Auktion angebotenen Pferde (Absetzer, Reitpferde, Mutterstuten, Deckhengste) sind aufgrund ihres Alters und der damit verbundenen individuellen Entwicklung
gebrauchte Sachen im Rechtssinne. Gemäß § 474 Abs.1 S.2 BGB sind die Regeln des Verbrauchsgüterkaufs nicht anwendbar.
2. Der Anbieter veräußert über den Versteigerer allein Pferde (Versteigerungsgut), die nach
ihrer Abstammung die rechtlichen Voraussetzungen dafür erfüllen, an Leistungsprüfungen
(im Sport) im Sinne der jeweiligen Prüfungsordnung des federführenden Sportfachverbandes im In- und Ausland teilzunehmen oder in der Pferdezucht eingesetzt zu werden
(Mutterstuten/Deckhengste).
3. Eine Erklärung zur Tauglichkeit des Versteigerungsgutes für die Teilnahme an Pferdesportveranstaltungen oder dem Training hierzu bzw. für die Zucht ist damit nicht verbunden.
Die Verwendbarkeit für den Einsatz zum Pferdesport bzw. die Qualität des Einsatzes in
der Zucht sowie sonstiger Beschaffenheiten ist daher nach diesem Vertrag auch nicht
ausdrücklich oder stillschweigend vorausgesetzt.
4. Der Tauglichkeit können vielmehr auch beim Versteigerungsgut Hindernisse entgegenstehen, die beim Zuschlag nicht sichtbar sind, sondern sich erst später, unter Umständen auch

erst beim Training oder beim Sporteinsatz, zeigen. Schon das Training stellt hohe Anforderungen an psychische und physische Belastbarkeit des Pferdes. Ob das Versteigerungsgut
diesen Belastungen genügen wird, ist zum Zeitpunkt der Versteigerung ungewiss. Erfahrungsgemäß ist nur ein Teil der Fohlen in der Lage, später an Pferdesportveranstaltungen
teilzunehmen, nur ein Teil der Pferde in der Lage, den Trainings- und / oder Sportbetrieb
dauerhaft durchzuhalten. Entsprechendes gilt für die Zuchttauglichkeit.
Der Ersteigerer hat deshalb anhand der Angaben im Auktionskatalog (insb. Abstammung,
Geschlecht, Farbe, Geburtsdatum) und der weiteren Merkmale des Versteigerungsgutes,
die er durch Besichtigung selbst feststellen kann, abzuwägen und zu entscheiden, ob er
durch den Kauf des Versteigerungsgutes die mögliche Chance zur Teilnahme an Pferdesportveranstaltungen oder der Zucht nutzen möchte. Sache des Ersteigerers ist es, vor dem
Zuschlag das Pferd selbst oder durch einen Tierarzt oder anderen Sachverständigen seines
Vertrauens auf alle wesentlichen Merkmale und Beschaffenheiten zu untersuchen oder
untersuchen zu lassen.
Abgesehen von der oben dargestellten Beschaffenheit wird das Pferd / Fohlen verkauft
wie besichtigt, unter vollständigem Ausschluss jeglicher Gewährleistung. Die Gewährleistungshaftung aus § 437 BGB wird, soweit gesetzlich zulässig, ausgeschlossen.
Kein Haftungsausschluss
Ansprüche des Käufers gegen den Verkäufer sind nicht ausgeschlossen, wenn die Haftung
beruht auf schuldhafter Verletzung von Leben, Körper, Gesundheit; Mängeln, deren Vorhandensein der Verkäufer arglistig verschwiegen oder deren Abwesenheit er garantiert
hat; grober Fahrlässigkeit des Verkäufers, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen; vorsätzlicher Verhaltensweise des Verkäufers.
Für den Fall, daß Gewährleistungsansprüche wirksam geltend gemacht werden, verjähren
die Gewährleistungsrechte des Käufers für gewerbliche Käufer (§ 14 BGB) 9 Tage nach
Übergabe, für Verbraucher (§ 14 BGB) nach den Vorgaben des Gesetzes, längstens aber
nach 12 Monaten nach Übergabe. Der Ersteigerer hat das Pferd nach Übergabe unverzüglich zu untersuchen und wenn sich ein Mangel zeigt, dies dem Anbieter unverzüglich
anzuzeigen. Macht der Ersteigerer nicht binnen 10 Tagen nach Übergabe eine schriftliche
Mangelanzeige, ist im Zweifel davon auszugehen, dass ein Mangel im Zeitpunkt der Übergabe nicht vorhanden war.
III. Ablauf der Versteigerung, Gebot und Zuschlag
1. Die Reihenfolge der Vorführung im Verkaufsring entspricht in der Regel der Reihenfolge
im Katalog. Aus begründetem Anlass ist der Veranstalter berechtigt, diese Reihenfolge
zu ändern. Dies gilt namentlich für nicht pünktlich im Ring erscheinende Pferde oder für
sonstige Fälle, in denen eine Abweichung dem Veranstalter zweckdienlich oder geboten
erscheint. Dem Anbieter steht kein diesbezügliches Mitspracherecht zu.
2. Die Gebote erfolgen in EUR.
C. Rechte und Pflichten des Anbieters
I. Einlieferung des Versteigerungsgutes
1. Die Einlieferung des Versteigerungsgutes erfolgt nach den Anmeldebedingungen zugleich
mit den dort genannten Unterlagen.
2. Zugleich mit der Einlieferung des Versteigerungsgutes sind dem Veranstalter auszuhändigen:
a) der Pferdepass
b) ein tierärztliches Gesundheitsattest, das vollständig ausgefüllt und vom untersuchenden Tierarzt unterzeichnet ist,
c) Nachweise der Impfungen (Für die korrekten Eintragungen der Impfungen ist der Anbieter verantwortlich),
d) Nachweis der Haftpflichtversicherung
3. Aus den in vorstehender Ziffer 2 bezeichneten Unterlagen muss gesondert für jedes Pferd
hervorgehen, dass
a) es aufgrund einer innerhalb der letzten 3 Tage vor dem Abtransport zur Versteigerung
erfolgten tierärztlichen Untersuchung frei von Erscheinungen einer ansteckenden Krankheit ist,
b) ansteckende Krankheiten unter den Pferden des jeweiligen Herkunftsbestandes in den
letzten 40 Tagen nicht vorgekommen sind.
II.Mitteilungspflicht
Der Anbieter ist verpflichtet, den Auktionskatalog unverzüglich nach Erscheinen auf die
inhaltliche Richtigkeit der dort gemachten Angaben bezüglich des Versteigerungsgutes
zu überprüfen. Änderungen oder Ergänzungen sind dem Veranstalter sofort mitzuteilen,
der berechtigt ist, diese auch noch mündlich in der Versteigerung kund zu tun.
III.Eigentumsvorbehalt
Bis zur Vollständigen Zahlung des Kaufpreises und aller sonstigen Kosten bleibt das Versteigerungsgut Eigentum des Anbieters. Bei allen Zahlungen, die nicht bar erfolgen, gilt
die Leistung erst bei endgültiger Gutschrift als bewirkt.
IV.Haftung
1. Der Anbieter haftet dem Veranstalter dafür, dass sämtliche von ihm mitgeteilten Angaben
vollständig und richtig sind, einschließlich
a) Anmeldeunterlagen
b) tierärztliche Bescheinigungen
c) Katalogbeschreibungen
2. Wird der Veranstalter vom Ersteigerer gleich aus welchem Rechtsgrund in Anspruch genommen, so hat der Anbieter den Veranstalter auf erstes Anfordern freizustellen, beziehungsweise ihm Ersatz für entstandenen Aufwand und darüber hinaus gehenden Schaden
zu leisten.
3. Für die dem Veranstalter zustehenden Gebühren und Kosten haften Anbieter und Ersteigerer gesamtschuldnerisch.
V. Besitzübergang, erneute Versteigerung
1. Der Besitz des Versteigerungsgutes - und damit Nutzen, Lasten und Gefahr - geht mit dem
Zuschlag auf den Ersteigerer über. Der Anbieter ist insoweit verpflichtet, dem Ersteigerer
mit dem Zuschlag das Versteigerungsgut auszuhändigen. Wegen der Einzelheiten der
Abwicklung des Kaufvertrages und der Übergabe des Pferdepasses wird auf E I Bezug
genommen.
2. Dem Anbieter obliegt die Entscheidung, ob er die Herausgabe des Passiertickets gem. E I
Ziff. 3 verweigert und das Versteigerungsgut innerhalb der Auktion erneut zur Versteigerung aufrufen lässt, z.B. weil der Ersteigerer seinen Pflichten gem. D I u. II nicht unverzüglich nachkommt oder aber der Anbieter begründete Zweifel an der Kreditwürdigkeit des
Ersteigerers hat. Die rechtlichen Konsequenzen aus dieser Entscheidung trägt der Anbieter.
Wird sie innerhalb von 30 Minuten nach dem Zuschlag dem Auktionsbüro mitgeteilt, wird
sich der Veranstalter bemühen, dem Wunsch des Anbieters nachzukommen und das Pferd
erneut aufzurufen; eine Pflicht hierzu besteht jedoch nicht.

VI. Kostentragung
1. Wird das Versteigerungsgut in der Auktion durch Zuschlag an einen Dritten veräußert, so
zahlt der Anbieter an den Veranstalter bis zu einem Verkaufspreis von EUR 2.500,00 1%
des Zuschlagpreises zuzüglich der gesetzlichen Mehrwertsteuer, bei einem Zuschlagspreis
von EUR 2.501,00 – EUR 4.000,00 5% und bei einem Zuschlagspreis ab EUR 4.001,00 8%
des Zuschlagpreises zuzüglich der gesetzlichen Mehrwertsteuer.
2. Bei ergebnislosem Angebot im Auktionsring ohne Zuschlag ist der Anbieter von Zuschlagsgebühren wie unter Ziff. 1 freigestellt.
3. Im Fall der Ersteigerung des Pferdes durch den Anbieter selbst zahlt dieser an den Veranstalter neben den in Ziff. 1 genannten Gebühren auch die Kosten und Gebühren eines
Ersteigerers.
4. Wird ein zur Auktion angemeldetes Pferd nach der endgültigen Aufnahme in den Katalog
vor der Auktion verkauft oder innerhalb eines Monats nach der Auktion freihändig verkauft
oder für fremde Rechnung exportiert, so zahlt der Anbieter die für einen Ersteigerer anfallenden Gebühren, errechnet nach dem tatsächlich erzielten Verkaufspreis. Der Anbieter
ist verpflichtet, dem Veranstalter den Verkaufspreis unverzüglich und ohne Aufforderung
mitzuteilen. Der Veranstalter ist berechtigt, den Verkaufspreis ohne Hinzuziehung eines
anderen Sachverständigen zu schätzen, falls der Anbieter den Preis trotz zweimaliger
Aufforderung nicht mitteilt.
5. Sämtliche vorgenannten Gebühren gelten neben den in den Anmeldebedingungen genannten Anmeldegebühren.
II. Kostentragung
1. Der Ersteigerer hat den Zuschlagpreis zuzüglich der nachfolgenden Kosten und Beträge
unverzüglich in der Verrechnungsstelle zu leisten:
a) der dem Anbieter zustehende Zuschlagpreis inklusive eventuell anfallender gesetzlicher
Mehrwertsteuer
b) eine Gebühr von 6% des Zuschlagpreises zuzüglich der gesetzlichen Mehrwertsteuer
an den Veranstalter.
2. Für die dem Veranstalter zustehenden Gebühren und Kosten haften Anbieter und Ersteigerer gesamtschuldnerisch.
3. Die Bezahlung des ersteigerten oder freihändig erworbenen Gutes erfolgt bei der Verrechnungsstelle im Falle der Versteigerung unmittelbar nach Zuschlag, im Falle des freihändigen
Verkaufs - soweit die Bezahlung des erworbenen Gutes erfolgt ist - hinsichtlich der dem
Veranstalter geschuldeten Gebühren unverzüglich nach Aufgabe derselben wie folgt:
a) in bar
b) durch bankbestätigtem Scheck
4. Ist eine Box noch 24 Stunden nach dem Auktionstag nicht geräumt, werden dem Käufer
vom Veranstalter pro angefangenen Tag EUR 30,00 in Rechnung gestellt.
D. Rechte und Pflichten des Ersteigerers
I. Namensnennung und Bestätigung des Kaufvertragsinhalts
1. Der Ersteigerer hat nach Zuschlag dem Beauftragten der Verrechnungsstelle unverzüglich
seinen vollständigen Namen und seine Anschrift zu nennen.
2. Weiter hat der Ersteigerer auf einem Formular des Veranstalters schriftlich zu bestätigen,
dass er bereits vor dem Zuschlag Kenntnis von den allgemeinen Versteigerungsbedingun-

I. Abwicklung des Kaufvertrages
1. Der Pferdepass für jedes an der Versteigerung teilnehmende Pferd befindet sich im Gewahrsam des Veranstalters, der ihn nach Zuschlag an den Ersteigerer aushändigt oder zustellt.
2. Wechselt das Pferd den Besitzer nicht in der Versteigerung, wird der Pass am Ende der Veranstaltung dem Anbieter gegen Quittung zurückgegeben oder später zurückgesandt.
3. Eine Übergabe des Pferdes durch den Veranstalter findet nicht statt. Der Besitzübergang
des Versteigerungsgutes an den Käufer nach Zuschlag ist vielmehr Sache des Anbieters.
der sich hierfür jedoch des Veranstalters bedienen kann. Der Veranstalter übergibt dem Ersteigerer insofern nach Bezahlung eine Anweisung und ein Passierticket. Das Passierticket
bleibt in den Händen des Ersteigerers und ist der Hofaufsicht vorzulegen, insbesondere,
wenn das Pferd den Stallbereich verlässt.
4. Auch bei Scheckzahlungen werden Anweisung und Passierticket dem Ersteigerer übergeben, wenn der Anbieter nicht unverzüglich Widerspruch erhebt. Die Zahlung mit bankbestätigtem Scheck gilt als vollständige Erfüllung, so dass kein Widerspruchsrecht gegeben
ist.
5. Der Anbieter ist verpflichtet, das Pferd so lange in seiner Obhut zu belassen, bis es vom
Ersteigerer übernommen wird. Das Halfter ist dem Ersteigerer mit zu übergeben. Der Ersteigerer ist verpflichtet, das Pferd unmittelbar nach Zuschlag zu übernehmen.
6. Bei Versteigerungen von Absetzern ist der Anbieter verpflichtet, das Fohlen bis zur Vollendung des fünften Lebensmonats zu seinen Lasten und seinem Risiko weiter bei der
Mutterstute zu belassen. Der Anbieter sichert dem Ersteigerer die Unversehrtheit des
Fohlens zu.
II. Bevollmächtigte
1. Bevollmächtigte haben dem Veranstalter vor Versteigerungsbeginn eine schriftliche Vollmacht vorzulegen. Diese hat zu enthalten
a) die Erklärung des Vollmachtgebers, dass der Bevollmächtigte berechtigt ist, im
Namen und für Rechnung des Vertretenen sämtliche notwendigen Erklärungen abzugeben und Handlungen vorzunehmen, insbesondere Versteigerungsgut zu veräußern
bzw. zu erwerben, den Vertretenen entsprechend diesen Versteigerungsbedingungen zu
verpflichten, das Versteigerungsgut herauszugeben bzw. abzunehmen und den Erlös in
Empfang zu nehmen bzw. den Kaufpreis zu bezahlen.
b) die Erklärung des Vollmachtgebers, dass ihm diese Versteigerungsbedingungen bekannt
sind und er sie vorbehaltlos anerkennt.
2. Wird eine schriftliche Vollmacht von Seiten des Anbieters nicht vorgelegt, ist der Veranstalter berechtigt, das Pferd von der Versteigerung auszuschließen. Fehlt die Vollmachtsurkunde auf Seiten des Ersteigerers, so ist der Veranstalter berechtigt, den Zuschlag zu
verweigern. In jedem Fall haftet der Bevollmächtigte als vollmachtsloser Vertreter.
III. Hinweise
1. Der Veranstalter weist darauf hin, dass den an der Auktion Beteiligten ein Tierarzt vor Ort
zur Verfügung steht, der aufgrund eines entsprechenden Auftrags für Kosten und Rechnung des Auftraggebers tätig wird.
2. Sofern der Veranstalter neben diesen Versteigerungsbedingungen noch andere Druckerzeugnisse herausgibt, werden diese nicht Inhalt der Versteigerungsbedingungen.
IV. Schlussbestimmungen
1. Sollte eine der vorgenannten Regelungen unwirksam sein oder werden oder die Bedingungen eine Lücke enthalten, so bleibt die Rechtswirksamkeit der übrigen Bestimmungen
hiervon unberührt. Die unwirksame Bestimmung oder die Lücke ist durch eine wirksame
Regelung zu ersetzen, die der Zielsetzung der Parteien wirtschaftlich, zivilrechtlich und
steuerrechtlich am nächsten kommt. Im Übrigen gelten die jeweiligen gesetzlichen Bestimmungen.
2. Es gilt ausschließlich das Recht der Bundesrepublik Deutschland.
3. Erfüllungsort ist der Auktionsort. Gerichtstand ist der Sitz des Veranstalters, soweit dies
gesetzlich zulässig vereinbar ist. Der Veranstalter kann auch an einem anderen zulässigen
Gerichtstand seine Ansprüche geltend machen.

A. General
I. Organiser
The organiser ofthe auction is

Place of auction is Gestüt Rahmannshof, Schaffelhofer Weg 67, D 45277 Essen
II. Organiser’s scope of services
The organiser shall seil the item of the auction (horse or interest) on behalf of and for the
account of the offerer through the fall of the hammer. Therefore, the legal relationship
created through the acquisition of the item of the auction shall be established and exist exclusively between the offerer and the auction buyer. The contents of the legal relationship
result in particular from B II below.
III. Organiser’s Liability
1. General
The organiser shall be liable for the proper realisation of the auction according to the presentterms and conditions exclusively. As for the rest, the organiser’s liability as well as the
liability of his vicarious agents shall be limited to intent and gross negligence, even in case
of fault through a poor choice of servant. This exclusion does not concern claims for
damages that are caused by wilfullness or recklessness. It does not concern damages
resulting of injuries of life and health and bodily harm out of neglect of duty either. A wilful
or reckless neglect of duty is alike a neglect of duty by a legal representative or accomplice.
2. Relationship with the auction buyer
The organiser does expressly not assume any liability for defects of the item of the auction.
The descriptions and details stated during the auction, in the catalogue or in the delivery
documents are based on information given by the offerer; the organiser has not verified
their completeness and accuracy as to the contents.
3. Relationship with the offerer
The organiser shall not be liable for catalogue descriptions and the details stated during the
auction on the item of the auction as far as they are based on information given by the
offerer. The offerer shall have to correct and / or complete any incorrect or incomplete information - if need be, even during the ongoing auction. The organiser does not take any responsibility for the auction buyer’s creditworthiness.
IV. Organiser’s rights
1. The organiser shall be entitled to demand interests for outstanding payments at a rate of
5% over the base interest rate according to § 247 section I BGB [German Civil Code].
2. a) The organiser shall be entitled, for a well-founded reason, to change the date of the
auction, to postpone the time of the start of the auction, to fix another place for the
auction, to order an interruption of the auction, to stop the auction without complete realisation or to take any similar steps,
b) in well-founded cases, to exclude individual persons from the participation in the
auction, from attending the auction as well as from entering the grounds of the auction or
the area of the boxes,
c) to forbid individual persons to bid,
d) to take out a third party insurance for the duration of the auction for a horse for which no
third party insurance has been proven; to reject horses even after they have entered the
grounds of the auction or are stabled there, if it turns out that they are not properly
vaccinated or are otherwise suffering from a transmissible or contagious disease, or to
isolate such horses, to exclude horses from the auction also for example in case of injuries,
unsatisfactory and / or poor nutritional and / or general horse condition, to take all other
measures that are necessary or useful in the interest of the auction and its realisation.
3. The organiser shall be entitled to reject horses already upon their delivery and to refuse
their standing in the area of the boxes if the documents required for them in the
registration terms and conditions or other recordsare incomplete. Even in case of such a rejection, the seller shall be obliged towards the organiser to pay the fees due to the
organiser according to the present auction terms and conditions or the registration terms
and conditions less any own costs the organiser saved on first request and not
withstanding any other rights of the organiser. The seller shall be free to prove that the organiser has suffered a smaller loss. The seller shall not have any other rights. In particular,
he / she will only have any rights of retention or rights of offsetting against claims if they
have been declared to be legally enforceable or are recognised by the organiser.
B. The auction
I. Character of the auction
1. The organiser shall call on the public for the auction. The auction will take place publicly at
the date of the auction and will be freely accessible for everyone for participation. The
auction will be a public auction according to § 383 section 3 BGB.
2. The item of the auction will be presented during the auction. Furthermore, it will be
available for closer inspection by the prospective buyers on the day of auction at the times
stated in detail in the auction catalogue.
II. Contents and subject matter of the sales contract
1. On account of their age and the associated individual development, the horses offered in
the auction (weanlings, riding horses, breeding mares, breeding stallions) shall constitute
used goods in the sense of the law. According to § 474 section 1 clause 2 BGB, the rules for
the sale of consumer goods shall not be applicable.
2. Through the organiser, the offerer shall sell only horses (item of the auction) the descent
of which meets the legal requirements for participating in performance tests (in sports)
as defined by the respective examination regulations of the responsible sports
association at home and abroad or for being used in horse breeding (breeding mares /
breeding stallions).
3. This shall not involve a declaration on the suitability of the item of the auction for the participation in equestrian sports events or the training for these events and / or for breeding.
Therefore, their appropriateness for being used in equestrian sports and / or the quality of
their use in breeding as well as any other properties shall not be assumed explicitly or implicitly under this contract.
4. On the contrary, the appropriateness of the item of the auction can also be impaired by obstacles that are not visible when the hammer falls, but turn up later, possibly only during
training or use in sports.Training alone makes high demands on the horse’s ability to cope
with psychic and physical stress. It is not certain at the moment of the auction whether the
item of the auction will meet these demands. Experience has shown that only some of the
foals will be able to participate in equestrian sports events later and only some ofthe horses
will be able to stand the training and / or sports activities permanently. The same applies to
the appropriateness for breeding.
5. Therefore, by means of the details given in the auction catalogue (in particulardescent, sex,
colour, date of birth) and the other characteristics of the item of the auction the auction
buyer can find out on his / her own when inspecting the item of the auction, the auction
buyer will have to consider carefully and to decide whether he / she wants to make use of
the possible chance of participating in equestrian sports events or breeding by buying the
item of the auction. It is the auction buyer’s responsibilityto examine himself / herself all
essential characteristics and properties of the horse, or to have them examined by a
veterinary surgeon or another expert he /she trusts before the hammer falls.
6. Apart from the quality described above, the horse / foal will be sold as is, any warranty
being completely excluded. The liability for breach of warranty according to § 437 BGB shall
be excluded to the extent permitted by law.
7. No exclusion for liability
Claims filed by the buyer towards the vendor are not excluded if liability is based on
culpable injury of life, body or health; defects the presence of which were fraudulently concealed or the absence of which was guaranteed by the vendor; gross negligence on the part
of the vendor; his legal representatives or vicarious agents; gross conduct by the vendor.
8. In case warranty claims should be asserted effectively, the buyer’s warranty rights will be
subject to a limitation period of 9 days after delivery for commercial buyers (§ 14 BGB), for
consumers (§ 14 BGB) they will be subject to a limitation period according to legal requirements, however, of 12 months after delivery at the latest. The auction buyer shall have to
examine the horse immediately after delivery and to inform the offerer of any defect that
might show. If the auction buyer does not give a notice of defects to the offerer within 10
days after the delivery, it will have to be assumed in case of doubt that there has been no
defect at the time of the delivery.
III. Course of the auction, bid and fall of the hammer
1. In general, the order of the presentation in the sale ring shall correspond to the order in the
catalogue. The organiser shall be entitled to change this order for a well-founded reason.
This shall apply above all for horses that do enter the ring in time or other cases in which
the organiser considers it useful or necessary. The offerer shall not have any right to be consulted in this context.
2. Bids shall be made in EUR.
C. Offerer’s rights and obligations
I. Delivery of the item of the auction
1. According to the registration terms and conditions, the delivery of the item of the auction
shall take place together with the delivery of the documents stated there.
2. The following documents have to be handed overto the organiser upon delivery of the item
of the auction:
a) the horse passport
b) a veterinary certificate of health that is completely filled in and signed by the veterinary
surgeon who performed the examination,
c) certificates of the vaccinations (the offerer is responsible for the correct entries of the vaccinations),
d) certificate of the third party insurance
3. The documents described above under item 2 have to indicate separately for each horse that
a) it is free from signs of a contagious disease on account of a veterinary examination performed within the last 3 days before the transport to the auction,
b) no contagious diseases have occurred within the last 40 days among the horses ofthe respective herd of origin.
II. Obligation to furnish information
The offerer will be obliged to check immediately after publication of the catalogue of the
auction whether the contents of the information given there on the item of the auction are
correct. The offerer will have to inform the organiser immediately of any modifications or
amendments. The organiser shall be entitled to announce them also verbally during the
auction.
III. Retention of title
The offerer will retain the title of the item of the auction until the purchase price and all
other costs have been paid completely. All payments that are not made in cash will be considered to have been effected only upon definitive credit.
IV. Liability
1. The offerer shall be liable towards the organiser for the completeness and correctness of all
information given by him / her, including
a) registration documents
b) veterinary certificates
c) catalogue descriptions.
2. If the auction buyer makes claims on the organiser for whatever legal ground, the offerer
will have to indemnify the organiser on first request and / or to compensate him for the expenses incurred and any further loss.
3. The offerer and the auction buyer will be liable jointly and severally for the fees and costs
owed to the organiser.
V. Transfer of possession, new auction
1. The possession of the item of the auction - and thus its use, expenses and risk - will be
transferred to the auction buyer when the hammer falls. Therefore, the auction buyer will
be obliged to hand over the item of the auction to the auction buyer when the hammer
falls. Reference is made to E I regarding the details of the contract of sale and the handing
over of the horse passport.
2. The offerer shall be free to decide whether he / she refuses to hand over the passage permit
according to E I item 3 and to have the item of the auction announced again for auction
within the auction, e.g. because the auction buyer does not immediately fulfil his / her
duties according to D I and II or the offerer has well-founded doubts regarding the auction
buyer’s creditworthiness. The offerer shall bear the legal consequences arising from this decision. If it is communicated within 30 minutes after the fall of the hammer to the auction
office, the organiser will make an effort to comply with the offerer’s wish and announce the
horse again; however, there is no obligation to do so.
Vl. Cost bearing
1. If the item of the auction is sold to a third party during the auction through the fall of the
hammer, the offerer will pay to the organiser up to a selling price of EUR 2,500.00 1% of the
hammer price plus statutory value-added tax, in case of a hammer price ranging from EUR
2,501.00 to EUR 4,000.00 5% and in case of a hammer price of EUR 4,001.00 and above 8%
of the hammer price plus statutory value-added tax.
2. If the item is offered in the auction ring unsuccessfully without fall of the hammer, the
offerer will be exempted from paying the hammer fee according to item 1.
3. If the offerer himself / herself buys the horse at the auction, he / she will have to pay to
the organiser the costs and fees of an auction buyer in addition to the fees mentioned in
item 1.
4. If a horse reqistered for the auction is sold before the auction after the final inclusion into
the catalogue or is sold by private treaty or exported for the account of another within a
month after the auction,the offerer will pay the fees arising for an auction buyer, calculated
on the basis of the actual selling price. The offerer will be obliged to inform the organiser of
the selling price immediately and without being requested. The organiser will be entitled
to estimate the selling price without consulting another expert, if the offerer does not communicate the price after the second request.
5. All fees mentioned above shall be in addition to the registration fees stated in the
registration terms and conditions.
D. Auction buyer’s rights and duties
I. Statement of name and confirmation of the contents of the contract of sale
1. The auction buyer will have to state his / her complete name and address to the agent of
the clearing office immediately after the fall of the hammer.
2. Furthermore, the auction buyer will have to confirm in writing on a form issued by the organiser that he has taken note of the general auction terms and conditions before the fall of
the hammer already and agrees that they apply and that he / she knows in particular the
purpose of the object of purchase and its particularities.
II. Cost bearing
1. The auction buyer has to pay the hammer price plus the following costs and amounts immediately at the clearing office:
a) the hammer price owed to the offerer plus any applicable statutory value-added tax
b) a fee of 6% of the hammer price plus statutory value-added tax to the organiser.
2. The offerer and the auction buyer will be liable jointly and severally for the fees and costs
owed to the organiser.
3. Payment of the item bought at the auction or bought by private treaty shall be made as follows at the clearing office in case of auctioning immediately after the fall of the hammer, in
case of sale by private treaty - if the payment of the good bought has been made regarding the fees owed to the organiser immediately after they have been imposed:
a) in cash
b) by bank-certified check
4. If a box is not cleared within 24 hours after the day of the auction, the organiser will charge
a fee of EUR 30.00 for each started day to the buyer’s account.
E. Miscellaneous
I. Settlement of the contract of sale
1. The horse passport for each horse participating in the auction will be in the organiser’s custody who will hand it out or send it to the auction buyer after the fall of the hammer.
2. If the horse does not change hands during the auction, the passport will be given back to
the offerer at the end of the event or returned by mail later.
3. The horse shall not be handed over by the organiser. On the contrary, the offerer is
responsible for transferring the possession of the item of the auction to the buyer after the
fall of the hammer, but he / she can use the organiser’s services to this effect. In this case, the
organiser shall hand out an order and a passage permit to the auction buyer upon payment.
The passage permit shall remain with the auction buyer and will have to be presented to the
supervisory staff, in particular, when the horse leaves the area of the stable.
4. The order and the passage permit shall be handed over to the auction buyer in case of check
payments as well, unless the offerer makes an objection. Payment by bankcertified check
will be considered to be a complete performance so that there is no right to object.
5. The offerer will be obliged to leave the horse in his / her care until it is taken over by the
auction buyer. The halter will have to be handed over to the auction buyer as well. The
auction buyer will be obliged to take over the horse immediately after the fall of the hammer.
6. In case of auctions of weanlings, the offerer will be obliged to leave the foal with its mother
until it reaches the age of five months at his / her expenses and risk. The offerer shall guarantee the auction buyer the integrity of the foal.
II. Agents
1. Agents will have to produce a written authority to the organiser before the start of the
auction. This authority will have to include
a) the principal’s declaration stating that the agent is authorised to make all necessary declarations and to do all actions on the principal’s behalf and account, in particular to sell and
/ or to buy items of the auctions, to oblige the principal according to the present auction
terms and conditions to deliver and / or take delivery of the item of the auction and to
receive the proceeds and / or to pay the purchase price.
b) the principal’s declaration stating that he/she knows the present auction terms and conditions and accepts them without reservation.
2. If the offerer’s agent does not produce a written authorisation, the organiser will be
entitled to exclude the horse from the auction. If the auction buyer’s agent does not
produce his / her letter of authorisation, the organiser will be entitled to refuse to knock
down. The agent shall be liable in any case as agent without authorisation.
IV. Final provisions
1. If one of the above provisions is or becomes ineffective or the terms and conditions contain
a gap, this will not affect the legal effect of the other provisions. The ineffective provision or
the gap has to be replaced by an effective provision that comes closest to the parties’ economic objective and their objective regarding civil and fiscal law. As for the rest, the legal
provisions shall apply.
2. The law of the Federal Republic of Germany shall apply exclusively.
3. Place of performance shall be the place of the auction. Place of jurisdiction shall be the organiser’s place of business to the extent this agreement is permissible by law. The organiser
shall be entitled to assert his claims at any other permissible place of jurisdiction.

III. Notes
l. The organiser points out that a veterinary surgeon will be available on site for the persons
involved in the auction who will act at the expenses and for the account of the ordering
party on the basis of a corresponding order.
2. If the organiser releases other publications in addition to the presentauction terms and
conditions, they will not become part of the auction terms and conditions.
